Abstract

L'ensemble du système juridique américain, les juges et les avocats effectuent en permanence des recherches dans un corps toujours croissant d'opinions judiciaires, ou de jurisprudence, pour trouver les plus pertinentes quant à la résolution de nouveaux litiges. Pour faciliter ces recherches, certaines sociétés rassemblent et publient les opinions judiciaires des tribunaux des Etats-Unis, à la fois sous forme papier et sous forme électronique, certaines affaires contenant des références à des affaires antérieures provenant d'autres tribunaux ayant déjà statué sur le même litige ou sur une partie de celui-ci. L'identification des affaires antérieures est problématique. La raison peut en être qu'un dispositif d'appariement de textes informatisé classique suggère non seulement trop d'affaires non antérieures, mais qu'il laisse également de côté trop d'affaires antérieures réelles. En conséquence, les inventeurs de la présente invention ont établi des systèmes, des procédés et un logiciel qui facilitent de manière générale l'identification d'un ou plusieurs documents liés à un document donné, et facilitent en particulier l'identification d'affaires antérieures pour une affaire donnée. Dans un mode de réalisation spécifique, des affaires antérieures candidates sont récupérées en fonction d'informations extraites d'une affaire d'entrée. Une machine à vecteur de soutien est ensuite utilisée pour déterminer quelles affaires antérieures candidates sont le plus probablement des affaires antérieures correspondant à l'affaire d'entrée.
