2. Statement motivated according to articles 29.6 and 29.7 of the Regulations for the execution of Law 11/1986, of March 20, on Patents on novelty and inventive activity; quotes and explanations in support of this statement

The document covered by the report refers to a cover for a vehicle compartment.

Said cover, as described in claim 1, is formed by at least two separable parts from each other, comprising fixing means between said separable parts.

Document D01 is a prior art document very close to the object of claim 1. Said document (references in brackets correspond to the figures of document D01) discloses a folding tray

(2) formed by four parts (26, 28, 32, 34) that are foldable together and at the same time, the parts (28) and (34) are separable from each other. According to a first embodiment (Figures 1-3) said two separable parts (28, 34) have a removable cylindrical hinge type fixing means (10). In figure 8, a second embodiment is shown in which the fixing means (70) between both separable parts (28, 34) is slightly different.

Therefore the object of claim 1 does not imply novelty and inventive activity. The same conclusion is reached in view of document D02 (paragraphs [0014], [0022] and [0036] and figures of said document) where the fixing between the separable parts is carried out by the support of one over the other.

Document D03 (see summary and figures 1-2) discloses a tray with two separable parts on one of its sides and where the means of connection between the two is made with a clamp (90). In this case it would be evident to place the same joining means on the other side of the separable parts and have the two parts of the tray completely independent. This document D03 anticipates by claim 1 the claim 1 of the application under study.

The dependent claims 2-3 have no novelty or inventive activity since, as can be seen in document D01, the fixing means (the removable hinge (10) or (70)) are in the sectioning zone between the parts separable and throughout the area. The same conclusion is reached in view of document D02 as the fixing between the separable parts is carried out by means of the support of one over the other, in the sectioning zone between the separable parts and throughout the entire area.

Dependent claims 4-7 do have novelty and inventive activity since none of the documents cited in the State of the Art Report shows fixing means such as those described in the application under study, and it is not considered to be obvious for a skilled in the art modifying document D01, D02 or D03 to obtain fixing means with the characteristics of these claims.

Dependent claim 8 has no inventive activity since it is apparent to one skilled in the art to add a handle to facilitate disassembly of the lid (see for example, document D04, reference 37).

Dependent claim 9 has no novelty or inventive activity since in documents D01, D02 and D03 the cover is removable.

Dependent claims 10-12 lack inventive activity in view of document D02 since, as seen in paragraphs [30-35] and in figure 4, the removable parts of the lid are fixed to the side walls (14a, 14b). That they are covered with textile material (for example, document D01, page 3, line 31) and that Velcro is used for their fixing are obvious characteristics for a person skilled in the art and widely used in this and other sectors.

Claims 13 and 14 also lack novelty, since both in D01, as in D02 and in D03 it is a cover for a trunk of a motor vehicle.

Therefore, claims 4-7 of the invention, because they are not included in the localized state of the art, are new (Law 11/1986, Art. 6.1.) And, as it is not obvious in an obvious way to an expert in the matter, have inventive activity (Law 11/1986, Art. 8.1.).
