2. Statement motivated according to articles 29.6 and 29.7 of the Regulations for the execution of Law 11/1986, of March 20, on Patents on novelty and inventive activity; quotes and explanations in support of this statement

The present invention relates to a folding display rack, formed entirely of essentially rigid sheets of cardboard.

The object of the invention according to the first (independent) claim is a collapsible cardboard display consisting of a body that adopts a straight parallelepiped deployed position, starting from a folded storage position. The body is formed by two parallel, vertical and opposite walls, anterior and posterior, joined together by vertical edges by lateral walls, which can be folded around said edges, each module of the body comprising an upper wing of the collapsible anterior wall inwards according to a horizontal fold line, forming a folding shelf. An intermediate vertical partition joins the side walls articulately, serving as a support for the folding shelf, the partition being provided with a rear folding flap, capable of being fixed to the rear wall.

Document D01, considered the closest state of the art, describes a collapsible cardboard display, consisting of a body that adopts a straight parallelepiped deployed position, starting from a folded flat storage position. The body is formed by two parallel, vertical and opposite walls, anterior and posterior, joined together by vertical edges by lateral walls, which can be folded around an intermediate vertical line, the anterior wall comprising an inwardly folding upper wing according to a horizontal fold line, forming a collapsible shelf; in this document an intermediate vertical partition serves as a support for the folding shelf. The difference between the display shelf disclosed in document DO1 and that of the application lies in the way in which the intermediate vertical partition joins the rest of the elements, which in the request is made through a flip-up flap that can be fixed to the back wall. This design feature is considered to be a mere obvious particular execution for a person skilled in the art.

Therefore, it is considered that the first claim lacks inventive activity.

Another document close to the state of the art is document D02, which discloses a folding cardboard display (in this case double) constituted by a body that adopts a straight parallelepiped deployed position, starting from a folded storage position. The body is formed by two parallel, vertical and opposite walls, anterior and posterior, joined together by vertical edges by lateral walls, which can be folded around said edges, each module of the body comprising an upper wing of the collapsible anterior wall inwards according to a horizontal fold line, forming a folding shelf. The difference between the request and this document D02 lies in the way in which support is provided to the shelves in an unfolded position that, while in DO2 it is sought through the material's own rigidity, in the request it is made by means of an intermediate vertical partition that serves as support for the folding shelf. This solution is also known from document D03, which refers to a collapsible cardboard display that adopts a straight parallelepiped deployed position, starting from a folded storage position. The body has a series of horizontal shelves, each of which is provided with an intermediate vertical partition serving as support for the shelf, the partition being provided with a fin capable of being fixed to the rear wall.

The design features of the dependent claims 2-8 are considered mere particular executions obvious to the person skilled in the art and are therefore not considered to involve inventive activity.

Consequently, it is considered that the invention as set forth in claims 1-8 lacks inventive activity (Art. 8.1 of Law 11/86 of Patents).
