Abstract
一种查询商标时显示商业用途的方法以及商标查询系统，属于互联网领域。所述方法包括：读取用户输入的文字（S101）；根据用户输入的文字查询近似商标，同时查询该文字的其他商业用途（S102）；向用户同时推送所述近似商标和所述商业用途的查询结果（S103）。可以让用户在查询近似商标的同时，知悉商标的商业用途，避免因为商业用途冲突而影响品牌效果。
Description
本发明属于互联网领域，尤其是涉及一种查询商标时显示商业用途的方法以及商标查询系统。
注册商标对一个企业/产品而言是传播的基础，有了注册商标才有后续的在品牌上的安全传播和发扬。
对一个商标而言，影响其品牌发展的最重要因素是该商标能否在产品销售地获得商标专有权，所以许多人注册商标之前，会先通过在某一个商标的尼斯分类上检索是否有相近似或者相同的在先申请，如果有，则会更换商标，现有技术中也存在类似的商标查询系统。
同时，影响一个商标对品牌保护的因素除了能够在相关某一商品种类上被授予专用权外，也包括商标在其他领域在先的商业用途。例如：“潘多拉”本身会联系到带来灾难和疾病的“潘多拉盒子”，但该品牌在实际使用中则被服装提供商诠释为了“有魅力”之含义；再如：同样一个词已经被用做猪饲料，但后来的商标注册人不知道这个事实，而在运动饮料对应的种类注册了商标，并将其用在运动饮料上，这样，也对品牌的塑造和传播埋下隐患。
本发明实施例提供了一种查询商标时显示商业用途的方法，目的在于解决当前商标系统只能查询近似或相同的在线商标，却无法查询商标的其他商业用途之问题。
本发明是这样实现的：一种查询商标时显示商业用途的方法，包括以下步骤：
读取用户输入的文字；
根据用户输入的文字查询近似商标，同时查询该文字的其他商业用途；
向用户同时推送所述近似商标和所述商业用途的查询结果。
本发明实施例还提供了一种商标查询系统，包括：
读取单元，用于读取用户输入的文字；
查询单元，与所述读取单元连接，用于根据用户输入的文字查询近似商标，同时查询该文字的其他商业用途；
信息推送单元，与所述查询单元连接，用于向用户同时推送所述近似商标和所述商业用途的查询结果。
进一步地，所述商标查询系统还包括：数据存储单元，其输入端与所述查询单元连接，输出端与所述信息推送单元连接，用于存储在先申请的商标以及存储相关文字的商业用途。
进一步地，所述商标查询系统还包括：更新单元，其输入端与所述数据存储单元连接，用于检索互联网上相关数据的更新情况，并定期更新所述数据存储单元。
通过该发明，可以让用户在查询近似商标的同时，知悉商标的商业用途，避免因为商业用途冲突而影响品牌效果。
图1是本发明实施例提供的一种查询商标时显示商业用途的方法的流程示意图；
图2是本发明实施例提供的商标查询系统的结构示意图。
为了使本发明的目的、技术方案及优点更加清楚明白，以下结合附图及实施例，对本发明进行进一步详细说明。应当理解，此处所描述的具体实施例仅仅用以解释本发明，并不用于限定本发明。
图1是发明实施例提供的一种查询商标时显示商业用途的方法的流程示意图，为了便于说明，只示出了与本发明实施例相关的部分。
在步骤S101中，读取用户输入的文字。
在步骤S102中，根据用户输入的文字查询近似商标，同时查询该文字的其他商业用途。所述商业用途为其他商号，或尼斯分类中其他类别的商标，或某商品/服务的品牌名称，以及上述商号、商标、品牌名称的使用情况。
在步骤S103中，向用户同时推送所述近似商标和所述商业用途的查询结果。
通过该发明，可以让用户在查询近似商标的同时，知悉商标的商业用途，避免因为商业用途冲突而影响品牌效果。
图2是本发明实施例提供的一种商标查询系统的结构示意图，该系统包括：
读取单元201，用于读取用户输入的文字；
查询单元202，与所述读取单元101连接，用于根据用户输入的文字查询近似商标，同时查询该文字的其他商业用途；
信息推送单元203，与所述查询单元202连接，用于向用户同时推送所述近似商标和所述商业用途的查询结果。
其工作原理是：读取单元201读取用户输入的文字，查询单元202根据用户输入的文字查询近似商标，同时查询该文字的其他商业用途；信息推送单元203在查询完毕后，向用户同时推送所述近似商标和所述商业用途的查询结果。
此外，若数据库为系统自带的数据库时，所述商标查询系统还包括一个数据储存单元，所述数控存储单元其输入端与所述查询单元连接，输出端与所述信息推送单元连接，用于存储在先申请的商标以及存储相关文字的商业用途。。
此外，若数据库为可以通过互联网更新的数据库时，所述商标查询系统还包括一个更新单元，用于检索互联网上相关数据的更新情况，并定期更新所述数据存储单元，该更新单元与数据存储单元连接。
通过该发明，可以让用户在查询近似商标的同时，知悉商标的商业用途，避免因为商业用途冲突而影响品牌效果。

- 一种查询商标时显示商业用途的方法，其特征在于，所述方法包括如下步骤：读取用户输入的文字；根据用户输入的文字查询近似商标，同时查询该文字的其他商业用途；向用户同时推送所述近似商标和所述商业用途的查询结果。
- 一种商标查询系统，其特征在于，所述商标查询系统包括：读取单元，用于读取用户输入的文字；查询单元，与所述读取单元连接，用于根据用户输入的文字查询近似商标，同时查询该文字的其他商业用途；信息推送单元，与所述查询单元连接，用于向用户同时推送所述近似商标和所述商业用途的查询结果。
- 如权利要求2所述的商标查询系统，其特征在于，所述商标查询系统还包括：数据存储单元，其输入端与所述查询单元连接，输出端与所述信息推送单元连接，用于存储在先申请的商标以及存储相关文字的商业用途。
- 如权利要求3所述的商标查询系统，其特征在于，所述商标查询系统还包括：更新单元，其输入端与所述数据存储单元连接，用于检索互联网上相关数据的更新情况，并定期更新所述数据存储单元。
