Detailed Description
The following description of the embodiments of the present application will be made clearly and completely with reference to the accompanying drawings of the embodiments of the present application, and it is apparent that the described embodiments are only some embodiments of the present application, not all embodiments. All other embodiments, which can be made by one of ordinary skill in the art based on the embodiments herein without making any inventive effort, are intended to be within the scope of the present application.
Referring to fig. 1, the present application provides a method for initiating a litigation of a lease, comprising:
s1, acquiring a lessee contract uploaded by a lessee, wherein the lessee contract comprises a plurality of lessee items;
as described in step S1, the backend system obtains the tenant contract uploaded by the tenant, and it can be understood that the tenant contract includes a plurality of tenants that need to be fulfilled by the tenant, such as "upload tenant personal proof material before XX date", "pay a fee before XX date" and "upload X-th lease fee before XX date", where each of the tenants includes an execution time for matching with the time node, and when the tenant completes the corresponding item in the tenants before the execution time, the backend system can determine that the tenant is completed.
In addition, the background system may be an independent server, or may be a cloud server that provides cloud services, cloud databases, cloud computing, cloud functions, cloud storage, network services, cloud communication, middleware services, domain name services, security services, content delivery networks (Content Delivery Network, CDN), and basic cloud computing services such as big data and artificial intelligence platforms, which are not limited in this invention.
S2, acquiring a preset time axis, wherein a plurality of time nodes matched with the lessees are arranged in the time axis, and the time nodes are used for being used as time stamps in a set block chain;
the step S2 is described above, in which the background system obtains a preset time axis, and a plurality of time nodes matched with the lessees are set in the time axis, where the time nodes are used as corresponding time stamps to upload to blocks set in a blockchain, so as to provide conditions for generating the blockchain;
it is to be appreciated that the time node matches the execution time and matches the tenant irrespective of whether the tenant has completed the time node.
S3, extracting the lessee information uploaded by the lessee in the lessee item, and uploading the lessee information to a set blockchain for encryption storage by combining the time node, so as to generate an evidence chain matched with the lessee contract;
as described in the above step S3, the backend system extracts the tenant information uploaded by the tenant in the tenant item, and it can be understood that the tenant information is an archive file of the backend system required to be uploaded by a user when executing the tenant item, for example, when the tenant item is a tenant item of "uploading tenant personal proof material before XX date" by the tenant, the business license and the identity card scanner uploaded by the tenant to the backend system are the tenant information, and similarly, when the tenant item is a tenant item of "uploading X-th lease before XX date" by the tenant, the payment proof uploaded by the tenant to the backend system is the tenant information, the backend system uploads the tenant information to a set block chain in combination with the time node for encryption storage, thereby generating a proof chain matching with the tenant contract;
it can be understood that the evidence chain is generated after the tenant information is encrypted by the blockchain, and the stored content cannot be modified after the encryption by the blockchain, so that the possibility that the tenant information is tampered by a tenant is eliminated.
And S4, judging whether the lessee has the default behavior, and if so, initiating litigation according to the evidence chain and the lessee contract.
As described in step S4, the background system determines whether the tenant has an default, and specifically, when the tenant cannot upload the tenant information at the execution time, the background system determines that the tenant has an execution failure, determines that the tenant has an default, and then obtains the evidence chain and initiates litigation according to the evidence chain and the tenant contract.
The above embodiments can be summarized, and the application has the following greatest beneficial effects: by acquiring the lessee contract of the lessee and the lessee items regulated to be fulfilled in the lessee contract, encrypting the uploaded lessee information of the lessee when the lessee fulfills the lessee items through the blockchain, generating a evidence chain for litigation, and directly carrying out litigation on the lessee according to the evidence chain and the lessee contract when the lessee breaks down, the function of encrypting the lessee information and preventing the lessee information from being tampered is realized, the problem that the prior leasing litigation in the prior art is easy to be tampered by the lessee due to the fact that the lessee information is distorted, the data distortion influences the subsequent litigation result is solved, and the difficulty of evidence is reduced.
In one embodiment, the lessee information includes a fulfillment date that matches the lessee;
the step S4 specifically includes:
s41, judging whether the lessee contract is signed successfully, if so, dividing the time axis by taking the signing time of the lessee contract as a node, generating an execution time axis by taking the signing time as a starting point, judging whether the difference between the execution date of the lessee executing the lessee matters and the execution date in the execution time axis is smaller than a preset threshold, if not, judging that the lessee has illegal behaviors, extracting evidence chains, and initiating litigation according to the evidence chains and the lessee contract.
As described in the above steps, the backend system determines whether the lessee contract is successfully signed, it may be understood that when the backend system obtains a control instruction sent by a lessor, it may determine that the lessee contract is successfully signed, in addition, when the lessee completes a preset number of lessees that must be completed, the backend system may also determine whether the lessee contract is successfully signed, then the backend system obtains a signing time of the lessee contract, and divides the time axis with the signing time as a node, thereby generating an execution time axis with the signing time as a starting point, it may be understood that the time node and the corresponding lessee in the execution time axis are all in an unfinished state, then the backend system determines whether a difference between an execution date of the lessee in the execution time axis and the execution date is smaller than a preset threshold, that is, and then the backend system extracts a lessee evidence in the execution time axis and a next lessee's condition is about to be executed, and if the lessee contract is about to be executed in the end of the lessee contract is initiated according to the preset time, and if the lessee's condition is about to be expired.
In one embodiment, the lesson information includes a contract place matching the lesson contract;
the step S4 specifically includes:
s42, judging whether overdue behaviors occur on the lessee, if yes, obtaining the default amount of the lessee, and judging whether the default amount exceeds a preset threshold, if yes, matching corresponding litigation courts according to the contract signing place, so that line litigation is conducted from the evidence chain and the lessee contract to the litigation courts, and if not, sending the evidence chain and the lessee contract to the internet courts by using an internet court litigation channel, so that line litigation is achieved.
As described in the above embodiment, the backend system determines whether the lender has overdue behavior, it can be understood that, after the lender successfully signs the lender contract, whether a delay behavior occurs in a subsequent process of fulfilling the lender (i.e., delivering a rent), if yes, the backend system determines that the lender has overdue behavior, and obtains the default amount of the lender, and then determines whether the default amount exceeds a preset threshold, if yes, the backend system determines that the default amount is larger, and requires a line-down litigation, and then the backend system matches a corresponding line-down litigation court according to the contractual place of the lender contract, and sends the line-down litigation court in combination with the evidence chain and the lender contract, and it can be understood that each line-down litigation court is provided with its own jurisdiction, so that the corresponding legal court can be matched with the corresponding legal court;
in addition, when the background system determines that the delinquent amount does not exceed a preset threshold, it may determine that the delinquent amount delinquent by the lessee is less at the moment, and at the moment, the background system may send the evidence chain and the lessee contract to an internet court by using an internet court litigation channel, thereby realizing online litigation.
In one embodiment, the step of determining whether the tenant contract is successfully signed specifically includes:
s43, extracting pre-signing matters in the lessees, wherein the pre-signing matters are used for enabling the lessees to fulfill the lessees before signing the lessees, acquiring the fulfilling time of the lessees before fulfilling the pre-signing matters, judging whether the fulfilling time is smaller than a preset threshold, and if yes, judging that the lessees contract is successfully signed.
As described in the above embodiment, the back office system extracts the pre-subscription matters in the lessee matters, and it is understood that the lessee matters include the lessee matters (i.e., the pre-subscription matters) that need to be fulfilled before the lessee contract is signed, such as "upload lessee personal proof material before XX date", "pay for the order before XX date", and so on, and the lessee matters that need to be fulfilled after the lessee contract is signed, such as "upload the X-th lease before XX date", and so on, and then the back office system acquires the lessee matters before the lessee is fulfilled, that is, the fulfillment time for the lessee personal proof material before XX date "and the pre-subscription matters such as" pay for the order before XX date "is completed, and determines whether the fulfillment time is smaller than a preset threshold, if yes, the back office system determines that the lessee contract is signed successfully, and otherwise determines that the lessee contract is failed.
In one embodiment, the lesson information includes a contract place matching the lesson contract;
after the step S4, the method further includes:
s44, generating an income promoting work order matched with the lessee contract, wherein the income promoting work order is used for being issued to the income promoting personnel to carry out the income promoting work, acquiring the income promoting range matched with the income promoting personnel, judging whether the contract signing place is positioned in the income promoting range, if so, sending the income promoting work order to the income promoting personnel, thereby designating the income promoting personnel to carry out the income promoting.
As described in the above embodiment, after the background system starts executing litigation operations for the lessee, an receipts job ticket matched with the lessee contract is generated, and it may be understood that the receipts job ticket is used to be distributed to armed receipts personnel to perform a collection job, and then the background system obtains a collection range matched with the receipts personnel to determine whether the place where the contract is signed is located in the collection range, if yes, the receipts job ticket is sent to the receipts personnel, so as to designate the receipts personnel to go to the place where the contract is signed to perform collection.
In an embodiment, if so, the step of sending the collection worksheet to the collection person, thereby designating the collection person to collect the collection further includes:
s45, acquiring the collection accelerating success rate of the collection accelerating personnel, judging whether the collection accelerating success rate is higher than a preset threshold, and if so, sending the collection accelerating work order to the collection accelerating personnel so as to appoint the collection accelerating personnel to carry out collection accelerating.
As described in the above embodiment, after the background system generates the harvest ticket matched with the lessee contract, the harvest success rate of each on-standby harvest person is obtained, and it may be understood that when the harvest success rate is lower than a preset threshold, the background system determines that the probability of the harvest person withdrawing the arrears is lower, so when the harvest success rate is higher than the preset threshold, the background system sends the harvest ticket to the harvest person, thereby designating the harvest person to perform the harvest, and if not, distributing the harvest ticket to the harvest person with other success rates up to standard.
In an embodiment, if so, the step of sending the collection worksheet to the collection person, thereby designating the collection person to collect the collection further includes:
s46, acquiring the collection time of the collection worksheet collected by the collection personnel, and generating a worksheet execution period by taking the collection time as a starting point, wherein the worksheet execution period is used for indicating the time spent by the collection personnel when the collection personnel executes the historical collection worksheet, judging whether the worksheet execution period is longer than a preset collection time limit, and if so, returning the collection worksheet to a background system and carrying out reassignment.
As described in the above embodiment, when the background system determines that the success rate of the collecting person reaches the standard, the collecting time of the collecting person for the collecting order is obtained again, and a work order execution period is generated with the collecting time as a starting point, it is understood that the work order execution period is used to indicate the time spent by the collecting person in executing a historical collecting order, where the historical collecting order is recorded as the collecting order completed by the collecting person, and then the background system determines whether the work order execution period is longer than the preset collecting time limit, if yes, the background system may determine that the time spent by the collecting person in executing the collecting order is more, does not meet the set requirement, and returns the sent collecting order to the background system and redistributes the collecting order.
