本申请涉及一种检测鉴定注册商标的商品真品的方法,特别涉及一种基于互联网检测鉴定注册商标的商品真品的方法。
在市场交易中存在着很多的假冒注册商标的商品,损害了消费者的利益,损害了生产或/和销售注册商标的商品的企业的利益,对国民经济的和谐发展始终产生负面的影响。
中国专利申请号:2018107194379专利申请,公开了一种防伪标签及其基于互联网检测鉴定注册商标的商品真品的方法,提供一种二维码防伪标签或RFID防伪标签及其基于互联网检测鉴定注册商标的商品真品的方法,让消费者能够参与对市场上交易的商品是否是注册商标的商品真品进行检测鉴定,达到消费者能够方便、迅速、正确地判断并抵制生产或/和销售假冒注册商标的商品。在商品流通的全过程中,存在着购买商品的消费者与商品的实 际使用者是不一致的情况,也存在着购买商品的消费者和实际使用商品的人在数量上或/和使用商品的时间上或/和使用商品的地点上是不一致的情况,也存在着对消费者购买的商品是否是注册商标的商品真品监督检查的社会需求,该技术方案缺少对消费者之外的其他人对消费者购买的商品是否是注册商标的商品真品进行检测鉴定的解决办法。
发明内容
本申请的多个方面提供一种基于互联网检测鉴定注册商标的商品真品的方法,用以实现消费者之外的其他人对消费者购买的商品是否是注册商标的商品真品的鉴定。
本申请实施例提供一种基于互联网检测鉴定注册商标的商品真品的方法,在互联网上设置一种服务于生产或/和销售注册商标的商品的企业与检测者合作使用一种防伪标签检测鉴定消费者购买的商品是否是注册商标的商品真品的网站,生产或/和销售注册商标的商品的企业的计算机服务器中存储与商品上的防伪标签的二维码信息或ID号对应的购买所述商品的消费者的智能手机类设备的手机号码或微信类工具的微信号部分或者全部特征信息,检测者操作智能手机类设备或微信类工具登录互联网上的所述网站连接所述检测者选择的对应于被检测鉴定的商品的生产或/和销售对应品牌注册商标的商品的企业的计算机服务器的用户接口,检测者对消费者已经购买了的所述商品的防伪标签进行检测,所述生产或/和销售对应品牌注册商标的商品的企业的计算机服务器接收所述检测者发出的检测扫描获得的二维码信息或检测阅读获得的ID号和接收所述检测者发出的对所述商品是否是所述对应品牌注册商标的商品真品的鉴定的请求之后,所述企业的计算机服务器得出所述商品的防伪标签的二维码信息或ID号是否是所述对应品牌注册商标的商品真品的所述防伪标签的二维码信息或ID号的鉴定结论,所述生产或/和销售对应品牌注册商标的商品的企业的计算机服务器将此鉴定结论直接发送给所述检测者,所述计算机服务器还一并发送不构成泄露隐私的购买所述商品的时间或/和购 买的地点或/和所述消费者的智能手机类设备的所述手机号码或微信类工具的所述微信号的部分特征信息或全部特征信息给所述检测者。本申请实施例的技术方案使得消费者购买商品以后,购买商品的消费者之外的不同的人在不同的时间或不同的地点使用商品的时候或者需要的情况下都可以在不构成泄露隐私的合规的范围内方便地、准确地检测鉴定所述商品是否是注册商标的商品真品。
为了实现上述目的,本申请实施例提供了一种基于互联网检测鉴定注册商标的商品真品的方法,适用于使用一种防伪标签检测鉴定商品是否是注册商标的商品真品,在互联网上设置一种网站,所述网站服务于生产或/和销售注册商标的商品的企业与检测者合作使用一种防伪标签检测鉴定消费者购买的商品是否是注册商标的商品真品,生产或/和销售注册商标的商品的企业的计算机服务器的用户接口加入所述网站,所述网站没有检测鉴定商品的功能,检测者操作智能手机类设备或微信类工具登录互联网上的所述网站。
在一可选实施方式中,所述方法还包括:在商品上安装一张印有二维码的防伪标签或安装一张RFID防伪标签,生产或/和销售注册商标的商品的企业的计算机服务器中存储商品二维码防伪标签上的二维码信息或存储商品RFID防伪标签上的ID号。
在一可选实施方式中,所述方法还包括:所述网站对加入网站的生产或/和销售注册商标的商品的企业依据国家权威的注册商标的或/和商品质量的管理或/和监督部门公开发布的信息进行准入审核把关;所述网站还设定一个加入的门槛,凡是在加入前调查或是在被举报后调查审核确认存在不正当竞争行为嫌疑的生产或/和销售注册商标的商品的企业,使其计算机服务器与检测者或/和消费者连接的用户接口暂时不得加入所述网站或者暂时退出所述网站。

本实施例技术方案中所述生产或/和销售对应品牌注册商标的商品的企业16的计算机服务器13得出的所述商品1的防伪标签2的所述二维码信息或所述ID号是否是所述对应品牌注册商标的商品1真品的所述防伪标签2的二维码信息或ID号的鉴定结论是严谨的、是可靠的。因为该检测鉴定的过程中并没有排除所述商品1原包装里面的商品有没有被假冒替换,也没有排除所述 商品1上的防伪标签2是不是被复制假冒的,本实施例技术方案得出的鉴定结论是科学的、是准确的,是正确。
本申请实施例的技术方案具有实用性,比较现有的技术方案具有新颖性、创造性。

本实施例的检测者19检测鉴定所述商品1的技术方案要得出所述商品1是否是注册商标的商品1真品的正确的最终的检测鉴定结论,是要排除所述商品1上的防伪标签2的防伪信息不是被复制假冒的,和还要排除所述商品1原包装中的真品是没有被假冒替换的。所述检测者19进一步地得到的所述生产或/和销售对应品牌注册商标的商品的企业16关于所述消费者4购买5所述商品1的时间或/和地点或/和所述消费者4的智能手机类设备9的所述手机号码或微信类工具39的所述微信号的部分特征信息是有意义的,是有价值的。
现有的防伪技术方案有仅仅凭被检测的所述商品1的防伪标签2的防伪信息是与生产或/和销售注册商标的商品的企业16的计算机服务器13中存储的商品1的所述二维码信息或所述ID号比对是相互匹配的就得出所述商品1是注册商标的商品1真品的检测鉴定结论是不可靠的。或者现有的防伪技术方案还有按所述商品1的防伪标签2的防伪信息被查询检测鉴定的次数的阈值来判别所述商品1是否是注册商标的商品1真品的鉴定结论更是不科学的、不可靠的。
本申请实施例的技术方案是现有技术所没有的,本申请实施例的技术方案具有实用性、具有新颖性、具有创造性。
第三实施例
图1为本申请实施例一种基于互联网检测鉴定注册商标的商品真品的方法的流程示意图。
如图1所示,为了实现上述目的,在第二实施例的基础上所述生产或/和销售对应品牌注册商标的商品的企业16的计算机服务器13在消费者4购买5商品1的时候接受和存储所述消费者4发出的请求,所述生产或/和销售对应品牌注册商标的商品的企业16同意所述请求在特定手机号码的智能手机类设备9或特定微信号的微信类工具39的这一部分检测者19或者全部的检测者19对所述商品1检测和提出鉴定请求之后,所述生产或/和销售对应品牌注册商标的商品的企业16的计算机服务器13在回复检测鉴定结论的同时一并发 送17给这一部分特定的或全部的检测者19所述消费者4的所述手机号码或所述微信号或/和购买5所述商品1的价格或/和购买5的时间或/和购买5的地点或/和购买5的数量的信息。

在本实施例中,例如,一些企业的财务部门或者政府的审计监督部门得到网站12上的生产或/和销售对应品牌注册商标的商品的企业16回复被检测鉴定的所述商品1上的防伪标签2的防伪信息是所述生产或/和销售对应品牌注册商标的商品的企业16的商品1真品防伪标签2上的二维码信息或ID号,并且审核所述计算机服务器13一并发来的购买5所述商品1的价格、数量、时间、地点和汇款接受单位都是相互匹配符合于掌控的信息的,所述企业的财务部门或者政府的审计监督部门得出所述商品1是所述生产或/和销售对应品牌注册商标的商品的企业16的商品1真品的最终判断结论。
本申请实施例提供的技术方案中的检测者19检测鉴定消费者4购买5的商品1与消费者4检测鉴定自己购买5的商品1是否是注册商标的商品1真品的方法是有区别的,对同一件商品1分别由消费者4或检测者19检测鉴定获得的生产或/和销售对应品牌注册商标的商品的企业16回复的检测鉴定结论也是有差别的。生产或/和销售对应品牌注册商标的商品的企业16是有义务一定要服务和满足所述消费者4检测鉴定所述商品1得到的是所述对应品牌注册商标的商品1真品的检测鉴定结论的,所述消费者4才能够放心地购买5所述商品1,所述生产或/和销售对应品牌注册商标的商品的企业16也是具备条件检测鉴定所述商品1并且得出明确的检测鉴定结论回复所述消费者4的;而由于检测者19检测鉴定所述商品1的时间、地点以及检测者19与消费者4的身份不同,所述生产或/和销售对应品牌注册商标的商品的企业16在没有能够排除被检测者19检测的所述商品1上的防伪标签2上的防伪信息是被复制假冒的,以及在没有能够排除所述商品1原包装里面的真品是被假冒的商品替换的情况下,所述生产或/和销售对应品牌注册商标的商品的企业16是不能够确定检测者19检测和提出鉴定的所述商品1是所述生产或/和销售注册商标的商品的企业16的商品1真品的。而消费者4是从生产或/和销售对应品牌注册商标的商品的企业16或所述企业16的销售终端处手接手地接收到所述商品1的,所述企业16是有根据所述商品1的原包装里面的真品没有被假冒的 商品替换,并且所述生产或/和销售注册商标的商品的企业16给予消费者4检测鉴定商品1的权限的技术方案也排除了复制注册商标的商品1真品上的防伪标签2的防伪信息假冒注册商标的商品获得是注册商标的商品1真品鉴定结论的可能性。所以生产或/和销售注册商标的商品的企业16对消费者4与检测者19分别对同一件商品1的检测鉴定给予的鉴定结论是有区别的、是不能混淆的,是不能让检测者19误解的。所以消费者4与检测者19对所述商品1是否是注册商标的商品1真品的检测鉴定方法是有区别的、是不同的。
本申请实施例的技术方案是现有技术所没有的,本申请实施例的技术方案具有实用性、具有新颖性、具有创造性。
第四实施例
图1为本申请实施例一种基于互联网检测鉴定注册商标的商品真品的方法的流程示意图。
如图1所示,检测者19操作8智能手机类设备9或微信类工具39登录11互联网上的所述网站12并连接上所述检测者19选择的生产或/和销售对应品牌注册商标的商品的企业16的计算机服务器13的用户接口,所述检测者19向所述计算机服务器13发出15购买5所述企业16销售的商品1的订单,所述企业16销售所述商品1给所述检测者19。
本实施例的技术方案方便了检测者19购买5生产或/和销售对应品牌注册商标的商品的企业16的商品1真品。本申请实施例提供的技术方案中设置的网站12使得检测者19不被生产或/和销售假冒注册商标的商品的企业或个人的套路迷惑、误导购买5假冒注册商标的商品和被假冒检测鉴定,检测者19登录11互联网上的网站12连接生产或/和销售对应品牌注册商标的商品的企业16的计算机服务器13得出的对商品1的检测鉴定结论是方便的、是权威的、是正确的,检测者19对所述网站12产生信任感,对所述网站12上连接的生产或/和销售注册商标的商品的企业16产生信任感。市场上有很多假冒注册商标的商品销售,人们往往防不胜防,互联网上也是有很多假冒注册商标的似是而非的混淆品牌(企业名称)的商品销售,普通的消费者4很难每次 都能够判断正确,检测者19可以通过操作8智能手机类设备9或微信类工具39登录11互联网上的所述网站12并连接上所述检测者19选择的放心可靠的生产或/和销售对应品牌注册商标的商品的企业16的计算机服务器13的用户接口购买5到所选择的对应品牌的注册商标的商品1真品,并且可以进一步地在所述网站12上连接生产或/和销售对应品牌注册商标的商品的企业16检测鉴定得出正确的检测鉴定结论。
本申请实施例的技术方案使得从消费者4购买5商品1到检测者19使用商品1或/和储运商品1或/和检查监督购买5商品1的多个侧面、多个环节上互补了打击假冒注册商标商品的生产或/和销售,满足了社会需求。
所以,本申请实施例提供的技术方案的检测者19检测鉴定所述商品1是否是注册商标的商品真品的技术方案是有意义的、是有价值的、是有必要的,也是和背景技术中介绍的技术方案是有区别的,是现有技术所没有的,是有创造性的。本申请实施例的技术方案是非显而易见的,本申请实施例的技术方案具有实用性、具有新颖性、具有创造性。
最后应说明的是:以上实施例仅用以说明本申请实施例的技术方案而非限制,尽管参照较佳实施例对本申请实施例进行了详细说明,本领域的普通技术人员应当理解,可以对本申请实施例的技术方案进行修改或者等同替换,而不脱离本申请实施例的技术方案的精神和范围。

- 一种基于互联网检测鉴定注册商标的商品真品的方法,适用于使用一种防伪标签(2)检测鉴定商品(1)是否是注册商标的商品(1)真品,在互联网上设置一种网站(12),其特征在于:所述方法包括:所述网站(12)服务于生产或/和销售注册商标的商品的企业(16)与检测者(19)合作使用一种防伪标签(2)检测鉴定消费者(4)购买(5)的商品(1)是否是注册商标的商品(1)真品,生产或/和销售注册商标的商品的企业(16)的计算机服务器(13)的用户接口加入(14)所述网站(12),所述网站(12)没有检测鉴定商品(1)的功能,检测者(19)操作(8)智能手机类设备(9)或微信类工具(39)登录(11)互联网上的所述网站(12)。
- 根据权利要求1所述的一种基于互联网检测鉴定注册商标的商品真品的方法,其特征在于:还包括:在商品(1)上安装(6)一张印有二维码的防伪标签(2)或安装(6)一张RFID防伪标签(2),生产或/和销售注册商标的商品的企业(16)的计算机服务器(13)中存储商品(1)二维码防伪标签(2)上的二维码信息或存储商品(1)RFID防伪标签(2)上的ID号。
- 根据权利要求2所述的一种基于互联网检测鉴定注册商标的商品真品的方法,其特征在于:还包括:所述网站(12)对加入(14)网站(12)的生产或/和销售注册商标的商品的企业(16)依据国家权威的注册商标的或/和商品质量的管理或/和监督部门公开发布的信息进行准入审核把关;所述网站(12)还设定一个加入(14)的门槛,凡是在加入(14)前调查或是在被举报后调查审核确认存在不正当竞争行为嫌疑的生产或/和销售注册商标的商品的企业(16),使其计算机服务器(13)与检测者(19)或/和消费者(4)连接的用户接口暂时不得加入(14)所述网站(12)或者暂时退出所述网站(12)。
- 根据权利要求3所述的一种基于互联网检测鉴定注册商标的商品真品的方法,其特征在于:还包括:所述网站(12)里面集合了同一类商品(1) 的生产或/和销售注册商标的商品的企业(16)的计算机服务器(13)的用户接口;或者所述网站(12)是一个综合性的大网站,在所述综合性的大网站里面按分门别类的商品名称分别子集合了生产或/和销售注册商标的不同商品的企业(16)的计算机服务器(13)的用户接口;检测者(19)在操作(8)智能手机类设备(9)或微信类工具(39)登录(11)互联网上的所述网站(12)后方便快捷地循径寻找和连接上检测鉴定消费者(4)购买(5)的商品(1)所需要的生产或/和销售对应品牌注册商标的商品的企业(16)的计算机服务器(13)的用户接口。
- 根据权利要求2所述的一种基于互联网检测鉴定注册商标的商品真品的方法,其特征在于:还包括:生产或/和销售注册商标的商品的企业(16)的计算机服务器(13)中存储与商品(1)上的防伪标签(2)的二维码信息或ID号对应的购买(5)所述商品(1)的消费者(4)的智能手机类设备(9)的手机号码或微信类工具(39)的微信号的部分或者全部特征信息。
- 根据权利要求2或4或5所述的一种基于互联网检测鉴定注册商标的商品真品的方法,其特征在于:还包括:检测者(19)操作(8)智能手机类设备(9)或微信类工具(39)登录(11)互联网上的所述网站(12)连接所述检测者(19)选择的检测鉴定消费者(4)购买(5)的商品(1)所需要的生产或/和销售对应品牌注册商标的商品的企业(16)的计算机服务器(13)的用户接口,实现所述检测者(19)与所述生产或/和销售对应品牌注册商标的商品的企业(16)检测鉴定所述消费者(4)购买(5)的所述商品(1)的信息相互之间端与端的及时交流。
- 根据权利要求6所述的一种基于互联网检测鉴定注册商标的商品真品的方法,其特征在于:还包括:所述检测者(19)操作(8)智能手机类设备(9)或微信类工具(39)对所述消费者(4)已经购买(5)了的所述商品(1)上的二维码防伪标签(2)检测扫描或RFID防伪标签(2)检测阅读,所述生产或/和销售对应品牌注册商标的商品的企业(16)的计算机服务器(13)接收所述检测者(19)发出(15)的检测扫描所述商品(1)上的二维码防伪标 签(2)上的二维码信息或接收所述检测者(19)发出(15)的检测阅读所述商品(1)上RFID防伪标签(2)的ID号和接收所述检测者(19)发出(15)的对所述商品(1)是否是所述对应品牌注册商标的商品(1)真品鉴定的请求之后,所述生产或/和销售对应品牌注册商标的商品的企业(16)的计算机服务器(13)据此从所述计算机服务器(13)的数据库中寻找并比对与存储的商品(1)的二维码信息或ID号是否相互匹配,得出所述商品(1)的防伪标签(2)的所述二维码信息或所述ID号是否是所述对应品牌注册商标的商品(1)真品的所述防伪标签(2)的二维码信息或ID号的鉴定结论,所述生产或/和销售对应品牌注册商标的商品的企业(16)的计算机服务器(13)将此鉴定结论直接发送(17)给所述检测者(19)。
- 根据权利要求7所述的一种基于互联网检测鉴定注册商标的商品真品的方法,其特征在于:还包括:所述生产或/和销售对应品牌注册商标的商品的企业(16)的计算机服务器(13)一并发送(17)不构成泄露隐私的购买(5)所述商品(1)的时间或/和地点或/和所述消费者(4)的智能手机类设备(9)的所述手机号码或微信类工具(39)的所述微信号的部分特征信息给所述检测者(19)。
- 根据权利要求8所述的一种基于互联网检测鉴定注册商标的商品真品的方法,其特征在于:还包括:所述生产或/和销售对应品牌注册商标的商品的企业(16)的计算机服务器(13)在消费者(4)购买(5)商品(1)的时候接受所述消费者(4)发出的请求,在特定手机号码的智能手机类设备(9)或特定微信号的微信类工具(39)的这一部分检测者(19)或者全部的检测者(19)对所述商品(1)检测和提出鉴定请求之后,所述生产或/和销售对应品牌注册商标的商品的企业(16)同意在所述计算机服务器(13)回复检测鉴定结论的同时一并发送(17)给这一部分特定的或全部的检测者(19)所述消费者(4)的所述手机号码或所述微信号或/和购买(5)所述商品(1)的价格或/和购买(5)的时间或/和购买(5)的地点或/和购买(5)的数量的信息。
