Be it-known that I, MARIE G. Jones, a

citizen of the United "States, residingat- Los Angeles, in the county of Los Angeles and State of Calitornia,-liaveinvented a new and useful Toy, ofwhich the following is aspecification.

The device forming the subject matter of this application is a toy, and one objectot the invention is to provide a device of this sort WhlCh wlll simulate the ascent of a figure, representing Santa-Claus, in a flue.-

Another object of the invention is to provide novel means for securing an ascent of the figure in the flue.

Another object of the invention to provide novel meansfOr holding the figure in a depressed position,responsiveto the. action of a spring.

A further object ofthe invention is to provide afiue which is so constructed that it may be opened readily, to permit a readjustment of the figure and the spring means which actuates the figure, mechanism bzing provided whereby relative longitudinal movement between the parts of the fine may be prevented.

It is within the, province of the disclosure 'to improve generally and to enhance the utility of devices or that type to which the "present invention appertains.

)lVith the aboveancl other -obiects in view which will appear the description 4 proceeds, the invention resides in the combination and arrangementgof parts and in the details of construction hereinafter described and claimed, it being understood that changes in the precise embodiment of the invention herein disclosed, can be made within the scope of what is claimed, without departing from the spirit of the invention.

Figure 1 shows in front elevation, a toy constructed in accordance with the present invention;

Figure 2 is a longitudinal section of the toy; and

Figure 3 is a detail showing the actuating spring and attendant parts.

In carrying out the present invention there is provided a flue which is denoted generally by the numeral 1. The flue 1 is a composite structure and includes, as shown, an upper tubular member 2 which, upon its outer surface, may be marked off or otherwise constructed asshown at 3, to represent brick work. A lower member 4 is telescoped into the upper member 2, the lower member preferably being'in the form of a box which is open at the front, as shown at 5. The lower member 1 is telescoped but partly into the upper member 2, so as to represent a fire-place, which, like the memher 2, may be marked *ofl as indicated at 6, to representbrick work. The bottom oi' the lower member 41 is denoted by the-numeral 7 the member' being supported upon legs 8, if desired. In order to prevent telescopic movement between the upper tubular member 2 and thelower member 1 of the 'fiue, any'suitable means may beprovided. In the present embodiment of the invention, a shelf 9 is pivoted at10'to the upper member ofthe 'fiue, near"to'the lower edge thereof. The rear edge 11 ofthe shelf 9 is adapted to be engaged in seats 12 formed in the forward edges'ofthe sidewalls of the lower member 4 ofthe flue, audit will be seen" that whenthe shelf in a horizontal position, as shown'indl i'gure' 2, the upper member 2 ot'the' flue cannotslide downwardly on the lower-"member a of the "flue. A figure 15, constructed conventionally to represent Santa Claus, is located in the lower member 4 of the flue, and is Visible through the open side 5 of the flue, the figure 15 carrying a pack 16, in which a plurality of toys or other loose objects 17 are placed. The figure 15 may include a depending flexible hood 18, on which the legs 50 of the figure are painted or otherwise marked, although the specific construction oi the figure above alluded to may be departed from without jeopardizing the utility of the invention. The hood 18 serves to house a helical spring 19, the upper end 20 of which is assembled with the figure 15. The spring 19 preferably is of conical form, the lowermost convolution of the spring resting on the bottom 7 of the lower member 1 of the flue. In the bottom 7 of the lower member of the flue, an opening 21 is fashioned, and through this opening extends a link 22, the upper end of which is engaged with the upper convolution of the spring 19. A pin or like releasing device, shown at 23,

is disposed below the bottom 7 of the lower member of the flue and passes through the lower end of the link 22, to hold the spring 19 strongly compressed, and to maintain the figure 15 in the position shown in Figures 1 and 2 of the drawings.

In practical operation, the pin 23 is pulled out of the lower end of the link 22, whereupon the figure 15 will be rendered responsive to the action of the spring 19, the figure, under such circumstances, ascending the flue l, and ordinarily, passing out of the 'upper end of the flue. hen the figure 15 emerges from the upper end of the flue 1, the toys 17 in the pack 16 are thrown about, in all directions, thereby adding to the amusement produced by the operation of the structure. hen the figure 15 ascends the flue 1, the spring 19 moves upwardly, away from the bottom 7 along with the figure. lVhen it is desired to replace the figure in the position shown in Figures 1 and 2, the upper member 2 of the flue is detached from the lower member 4 of the flue, in the manner hereinbefore set forth, thereby permitting a ready adjustment of the figure 15, the spring 19, the link 22 and the pin 23, the upper member 2 of the flue being replaced on the lower member 41, after the figure 15 has been placed as aforesaid.

The device, generally considered, is so constructed that it will represent the. ascent of Santa Claus in a chimney.

Having thus described the invention, what is claimed is:

1. A toy embodying a flue having an opening simulating a fire-place; a figure in the fire-place; a spring carried by the figure and compressed between the figure and the bottom of the fire-place; and means for holding the spring compressed, said means being releasable to cause the figure to ascend the flue, and to cause the spring to move out of contact with the bottom of the fireplace along with the figure.

2. A toy embodying a flue comprising a tubular upper member and a lower member disposed in telescoped relation to the upper member, the lower member being openat the front; a figure in the lower member and visible through the front thereof; spring means for causing the figure to ascend the flue; and mechanism for releasing the figure to the action of the spring means, the upper member being removable from the lower member to permit a readjustment of the figure, the spring means and said mechamsm.

3. A toy constructed as set forth in claim 2, and further characterized by the provision of a shelf movably mounted on the upper member of the flue, the shelf and the lower member of the flue having interengaging parts which coact to limit the telescoping movement between the upper and lower members of the flue.

4. A toy embodying a flue having an open ing simulating a fire-place, a figure in the fire-place, a plurality of objects carried by the figure, a spring carried by the figure and compressed between the figure and the bot tom of the fire-place, and means for holding the spring compressed, said means being releasable to cause the figure to ascend the flue and to scatter said objects from the figure, the spring moving out of contact with the bottom of the fire-place, along with the figure, to enable the figure to imitate, closely, a jumping operation.
