在产品信息获取单元110所获取的信息中,艺术品资产信息,包括多种确认方式。在一实施例中,艺术品资产的份额多少,是经由艺术家本人同意确认给予的总价值划分,需要艺术家签订总艺术价值份额认定的合同。而艺术品资产可以通过调研历年与艺术家合作的画廊、艺术机构以及收藏爱好者,了解当时的售卖价格,计算出每年平均交易额度。接着,根据艺术家的主要艺术生涯,由艺术评审团、画廊艺术机构以及广大收藏爱好者制定权重,以形成特定的艺术品资产信息。
其中,交易性质,可以是根据交易产品而形成的特定交易形式,不同的艺术品可以有不同的交易性质;也可以是根据不同的交易类型,而形成特有的交易模式。
在抵押信息获取单元120所获取的信息中,可以通过明确的抵押信息直接体现,也可以通过现金流向信息间接获取,还可以通过数据更新来推测出真正的抵押方,这些信息均可以与上述的背书策略相结合,降低交易风险。
还请参阅图2,图2为本发明某一实施例中的交易处理模块的结构框图,进一步地实施例中,所述交易处理模块200还包括:
用户服务单元,用于进行用户服务;其中,所述用户服务,包括账户信息处理、账户信用评级、网络支付和/或资产登记。由此,通过用户服务单元,将现实中的用户操作与虚拟的区块链相组合,方便用户进入区块链,实现基于区块链的艺术品证券化。更重要的是,利用了区块链的不可篡改性,记录交易的全过程或者某一特定过程,以形成特定的安全屏障。
进一步地实施例中,所述用户服务单元,还用于:进行评估信息、监管信息、法务信息或者咨询信息处理。需要了解的是,在交易全过程中,评估信息、监管信息、法务信息或者咨询信息,可以针对交易全程,也可以对交易过程的一部分。由此,用户获得了较优的全方位地服务,可以更客观、正确、有效地评价交易。
在上述区块链中,通过统一的标识由各个节点扩散并存入区块链,交易者的账户以及合同均被录入区块链,区块链中的个体是匿名的,但合同记录在公共账本内。监管者可以通过这个区块链了解市场上的活动,同时维护个体成员的隐私。
请参阅图4,图4为本发明某一实施例中的验证单元的结构框图。进一步地,所述验证单元240,还包括:
判断子单元241,用于根据对应的背书策略,交易节点分别判断所述交易条件;其中,所述交易节点,包括服务平台节点及交易所节点
共识子单元242,在根据所述交易节点达成共识后,对所述交易条件进行判断。
本实施例中,通过判断子单元241及共识子单元242,统合交易系统,通过冗余数据的判断与识别,将整体数据进行分析与综合,改变数据结构,形成更安全的系统。其中,多方之间的定期交付合同被写入区块链中,区块链中的个体是匿名的,但合同记录在公共账本中。
需要了解的是,所述信息获取模块100及所述交易处理模块200均基于智能合约。
其中,在某一智能合约中,如果所有未来交易都已经完成,则将合约的状态标记为完成,并将完结并从区块中终结其智能合约,如果未来交易尚未完全结束,将继续在下次区块生成时进行验证。
需要了解的是,本发明提出智能合约在艺术品资产证券化信息共享的应用模式,将艺术品资产证券化交易放入智能合约同意的条件,范围和义务。规定的权利和义务通过计算机网络自动执行,一旦双方达成协议并执行。智能合约的特征是是自我验证、自执行、防篡改,保证更高程度的安全性,减少对中介方的依赖,降低交易成本。
通过智能合约的交易方式,传统的资产证券化产品的暗箱操作也可以得到有效控制。在本发明的智能合约中,现时点的金融参照数据,各项风险测算等记录在其中,在未来区块生成并检验的时点中回更新并进行现金流的核算。
本申请第二方面提供一种计算机可读存储介质,其上存储有计算机程序,该程序被处理器执行时实现基于区块链的艺术品证券化产品交易的系统。
本发明实施例中,如果以软件功能模块的形式实现上述艺术品证券化产品交易的系统,并作为独立的产品销售或使用时,也可以存储在一个计算机可读取存储介质中。
基于这样的理解,本发明实施例的技术方案本质上或者说对现有技术做出贡献的部分可以以软件产品的形式体现出来,该计算机软件产品存储在一个存储介质中,包括若干指令用以使得一台计算机设备(可以是个人计算机、服务器、或者网络设备等)执行本发明各个实施例所述方法的全部或部分。而前述的存储介质包括:U盘、移动硬盘、只读存储器(ReadOnlyMemory,ROM)、磁碟或者光盘等各种可以存储程序代码的介质。这样,本发明实施例不限制于任何特定的硬件和软件结合。
本申请第三方面提供一种终端,包括:一个或多个处理器及存储器,一个或多个应用程序;其中,所述一个或多个应用程序被存储在所述存储器中并被配置为由所述一个或多个处理器执行,所述一个或多个应用程序配置用于执行上述基于区块链的艺术品证券化产品交易的系统。
大多数实施方案中,本领域技术人员使用至少一个网络来支持使用各种商用协议诸如TCP/IP、OSI、FTP、UPnP、NFS、CIFS和AppleTalk中的任何协议的通信。网络可以是例如局域网、广域网、虚拟专用网络、互联网、内联网、外联网、公共交换电话网、红外网络、无线网络及其任何组合。
而在利用网络服务器的实施方案中,网络服务器可运行各种服务器或中间层应用程序中的任何一者,包括HTTP服务器、FTP服务器、CGI服务器、数据服务器、Java服务器和业务应用程序服务器。
一个或多个服务器还可能够响应于来自用户设备的请求而执行程序或脚本,诸如通过执行一个或多个应用程序,所述一个或多个应用程序可被实现为以任何编程语言诸如C、C#或C++或者任何脚本语言诸如Perl、Python或TCL以及它们的组合编写的一个或多个脚本或程序。
一个或多个服务器还可包括数据库服务器,包括但不限于可从商购获得的那些。
还可对此类程序进行编码并使用载波信号进行传输,所述载波信号适于经由符合各种协议的有线网络、光网络和/或无线网络来进行传输,包括因特网。同样地,根据本发明的实施方案的计算机可读介质可使用通过此类程序编码的数据信号来创建。用程序代码编码的计算机可读介质可封装有兼容设备或独立于其他设备提供(例如,经由互联网下载)。任何此类计算机可读介质可存在于或位于单个计算机产品(例如,硬盘驱动器、CD或整个计算机系统)内,并且可存在于或位于系统或网络内的不同计算机产品内。计算机系统可包括监视器、打印机或用于将本文所提及的任何结果提供给用户的其他合适的显示器。
综上所述,现有的艺术品资产证券化模式仍然是传统的中心化方式,但是由于资产证券化的流程复杂,涉及参与方多,存在着信息不对称、交易双方不信任等问题,如何有效地解决相关的问题是促进资产证券化市场的有效发展,更好地进行资产的风险控制的首要方向。
基于此,本发明提出针对艺术品资产证券化的信息共享上的痛点与难点,依托区块链技术的发展,提出智能合约在艺术品资产证券化产品的分布式信息共享平台以及抵押信息共享系统,降低了风险性与安全性。
以上所述仅为本发明的实施例,并非因此限制本发明的专利范围,凡是利用本发明说明书及附图内容所作的等效结构或等效流程变换,或直接或间接运用在其他相关的技术领域,均同理包括在本发明的专利保护范围内。

Claims (10)

  1. 一种基于区块链的艺术品证券化产品交易的系统,其特征在于,包括:
    信息获取模块,用于获取所述艺术品证券化产品的交易信息;
    交易处理模块,用于将所述交易信息上链,以公开所述交易信息。
  2. 如权利要求1所述的基于区块链的艺术品证券化产品交易的系统,其特征在于,所述交易信息包括交易提议信息及交易条件,所述交易处理模块包括:
    区块生成单元,用于获取并判断所述交易提议信息,形成数据区块;其中,所述数据区块包括所述交易条件;
    验证单元,用于根据预设的背书策略,对所述交易条件进行判断。
  3. 如权利要求2所述的基于区块链的艺术品证券化产品交易的系统,其特征在于,所述交易处理模块基于分布式账本,所述交易处理模块还包括:
    更新单元,用于将所述数据区块添加到所述区块链,更新所述分布式账本。
  4. 如权利要求3所述的基于区块链的艺术品证券化产品交易的系统,其特征在于,所述交易信息包括产品信息、抵押信息及发行信息,所述信息获取模块包括:
    产品信息获取单元,用于获取艺术品资产信息、交易性质、交易时间、交易数额中的至少一项;
    抵押信息获取单元,用于获取抵押信息、现金流向信息、数据更新中的至少一项;
    发行信息获取单元,用于获取投资者身份、投资者提议的价格。
  5. 如权利要求4所述的基于区块链的艺术品证券化产品交易的系统,其特征在于,所述交易处理模块还包括:
    用户服务单元,用于进行用户服务;
    其中,所述用户服务,包括账户信息处理、账户信用评级、网络支付和/或资产登记。
  6. 如权利要求5所述的基于区块链的艺术品证券化产品交易的系统,其特征在于,所述用户服务单元,还用于:
    进行评估信息、监管信息、法务信息或者咨询信息处理。
  7. 如权利要求6所述的基于区块链的艺术品证券化产品交易的系统,其特征在于,所述验证单元,还包括:
    判断子单元,用于根据对应的背书策略,交易节点分别判断所述交易条件;其中,所述交易节点,包括服务平台节点及交易所节点
    共识子单元,在根据所述交易节点达成共识后,对所述交易条件进行判断。
  8. 如权利要求1-7任意一项所述的基于区块链的艺术品证券化产品交易的系统,其特征在于,所述信息获取模块及所述交易处理模块均基于智能合约。
  9. 一种计算机可读存储介质,其上存储有计算机程序,其特征在于,该程序被处理器执行时实现权利要求1-8中任一项所述基于区块链的艺术品证券化产品交易的系统。
  10. 一种终端,其特征在于,包括:一个或多个处理器及存储器,一个或多个应用程序;其中,所述一个或多个应用程序被存储在所述存储器中并被配置为由所述一个或多个处理器执行,所述一个或多个应用程序配置用于执行根据权利要求1至8任一项所述基于区块链的艺术品证券化产品交易的系统。
