El documento D01 se considera el más próximo del estado de la técnica al objeto de la invención reivindicada en las reivindicaciones nº 1, 2 y 3 (las referencias y comentarios entre paréntesis corresponden a este documento). Así con respecto a las características descritas en la reivindicación nº 1, divulga una suela con dispositivo de giro para calzado, que comprende una pareja de discos, un disco superior (6), y un disco inferior (7), estando ambos discos relacionados entre sí a través de un eje de giro (5), que recibe a un fleje (14) que regula el giro del disco inferior (7) con respecto al conjunto. La suela reivindicada en la presente solicitud, de acuerdo con la reivindicación nº 1 difiere de lo conocido en el documento D01, en la existencia de dos capas o plantillas superpuestas a las que están asociadas la pareja de discos sin embargo, esta característica ya ha sido empleada en el documento D02 donde se divulga una suela con dispositivo de giro que comprende 2 plantillas superpuestas (2 y 3a) a las que están asociadas una pieza superior (6) en forma de disco (ver figuras) solidaria a la plantilla superior (2) y un disco inferior (7), que queda enrasado con el perfil de la suela o plantilla inferior, estando ambos discos relacionados entre sí a través de un eje de giro, y donde el disco superior (6) presenta un diámetro menor que el disco inferior (7), con la particularidad de que sobre la cara superior del disco inferior (7) se establece un rebaje escalonado (ver figuras 2 y 3 ) alargado y dimensionalmente adecuado para recibir en su seno a una pieza (8) que es solidario al disco superior (6), y que juega en dicho rebaje, regulando el giro del disco inferior (7) con respecto al conjunto (descripción, página 2, líneas 3 a 5, líneas 27 a 29). Estas características proporcionan las mismas ventajas que la presente solicitud por lo que el experto en la materia podría por lo tanto considerar como una opción válida el incluir dichas características del documento D02 en el documento D01 para resolver el problema planteado, dado que resuelven el mismo problema técnico planteado, de forma que el objeto de la reivindicación nº 1 no implica actividad inventiva y no satisface el criterio establecido en el Artículo 8.1 de la Ley 11/86 de 20 de marzo de patentes. Con respecto a las características descritas en la reivindicación nº 2, donde se divulga que el fleje se remata en expansiones circulares materializándose en un fleje en espiral, constituye una opción de diseño dado que dicha característica sólo puede considerarse que posee actividad inventiva, si presentara efectos o propiedades inesperadas en relación al resto de elementos (flejes o elementos elásticos) usados en los documentos D01 y D02; sin embargo, no se han indicado dichos efectos o propiedades en la solicitud. Además encontramos en el documento D03 la presencia de este tipo de flejes (18) rematados en expansiones circulares extremas, por lo que se trata de una característica obvia para un experto en la materia y por tanto no se aprecia actividad inventiva en el objeto de la reivindicación nº 2. Con respecto a las características descritas en la reivindicación nº 3, ya el documento D02 divulga esta variante de la suela dotada con tacos (12 y 13) fijados sobre el disco inferior mediante tornillos (ver figuras), de manera que este disco inferior presenta un giro relativo respecto de la plantilla inferior con la particularidad de que concéntricamente al disco inferior se ha previsto el disco superior que va fijado, mediante tornillos a la correspondiente plantilla, en este caso la inferior y que mantiene al fleje sobre en rebaje escalonado en el disco inferior. La invención reivindicada según la reivindicación nº 3 difiere del documento D02 en la existencia del fleje con las expansiones circulares y extremas.
