一种数字资产按策略交易的方法及系统。该方法为:1)生成数字资产的权属标识;2)在交易服务器为每一权属标识设置数字资产拥有者的交易策略;3)交易服务器根据数字资产采购者的交易策略与权属标识设置的交易策略进行撮合交易和计价。该方法使数字资产的交易摆脱人工撮合的瓶颈,直接对接碎片化供需双方,解决网络时代的数字资产交易效率问题。

一种数字资产按策略交易的方法及系统 技术领域
本发明属于计算机技术领域,具体涉及各种数字化资产的权益通过计算机自动化交易的方法及系统。
背景技术
在现实社会活动中存在各种权属交易,交易形式包括各类权属的有偿转移和使用,多数权属交易由中介机构的人工撮合完成。在一些价值和权属较具体且容易量化的领域,如金融类有价证券,已经可以实现高效的计算机自动化撮合交易。而对于数字资产的权益(如数字化作品的著作权、使用权、代理权,或现实资产的数字化资产证明)交易则还较难实现自动化撮合和计价,较普遍采用的撮合和交易方式为:
1)线上代理交易模式
线上定价交易:将作品或数字资产通过版权声明或DRM方式保护起来,并按照拷贝销量计价或平台分成的方式完成交易。
买断式交易:与数字资产拥有方约定一次性买断价格(稿费、发行权等形式)收购,获得后续收益权。收购方以广告经营或流量经营等方式实现后续收益。
2)线下代理交易模式
委托或合作出版:数字资产拥有者与出版机构合作,按照传统版税分成方式完成交易。
以上交易方式不适合互联网时代碎片化创作和碎片化消费的发展趋势,由于对数字资产的权益缺少恰当的量化策略,数字资产不能及时获得客观的定价,不能实现普遍和广泛的撮合。导致相当多的数字资产为了传播需要,放弃部分权力主张,交由分发平台免费分发;或自行承担在网络分发的成本,同时饱受网络盗用的困扰。
发明内容
针对现有技术中存在的技术问题,本发明的目的在于提供一种数字资产按策略交易方法及系统。本发明包括交易服务器和去中心化网络节点,其中交易服务器亦可以同时承担去中心化网络节点的角色。
本发明方法的主要内容为:
1,生成数字资产的数字指纹,并与可选扩展描述信息组合为权属注册数据块A;该扩展 描述信息用于描述该数字资产的属性,包括作者/权利人/资产类型等;该信息是可选的,即用户可以出于保密需要而不提交任何描述信息,这种情况下“扩展描述信息”为空。在提供该信息的情况下,后续利用该信息可用于数字资产注册信息的查询和分类。
2,在去中心化网络中注册该权属注册数据块A,获取注册成功的索引标识,该索引标识与数字资产描述信息组合为权属标识;其中,数字资产描述信息是交易服务器对该数字资产进行管理所定义的描述信息。
3,在交易服务器上以权属标识为标的,对每一权属标识设置交易策略;
4,交易服务器按照交易策略撮合交易和对使用者计价。
本发明的技术方案为:
一种数字资产按策略的交易方法,其步骤为:
1)生成数字资产的权属标识;
2)在交易服务器为每一权属标识设置数字资产拥有者的交易策略;
3)交易服务器根据数字资产采购者的交易策略与权属标识设置的交易策略进行撮合交易。
进一步的,步骤1)的实现方法为:首先生成数字资产的数字指纹,然后根据该数字指纹生成该权属标识。

交易服务器,用于为每一数字资产生成一权属标识,并为该权属标识设置对应数字资产拥有者的交易策略;以及根据数字资产采购者的交易策略与权属标识设置的交易策略进行撮合交易和计价;以及提供数字资产的引用或使用接口;
采购者应用单元,对数字资产进行引用或使用;代理数字资产的引用或使用接口。
进一步的,还包括去中心化网络中的节点计算机;数字资产拥有者通过该用户终端设备生成数字资产的数字指纹并将其发送给交易服务器,或者交易服务器为每一数字资产生成一数字指纹;交易服务器将数字资产的数字指纹与该数字资产的可选扩展描述信息组合为权属注册数据块A,然后在去中心化网络中的节点计算机中注册该权属注册数据块A,获取注册成功的索引标识,然后将该索引标识与数字资产描述信息组合生成该数字资产的权属标识。
进一步的,数字资产拥有者通过用户终端设备自行生成权属注册数据块A并向去中心化网络中注册,获取注册成功的索引标识后,再由数字资产拥有者通过用户终端设备将索引标识提交给交易服务器,由交易服务器为该索引标识生成对应数字资产的权属标识。
本发明主要步骤为:
1,自动化生成权属标识:使用数字指纹算法获得数字资产的唯一数字标识(在用户本机上实施或通过浏览器访问交易服务器,委托交易服务器实施),为该标识增加可选扩展描述信息组合为权属注册数据块A提交到去中心化网络节点注册,该数据块A在去中心化网络中成功注册和存储后,将该数据块A在去中心化网络中的索引标识与数字资产描述信息组合为数据块B,数据块B为该数字资产对应的权属标识。
2,对权属标识设定交易策略:交易策略是对某一权属标识自定义的一组规则,该规则描述了权属标识所对应的数字资产的交易限制条件、交易撮合条件、相应计价策略、数字资产 可以按何种方式被引用/使用(如展示、代理、再创作等)。这些策略内容可由用户自定义,由交易服务器解释和执行(如按关键字匹配和排除、按预设条件匹配和排除等)。其中,数字资产的潜在使用者则以采购者的角色设置交易策略,交易策略则描述了采购者接受以何种计价策略采购数字资产的引用/使用;
3,按交易策略撮合引用需求:交易服务器按照数字资产的提供者和采购者所设定的交易策略,自动撮合交易。当供需双方所设定的交易策略匹配时,则交易撮合成功,向交易双方发送交易确认并为交易双方生成电子合约,其中电子合约中包含交易策略的匹配记录和引用/使用方式;
4,按电子合约和交易策略计价:交易撮合成功后,交易采购者获得权属标识对应的对数字资产的引用/使用接口,采购者通过该接口引用/使用数字资产,并在电子合约的持续期内按交易策略中既定的计价策略计价;
其中,如权属标识带有嵌套或并列属性,按照交易策略中的分成策略执行分成计价。
与现有技术相比,本发明的积极效果为:
本发明对数字资产的所有权鉴权和使用权交易提出了一种适合于网络化和自动化应用的解决方案,在所有权鉴权方面采用了去中心化网络辅助鉴权的方式,使注册和鉴权过程更方便由计算机自动实现,比传统机构的注册和鉴权方式更高效;在使用权交易方面,本发明对数字资产绑定量化交易策略,可以利用计算机自动化的完成数字资产的鉴权、撮合、引用、计价等环节,更加适应网络时代的碎片化交易需求。传统数字资产的网络化展示交易需要通过网站运营者/出版商/代理机构与数字资产的拥有者事先协商交易方式和价格才能达成交易,受沟通效率所限,需求双方很难获得充分接触,达成交易所需时间较久,数字资产在达成交易前有被盗用风险且很难举证。由于网络时代信息传播很快,数字资产的价值受时限影响很大,传统交易效率过低的问题导致部分数字资产持有人为获得期望的传播效果,放弃作品的网络使用权主张,退而求其次仅要求署名权。本发明提供的方法较好的解决了以上问题,交易策略撮合方法可以使双方的交易需求得到最大程度的表达,通过计算机匹配交易策略可实现很高的撮合效率;交易行为可以量化到具体的展示次数,计价粒度远优于传统的协商计价方式;实时计价的方式有助于数字资产的价格更贴近市场实际需求;去中心化的鉴权方法满足了快速确权的需要,并且容易对盗用行为举证;本发明对网络数字资产的产量持续大幅增加、生产和消费都趋于碎片化的趋势有更好的适应性。

如图2所示,系统中包括交易服务器、去中心化网络中的节点计算机、用户计算机/终端设备(分别由数字资产拥有者、数字资产采购者各自拥有和使用)、采购者应用单元(软件/接口/服务器等)。
1,数字资产拥有者用户对待交易的数字资产使用数字指纹(如数字摘要)算法,获得数字资产的数字指纹;
2,用户通过自己的计算机/终端设备向交易服务器提交数字资产和相应的数字指纹,或用户提交数字资产,由交易服务器为该数字资产计算对应的数字指纹;
3,交易服务器接收到数字资产和相应的数字指纹,根据用户定义或系统默认设置生成扩展描述信息,与该数字指纹组装为权属注册数据块A(如图3所示)。扩展描述信息中包含该数字资产的基本属性描述,其中包括作者/权利人信息、创作/建立日期、数字资产类别/格式/字符集/编解码协议等。向去中心化网络中提交和注册数据块A并产生对应的权属标识,方法为:
a)向去中心化网络中的节点计算机发送注册请求;
b)按照去中心化网络中的去中心化注册和存储协议注册和存储数据块A;
c)交易服务器监听和查询注册状态,确认注册和存储成功后,记录数据块A在该去中心化网络上的索引标识;
d)将索引标识附加上数字资产的描述信息,按图4所示方式封装为数据块B,数据块B即为该数字资产对应的权属标识。其中,数字资产描述信息中包含交易服务器的用户帐户信息,或可以索引到用户帐户信息的指针。
4,数字资产拥有者对该数字资产对应的权属标识设置交易策略,该交易策略包括限制条件、撮合条件、计价策略、分成策略以及数字资产可以被引用或使用的方式,包括外链、远程/本地/缓存展示、嵌入/被嵌入、代理、联合创作/再创作等。
5,数字资产采购者通过自己的计算机/终端访问交易服务器,设置采购交易策略,该交易策略包括期望的引用/使用方式、可接受的计价策略、限制条件等;
6,交易服务器遍历权属标识,通过权属标识中的数字资产描述信息获得用户帐户信息,并进一步的获得该用户对这个权属标识设置的交易策略,根据数字资产拥有者和采购者所设置的交易策略,撮合潜在的交易需求,方式包括:
a)根据双方给定的策略,自动化完成交易撮合;
b)根据双方给定的策略,自动化推荐可以撮合的交易,允许双方进一步筛选;
c)由双方各自按照期望的策略搜索潜在的交易对方,并在搜索结果中提供交易策略调整参考建议,供交易者调整交易策略;
d)由双方各自按照期望的策略搜索潜在的交易对方,并为双方提供接洽接口。
7,交易撮合完成后,交易服务器将对该笔交易为双方生成电子合约,并依电子合约执行后续的计价策略,方法为:
a)采购方获得对应数字资产的引用/使用接口,通过该接口可以实现对数字资产的引用/使用,在采购方指定的应用中展示/使用;
b)采购方的每次引用/使用都会触发交易服务器上与该交易对应的计价策略,对引用/使用行为计价;
c)计价结果同时发送给交易双方;
d)若达到交易策略中的交易终止条件,该项交易终止,数字资产的引用/使用接口不再有效,在采购者应用中的展示/使用停止。
或:
a)交易服务器向采购方授予与该数字资产对应的引用/使用标识,当采购方在指定的应用中使用数字资产时,必需同时展示该引用/使用标识;
b)采购方的每次展示引用/使用标识都会触发交易服务器上与该交易对应的计价策略,对引用/使用行为计价;
c)计价结果同时发送给交易双方;
d)若达到交易策略中的交易终止条件,该项交易终止,数字资产的引用/使用标识不再有效。交易服务器向交易双方发送该项数字资产交易结束的提示。

Claims (14)

  1. 一种数字资产按策略交易的方法,其步骤为:
    1)生成数字资产的权属标识;
    2)在交易服务器为每一权属标识设置数字资产拥有者的交易策略;
    3)交易服务器根据数字资产采购者的交易策略与权属标识设置的交易策略进行撮合交易。
  2. 如权利要求1所述的方法,其特征在于,步骤1)的实现方法为:首先生成数字资产的数字指纹,然后根据该数字指纹生成该权属标识。
  3. 如权利要求2所述的方法,其特征在于,步骤1)的实现方法为:首先生成数字资产的数字指纹,然后根据该数字指纹注册到一去中心化网络中生成该权属标识。
  4. 如权利要求3所述的方法,其特征在于,步骤1)的实现方法为:将数字资产的数字指纹与可选扩展描述信息组合为权属注册数据块A;然后在去中心化网络中注册该权属注册数据块A,交易服务器获取注册成功的索引标识,然后将该索引标识与数字资产描述信息组合生成该权属标识。
  5. 如权利要求1所述的方法,其特征在于,步骤1)的实现方法为:首先生成数字资产的数字指纹,然后将该数字指纹注册到交易服务器中生成该权属标识。
  6. 如权利要求5所述的方法,其特征在于,步骤1)的实现方法为:将数字资产的数字指纹与可选扩展描述信息组合为权属注册数据块A;然后在交易服务器中注册该权属注册数据块A,获取注册成功的索引标识,然后将该索引标识与数字资产描述信息组合生成该权属标识。
  7. 如权利要求4或6所述的方法,其特征在于,该扩展描述信息包括作者、权利人和资产类型。
  8. 如权利要求4或6所述的方法,其特征在于,所述交易服务器信息根据该扩展描述信息对数字资产进行分类;该数字资产描述信息为交易服务器对数字资产进行管理所定义的描述信息。
  9. 如权利要求1~6任一所述的方法,其特征在于,数字资产拥有者的所述交易策略描述数字资产的被引用或使用方式、限制条件、交易撮合条件、计价策略;数字资产采购者的交易策略包括计价策略和数字资产的引用或使用方式。
  10. 如权利要求9所述的方法,其特征在于,交易服务器对数字资产拥有者的交易策略和数字资产采购者的交易策略进行匹配,匹配成功后生成电子合约,在该电子合约的持续期内为 交易双方计价和结算。
  11. 如权利要求9所述的方法,其特征在于,所述计价策略中设有数字资产的交易计价方法;在数字资产采购者对数字资产发生实际引用或使用时,触发交易服务器按照实际引用或使用量为交易双方结算。
  12. 一种数字资产按策略交易系统,其特征在于,包括交易服务器、用户终端设备、采购者应用单元;其中,
    数字资产拥有者通过该用户终端设备将数字资产及其交易策略发送给交易服务器,数字资产采购者通过该用户终端将交易策略发送给交易服务器;
    交易服务器,用于为每一数字资产生成一权属标识,并为该权属标识设置对应数字资产拥有者的交易策略;以及根据数字资产采购者的交易策略与权属标识设置的交易策略进行撮合交易和计价;以及提供数字资产的引用或使用接口;
    采购者应用单元,对数字资产进行引用或使用;代理数字资产的引用或使用接口。
  13. 如权利要求12所述的系统,其特征在于,还包括去中心化网络中的节点计算机;数字资产拥有者通过该用户终端设备生成数字资产的数字指纹并将其发送给交易服务器,或者交易服务器为每一数字资产生成一数字指纹;交易服务器将数字资产的数字指纹与该数字资产的可选扩展描述信息组合为权属注册数据块A,然后在去中心化网络中的节点计算机中注册该权属注册数据块A,获取注册成功的索引标识,然后将该索引标识与数字资产描述信息组合生成该数字资产的权属标识。
  14. 如权力要求13所述系统,其特征在于,数字资产拥有者通过用户终端设备自行生成权属注册数据块A并向去中心化网络中注册,获取注册成功的索引标识后,再由数字资产拥有者通过用户终端设备将索引标识提交给交易服务器,由交易服务器为该索引标识生成对应数字资产的权属标识。
