STATEMENT UNDER ARTICLE 19

In response to the objections raised in the International Searching Report (ISR), the Applicant has amended the original independent claims 1 and 25, and the dependent claim 24. The Applicant believes that the scope of the amended claim set is within the scope of the originally filed subject matter, and no new subject matter is added.

With respect to the objection related to the unity of invention, the Applicant respectfully disrespects with the Examiner and submits that the amended claims are linked to a single inventive step. Specifically, with respect to claims 16 and 18, the Applicant submits that the claims 16 and 18 are dependent on independent claim 1 and hence forms the part of the inventive concept of the independent claim 1. Moreover, with respect to independent claim 27, the Applicant submits that the independent claim 1 and the independent claim 27 both relates to a single inventive concept of a package for ready- for- eat food item that includes a container, a covering layer, and a compartment coupled to the covering layer, such that the covering layer forms seals the container hermetically and physically to ensure that no entry of moisture or other matter is possible inside the container. Further, each of the independent claim 1 and 27 captures different implementation of the aforementioned concept.

With respect to the objection related to novelty and inventive step, the Applicant submits that prior arts D1-D5 does not disclose a combination of the covering layer that hermetically seals the container when a base of the compartment is pierced and a piercing object attached to the covering layer such that the piercing layer protrudes into the compartment and the piercing object can pierce the base of the compartment to allow mixing of food item and the additional ingredient inside the compartment. For instance,

Dl, D2, D4, and D5 fails to disclose the piercing object that protrudes into the compartment and punctures the base of the compartment while the covering layer keeps the container hermetically and physically sealed. On the other hand, although D3 illustrates a piercing member that protrudes inside the compartment, D3 fails to disclose that the covering layer seals the container hermetically and physically after the piercing object has pierced the base of the compartment. Therefore, the Applicant submits that the amended independent claims 1 and 25 claims are novel and involve an inventive step with respect to the cited prior art documents D1-D5 in the ISR.
