【発明の詳細な説明】

【産業上の利用分野】本発明は、情報信号が記録される
データ記録媒体とこのデータ記録媒体へのデータの記録
方法、並びにこのデータ記録媒体からのデータの再生方
法に関する。

【従来の技術】音声や各種データ等の情報信号が記録さ
れるデータ記録媒体として、近年は、これら情報信号を
光学的に記録するもの、具体的には音楽用のいわゆるコ
ンパクトディスク（ＣＤ）や当該ＣＤ規格のディスクを
データ用に使用するＣＤ−ＲＯＭ等が、全世界に普及し
ている。

【発明が解決しようとする課題】ところで、上記ＣＤや
ＣＤ−ＲＯＭが全世界に普及すると同時に、海賊版も出
回り出している。
【０００４】その中にはディスクの保護層を剥してアル
ミ層（すなわちピット形成部分）を露出させ、それにメ
ッキをして原盤を作り、そのままスタンピングをしてＣ
Ｄの複製を作ってしまうと言う悪質なものがあり、それ
に対する防御法は極めて困難である。
【０００５】また、上述の問題は、次世代のデータ記録
媒体と言われているいわゆるディジタルビデオディスク
（ＤＶＤ）でも深刻である。
【０００６】そこで、本発明は上述の実情に鑑み、簡単
に複製されることなく、また、例えピット形成部分の複
製ができたとしても、記録されている情報信号を容易に
再生することができないようにすることが可能なデータ
記録媒体、データ記録方法及びデータ再生方法を提供す
るものである。

【課題を解決するための手段】本発明のデータ記録媒体
は、記録形式または記録層が異なる少なくとも２つの記
録領域を有し、一つの記録領域に暗号化データを記録
し、別の一つの記録領域に上記暗号化データの暗号化を
解くための鍵情報の少なくとも一部を記録してなるこ
と、或いは、記録すべきデータを少なくとも２つの記録
領域にまたがって記録してなることにより、上述の課題
を解決する。
【０００８】また、本発明のデータ記録方法は、記録形
式または記録層が異なる少なくとも２つの記録領域を有
するデータ記録媒体に対してデータを記録する記録方法
であり、一つの記録領域に記録すべきデータを暗号化し
た暗号化データを記録し、他の一つの記録領域に上記暗
号化データの暗号化を解くための鍵情報の少なくとも一
部を記録すること、或いは記録すべきデータを少なくと
も２つの記録領域にまたがって記録することにより、上
述の課題を解決する。
【０００９】さらに、本発明のデータ再生方法は、記録
形式または記録層が異なる少なくとも２つの記録領域を
有するデータ記録媒体からデータを再生するデータ再生
方法であって、少なくとも２つの記録領域にまたがって
記録されたデータを読み出し、当該読み出したデータを
合成することにより、上述の課題を解決する。

【作用】本発明によれば、暗号化データとその暗号化を
解くための鍵情報を、記録形式または記録層が異なる少
なくとも２つの記録領域に別々に記録すること、或いは
記録すべきデータを記録形式または記録層が異なる少な
くとも２つの記録領域にまたがって記録するようにして
おり、このとき例えば一方の記録領域の内容を複製でき
たとしても、他方の記録領域の複製が困難であれば、最
終的なデータ（再生データ）を得ることはできない。

【実施例】以下、本発明の好ましい実施例について、図
面を参照にしながら説明する。
【００１２】本発明の実施例では、先ず、２つの記録形
式に対応する記録領域として、２つの記録層を有してな
る光ディスクを、データ記録媒体として用いた場合につ
いて説明する。
【００１３】すなわち、図１に示すように、本実施例の
光ディスクＤは、ベース基盤Ｂ上に第１，第２の２つの
記録層Ｌ1，Ｌ2が積層して形成され、さらにこれら記録
層の上部に透明の保護層Ｐが設けられてなるものであ
り、例えば第１の記録層Ｌ1に暗号化データを記録し、
第２の記録層Ｌ2に上記暗号化データの暗号化を解く
（以下、復号化すると言う）ための鍵情報（以下、暗号
化キー情報と呼ぶ）を記録するようにしている。なお、
上記光ディスクＤの第１の記録層Ｌ1に記録される上記
暗号化データは、例えば、上記暗号化キー情報に基づい
て暗号化回路３が入力データ（すなわち記録すべきデー
タ）を暗号化したものである。
【００１４】一方、上記光ディスクＤの再生時には、図
２に示すように、上記第１の記録層Ｌ1に記録された暗
号化データと、上記第２の記録層Ｌ2に記録された暗号
化キー情報とを読み出し、例えば復号化回路４におい
て、上記暗号化キー情報に基づいて上記暗号化データの
暗号化を解く（復号化する）ことによって再生データを
得るようにする。より具体的には、復号化回路４におい
て、暗号化キー情報に応じた復号化キー情報を生成し、
この復号化キー情報に基づいて上記暗号化データを復号
化する。
【００１５】当該光ディスクＤの再生時の処理の流れ
は、図３に示すようになる。なお、光ディスクＤは、図
４に示すように、中央にセンタ孔１０２を有しており、
この光ディスクＤの内周から外周に向かって、プログラ
ム管理領域であるＴＯＣ（table of contents ）エリア
となるリードイン（lead in ）領域１０３と、データが
記録されるデータ領域１０４と、データ終了領域、いわ
ゆるリードアウト（leadout）領域１０５とが形成され
るものであり、当該光ディスクＤの第１の記録層Ｌ1の
最内周の上記ＴＯＣエリアには、例えば第２の記録層Ｌ
2に暗号化キー情報が記録されているか否かを示す情報
が記録されているとする。
【００１６】図３において、ステップＳ１では光ディス
クＤの１層目である第１の記録層Ｌ1のＴＯＣエリアの
情報を読み取る。
【００１７】次に、ステップＳ２では、上記ＴＯＣエリ
アの情報から、２層目である第２の記録層Ｌ2に暗号化
キー情報が有るか否かの判定を行う。当該ステップＳ２
において、第２の記録層Ｌ2に暗号化キー情報が記録さ
れていないと判定した場合には、ステップＳ６に進む。
ここで、光ディスクＤに暗号化キー情報が記録されてい
ないと言うことは、第１の記録層Ｌ1に記録されている
データが、暗号化されていないデータであることを示す
ため、上記ステップＳ６では、当該記録層からデータを
そのまま読み出す。これに対して、ステップＳ２で暗号
化キー情報が記録されていると判定した場合には、ステ
ップＳ３に進む。
【００１８】ステップＳ３では、上記第２の記録層Ｌ2
の暗号化キー情報を読み込み、次のステップＳ４では、
第１の記録層Ｌ1の暗号化キー情報を読み出す。
【００１９】次のステップＳ５では、第２の記録層Ｌ2
から読みとった暗号化キー情報に基づいて、第１の記録
層Ｌ1から読み取った暗号化データを復号化する。
【００２０】上述したように、本実施例においては、暗
号化データを光ディスクＤの第１の記録層Ｌ1に記録
し、上記暗号化データの暗号化を解くための暗号化キー
情報を上記第１の記録層Ｌ1とは別の記録層である第２
の記録層Ｌ2に記録するようにしている。したがって、
例えば上記保護層Ｐを剥して第１の記録層Ｌ1を露出さ
せ、当該第１の記録層Ｌ1に例えばメッキ等を施して海
賊版の原盤を作成できたとしても、第２の記録層Ｌ2の
暗号化キー情報をも複製することは困難であり、このた
め、本実施例の光ディスクＤによれば、上記第１の記録
層Ｌ1に記録されている暗号化データから再生データを
得ることはできない。
【００２１】上述した実施例では、２つの記録形式に対
応する記録領域として第１の記録層Ｌ1及び第２の記録
層Ｌ2を有する光ディスクＤについて説明したが、その
他、上記２つの記録形式に対応する記録領域として、例
えば、光磁気による記録領域とピットによる記録領域、
相変化型の記録領域とピットによる記録領域、有機色素
型の記録領域とピットによる記録領域、紫外線レーザ光
により記録がなされる記録領域とピットによる記録領域
などの組み合わせを使用することができる。これらにお
いて、上記暗号化データを上記ピットによる記録領域に
記録し、上記暗号化キー情報を上記光磁気による記録領
域や相変化型の記録領域、有機色素型の記録領域、紫外
線レーザ光により記録がなされる記録領域に記録する。
その他、上記２つの記録形式に対応する記録領域として
は、ディスク上のグルーブの変化、すなわちいわゆるウ
ォブルによる記録領域と、ピットや光磁気，相変化，有
機色素などによる記録領域との組み合わせも使用するこ
とができる。この場合、暗号化キー情報は例えばウォブ
ルによる記録領域に記録することができる。
【００２２】このように、一方の記録領域が複製し易い
ピットによる記録領域であったとしても、他方の記録領
域を複製し難い上記光磁気による記録領域や相変化型の
記録領域、有機色素型の記録領域、紫外線レーザ光によ
り記録がなされる記録領域等にすることで、例えば上記
保護層Ｐを剥して上記ピットによる記録領域を露出さ
せ、当該ピットによる記録領域に例えばメッキ等を施し
て海賊版の原盤を作成できたとしても、上記他方の記録
領域を複製することは困難であり、したがって、当該光
ディスクから再生データを得ることはできないことにな
る。
【００２３】なお、前記紫外線レーザ光による記録と
は、例えばポリカーボネートやアクリル等を材料とする
光ディスクの基板に対して、当該ポリカーボネートやア
クリル等を加工するのに適した紫外線レーザ光を照射
し、この紫外線レーザ光のスポットが照射された部分が
溶発いわゆるアブレーションによって削り取られること
によってピットを形成することであり、したがって、上
記紫外線レーザ光による記録がなされる記録領域は、デ
ィスク上の本来のピットによる記録領域以外の場所に形
成することができる。このように本来の記録領域以外の
場所に暗号化キー情報を記録するようにすれば、複製は
困難となる。また、上記ポリカーボネートは波長が約２
９０ｎｍ以下の光を吸収し、アクリルは波長が約３５０
ｎｍ以下の光を吸収すること、及び、波長が１９０ｎｍ
以下の紫外レーザ光は空気に吸収されることから、当該
光ディスクの基板を短時間で光分解することが可能な紫
外線レーザ光の波長としては１９０〜３７０ｎｍが用い
られる。
【００２４】なお、上述した各実施例において、暗号化
キー情報の全てを光ディスクに記録する必要はなく、例
えば一部のみ記録し、残りの暗号化キー情報は外部入力
手段等から入力するようなことも可能である。
【００２５】次に、２つの記録形式として、一方の記録
形式はピットによる記録形式とし、他方の記録形式を高
出力のレーザ等によるディスク上への刻印とすることも
できる。この場合、ピットによる記録領域に上記暗号化
データを記録するが、暗号化キー情報としては例えば文
字や数字等のコード（いわゆるＳＩＤコード）を用い、
これら文字や数字等からなる暗号化キー情報を光ディス
クの例えば内周部分に高出力のレーザ等によって刻印す
るようにする。このように、文字や数字等の光ピックア
ップ装置では読み取ることのできない情報を暗号化キー
情報として用いた場合、光ディスク再生装置に対して
は、これら文字や数字等の暗号化キー情報を例えばキー
ボード等の外部入力手段を用いて入力することになる。
これにより、当該再生装置は、上記外部入力手段からの
暗号化キー情報に基づいて上記暗号化データを復号化す
ることができるようになる。上述の場合も、上記ピット
による記録領域を複製できたとしても、外部入力手段に
よって上記文字や数字等からなる暗号化キー情報を入力
しなければ当該光ディスクから再生データを得ることは
できないことになる。
【００２６】また、２つの記録形式に対応する記録領域
として、前述したような第１の記録層Ｌ1及び第２の記
録層Ｌ2を有する光ディスクＤを用いた場合、例えば図
５に示すように、第１の記録層Ｌ1と第２の記録層Ｌ2に
またがって交互にデータを記録することでも複製防止が
可能となる。すなわち、この図５のような記録を行った
場合も、例えば上記保護層Ｐを剥して第１の記録層Ｌ1
を露出させ、当該第１の記録層Ｌ1に例えばメッキ等を
施して海賊版の原盤を作成できたとしても、第２の記録
層Ｌ2を複製することが困難であり、このため、当該光
ディスクＤに記録されているデータを再生することがで
きず、したがって海賊版を簡単に作成することができな
くなる。
【００２７】ここで、上記第１，第２の記録層Ｌ1，Ｌ2
にまたがって記録されるデータは、必ずしも暗号化され
ている必要はなく、当該ディスクからのデータ再生の際
には、これら第１の記録層Ｌ1と第２の記録層Ｌ2にまた
がって記録されたデータを読み出し、その後これら第１
の記録層Ｌ1からの情報と第２の記録層Ｌ2からの情報と
をコンバインして再生データを得るようにする。また、
当該ディスクが図５のような記録形式をとっていること
は、例えば第１の記録層Ｌ1のＴＯＣエリアに、上記図
５のような記録がなされている旨を示す情報を記録する
ことで区別でき、したがって当該ディスクの再生の際に
は、上記ＴＯＣエリアの情報に応じて、これら第１の記
録層Ｌ1と第２の記録層Ｌ2にまたがって記録されたデー
タを読み出し、その後これら第１の記録層Ｌ1からの情
報と第２の記録層Ｌ2からの情報とをコンバインして再
生データを得るようにすることになる。
【００２８】なお、上記第１の記録層Ｌ1と第２の記録
層Ｌ2に記録されているデータを交互に再生すること
は、現在の光ピックアップ装置の性能上、非常に困難で
あるため、実際には、例えば、先に第１の記録層Ｌ1上
に記録された所定の長さ（例えばセクタ）のデータを読
み出してメモリ等に保存しておき、その後、第２の記録
層Ｌ2上に記録された所定の長さ（例えばセクタ）のデ
ータを読み出してメモリに保存し、これらメモリに保存
されたデータを交互に読み出して合成することで再生デ
ータを得るようにすることが考えれる。
【００２９】その他、上述したことは、いわゆる両面デ
ィスクであっても適用可能であることは言うまでもな
い。また、上記暗号化データと暗号化キー情報の組は、
ファイル単位で異なるものとすることも可能である。こ
のようにファイル単位で上記暗号化データと暗号化キー
情報の組を異ならせた場合には、各ファイルの識別情報
を記録しておく必要がある。このようにファイル毎に暗
号化データと暗号化キー情報の組を異ならせることで、
さらに複製防止の効果を高めることが可能となる。
【００３０】次に、上述した各実施例の光ディスクＤを
再生する再生装置の概略構成について、図６を用いて説
明する。
【００３１】先ず、光ディスクＤに暗号化データと暗号
化キー情報が記録されている場合の動作について述べ
る。
【００３２】この図６において、光ピックアップ１７
は、上記光ディスクＤ上にレーザ光を集光し、このレー
ザ光の反射光を受光することにより、当該光ディスクＤ
に記録されているデータ信号を読み出し、このデータ信
号をデコード回路１５に送る。また、光ピックアップ１
７は、上記レーザ光の反射光に基づくフォーカスサーボ
エラー信号，トラッキングエラー信号をサーボ回路１４
に送る。
【００３３】サーボ回路１４は、コントローラＣＰＵ１
０の制御に基づき、上記フォーカスサーボエラー信号，
トラッキングエラー信号に応じたフォーカスサーボ信号
及びトラッキングサーボ信号を生成して光ピックアップ
１７に送る。また、当該サーボ回路１４からは、光ディ
スクＤの回転サーボ信号も出力され、モータ１８は当該
回転サーボ信号により回転が制御される。
【００３４】一方、デコード回路１５では、上記光ピッ
クアップ１７からのデータ信号の復調及び誤り訂正処理
を行う。
【００３５】ここで、上記光ディスクＤから読み出され
上記デコード回路１５によりデコードされた暗号化キー
情報は、コントローラＣＰＵ１０により制御されるワー
クＲＡＭ１２に蓄えられる。コントローラＣＰＵ１０
は、上記ＲＡＭ１２に蓄えられた暗号化キー情報を用い
て、光ディスクＤから読み出されデコード回路１５にて
デコードされた暗号化データを復号化する。なお、上記
コントローラＣＰＵ１０が使用するプログラムデータは
プログラムＲＯＭ１３に蓄えられている。
【００３６】上述のようにして復号化された再生データ
は、インターフェイス回路１６を介して出力端子１１か
ら外部に出力される。
【００３７】これに対して、光ディスクＤにおいて、記
録すべきデータが２つの記録領域にまたがって記録され
ている場合の動作は以下のようになる。
【００３８】すなわち、光ピックアップ１７は、上記光
ディスクＤの２つの記録領域にまたがって記録されてい
たデータをそれぞれ読み出す。これらデータは、それぞ
れ上記デコード回路１５によりデコードされ、コントロ
ーラＣＰＵ１０により制御されるワークＲＡＭ１２に蓄
えられる。コントローラＣＰＵ１０は、上記ＲＡＭ１２
に蓄えられたデータを読み出して合成する。これによ
り、再生データが得られるようになる。

【発明の効果】本発明においては、記録すべきデータを
暗号化した暗号化データとその暗号化を解くための鍵情
報を、記録形式または記録層が異なる少なくとも２つの
記録領域に別々に記録すること、或いは記録すべきデー
タを記録形式または記録層が異なる少なくとも２つの記
録領域にまたがって記録することで、簡単に複製するこ
とができず、また、例え一方の記録領域の内容を複製で
きたとしても、他方の記録領域を複製が困難なものとす
ることで、最終的なデータ（再生データ）を容易に得る
ことはできない。

    【特許請求の範囲】
  1. 【請求項１】 少なくとも２つの記録形式にそれぞれ対
    応する記録領域を有し、 一つの記録領域に暗号化データを記録し、別の一つの記
    録領域に上記暗号化データの当該暗号化を解くための鍵
    情報の少なくとも一部を記録してなることを特徴とする
    データ記録媒体。
  2. 【請求項２】 上記暗号化データと鍵情報とは、記録さ
    れるファイル単位で異なることを特徴とする請求項１記
    載のデータ記録媒体。
  3. 【請求項３】 少なくとも２つの記録層を有し、 一つの記録層に暗号化データを記録し、別の一つの記録
    層に上記暗号化データの当該暗号化を解くための鍵情報
    の少なくとも一部を記録してなることを特徴とするデー
    タ記録媒体。
  4. 【請求項４】 上記一つの記録層と別の一つの記録層と
    で記録が重ならない領域を有することを特徴とする請求
    項３記載のデータ記録媒体。
  5. 【請求項５】 上記暗号化データと鍵情報とは、記録さ
    れるファイル単位で異なることを特徴とする請求項３記
    載のデータ記録媒体。
  6. 【請求項６】 少なくとも２つの記録形式にそれぞれ対
    応する記録領域を有し、 記録すべきデータを少なくとも２つの記録領域にまたが
    って記録してなることを特徴とするデータ記録媒体。
  7. 【請求項７】 上記少なくとも２つの記録領域にまたが
    った記録は、記録されるファイル単位で異なることを特
    徴とする請求項６記載のデータ記録媒体。
  8. 【請求項８】 少なくとも２つの記録層を有し、 記録すべきデータを少なくとも２つの記録領域にまたが
    って記録してなることを特徴とするデータ記録媒体。
  9. 【請求項９】 一つの記録層と別の一つの記録層とで記
    録が重ならない領域を有することを特徴とする請求項８
    記載のデータ記録媒体。
  10. 【請求項１０】 上記少なくとも２つの記録層にまたが
    った記録は、記録されるファイル単位で異なることを特
    徴とする請求項８記載のデータ記録媒体。
  11. 【請求項１１】 少なくとも２つの記録形式にそれぞれ
    対応する記録領域を有するデータ記録媒体に対してデー
    タを記録するデータ記録方法であって、 一つの記録領域に暗号化データを記録し、 別の一つの記録領域に上記暗号化データの当該暗号化を
    解くための鍵情報の少なくとも一部を記録することを特
    徴とするデータ記録方法。
  12. 【請求項１２】 上記暗号化データと鍵情報とは、記録
    されるファイル単位で異なることを特徴とする請求項１
    １記載のデータ記録方法。
  13. 【請求項１３】 少なくとも２つの記録層を有するデー
    タ記録媒体に対してデータを記録するデータ記録方法に
    おいて、 一つの記録層に暗号化データを記録し、 別の一つの記録層に上記暗号化データの当該暗号化を解
    くための鍵情報の少なくとも一部を記録することを特徴
    とするデータ記録方法。
  14. 【請求項１４】 上記一つの記録層と別の一つの記録層
    とで記録が重ならない領域を有することを特徴とする請
    求項１３記載のデータ記録方法。
  15. 【請求項１５】 上記暗号化データと鍵情報とは、記録
    されるファイル単位で異なることを特徴とする請求項１
    ３記載のデータ記録方法。
  16. 【請求項１６】 少なくとも２つの記録形式にそれぞれ
    対応する記録領域を有するデータ記録媒体に対してデー
    タを記録するデータ記録方法であって、 記録すべきデータを少なくとも２つの記録領域にまたが
    って記録することを特徴とするデータ記録方法。
  17. 【請求項１７】 上記少なくとも２つの記録領域にまた
    がった記録は、記録されるファイル単位で異なることを
    特徴とする請求項１６記載のデータ記録方法。
  18. 【請求項１８】 少なくとも２つの記録層を有するデー
    タ記録媒体に対してデータを記録するデータ記録方法に
    おいて、 記録すべきデータを少なくとも２つの記録層にまたがっ
    て記録することを特徴とするデータ記録方法。
  19. 【請求項１９】 一つの記録層と別の一つの記録層とで
    記録が重ならない領域を有することを特徴とする請求項
    １８記載のデータ記録方法。
  20. 【請求項２０】 上記少なくとも２つの記録層にまたが
    った記録は、記録されるファイル単位で異なることを特
    徴とする請求項１８記載のデータ記録方法。
  21. 【請求項２１】 少なくとも２つの記録形式にそれぞれ
    対応する記録領域を有するデータ記録媒体からデータを
    再生するデータ再生方法であって、 一つの記録領域に記録されている暗号化データを読み出
    し、 別の一つの記録領域に少なくとも一部が記録されている
    上記暗号化データの当該暗号化を解くための鍵情報を読
    み出し、 上記鍵情報に基づいて上記暗号化データの暗号化を解く
    ことを特徴とするデータ再生方法。
  22. 【請求項２２】 上記暗号化データと鍵情報とは、記録
    されたファイル単位で異なることを特徴とする請求項２
    １記載のデータ再生方法。
  23. 【請求項２３】 少なくとも２つの記録層を有するデー
    タ記録媒体からデータを再生するデータ再生方法におい
    て、 一つの記録層に記録されている暗号化データを読み出
    し、 別の一つの記録層に少なくとも一部が記録されている上
    記暗号化データの当該暗号化を解くための鍵情報を読み
    出し、 上記鍵情報に基づいて上記暗号化データの暗号化を解く
    ことを特徴とするデータ再生方法。
  24. 【請求項２４】 上記暗号化データと鍵情報とは、記録
    されたファイル単位で異なることを特徴とする請求項２
    ３記載のデータ再生方法。
  25. 【請求項２５】 少なくとも２つの記録形式にそれぞれ
    対応する記録領域を有するデータ記録媒体からデータを
    再生するデータ再生方法であって、 少なくとも２つの記録領域にまたがって記録されたデー
    タを読み出し、 当該読み出したデータを合成することを特徴とするデー
    タ再生方法。
  26. 【請求項２６】 上記少なくとも２つの記録領域にまた
    がって記録されたデータは、ファイル単位で異なること
    を特徴とする請求項２５記載のデータ再生方法。
  27. 【請求項２７】 少なくとも２つの記録層を有するデー
    タ記録媒体からデータを再生するデータ再生方法におい
    て、 少なくとも２つの記録層にまたがって記録されたデータ
    を読み出し、 当該読み出したデータを合成することを特徴とするデー
    タ再生方法。
  28. 【請求項２８】 上記少なくとも２つの記録層にまたが
    って記録されたデータは、ファイル単位で異なることを
    特徴とする請求項２７記載のデータ記録方法。
