The invention is more particularly concerned with an improved holder for a lipstick characterized by'means of advancing and ejecting the end portion of the stick member which usually remains in the holder so that it can be used and so that the entire stick member can be displaced and so that a fresh stick member can be engaged in the holder, enabling the holder to be used repeatedly and/ or enabling stick members of different color to be engaged in the construction, as circumstances require.

In the ordinary lipstick case, the stick member is engaged in and supported -by a cup member, to project therefrom. The portion of the stick member occurring in the cup member is substantially engaged in or shrouded by the cup member in such a manner that it cannot be used, thereby resulting in considerable waste.

The ordinary lipstick case is considerably more costly than the stick member engaged therein and is such that when so much of the stick member is used that it can no longer be applied to ones lips, the entire case, with the remaining stick member must be disposed of.

As a result of the above, lipstick cases are made as cheap or inexpensive as possible, and to the end that quality or more luxurious lipstick cases are not provided, as they would be too costly.

Many attempts have been made to provide lipstick case constructions wherein the entire stick member can be used without waste and wherein new stick member can be easily and conveniently engaged so that the case construction can be used repeatedly. The end sought in such attempts has been to materially reduce the cost of the lipsticks to the consumer and also making it economically possible to provide cases of superior quality.

The past attempts along the above lines have resulted in rather complicated, hard to manufacture constructions, requiring special stick member, special skill in operation and/or structures which are not dependable.

An object of the present invention is to provide a lipstick case construction having a vertically shiftable cup member to engage and carry a stick member, and means carried by the cup member to selectively advance the stick member from engagement in the cup member and so that the entire stick member can be used.

Another object of my invention is to provide a construction of the character referred to wherein the said means carried by the cup member can be operated to eject or disengage a stick member from the cup member and be reset so as to facilitate engagement of a new or fresh stick member in the cup member.

A further object of this invention is to provide a construction of the character referred to wherein the advancing or ejecting means carried by the cup member is extremely simple, practical and dependable and is such that it can be established at little cost and such that it requires no special skill or operate.

The various objects and features of my invention will be fully understood from the following detailed description of typical preferred forms and application of my invention throughout which description reference is made to the accompanying drawings; in which:

The basic lipstick case that I provide in carrying out the present invention can vary widely in form and construction. In the drawings, I have shown a typical lipstick case including a casing 1.0 having an open'end normally closed by a sleeve-like closure il. which encloses the major portion of the length of the casing it). The casing I@ includes an outer tubular section I2, and an inner tubular section I3. At the open end of the casing lil, the sections i2 and 13 are even and the adjacent faces of the said sections are in spaced relationship from each other' throughout the major portion of their longitudinal extent. The end of the inner section I3 opposite the open end of the casing liti is projected beyond the adjacent end of the outer section IZ and is formed with an enlarged finger grip portion ld by which the inner section can be rotated relative to the outer section. The enlarged portion ld establishes an upwardly disposed shoulder 14a against which the adjacent end of the outer section I2 abuts and against which the closure il stops when in position on or over the casing.

The end of the enlarged portion 14, opposite the casing, is open. A suitable plug-like closure l5 is slidably engaged in the open end of the portion 14 and is such that it can be readily removed to provide access to the interior of the casing and rte-engaged in the portion 14, Y

as circumstances require.

Sldably disposed within the inner section 13 is a cupshaped member 16 and the stick member 17 carried thereby with relation to the open end of the casing iii. The advancing and retracting means includes a radially projecting pin 1S on one side the cap member, and a cam sleeve 19, having an elongate special slot or groove Ztl therein and carried by the outer section I2 of the casing to occur between the said inner and outer sections. The pin 18 projects through a longitudinally disposed elongated slot 21 in-one side of the inner casing and into engagement in the groove 20 in the cam sleeve.

The construction thus far described is conventional in the art, save the open end of the enlargement 14 and the plug l5 therefor. Accordingly, further detailed description of he basic lipstick casing construction illustrated, can -be dispensed with. i

In operation, it will be apparent that, when the portion ld on the section 13 is gripped and turned, the inner section 13 is rotated in one direction or the other relative to the outer section 12 and the cam sleeve 19 and in which the pin 13 of the cup member is engaged. This relative rotation causes the cup member 16 to shift longitudinally in the inner section of the casing and the stick member carried thereby to shift into and out of the open end of the casing, as circumstances require and as controlled by the direction of rotation o-f the said portion 14.

The cup member 16 is characterized by a cylindrical axially disposed side wall 25 and a Hat bottom wall 26.

The means provided by the present invention to selectively advance the portion of the stick member engaged in the cup member, out of the cup member includes generally, disc-shaped platform 30 slidably engaged in the cup member to normally occur adjacent the bottom Wall aoeefroa 9 thereof and upon which the stick member is seated and an elongated stem 3l fixed to the platform and projccting downwardly through a suitable opening 32 provided in the bottom wall 26 ofthe cup member.

In the form of the invention shown in FIGS. 2, 3, and 4 of the drawings, the stem 3]. is a tubular member and is provided with a plurality of longitudinally spaced radially outwardly projecting teeth-like dogs 33.

The dogs 33 may be established in the tubular stem by initially' lancing the stem transversely of the axis of the stem and subsequently engaging a suitable tool in said laneed positions of the tube and upsetting the tube wall in the manner desired.

The dogs 33 are established in the tubular stem so aS to define longitudinally upwardly inclined leading surfaces 34 and substantially longitudinally downwardly disposed stop shoulders 3S.

The opening 32 in the bottom wall 26 of the cup member is of a sufficient size to freely receive the stem 31, but is not of sufficient size to freely receiving the portion of the stem where the dogs 33 project therefrom. As a result of the above relationship of parts, stern 3l can only be urged upwardly through the opening 32 in the botom wall 26 by the application of sufficient pressure to cause the dogs 33 and/ or the bottom wall 26 to flex suticiently to permit the dogs 33 to be urged through the opening.

The construction, that is, the cup member and the stem are established of rather thin sheet metal stock which is such that it can be readily flexed the desired amount for the purpose here intended.

By virtue of the upwardly inclined leading surfaces 34 on the dogs 33, the stem can be urged upwardly through the bottom wall 26 within the application of little pressure, while the substantially downwardly disposed stop shoulders of the jaws engage the top surface of the bottom wall 26 upon downward pressure on the stern and are such as to positively prevent downward movement of the stem and resulting downward movement of the platform 30 in the cup.

With the above construction, it will be apparent that when the stick member is worn down to the upper or top edge of the cup member, that portion of the stick member occurring within the cup member can be advantageously advanced out o-f the cup by urging the stem 31 and platform 30, on which the stick member is seated, upwardly. It will be further apparent that when the lipstick is subsequently used and pressure is exerted downwardly through the stick member, downwardly shifting of the stick members is prevented -by the action of the stop shoulders 35 ofthe dogs 33 engaging the top surface of the bottom wall of the cup.

The stern 31 is of suicient longitudinal extent so that the platform 30 can be urged, at least, to the upper edge of the cup member and so that the stick member can be completely ejected from engagement in the cup member.

In the preferred carrying out `of the invention and to facilitate returning the platform 30 to its normal position, adjacent the bottom wall 26 of the cup member and so that a iirst stick member can be engaged in the cup member, the opening 32 in the bottom wall 26 of the cup member is provided with a notch 37 at one side to freely receive the dogs 33 and the lower end of the stem is provided with a suitable tool engaging slot, or diametn'cally opposed radial tool receiving notches 38 to facilitate rotating the stem.

With this relationship of parts, it will be apparent that the stem can be rotated to a position where the dogs 33 are aligned with the notch 37 in the bottom wall 36 and where stop shoulders on the dogs are out of engagement with the bottom wall of the cup and the stem on the plat- -form are free to be shifted downwardly.

It is to be understood that access to the stem, for operating the construction in the manner set forth above, is made through the bottom of the enlargement 14 of `the casing l0, when the plug is removed.

ln the form of the invention shown in FIGS. 5 and 6 of the drawings, the cup member le and platform 39 remain the same. The stem 3l', however, consists of an elongate strap of spring metal having an upper end xed to the platform r[he stem 31 projects downwardly through the opening 32 in the bottom wall 26 of the cup member as in the rst form of the invention, with the exception that the opening 32 is rectangular or square, rather than round. The opening 32 is arranged in the bottom wall Z6 of the cup so that the stem normally occurs adjacent one side of the opening, as clearly illustrated in FIG. 5 of the drawings.

The dogs 33 in the second form of the invention are simple, laterally outwardly, downwardly inclined tabs formed in the stem. The dogs being formed of the same stock as the stem are resilient and are disposed so that their lower edges or ends establish strap shoulders 35 that oppose the top surface of the bottom wall 26 adjacent the opening 32.

With the above relationship of parts, it will be apparent that when it is desired to advance the stick member out of the cup member, as set forth in the preceding, the operator need only urge the stem upwardly, whereupon the stem and/or the dogs occurring below the bottom wall 26 will readily flex and advance upwardly through the opening 32 and past the bottom wall 26.

It will be further apparent that upon the exertion downward pressure on the stick, the dogs 33 engage the bottom wall 26 and suitably prevent downward shifting of the stick.

When it is desired to return the platform 30 to its normal position adjacent the bottom wall 26 of the cup member, the operator need only ilex the stem laterally in the opening 32' so that the dogs clear the bottom of the cup member, and pull the stem downwardly.

To facilitate returning the platform 30 to its normal position, the stem can, as shown, be provided with a suitable tab 30 at its lower end, which tab can be provided with a suitable tool engaging slot 4l.

From the foregoing, it will be apparent that I have invented an extremely simple, highly effective and dependable construction for advancing and/or ejecting the stick members from the stick carrying cups of lipstick dispensers or cases.

Having described only two typical preferred forms and applications of my invention, l do not wish to be limited or restricted to the specific details herein set forth, but wish to reserve to myself any modifications or variations that may appear to those skilled in the art and fall within the scope of the following claims:

Having described my invention, I claim:

1. ln a holder for lipstick, an elongate, vertically disposed, tubular casing having open top and bottom ends, a cup member having a ilat bottom wall and a tubular side wall slidably disposed within the casing for movement toward and away from the upper open end of the casing, an elongate, vertically disposed stick member arranged within the upper portion of the casing and having its lower end portion pressed into and supported by the cup member, a platform slidably engaged in the cup member to normally occur adjacent the bottom wall of the cup member and engaged with the bottom end of the stick member, an opening in the bottom wall of the cup member, an elongate, vertically disposed stem xed to and depending from the platform and projecting through the opening in the bottom wall of the cup member, said stem having a plurality of vertically spaced, laterally projecting, resilient dogs with upwardly inclined leading surfaces and substantially downwardly disposed stop shoulders, the portion of the bottom wall of the cup member defining the opening serving to engage the leading surface of the dogs and deflect the dogs inwardly when the stem is urged upwardly through the said bottom wall, the stop shoulders of the dogs serving to engage the top surface of said bottom wall and stop downward shifting of the stem through the said bottom wall, said stem being engageable through the open bottom end of the casing, said opening in the bottom wall of the cup member being rectangular, said stern being formed of a strap of spring metal and normally occurring adjacent one side of the opening, and spaced from the opposite side of said opening, the dogs on the step projecting from the side thereof occurring adjacent the said one side of the opening, said stem being adapted to be sprung toward said other side of the opening whereby the dogs are shifted from position above the top surface of the bottom wall of the cup member and so the stem can be shifted downwardly through the opening in the bottom wall.

2. In a holder for lipstick, an elongate, -vertically disposed, tubular casing having open top and bottom ends, a cup member having a at bottom wall and a tubular side wall sl-idably disposed within the casing for movement toward and away from the upper open end of the casing, an elongate, vertically disposed stick member arranged within the upper portion of the casing and having its lower end portion pressed into and supported by the cup member, a platform slidably engaged in the cup member to normally occur adjacent the bottom wall of the cup member and engaged with the bottom end of the stick member, 'an opening in the bottom wall of the cup member, an elongate, vertically disposed stem fixed to and depending from the platform and projecting through the opening in the bottom wall of the cup member, said stem having a plurality of vertically spaced, laterally projecting, dogs with upwardly inclined leading surfaces and substantially downwardly disposed stop shoulders, the portion of the bottom wall of the cup member defining the opening serving to engage the leading surface of the dogs and deflect the dogs inwardly when the stem is urged upwardly through Ithe said bottom wall, the stop` shoulders of the dogs serving to engage the top surface of said bottom wall and stop downwardly shifting of the stem through the said bottom wall, said stem being engageable through the open bottom end of the casing, said opening in the bottom wallof the cup member being rectangular, said stem being formed of a strap of spring metal and normally occurring adjacent one side of the opening, and spaced from the opposite side of said opening, the dogs on the stem projecting lfrom the side thereof occurring adjacent the said one side of the opening, said stem being adapted to be sprung towards said other side of the opening whereby the dogs are shifted from position above the top surface of the bottom wall of the cup member and so the stem can be shifted downwardly through the opening in the bottom wall, said stem having a tab with a tool engaging slot at its lower end.

3. In a holder for lipstick, an elongate, vertically disposed, tubular casing having open -top and bottom ends, a cup member having a vflat bottom wall and a tubular side wall slidably disposed within the casing for movement toward and away from the upper open end of the casing, an elongate, vertically disposed stick member arranged within the upper portion of the casing and having its lower end portion pressed into and supported by the cup member, a platform slidably engaged in the cup member to normally occur adjacent the bottom wall of the cup member and engaged with the bottom end of the stick member, an opening in the bottom wall of the cup member, an elongate, vertically disposed resilient stem fixed to and depending from the platform and projecting freely through the opening in the ybotom wall of the cup member, said stem having a plurality of vertically spaced, laterally projecting, resilient dogs with upwardly inclined leading surfaces and substantially downwardly disposed stop shoulders, the portion of the bottom wall of the cup member defining the opening yserving to engage the leading surface of the `dogs and deflect the stem laterally and the dogs inwardly relative to the stem when the stem is urged upwardly through the said bottom wall, the stop shoulders of the dogs serving to engage the top surface of said bottom wall and stop downward shifting of the stem through the said bottom wall, said stem being engageable through the open bottom end of the casing and equal or greater .in longitudinal extent than the vertical extent of the cup so that the platform can be shifted vertically to `the top of the cup and shift the stick member from engagement in the cup.
