Description

具商業規則應用之媒體內容來源偵測系統、方法與電腦可讀取式媒體
本發明係用以確認網路(例如網際網路)上可得之聲音或影像內容的來源，並利用此類的資訊對該等內容進行著作權的保護及/或多個商業規則的應用。
多數使用者在上傳受到著作權保護的內容至網站時並未獲得授權。因此，網站的管理者通常需要花費高昂的費用在其網站的架構中建立防衛機制，用以避免(或盡量減少)著作權的侵害。
本發明係提供一種結合特定商業規則且用於保護一線上發佈內容之著作權的系統與方法。根據本發明所揭示內容之一態樣，該系統與方法可藉由分析分析為上傳至一個網路而顯示的內容中的一部份以偵測與一個內容擁有者相關的圖像，將所偵測到圖像以及一組參考圖像進行比較以辨識該內容擁有者，並且應用多個商業規則以控制未經授權的內容的上傳行為。該圖像可能是包含在該內容中作為一個數位的線上圖形以代表該內容擁有者的一個標示。或者是該圖像亦可是出現在一個影像中的一個人臉，且該分析並包含一個自動化的臉部辨識步驟。舉例而言，當該內容包含一個影像時，該分析可藉由影像畫面中的一個樣本畫面或一個具有事先選定長度的一個片段而實現。
在所偵測到圖像以及該等參考圖像中所進行的比較可包含計算在所偵測到圖像以及該等參考圖像之間的符合程度，如果該符合程度達到一個預定標準，則可能會需要對該圖像進一步分析(或進行人工方式的檢查)。
而商業規則的應用可包含將上傳該內容的一個使用者的辨識特徵以及一組與該內容擁有者相關的已授權使用者辨識特徵進行比較，若該使用者確認為已獲得授權時則准許該上傳，而若該使用者確認為尚未獲得授權時則處置該上傳。如果該使用者尚未獲得授權，則當該使用者支付一定金額的費用後可准許該上傳動作，並使其在後續可以存取所上傳的內容。
根據本發明所揭示內容之一部份，揭露包含一個伺服器的一個系統用以實現具有上述特徵的一個方法。
而在此所揭露之系統與方法提供了一個簡單且具有效率的方式，用以在內容擁有者提供明確的視覺性線索或者非視覺性的記號時可用來辨識其內容，因此該內容的下游資料接收者可利用內容分析技術確認該內容的形式並進而應用適當的商業規則。
前述內容已廣泛的描述本發明之精神，並揭露本發明的首要特徵以協助習知技藝者可更清楚的瞭解以下詳細描述的說明內容。而與本發明所主張保護範圍相關的其他特徵亦會在之後一併陳述。習知技藝者可輕易的根據本發明所揭露概念以及特定實施例，並進而設計或修改其他架構以實現與本發明相同之目的，且所修改之其他架構並不悖離本發明之精神及範圍。
以下揭示本發明一實施例，其中一個影像內容具有一個數位化的線上圖形，而該數位化的線上圖形係為代表該內容擁有者的一個標示(logo)。然而，慶幸的是商業上的產品內容通常包含許多的特徵(視覺上以及聽覺上的)，且該等特徵可作為該內容擁有者的有效辨識特徵，亦是代表該擁有者的一種標示。
第一圖顯示將一影像內容1下載至一個用戶端電腦2(通常是一台個人電腦)的一個實施例。該用戶端電腦2的使用者可經由一網際網路(Internet)10提出一個關於圖像內容的請求。圖像來源11可以是電影、電視節目或相片等的發行者(publisher)或播送者(distributor)。該圖像來源11從一個儲存裝置12接收該圖像，並且提供使用者可下載該圖像。該內容1包含一個標示3(通常是在顯示器右下角的一個半透明輪廓)。該內容1通常是受到著作權的保護，因此使用者只被授權可觀賞該內容1但無法保留一份複製本。然而，當缺乏適當的偵測軟體去偵測受著作權保護的內容時，使用者即可將該內容上傳至一個使用者空間17，且經由一個網路15以及線上應用服務提供者例如雅虎(Yahoo!)而存取該內容，並將該內容儲存在一個儲存單元18。一般而言，該內容是由該使用者藉由該網際網路10而傳送至該網路15的一個存取伺服器16(ingest server)。而該圖像來源11與該儲存裝置12亦可是該網路15的一部份。
第二圖顯示本發明一實施例，其中該網路15進一步包含一標示偵測與規則引擎20，用以在該存取伺服器16接收該內容之前處理該內容。雖然該標示偵測與規則引擎20與該存取伺服器16彼此分開，但亦可藉由同一個伺服器硬體架構一併運作。且在一個儲存裝置21中並包含具有多個標示的資料庫，用以與接收之影像內容進行比較。
雖然在多數的例子中，牽涉受著作權保護的內容的偷竊行為通常與具有商業價值的娛樂內容有關，但廣泛種類的內容皆可藉由與一個相關且較小的樣本標示進行比較而獲得保護。當該標示是一個數位圖形或者是記號(bug)時，如第三A圖所示，找尋該標示的工作即可簡化到在一個影像畫面的一個角落24中可預期的位移範圍內進行。另外，如第三B圖所示，該標示的偵測亦可包含辨識在該畫面中出現的一個人臉25。
第四圖顯示一個使用該標示偵測與規則引擎20偵測一個標示的方法的流程圖。在步驟31中，該接收的內容輸入該網路並開始進行處理。在步驟32中，該接收的內容隨即進行解壓縮(decompression)，例如轉換至一種串流格式的影像(flash video)。在步驟33中，解壓縮後的影像或其一部份則被用於分析以偵測一個標示。不論該內容中的標示是否可用人眼觀察而得，在其中內容的分析技術例如圖像辨識皆可用來偵測一個標示的存在。且在分析的過程中通常不需要分析該影像中的所有畫面，該影像可利用取樣產生一個預定數量的畫面，或者取出一個具有預定長度的片段。舉例而言，分析大約2.5分鐘長度的片段即可用來取代較長的電視廣告時間，亦即僅擷取一個受著作權保護節目的至少某些部份。
在步驟34中，選定的畫面或片段則可用於在每一個畫面中可預測的位置上與多個已知的標示進行比較。在步驟35中，如果在接收到的影像中偵測到一個標示，該標示偵測與規則引擎20則應用商業規則以確認該影像內容是否欲進行上傳，且取消該傳送者的動作或要求該傳送者支付一定金額以上傳該內容，以下並詳細描述該過程。
第五圖說明本發明一實施例中進行標示偵測與比較步驟進一步細節的流程圖。在步驟401與步驟402中，接收並解壓縮該影像內容，並使用內容分析技術分析該影像內容。該影像內容或者其中一個樣本可用來對一個螢幕上的圖形(on-screen graphic)或做為其他辨識特徵進行分析。該內容分析技術可包括臉部辨識、聲音辨識、字元辨識(optical character recognition,OCR)，或利用在該內容中可得的聽覺資訊(例如指示廣播廣告插入點的數位提示音，或者是相近的標題文字辨識)進行偵測。雖然該標示通常為一個視覺上可見且顯示在螢幕上並用以對該圖像(或影像畫面)標記的圖形，但自動化的內容分析技術對無法以人眼觀察的標示同樣有效。
在步驟403與步驟404中，當偵測到一個標示時，該標示則用來與內容提供者(創作者、發行者或播送者等)事先提供的多個取樣標示進行比較，並儲存在該儲存裝置21中。在步驟405中，如果該標示可清楚的辨識，則該影像內容的辨識資訊即輸入至一個商業規則引擎以進行下一個步驟。在一個實施例中，該標示有可能無法與該等取樣標示中任一個取樣標示完全相符，但可能達到某種程度的相符程度，例如具有百分之90的相符程度，則該標示可稱之為與一個已知標示模糊匹配(fuzzy match)。如果發現一個模糊匹配，則該規則引擎可產生一個報告用以通知一個觀察者以人眼觀察該標示。在步驟409中，該內容則有可能進行其他的處理，包括離線的檢閱(off-line review)等，以確認是否與一個已知標示具有更高的相符程度。
在步驟408中，如果無法辨識出任何的標示，則可准許該內容的上傳。在步驟406中，如果該內容包含一個已知的標示，則該商業規則引擎即確認是否處置該內容。舉例而言，每一個已知標示皆可能具有一張可允許的使用者名單41(集合團體、聯合成員或僅是可允許的上傳使用者)。在步驟407與步驟410中，如果上傳該內容的使用者屬於該可允許的使用者名單中，則仍可准許該上傳。否則，在步驟411中，該規則引擎即確認該內容屬於被保護範圍，且欲傳送該內容的使用者是未經過授權的。
該商業規則引擎可建立多個可能的方式用以處置未經授權的使用者上傳該內容的行為。第六圖顯示用以處置該內容的二擇一的方法的步驟流程圖。在步驟501中，應用該商業規則以反應特定內容擁有者事先建立的方針。根據該內容擁有者的指引，可進行步驟502以拒絕未授權的上傳或者進行步驟510)對該使用者增加條件以准許該上傳。當該內容的上傳應該被拒絕時，可進行步驟503以直接刪除該內容或者進行步驟504以回報該使用者。該引擎更可進一步對該事件作記號(例如在一個檔案中產生一個條目，或傳送一個訊息至該內容擁有者等)。
或者在步驟510中，該內容擁有者可選擇准許該使用者上傳該內容，以從其中得到報酬。在一個實施例中，該規則引擎在步驟511中對上傳的內容作記號，並持續紀錄該使用者在之後對該內容的存取動作。而在步驟512中，該網路15的管理員即可根據該內容的播放次數依次收費，並提供該內容擁有者其報酬。在此例中，該規則引擎亦可在該內容上傳前對該內容附加相關的歸屬資訊(attribution information)。
每一個內容使用者對於未獲得授權的使用者不需採取相同規則。舉例而言，一個擁有者可能選擇禁止所有欲上傳其內容的行為，另一個使用者可能選擇允許部分選定的項目的上傳行為。而一個欲上傳較流行或者較新的電影的使用者可能會被要求比上傳較舊電影的使用者更高的報酬。
本發明所揭示之系統與方法可用來保護視覺上或非視覺上(例如聽覺上或音調上)的受著作權保護內容。一個音調上的標示特別是可能會被用來辨識影像或聲音內容擁有者。
雖然本發明已由多個特定的實施例而揭示其內容，然而習知技藝者亦可根據前述多個描述而清楚知悉其替代物，或其修改與變更。本發明所揭示內容可包含所有其他符合在本發明所主張專利權保護範圍與精神之中的可替代物，或其修改與變更。

Claims (16)

  1. 一種具商業規則應用之媒體內容來源偵測方法，包含：利用一電腦使用內容分析技術分析內容的一部份，該內容的一部份為上傳至一個網站而顯示，以偵測視覺顯示在前述部份中與一內容擁有者相關的一張圖像；利用該電腦將前述偵測到之圖像與一組參考圖像比較，以辨識前述為上傳至一個網站而顯示的內容之該內容擁有者；利用該電腦存取一組可允許用來上傳前述內容的使用者之辨識特徵；利用該電腦將前述為上傳至一個網站而顯示的內容之一使用者的辨識特徵以及該組與前述內容擁有者相關的已授權使用者之辨識特徵進行比較；若前述使用者確認為尚未獲得授權時，利用該電腦准許上傳前述內容至該網站；以及利用該電腦使前述未授權使用者對於前述上傳內容的後續存取支付費用。
  2. 如申請專利範圍第1項之方法，其中前述從為上傳至一個網站而顯示的內容中之該部份內容偵測到之圖像係包含代表前述內容擁有者的一個標示的一數位圖形。
  3. 如申請專利範圍第1項之方法，其中前述從為上傳至一個網站而顯示的內容中之該部份內容偵測到之圖像包含一人臉，且前述分析包含一自動化人臉辨識步驟。
  4. 如申請專利範圍第1項之方法，其中前述比較進一步包含： 計算前述偵測到之圖像與一參考圖像之間的符合程度；若前述符合程度達到一個預定標準，則回報一個對前述所偵測到圖像進行更進一步分析的請求。
  5. 如申請專利範圍第4項之方法，其中前述更進一步的分析包含以人工方式進行檢查(human inspection)。
  6. 如申請專利範圍第1項之方法，其中前述為上傳至一個網站而顯示的內容包含多個影像畫面，且前述分析係在前述多個畫面中的一個取樣樣本進行。
  7. 如申請專利範圍第1項之方法，其中前述為上傳至一個網站而顯示的內容中之該部份內容係為一影像節目的一個片段，且前述片段具有一個事先選定長度。
  8. 一種具商業規則應用之媒體內容來源偵測方法，包含：利用一電腦分析為上傳至一個網站而顯示的內容中一部份，以偵測代表一內容擁有者的一個標示；利用該電腦比較前述偵測到之標示與一組參考標示，以辨識前述內容的擁有者；利用該電腦存取一組可允許用來上傳前述內容的使用者之辨識特徵；利用該電腦將前述為上傳至一個網站而顯示的內容之一使用者的辨識特徵以及該組與前述內容擁有者相關的已授權使用者之辨識特徵進行比較；若前述使用者確認為尚未獲得授權時，利用該電腦准許上傳前述內容至該網站；以及 利用該電腦使前述未授權使用者對於前述上傳內容的後續存取支付費用，其中，前述內容包含多個影像畫面，且前述分析係在前述多個畫面中的一個取樣樣本進行，使得若確認前述使用者為已獲得授權時，准許前述內容之上傳至該網站。
  9. 一種具商業規則應用之媒體內容來源偵測系統，包含：一伺服器，其組態用以利用一電腦使用內容分析技術分析內容的一部份，該內容的一部份為上傳至一個網站而顯示，以偵測視覺顯示在前述部份中與一內容擁有者相關的一張圖像；利用該電腦比較前述偵測到之圖像與一組參考圖像，以辨識前述內容之該內容擁有者；利用該電腦存取一組可允許用來上傳前述內容的使用者之辨識特徵；利用該電腦將前述為上傳至一個網站而顯示的內容之一使用者的辨識特徵以及該組與前述內容擁有者相關的已授權使用者之辨識特徵進行比較；若前述使用者確認為尚未獲得授權時，利用該電腦准許上傳前述內容至該網站；以及利用該電腦使前述未授權使用者對於前述上傳內容的後續存取支付費用。

  12. 如申請專利範圍第9項之系統，其中前述伺服器係用以：計算在前述偵測到之圖像與一參考圖像之間的符合程度；以及若前述符合程度達到一個預定標準，則回報一個對前述偵測到之圖像進行更進一步的分析的請求。
  13. 如申請專利範圍第9項之系統，其中前述內容包含多個影像畫面，且前述伺服器係組態以分析前述多個畫面中的一個取樣樣本。
  14. 一種具商業規則應用之媒體內容來源偵測系統，包含：一伺服器，其組態以利用一電腦分析為上傳至一個網站而顯示的多個影像畫面的內容中一個取樣樣本，以偵測代表一內容擁有者的一個標示，前述標示包含聲音資訊；利用該電腦比較前述偵測到之標示與一組參考標示，以辨識前述內容的該內容擁有者；利用該電腦存取一組可允許用來上傳前述內容的使用者之辨識特徵；利用該電腦將前述為上傳至一個網站而顯示的內容之一使用者的辨識特徵以及該組與前述內容擁有者相關的已授權使用者之辨識特徵進行比較；若前述使用者確認為尚未獲得授權時，利用該電腦准許上傳前述內容至該網站；以及 利用該電腦使前述未授權使用者對於前述上傳內容的後續存取支付費用。
  15. 一種具商業規則應用之媒體內容來源偵測電腦可讀取式媒體，其具有多個指令用以執行一個方法，前述方法，包含：利用一電腦使用內容分析技術分析內容的一部份，該內容的一部份為上傳至一個網站而顯示，以偵測視覺顯示在為上傳至一個網站而顯示的內容中之前述部份中與一內容擁有者相關的一張圖像；利用該電腦比較前述偵測到之圖像與一組參考圖像，以辨識前述為上傳至一個網站而顯示的內容之該內容擁有者；以及利用該電腦存取一組可允許用來上傳前述內容的使用者之辨識特徵；利用該電腦將前述為上傳至一個網站而顯示的內容之一使用者的辨識特徵以及該組與前述內容擁有者相關的已授權使用者之辨識特徵進行比較；若前述使用者確認為尚未獲得授權時，利用該電腦准許上傳前述內容至該網站；以及利用該電腦使前述未授權使用者對於前述上傳內容的後續存取支付費用。
