be securely locked in position in the pocket of a wearer to keep the pen or pencil from becoming detached and lost. One of the mainfaultsof the present type of clips is that with persons whoare active, the clipgradually disengages itself from the pocket material. This invention aims to eliminate this danger by providing an articulate clip on which a locking tooth is provided, the tooth being adapted to pierce the pocket material. and rigidly retain the article to which the clip is attached in position in the pocket, so that no matter how active a per son may be, the safety clip still retains its position until released..

The above and other objects will become apparent in the description below, in which characters of reference refer to like-named parts in the drawing.

Referring briefly to the drawing, Figure 1 is a front elevational view of a fountain pen, showing the safety clip attached thereto, this view being shown enlarged.

Figure 2 is an enlarged front elevational view of the clip in looking position.

Figure 3 is a side elevational view of Figure 2.

Figure +t is a front elevational view enlarged of the clip, showing the same in the position in which it is retained when inserting the article to which it is attached into the pocket.

Figure 5 is a side elevational view of Figure 4.

Referring in detail to the drawing, the numeral indicates the barrel of a fountain pen at one end of which the usual pen is inserted. This pen end is oridinarily covered by a cap 11 which slips over the barrel 10 when not in use. The safety clip is attached to this cap 11, preferably the upper end. The clip comprises an encircling hoop or band 12 which may be permanently mounted on the periphery of the barrel 11 after production, or it may be molded 1.1.,v 1925.. Serial No. 8,344;

16 and 17 are bent toward each other and form lips, the purpose for which will be more fully hereinafter described. Mounted on the pivot pin within the slot 15, is a locking lever 20' which, in normal position, extends vertically downward aligned with the plate 14.. Thisflocliing' lever is provided with a pair of channels 2:1 and 22, and the channels when aligned with the'legs 16 and 17' of' the plate 14-,are adapted to receive the tips 23 of said legs and in this manneryielda-bly lock the locking lever 2O i'na position alignedwith thewlegs 16 and 17, and plate 14;. Off-set from the pivot pin 19, which supports the locking lever, is a triangular tooth 24; which extends inwardly toward the band 12 and is adapted to be removed from the surface of the pen or pencil to which the article is attached, by a small distance. The lower end of the locking lever is provided with a balled end so that the cloth material may easily be slipped between the outline of the article to which the clip is attached to the balled portion 25, as indicated in Figures 1 and 2.

When desiring to attach a fountain pen or pencil, which is equipped with this type of safety clip, to the person, the locking lever 20 is rotated to the position shown in Figure 4, that is, it is rotated to a position at right angles to the plate 14. As the mate rial forming the pocket of the article of apparel enters the space 26 between the pen or pencil, and the balled end of the looking lever, the pocket material will engage a semi-circular head 27 at the upper end of the locking lever, and by engaging this head, will lift the latter when the pen or pencil is being shoved down in the pocket, and will in this manner rotate the locking lever 20 downwardly. 16 and 17 are spread apart and away from each other to permit passage of the upper end of the locking lever, and as the

16 and 17, the latter being resilient, will snap into these channels and lock the locking lever in the position indicated in Figure 2, in which the locking tooth 24 pierces the pocket material and se-- curely locks the pen or pencil in the pocket so that the same is incapable of being shifted.

I claim 1. In combination with a pen or pencil, a safety clip adapted to lock said pen or pencil in the pocket comprising a band rigid with said pen or pencil, a plate depending therefrom, the lower end of said plate being bifurcated by a slot, said plate having legs at its lower end, a locking lever pivoted on said legs, said lever having parallel longitudinal channels at its sides, the legs cooperating with the channels to lock said lever in a position aligned with the plate, and a tooth on said lever adapted to project toward the pen or pencil and pierce the pocket material to lock said pen or pencil in place in the pocket.

2. In combination with a pen or pencil, a safety clip adapted to lock said pen or pencil in the pocket comprising a band rigid with said pen or pencil, a plate depending therefrom, the lower end of said plate being bifurcated by a slot, transversely resilient legs at the lower end of said plate, a locking lever pivotally mounted between said legs, the lower ends of said legs being curved toward each other, channels in said locking lever adapted to receive the lower ends of the legs and lock the locking lever in a position aligned with the plate, a tooth on said locking lever and semi-circular head on the end of said locking lever adapted to be engaged by the upper edge of the pocket when the locking lever is at right angles to the plate member, said engagement causing the locking lever to be rotated from the open to the locked position.

3. In combination with a pen or pencil, a safety clip adapted to lock said pen or pencil in the pocket comprising a band rigid with and encircling said pen or pencil, a plate depending therefrom beside the pen or pencil forming a vertical arm, a locking lever hinged to the lower end of said plate, a tooth on the side of the locking lever near one end thereof extending sidewise from said lever toward the pen or pencil, the end of the lever extending beyond the tooth being adapted to be interfered with by the pocket of the user when the clip is being entered into a pocket, said tooth being adapted to lock the pen or pencil in the pocket when the lever and arm are aligned, and cooperating means on the lever and vertical arm for yieldably locking the plate and locking lever in aligned position.
