Specification of Letters Patent.

To all whom it may concern:
Be it known that I, YVILLIAM J. MoGIRR, a citizen of the United States, residing at Pinsonfork, in the county of Pike and State of Kentucky, have invented a new and useful Metal Tie, of which the following is a specification.
The device forming the subject matter of this application is a fastening means adapted to hold a railroad rail in place on a tie.
One object of the invention is to provide a novel form of movable retainer, adapted to engage one side of a rail, and to provide means whereby the said retainer is held in place with respect to the tie and the rail.
It is within the province of the disclosure to improve generally and to enhance the utility of devices of that type to which the present invention appertains.
With the above and other objects in view which will appear as the description proceeds, the invention resides in the combination and arrangement of parts and in the details of construction hereinafter described and claimed, it being understood that changes in the precise embodiment of the invention herein disclosed can be made within the scope of what is claimed, without departing from the spirit of the invention.
In the accompanying drawings Figure 1 shows in top plan, one end of a tie, constructed in accordance with the present invention;
Fig. 2 is a longitudinal section of. the structure shown in Fig. 1; and
Fig. 3 is a bottom plan of the structure shown in Fig. 1.
In carrying out the present invention there is provided a tie 1 which preferably is made of metal, the tie including a fiat central portion provided with a longitudinal reinforcing rib 3, the central portion of the tie being denoted by the reference character 2. The tie l is alike at both ends, and one end of the tie, therefore, only, is shown and described. The central portion 2 of the tie is formed integrally with an end in the form of an inverted trough, preferably somewhat narrower than the central portion 2, and including a top 1 and depending flanges or side walls 5.
Resting on the end of the tie 1 is a rail 7. The numeral 8 denotes a fixed retainer of any desired form engaging the upper face and the web ings, and then the inner side of the rail 7 is engaged by an adjustable retainer which will now be described. I
The top 4 of the tie carries a pivot element 16 on which is mounted to slide longitudinally, and to swing horizontally, a retainer 17, preferably in the form of a plate, provided with a slot 19 which receives the pivot element 16, the slot 19 extending longitudinally of the retainer. The inner end of the retainer 17 is bent upwardly to form a flange 18 whereby the retainer may be manipulated. The retainer at its outer end overlaps the flange of the rail 7 and bears against the web of the rail. superposed on the retainer 17 is a resilient latch 20 which is mounted to swing horizontally on the pivot element 16. The latch 20 has a depending end 21 which passes through the slot 19 and bears on the flange of the rail 7. Since the end 21 of the latch 20 passes through the slot 19 and bears on the flange of the rail 7, it will be obvious that the re tainer 17 cannot be retracted until the end 21 of the latch is raised. In practical operation, the end 21 of the resilient latch is raised clear of the slot 19 and, if desired, the latch 20 may be swung laterally on the pivot element 16 until the lower extremity of the end 21 of the latch rests on the upper sur face of the retainer 17 at one side of the slot 19. Then, the retainer 17 may be retracted, the slot 19 permitting the retainer 17 to move with respect to the pivot element 16.
After the rail 7 has been placed on the tie, in engagement with the fixed retainer 8, the movable retainer 17 is pushed forwardly, and the end 21 of the latch 20 is permitted to swing downwardly into the slot 19, whereupon the retainer 17 will be held against retraction, and in the position shown in Fig. 2.
Having thus described the invention, what is claimed is V 1. In a device of the class described, a tie; a rail thereon; a movable retainer engaging the rail and having an, opening; means in the opening and engaging the tie for guiding the movement of the retainer toward and away from the rail; and a swinging latch carried by said means and engaging the retainer to hold the retainer against retraction with respect to the rail.
2. In a device of the class described, a tie; a rail thereon; a movable retainer engaging the rail and having an opening; means in the opening and engaging the tie for guiding the movement of the retainer toward and away from the rail; and a swinging latch carried by said means, the latch entering the opening and coacting with the retainer at one end of the opening to hold the retainer against retraction.
8. In a device of the class described, a tie;
the opening and engaging the tie for guiding the movement of the retainer toward and away fromthe rail; and a swinging latch mounted at oneend 0n the retainer, the other end of the latch entering the opening and coacting with the retainer at said end of the opening, to prevent a retraction of the retainer with respect to the rail.
