Abstract
Description
図1は、本発明の実施形態に係る知財評価システムのブロック図である。図1に示すように、本発明の実施形態に係る知財評価システム1は、特許情報を評価する権利侵害解析評価部11と侵害性解析評価部12を備える。権利侵害解析評価部11は、自己保有特許の権利行使可能性を解析評価する。また、侵害性解析評価部12は、自己の製品が他人の特許を侵害するか否かを解析評価する。
所定の事案と関係すると知財評価システムによって判断されたデータが、データ表示部25に表示されても良い。データ表示部25に表示されたデータについて、弁護士等の査読を受け、知財評価システムによって判断された結果が妥当であるか否かを、操作者入力受付部16から弁護士等によってフィードバックされても良い。要素評価部19は、上記フィードバックに基づいて各データ要素を再評価できる。
本発明の実施形態に係る知財評価システムを用いる権利行使の解析評価について以下に記載する。図4は、本発明の実施形態に係る権利行使の解析評価の1例を示すフローチャートである。権利行使の可能性を有する1≦n≦N件の特許を特定する(S201)。権利行使の可能性を有する他社の製品データを自分で入力する。
侵害性評価(クリアランス)の解析評価について以下に記載する。侵害性評価(クリアランス)は、自分の製品が他人の特許を侵害しているか否かを評価することを言う。図5は、侵害性評価(クリアランス)の解析評価の1例を示すフローチャートである。侵害性評価では、最初に自分の製品r(1≦r≦R件)を特定する(S301)。特定する製品が開発中の場合もあり、特定する自己の製品データに関する情報が少ないことが多い。少ない製品データから検索式を用いて、キーワードを抽出する。(S302)キーワードを用いて特許を検索し、スコアを算出する等をして自己の製品に対して検索された特許が関係性を有するか評価する(S303)。
本発明の実施形態に係る知財評価システムを用いる営業秘密データの管理評価について記載する。図6は、営業秘密データの管理評価の1例を示すフローチャートである。本発明の実施形態に係る知財評価システムにおいて、新たな入力データを取得する(S401)。取得データから営業秘密データを3要件(秘密管理性、有用性、及び非公知性)で抽出する(S402)。抽出された営業秘密データのスコア値を算出する(S403)。
本発明の実施形態に係る知財評価システムを用いる電子スタンプ(電子公証)の管理評価について記載する。図7は、電子スタンプ(電子公証)の管理評価の1例を示すフローチャートである。電子スタンプの対象を選定する(S501)。選定された電子スタンプの対象に応じて、要素を評価し、キーワードを抽出する(S502)。取得データから、抽出されたキーワードを用いて電子スタンプの対象となる電子スタンプ候補データを抽出する(S503)。
知財評価システムの制御ブロックは、集積回路(ICチップ)等に形成された論理回路(ハードウェア)によって実現してもよいし、CPU(Central Processing Unit)を用いてソフトウェアによって実現してもよい。後者の場合、知財評価システムは、各機能を実現するソフトウェアである知財評価プログラムの命令を実行するCPU、上記知財評価プログラムおよび各種データがコンピュータ(またはCPU)で読み取り可能に記録されたROM(Read Only Memory)または記憶装置(これらを「記録媒体」と称する)、上記知財評価プログラムを展開するRAM(Random Access Memory)などを備えている。そして、コンピュータ(またはCPU)が上記知財評価プログラムを上記記録媒体から読み取って実行することにより、本発明の目的が達成される。上記記録媒体としては、「一時的でない有形の媒体」、例えば、テープ、ディスク、カード、半導体メモリ、プログラマブルな論理回路などを用いることができる。また、上記知財評価プログラムは、当該知財評価プログラムを伝送可能な任意の伝送媒体(通信ネットワークや放送波等)を介して上記コンピュータに供給されてもよい。本発明は、上記知財評価プログラムが電子的な伝送によって具現化された、搬送波に埋め込まれたデータ信号の形態でも実現され得る。
本発明は上述したそれぞれの実施の形態に限定されるものではなく、請求項に示した範囲で種々の変更が可能であり、異なる実施の形態にそれぞれ開示された技術的手段を適宜組み合わせて得られる実施の形態についても、本発明の技術的範囲に含まれる。さらに、各実施の形態にそれぞれ開示された技術的手段を組み合わせることにより、新しい技術的特徴を形成できる。
特許情報、利用者情報、アクセス履歴情報を含むデジタル情報を取得し、利用者情報に含まれる利用者から特定の者を指定し、指定された特定の者に関するアクセス履歴情報に基づいて、特定の者がアクセスした特許情報のみを抽出し、抽出された特許情報に含まれる文書ファイルが、所定の知財事案に関連するものであるか否かを示す付帯情報を設定し、付帯情報に基づいて、所定の知財事案に関連する文書ファイルを出力する。
Claims (12)
- 取得された特許情報に関するデータから所定の知財事案との関係性を評価する知財評価システムであって、
前記取得された特許情報に関するデータと前記所定の知財事案との関係性を評価するための要素を評価し、及び評価された要素を再評価して更新する要素評価部と、
前記要素に基づいて、前記取得された特許情報に関するデータと前記所定の知財事案との関係性を評価し、及び評価された関係性に基づいて再評価することにより更新された要素に基づいて、前記取得された特許情報に関するデータと前記所定の知財事案との関係性を再評価して更新する関係性評価部と、
前記関係性評価部により得られた関係性又は更新された関係性について閾値を特定し、該関係性又は更新された関係性と該閾値を比較する閾値特定部と、
前記要素評価部、前記関係性評価部、及び前記閾値特定部を制御して、前記取得された特許情報と前記所定の知財事案との再評価された関係性を取得し、該再評価された関係性と前記閾値との比較に応じて、該再評価された関係性を、特許情報と所定の知財事案との関係性を評価した結果として出力する特許情報解析部を備える知財評価システム。 - 権利行使の根拠となる特許を特定し、製品が、特定された権利行使の根拠となる特許に対して有する関係性を評価する権利侵害解析評価部を備える請求項1に記載の知財評価システム。
- 前記製品に関するデータが、ウェブ上で検索されたキーワードに基づいて更新して特定される請求項2に記載の知財評価システム。
- 前記製品に関するデータについて、特定された権利行使の根拠となる特許との関係性を評価する請求項3に記載の知財評価システム。
- 前記製品に関するデータについて、前記特定の知財事案との関係性の強さを示すスコア値を算出することにより、特定された権利行使の根拠となる特許との関係性を評価する請求項2から4のいずれか1項に記載の知財評価システム。
- 算出された該スコア値が高い製品に関するデータからキーワードを抽出することにより、特定された権利行使の根拠となる特許との関係性を評価する請求項5に記載の知財評価システム。
- 特定された権利行使の根拠となる特許との関係性の評価からクレームチャートを作成する請求項2から6のいずれか1項に記載の知財評価システム。
- 製品を特定し、特定された該製品に対する検索により取得された特許が、特定された該製品に対して有する関係性を評価する侵害性解析評価部を備える請求項1~7のいずれか1項に記載の知財評価システム。
- 営業秘密に関するデータを抽出し、当該抽出された営業秘密に関するデータと営業秘密との関係性を評価し、当該関係性が特定の閾値を超える場合に、前記抽出された営業秘密に関するデータの外部持ち出し又は送信準備作業を監視し、前記外部持ち出し又は準備作業が検出された場合に、前記外部持ち出し又は準備作業に対応する処理を実行する営業秘密管理評価部を備える請求項1から8のいずれか1項に記載の知財評価システム。
- 電子スタンプの対象を選定し、電子スタンプの対象を特定する要素を評価し、取得データから電子スタンプ候補データを抽出し、評価された要素に基づいて電子スタンプ候補データの関係性を評価し、評価された要素と関係性を更新し、評価又は更新された関係性が所定値を超える場合に電子スタンプ処理を認証し、電子スタンプ処理を送信する電子スタンプ管理評価部を備える請求項1から9のいずれか1項に記載の知財評価システム。
- 取得された特許情報に関するデータから所定の知財事案との関係性を評価する知財評価システムの制御方法であって、
取得された特許情報に関するデータと所定の知財事案との関係性を評価するための要素を評価する要素評価ステップと、
前記要素に基づいて前記データ入力受付部により取得された特許情報に関するデータと所定の知財事案との関係性を評価する関係性評価ステップと、
取得された特許情報に関するデータと所定の知財事案との関係性を評価するための前記要素を再評価する要素再評価ステップと、
再評価された前記要素に基づいて取得された特許情報に関するデータと所定の知財事案との関係性を再評価する関係性再評価ステップと、
再評価された関係性を、前記関係性について特定された閾値と比較する比較ステップと、
