Be it known that I, Honirrsnas MORRIER,

a citizen of the United States, residing at Portsmouth, in the county of Rockingham and State of New Hampshire, have invented a new and'useful apparatus to be known as a Cigar and Cigarette Ash Protector and Fire Preventer, of which the following is a specification.

The invention relates to an apparatus which entirely encloses a cigaror cigarette of any size or shape, and, While not restricting the draft or case in smoking, holds the ashes and fire, allowing no sparks or ashes to be blown or to fall on persons, or

where said sparks and ashes may cause danger or discomfort.

It is well known that as in the case with the well-known Davy lamp, explosive gases or vapors cannot be ignited by flame or fire surrounded by wire screen or finely perforated metal; therefore. by use of this apparatus or instrument. a burning cigar or cigarette may be safely carried or smoked in a garage or any place wher there was danger of unexpectedly coming in contact with inflammable gases or material.

While the invention, here described is of especial value when used in automobiles where the wind can and does blow sparks, and ashes. from an unprotected cigar or cigarette, into the rear of the car and onto the people riding there. this invention is also intended to be used in any place where ashes or sparks may fall and be dangerous or annoying.

The invention may be used with both cigars and cigarettes, and is featured by a casing for enclosing the article to be smoked 4.0 and clamp of a form and nature for hold.-

ing the casing on the article in a manner that will not injure it or be inconvenient to the smoker.

To the accomplishment of. the object named. and such others as may hereinafter appear as will readily be understood by those skilled in the art from the following description. the invention comprises the features and combination of parts hereinafter described and then particularly pointed out in the appended claims.

The preferred form of my invention is illustrated in the accompanying drawing in which:

In the embodiment of the invention illus trated in the drawing the device is shown as comprising a cylinder or tube'l made of perforated 'metal, although it is within the scope of the invention to use wire cloth or any suitable fire proof material which will permit the passage of air. and smoke but will retain the fire and'ash. At one end the tube 1 is provided with a two part clip 2 for embracing the inserted article and holding the device thereon. The parts of this clip are'of a skeleton Wire construction comprising longitudinal members with con nected semi-circular bows, as shown in the drawing. One part is rigid with the tube 1 and the other is hinged on the first at 3. The hinge 3 may be of any common form that will cause the two parts to form a circular clamp, when closed, as shown in Fig. 2, and yet permit the clip to be opened w thout effort and to remain open, as shown in Fig. 1, while inserting the article to be smoked or removing the butt. A. spring snap for holding the parts together is carried by the hingedpart. The other end of thetube 1 is, provided with a perforated cap or cover 4 which is hinged at 5. This cover is snapped into its closed position while smoking, see Fig. 2, and may be opened to discharge an accumulation of ash from the tube whenever desired. I

An important feature of the device resides in the combination with a tube, which is of a length to receive substantially the whole article to be encased, of means for retaining the tube on the. article while still permitting the article itself to be held by the fingers of the smoker. To this end the complemental skeleton construction of the two clip parts has been devised which pro-' vides digital openings exposing a' relatively large surface of the article, within the frame of the clip 2 which, because of the length of the tube 1, embraces the article at a point very near its lip end. The advantage of a long ash holding tube that need not be adjusted after once being attached, combined with ample exposed surface for handling the article to b smoked without danger of burning the fingers by grasping construction of the Clip',-Wl1iCh lies smoothly against the article held and has no projecting operating handle for opening it, since this permits a cigarwith a protective tube thereon to be carried in the pocket without inconvenience.

In devices of this character it is important that the clip for holding the protective tube in place be of such a construction that its function is performedthrough pressure alone. If teeth, which penetrate the Wrapper of the cigar or cigarette, are used to hold the tube in place then the draft is inj uriously affected and the device becomes useless.

It is obvious that the device of my invention may be used with a cigar or cigarette holder, if desired.

The scope of the invention having been indicated and the preferred form of the invention having been specifically described, what I claim as new, is

1, A device ofthe class described comprising a perforated tube substantially the length of the article to be smoked having a circumferential spring clip at one end for holding the tube in place on the article said clipbeing formed of two semi-cylindrical parts lying closely adjacent the lip end of he article, each of said parts having digital openings through which the article may be grasped by the fingers of the smoker.

2. A device of the class described comprising a perforated tube having a two part clip at one end of the tube formed of wire, the opposedends of said parts forming a circular band for engaging by external pressure only the surface of the article to be smoked,

and each part having a member lying longi tudinally of the tube which members are re-- rigid with the tube having two longitudinal legs and a semicircu-lar end connection therebetween, and a complemental skeleton wire part hinged to one of said longitudinal legs, whereby when the two parts are closed an article within the tube Will be embraced by the circumferential band formed by the two semi-circular ends, and the article itself may be grasped by the smoker where its surface lies exposed between said band and the tube.

4. A device of the class described con1prising perforated tube substantially the length of the article to be smoked open at one end andclosed at its other end, means adjacent the open end to hold the tube on the article by external pressure on its surface, and digital openings adjacent said means through which the article may be grasped by the fingers of the smoker.

A device of the class described comprising a perforated tube substantially the length of the articleto be smoked open at one end and closed at its other end, pressure means secured to the tube and extending longitud'inall} thereof for holding the tube on the article, and digital openings intermediate the ends of said pressure means through which the'surface of the article is exposed.
