Abstract

Se facilita un método para reducir los daños causados por organismos perjudiciales en el cultivo del maíz. Se pueden reducir los daños causados por organismos perjudiciales en el cultivo del maíz realizando las siguientes etapas: A) hacer un surco en un suelo cultivado; B) sembrar con maíz el surco formado en la etapa anterior; C) aplicar al surco uno o más compuestos seleccionados entre el grupo de compuestos (II) mencionado a continuación, o C') aplicar al surco uno o más compuestos seleccionados entre el grupo de compuestos (I) mencionado a continuación y uno o más compuestos seleccionados entre el grupo de compuestos (II) mencionado a continuación, y D) cerrar el surco. (Grupo de compuestos (I): grupo consistente en clotianidina, tiametoxam, imidacloprid y tiacloprid); grupo de compuestos (II): grupo consistente en bifentrina, biorresmetrina, deltametrina, bioaletrina, etofenprox, fenpropatrina, cipermetrina, alfa-cipermetrina, zeta-cipermetrina, fenvalerato, esfenvalerato, ciflutrina, beta-ciflutrina, alfa-cipermetrina, tralometrina, fluvalinato, permetrina, lambda-cihalotrina, flucitrinato y teflutrina).

  2. 2. Declaración motivada según los artículos 29.6 y 29.7 del Reglamento de ejecución de la Ley 11/1986, de 20 de marzo, de Patentes sobre la novedad y la actividad inventiva; citas y explicaciones en apoyo de esta declaración
    El objeto de la presente invención es un método para reducir los daños causados por organismos perjudiciales en el cultivo de maíz que consiste en aplicar a un surco sembrado con una semilla de maíz un compuesto seleccionado entre: bifentrina, biorresmetrina, deltametrina, bioaletrina, etofenprox, fenpropatrina, cipermetrina, alfa-cipermetrina, zeta-cipermetrina, fenvalerato, esfenvalerato, ciflutrina, beta-ciflutrina, alfa-cipermetrina, tralometrina, fluvalinato, permetrina, lambdacihalotrina, flucitrinato y teflutrina. También se reivindica en la reivindicación independiente 6 un método en el que se aplica al surco sembrado con maíz una composición formada por uno o más de los compuestos mencionados anteriormente y uno
    o más compuestos seleccionado entre: clotianidina, tiametoxam, imidacloprid y tiacloprid.
    El documento D1 divulga un método para proteger de los insectos del suelo semillas de maíz sembradas en surcos mediante la aplicación de microgránulos que contienen un compuesto piretroide sintético seleccionado entre bifentrina, biorresmetrina, deltametrina, , etofenprox, fenpropatrina, cipermetrina, beta-cipermetrina, zeta-cipermetrina, fenvalerato, esfenvalerato, ciflutrina, alfa-cipermetrina, tralometrina, fluvalinato, permetrina, lambda-cihalotrina, flucitrinato y deltametrina.
    Por lo tanto, a la vista de este documento las reivindicaciones 1 a 5 y 18 a 20 de la presente solicitud no tienen novedad ni actividad inventiva. (Art. 6.1 y 8.1 LP).
    El documento D2 divulga un método para controlar insectos del suelo mediante una composición insecticida granular que se aplica al surco sembrado con semillas de maíz y que consiste en una combinación de un compuesto neonicotinoide seleccionado entre clotianidina, tiametoxam, imidacloprid y tiacloprid entre otros y un compuesto piretroide seleccionado entre beta-ciflutrina, deltametrina, teflutrina y cis-cipermetrina entre otros.
    Por lo tanto, a la vista de este documento, las reivindicaciones 6,7,8,10,14 y 15 no son nuevas ni tienen actividad inventiva (Art. 6.1 y 8.1 LP).
    En cuanto a las características de las reivindicaciones 9, 11,12, 13, 16 y 17, en las que se recoge que la composición de la invención está en forma de dispersión acuosa, carecen de actividad inventiva dado que ya es ampliamente conocido en el estado de la técnica el uso de composiciones insecticidas sinérgicas de neonicotinoides y piretroides sintéticos en forma de dispersión acuosa (ver documento D3, párrafo 12). (Art. 8.1 LP).
