此外， 由于所述标识具有上述与外部的网络服务器 107和外部通信 设备 108连接的特征， 因此当用户购买所述标识以及标识的产品或装置 时， 也可以将用户的相关信息与外部的网络服务器 107或外部通信设备 108上存储的已有用户信息进行比较， 如杲该用户不是具有该标识使用 权的用户或者说该用户无权使用所述标识时， 则商家可以不提供所述标 识的产品或装置给该用户。 对擅自使用者， 相同标识的用户也很方便地 鉴别出该标识的无效性。
优选地， 所述的标识牌表征的商品的相关信息或有用价值的相关 信息是商品的商标以及道德行为内容、 科技内容、 销售内容和网络相 关信息等。 更加优选地， 所述的道德行为内容、 科技内容、 销售内容 和网络相关信息等通常是指附着或加载于所迷商品上的标识显示的 内容。
优选地， 所述标识还具有监督和追溯功能。 所有对标识使用权有效 的用户可以通过所述外部网络服务器 107或外部通信设备 1 08实现监督和 追溯功能。 例如， 可以通过外部网络服务器 1 07或外部通信设备 108实现 用户间的信息交互和互相监督， 而当用户违反相关规定时， 可以取消其 对标识的使用权， 起到监督促进的作用， 而同时， 根据用户相关信息， 追溯用户的权责。 图 2是才艮据本发明的一个优选实施例的所述标识具有标识位置确定 装置的系统方块图。 如图 2所示， 其中与图 1相同的装置和连接关系在 此不再赘述， 在图 2示出的实施例中， 增加了标识位置确定装置 201和 外部载体 202， 用于确定标识贴附于外部载体 202上的确切位置。 具 体地， 所述标识位置确定装置 201可以发出位置定位信号， 用于表征 所述标识是否位于载体的正确定位位置上。 该标识位置确定装置 201 可以将商品或载体与所述标识联系起来， 实现商品或外部载体 202与 标识的信息互动和交流。
优选地， 其中所述标识的贴附位置根据标识的类型和所述载体的 类型确定。 例如， 当载体 202为衣服时， 可以将标识置于衣领外、 肩 部和背部等外表面醒目位置； 当载体 202为箱包时， 可以将标识置于 外表正面醒目的位置； 当载体 202为汽车等移动设备时， 通常可以将 标识置于汽车前端、 车窗、 车顶等醒目的位置； 当载体 202为书拒、 衣拒等固定装置时， 所述标识可以置于书拒或衣柜的正面； 又比如当 所述标识为商标类型时， 通常直接嵌入到所述载体上， 当所述标识为 电子芯片等类型时，可以将标识置于所述电子芯片的表面等；优选地， 所述的标识类型包括标识标签、 标识牌、 商标、 标识垫和标识笔等。 图 3是根据本发明的一个优选实施例的所述标识的认证确认装置 为单独的移动通讯终端 301的系统方块图。 如图 3所示， 其中与图 2 相同的装置和连接关系在此不再赘述， 在图 3示出的实施例中， 所述的 认证确认装置为单独的移动通讯终端 301 , 例如手机， IPAD, 个人数字 助理等， 当然， 图示的实施例中， 所述标识牌装置 101 自身仍旧具备认 证确认装置 104。
具体地， 当使用标识的两个或者多个用户碰面时，根据所述标识 100 的显示装置 103显示的用户相关信息， 例如用户 ID等， 可以通过移动通 讯终端 301与网络服务器 107或外部通信设备 108实现信息交互， 用以 认证所述用户对所述标识的使用权是否有效， 同时通过自身的信息处理 装置或者通过所述信息单元 106发送有效或者无效信息给所述的显示装 置 103, 当然， 也可以直接在所述移动通讯终端上直接显示眼前的用户 对所述标识的使用权是否有效。 在实际的应用中， 优选地， 所述认证确认装置可以是移动通信终端， 也可以是位于所述标识中的认证装置， 同时也可以是外部网络服务器或 者外部通信设备上的认证装置或认证系统， 对于本领域技术人员来说， 只要能实现用户对标识的使用权是否有效的认证或者实现用户身份等信 息的认证即可。 而所述认证确认装置可以通过生物识别技术、 加解密 技术或网络认证技术实现。
优选地， 对于标识自身来说， 有应用价值的信息可以是道德行为内 容， 例如 "我诚信" 等， 也可以是行业标识， 如该标识表征使用该标识 的用户属于哪个行业， 例如化工行业， 汽车行业等等； 也可以是科技用 语， 例如存储器， 智能芯片等等； 还可以是职业， 例如销售， 财务， 机 械师， 人力资源等； 同时还可以是其他类型， 例如商标标识等； 而对于 标识所显示的内容也可以进行多种选择， 例如显示用户 ID, 行业相关信 息， 标识使用者的相关信息和通讯交互信息等。
而对于上述标识的位置来讲， 优选地， 其通常位于载体的比较醒目 的位置， 例如汽车前端， 衣服的衣领的外部、 肩部和背部等外表面， 箱 包的正面或顶部等。
优选地， 所述标识通常用于便携式产品或装置上， 例如衣服， 背 包， 办公拒， 汽车等； 而所述的标识类型包括标识标签、 标识牌、 商 标、 标识垫和标识笔等。 所述标识制作时选用的材料根据标识载体的 类型和标识自身的类型确定， 通常所述的标识利用各种布料、 印染、 刺綉、 塑料、 金属材料、 或柔韧性较好的化学材料制作， 也可以利用 集成电路板或芯片组方式制作， 以适应标识载体的特征或特性，此外， 标识还可以采用各种提高美观、 漂亮的材料、 反光材料、 玉石材料等。 而标识的形状可以是立体的， 例如芯片等； 也可以是平面的， 例如商标 标识等。 下面以三种最常见的标识移动载体的方式说明本发明请求保护的 技术方案， 以便更好地理解本发明。 其中图 4示出了移动载体为衣服 的 4a和 4b两个实例， 图 5示出了移动载体为箱包的一个实例， 图 6 示出了移动载体为汽车的一个实例。 其中对于标识的具体结构在此不 再赘述。
如图 4a所示， 示出了所述标识的载体为衣服的示意图。 其中， 传 统的标识通常位于图示的 401和 4 02的位置， 即传统的衣服标识和尺 码标识或商标都是缝纫在衣服的内侧面， 尤其是衬衣、 T恤、 秋衣等贴 身内衣， 标识或商标都是与人体接触的。 这些标识或由于制作材料的原 因、 或由于立体突出的原因， 或由于加工的原因， 由于穿着的不舒服， 很多人被迫把标识拆掉， 造成商标性能的缺失。 另外， 标识缝纫在内部， 只在购买衣服时能够看到， 平时人们穿着时就看不到了， 因此标识的信 息传递效果不好。而本发明的所述标识 403可以设置于如图所示的正面， 也可以设置于衣领的外部、 肩部和背部等外表面， 解决了上述现有衣服 标识或商标的上述缺陷， 不再只是商品的商标， 而是增加了道德行为、 行业、 职业等有应用价值的信息， 使标识的信息传送功能得到强化。 这 样， 大大加强了具有相同衣服标识的两个或者多个用户之间进行信息交 互的能力。
如图 4b所示， 示出了所述标识的载体为衣服的另一种示意图， 图 示为衣服的背面。 图中的 404， 405， 406， 407， 408都是本发明所述的增 加了有应用价值信息的标识， 由于其中任一个都是设置于衣服领的外 部、 肩部或背部等外表面醒目的位置。 "我诚信" 的有应用价值信息， 很 容易被人们所发现， 一方即可获知对方有诚信承诺， 可以直接进行思想 沟通和信息交流， 如果是同类标识的用户， 当然双方也可以在沟通和交 流中进行相互查询和监督。
如图 4a和图 4b示出的 "我诚信，， 标识， 可以标识具有该标识的用 户的 "诚信度"较高， 而且该标识的显示装置可以明确显示出 "我诚信，，， 此外， 该标识还可以具有通过 "我诚信" 标识的亮暗程度表征标识的使 用权有效或无效的功能。 例如， 当某用户看到穿有 "我诚信" 标识的衣 服的另一个用户， 通常该标识处于 "亮" 的状态， 而该用户可以通过移 动通信终端或者登陆网络的方式查询所述标识的使用的有效性， 可以通 过所述标识显示的用户 ID等方式进行查询， 当发现穿着该标识的用户具 有失信或违反诚信的行为时， 也可以通过移动通信终端或者所述网络向 服务器发送该 ID的用户具有失信行为，所述服务器为使用该标识的用户 在网上注册的服务器，而所述服务器可以注销或评价该 ID的用户对该标 识的使用权， 同时使得所述标识 "我诚信" 处于 "暗" 的状态， 当然亮 暗状态仅仅是表征该标识是否有效的一种方式， 还可以通过其他方式实 现该标识的无效或有效，例如用户通过用户 ID直接在服务器上发现该用 户 ID已经失效， 即该用户对标识的使用权已经无效。 如图 5所示， 示出了所述标识的载体为箱包的示意图。在图 5中， 传统标识 501位于图示的位置， 以商标的形式展现， 而其只是一种商 品的标识， 不具有通信和信息交互功能， 而本发明所述的标识 502 "我 诚信" 位于箱包最醒目的位置一箱包表面， 是商品标识外增加的有应 用价值的信息， 当其他用户看到使用该标识的用户时， 可以认为该用 户的诚信度非常高， 就可以放心与该用户进行交流或交易， 实现信息 交互。 同样， 也可以通过与图 4相同的方式实现用户对标识的使用权 是否有效的查询， 并反馈信息给服务器。 箱包属于便携式产品的一种， 其本身就成为用户间交流最好的一种标识载体， 同时， 所述标识的内 容和方式也可以采用多种， 包括标识的定位位置， 例如可以位于箱包 的拉杆上， 箱包的侧面等等。 而所述标识 502由于具有认证确认装置 和显示装置， 以及通信装置和信息处理单元， 因此可以实现与服务器 或 PC之间的信息交互， 也可以实现标识的显示， 具有通信和信息交 互功能。
如图 6所示， 示出了所述标识的载体为汽车的示意图。在图 6中， 所述标识 "我诚信" 位于侧面门上， 当然 601和 602是传统的标识放 置的位置， 然而这种传统标识通常以商标的形式标识， 而且， 它本身 不具备信息传输和通讯的功能。 而图示的标识 603也可以位于车前侧 的车盖上或者其他位置， 例如车玻璃内部， 甚至更优选地， 所述标识
603还可以与汽车内部的结构连接， 通过对汽车的控制， 控制所述标 识的显示状态和其他状态， 例如通信状态。 而当使用带有同样标识的 汽车用户相遇时， 可以对双方的信任度大为增加， 从而增加用户之间 交流和进行信息交互的频率。 此外， 由于标识 603可以与汽车连接， 因此还可以通过汽车上的相应装置进行网上查询或者实现与服务器 的信息交互， 进而根据所述标识的相关信息， 例如用户 ID， 对所述用 户对该标识的使用权的有效性或无效性进行查询， 并反馈信息给服务 器或网络设备， 当服务器或网络设备发现使用该标识的用户诚信度不 够时， 取消或评价其对该标识的使用， 即该标识具有自我或相互追溯 权。
由此可见， 标识上的内容不仅再是生产企业的商标， 而是增加了有 应用价值的信息， 并且这些有应用价值的信息， 无论单位或个人， 只有 通过互联网平台上的服务器或 PC进行登记确认后 , 才能够具有使用权。 而且， 一旦使用者在使用有应用价值的信息中出现违背自己确认过的条 约， 例如诚信度承诺确认， 将能够通过互联网平台上的服务器或 PC取消 其对所述标识的使用权或进行评价， 通过互联网平台公诸于众。
当然， 图 4-6的举例并非穷举， 旨在能更好地理解本发明的主旨。 图 7是根据本发明的一个优选实施例的所述标识贴附装置的结构 示意图。 如图 8所示， 标识贴附装置 700包括标识贴附头 701和手持装置 702， 所述标识贴附头 701的形状图示为球形， 然而其形状可以根据所 述标识 100的形状以及标识要贴附的装置的形状产生变化， 而所述手 持装置 702和标识贴附头 701通过连接装置 703连接， 通常， 所述标识 贴附头 701可以采用柔韧性较好的化学材料、 塑料或金属材料制成， 这样， 标识可以通过粘结或贴附的方式和标识贴附头连接到一起， 优 选地， 所述连接装置 703是物理连接装置， 更加优选地， 所述标识贴 附头 701和手持装置 702可一体化形成， 或者所述的标识贴附头是可拆 卸的。 在实际的应用中， 由于标识贴附头的柔韧性较好， 因此所述标 识可以容易地贴附或连接到所述的标识贴附头， 同时， 由于标识贴附 头的形状可以根据所述标识的形状发生变化， 同时根据标识要贴附的 装置或位置的形状也可以产生变化， 因此大大增加了标识贴附的效率 和便利性。 在显示商品或产品商标的同时， 增加的有应用价值信息对 提高人们之间的思想沟通和信息交流起到了巨大的促进作用。
总而言之， 不同地方、 不同单位的同类人群， 根据所述标识的相关 显示信息， 艮便利地获知对方的行业或职业等相关信息， 并且经过了诚 信承诺的确认。 这有利于双方进行更快捷有效的信息交互， 而且同类标 识的用户之间很容易认同对方。 这种认同方式可以提高社会沟通和信息 交流的频率十倍甚至几十倍， 可以使诚信、 管理、 科技、 信息、 服务、 协调等方面达到飞速的发展， 促进社会的和谐和知识进步。 虽然关于示例实施例及其优点已经详细说明， 应当理解在不脱离 本发明的精神和所附权利要求限定的保护范围的情况下， 可以对这些 实施例进行各种变化、 替换和修改。 对于其他例子， 本领域的普通技 术人员应当容易理解在保持本发明保护范围内的同时， 工艺步骤的次 序可以变化。
此外， 本发明的应用范围不局限于说明书中描述的特定实施例的 工艺、 机构、 制造、 物质组成、 手段、 方法及步骤。 从本发明的公开 内容， 作为本领域的普通技术人员将容易地理解， 对于目前已存在或 者以后即将开发出的工艺、 机构、 制造、 物质组成、 手段、 方法或步 骤， 其中它们执行与本发明描述的对应实施例大体相同的功能或者获 得大体相同的结果， 依照本发明可以对它们进行应用。 因此， 本发明 所附权利要求旨在将这些工艺、 机构、 制造、 物盾组成、 手段、 方法 或步骤包含在其保护范围内。

Claims

权 利 要 求 书
1. 一种标识， 包括标识牌装置和信息处理装置， 其特征在于： 所述标识牌装置包括显示装置和认证确认装置， 所述显示装置用 于显示标识牌表征的商品的相关信息或有用价值的相关信息；
所述信息处理装置包括通信装置和信息处理单元， 通信装置用于 实现标识牌装置与外部通讯设备或网络设备的通信， 信息处理单元用 于根据上述通信后的结果确定使用者对所述标识牌装置的使用权是 否有效， 并发送有效信息或无效信息给所述认证确认装置；
所述认证确认装置用于确认使用所述标识的商品的使用权的有 效性或无效性， 并发送有效信息或无效信息给所述显示装置；
所述显示装置显示所述标识的有效信息或无效信息。
2. 如权利要求 1所述的标识，其中所述的标识牌表征的商品的相 关信息或有用价值的相关信息是商品的商标以及道德行为内容、 科技 内容、 销售内容和网络相关信息等。
3.如权利要求 1或 2所述的标识，其中还包括标识位置确定装置， 用于确定标识贴附于载体上的确切位置。
4. 如权利要求 3 所述的标识， 其中所述标识的贴附位置根据标 识的类型和所述载体的类型确定。
5.如权利要求 1 所述的标识， 其中所述标识用于便携式产品或装 置上。
6.如权利要求 5所述的标识， 其中所述的便携式产品或装置是衣 服、 箱包和汽车等商品。
7.如权利要求 6所述的标识， 其中所述标识在衣服的衣领外部、 肩部、 背部等外表面； 箱包外表面等醒目位置； 汽车前端或顶部等比 较醒目的位置。
8. 才艮据权利要求 1-7任意一项所述的标识， 其中所述认证确认装 置可以通过生物识别技术、 加解密技术或网络认证技术实现。
9. 根据权利要求 1-7任意一项所述的标识， 其中所述的标识类型 包括标识标签、 标识牌、 商标、 标识垫和标识笔等。
10. 根据权利要求 1-7任意一项所述的标识， 其中所述的标识利用 各种布料、 印染、 刺绣、 塑料、 金属材料、 玉石材料或柔韧性较好的 化学材料制作。
11. 根据权利要求 1-7任意一项所述的标识， 其中所述的标识可以 利用集成电路板或芯片组方式制作。
12. 一种标识贴附装置， 包括标识贴附头和手持装置， 其特征在 于：
所述标识贴附头的形状可以根据所述标识的形状以及标识要贴 附的装置的形状产生变化；
所述手持装置和标识贴附头通过连接装置连接。
13. 如权利要求 12所述的标识贴附装置， 其中所述连接装置是物 理连接装置。
14. 如权利要求 12所述的标识贴附装置， 其中所述标识贴附头和 手持装置可一体化形成。
15. 如权利要求 12所述的标识贴附装置， 其中所述的标识贴附头 采用柔韧性较好的化学材料、 塑料或金属材料制成。
16. 如权利要求 12所述的标识贴附装置， 其中所述的标识贴附头 是可拆卸的。
