- step 12 the eNB is not able to allocate the requested radio resources.
- step or message 13 eNB sends a reject message such as SAE Access Bearer REJECT for MME instead of building up the radio link. Note, that in this case the terminal is not getting any TFT of GBR information.
- MME When the REJECT arrives at MME, MME knows that for the particular bearer ID the terminal is waiting for response. MME sends an information to the terminal UE such as "network busy" indicator using direct transfer in order to inform the terminal on the failed bearer setup.
- a "Network busy"- message is an indicator that network is not able to provide dedicated resources with the requested QoS. The message has to include UL TFT.
- step or message 14 MME answers UPE bearer response message with REJECT.
- step or message 15 UPE sends a policy acknowledgement with information to remove the charging bindings.
- the invention thus provides at least according to some of the embodiments, an architecture where the QoS in controlled by the network only instead of negotiating it between the terminal and the network (e.g. QoS/bearer needed due IMS streaming request from a terminal) , and the network makes a decision whether or not the terminal needs an indication of unsuccessful radio resource reservation (e.g. if QoS aware terminal/application, e.g. a legacy application from 2G/3G networks used in multimode terminal) .
- the terminal In case of full network controlled resource reservation, the terminal is not allowed to request QoS.
- the SAE radio bearer setup messaging is used to transfer QoS information to the terminal. If the bearer setup fails, the terminal is thus automatically getting an indication of the failure.
- an application such as a QoS aware application can thus be provided with information about failure in resource reservation to be able to gracefully cancel a session setup or to renegotiate the session parameters if default QoS is not to be concerned for the application. Without failure indication QoS aware applications may have unstable behavior when waiting for resource reservation feedback before completing the session setup.
- the network is able to terminate the session setup in case of resource reservation failure to prevent "ghost calls" without sufficient resources. If the QoS awareness of the application is supported with the failure indication, the session setup is not necessarily terminated, but the decision how to continue is left for the application itself.
- SAE/LTE can be implemented on top of existing network, and most likely the first terminals are multimode terminals supporting LTE and 2G/3G access technologies.
- the QoS mechanism in 3G networks provides support from the terminal and applications and therefore the future multimode terminal preferably have QoS capabilities for 3G access network usage.
- the applications are able to request QoS and the terminal is able to modify the QoS request to secondary PDP context request when the terminal is attached to 3G access network.
- An application running in a terminal can be made aware of failure in resource reservation so as to avoid any disadvantage as to the end user's quality of experience.
- a QoS aware application is provided with the information about failure in resource reservation to be able to gracefully cancel a session setup or to renegotiate the session parameters if default QoS is not to be concerned for the application. Without failure indication QoS aware applications may have unstable behavior when waiting for resource reservation feedback before completing the session setup. In case of IMS VoIP, network is able to terminate the session setup in case of resource reservation failure to prevent "ghost calls" without sufficient resources. If the QoS awareness of the application is supported with the failure indication, the session setup is not necessarily terminated, but the decision how to continue is left for the application itself.
- the embodiments of the invention illustrate example as to how the information of non-successful resource reservation can be transmitted to the terminal in LTE.
- the invention solves the problem of QoS aware application usage in terminals such as an e.g. 2G/3G/3G LTE capable terminal.
- Embodiments incorporate the behaviour or features required by terminal and network to transfer information of successful or unsuccessful resource reservation in the network that controls QoS, so as to transfer the information of successful or unsuccessful resource reservation up to the application layer.
- At least one or more of the embodiments of the invention shows how the network will give enough information for the terminal and how the terminal transfers internally the information to the application.
- the network has full control of QoS and the terminal is automatically given only the radio L2 information, which is required to map services to right radio bearers.
- Embodiments of the invention make it possible to support QoS aware applications in LTE.
- QoS aware application is SIP application supporting preconditions signalling.
- Embodiments re-use the current 3G application implementation. It helps to build multi-radio terminals, with minimal or no changes to the application behaviour. (Application is not required to adjust its behaviour to the currently used access technology) .
- Embodiments may re-use the layer 3 intelligence, already implemented for 3G terminals (some modification required) .
- the proposed solution without optimisation is able to support all kind of QoS aware applications, not only SIP applications. With the optimisation described, the proposed solution does not add any unnecessary signalling to the network.
- the proposed solution without optimisation may be implemented using some signalling to the network.
- the functionality described is visible when network sends failure indication to terminal.
- a communication system and network entities as well as communication devices and methods are provided wherein a network may have control of QoS.
- An information such as a "network busy" message may be sent to a terminal, dependent on the terminal capabilities such as QoS aware or not, if a dedicated bearer setup fails.
- One or more embodiments of the invention thus provide a network entity, apparatus, network, or method, comprising: triggering a policy enforcement in a user plane entity using an application level signaling or a new uplink or downlink flow; transmitting a system architecture evolution (SAE) access bearer message request to a mobile management entity to create a dedicated SAE access bearer for a particular service; initiating a set-up for the dedicated SAE access bearer at the mobile management entity and transmitting the message request from the mobile management entity to a base station; performing an admission control for guaranteed bit rate information services at the base station; transmitting a message from the base station to a terminal to perform a dedicated SAE bearer set-up; transmitting a response message to the mobile management entity indicative of a successful radio resource reservation; and based on the response message, transferring the information to the application or discarding at the terminal the information and continuing to use a default bearer.

- the message request to the mobile management entity may comprise a user plane entity tunnel endpoint identifier and internet protocol address, a layer 3 quality of service, a guaranteed bit rate and a non-access stratum message, including an uplink traffic flow template, quality of service information required, or a header compression configuration.
- the message request to the base station may comprise a user plane entity tunnel endpoint identifier and internet protocol address, a layer 3 quality of service, a guarantee bit rate and a non-access stratum message, including an uplink traffic flow template, quality of service information required, a header compression configuration, or a SAE bearer identification.
- the response message may comprise an evolved Node B tunnel endpoint identifier and internet protocol address and a SAE bearer identification.
- the access bearer message may comprise a layer 3 quality of service, a user plane entity tunnel endpoint identifier and internet protocol address, a guaranteed bit rate, a bearer identification, a piggy packed non-access stratum message with a traffic flow template, a header compression configuration, and quality of service information required by applications or services .
- An apparatus, terminal, or a method of or provided in a terminal may comprise: in response to a detection of a failure in an admission control for guaranteed bit rate information services to create a dedicated system architecture evolution access bearer for a particular service, receiving a network busy message indicative of an unsuccessful radio resource reservation using a direct transfer mechanism; when no quality of service awareness exists, discarding information in the network busy message and continuing to use a default bearer; and when quality of service awareness exists, based on the information in the network busy message, determining whether to continue using a default quality of service, restart a session negotiation, or abandon a session.
- determining at the mobile management entity that for a particular bearer, the terminal is waiting for a response ; transmitting from the mobile management entity to the terminal the network busy message to inform the terminal of a failed bearer setup, wherein the network busy message indicates that a network is unable to provide dedicated resources with a requested quality of service and comprises an uplink traffic flow template.
- the network busy message may comprise at least one of an indicator that the network is unable to create the dedicated system architecture evolution bearer with a requested quality of service, a downlink and uplink logical channel identifier message, a layer 2 quality of service message, and a non- access stratum message.
- One or more embodiments of a method, apparatus, or entity for or in a network may comprise: triggering a policy enforcement in a user plane entity using an application level signaling or a new uplink or downlink flow; transmitting a system architecture evolution (SAE) access bearer message request to a mobile management entity to create a dedicated SAE access bearer for a particular service; initiating a set-up for the dedicated SAE access bearer at the mobile management entity and transmitting the message request from the mobile management entity to a base station; performing an admission control for guaranteed bit rate information services at the base station; detecting a failure in the admission control; transmitting a message from the base station to the mobile management entity indicative of an unsuccessful radio resource reservation; and transmitting a network busy message from the mobile management entity to the terminal using a direct transfer mechanism.

- the access bearer message may comprise at least one of a layer 3 quality of service, a user plane entity tunnel endpoint identifier and internet protocol address, a guaranteed bit rate, a bearer identification, a piggy packed non-access stratum message with a traffic flow template, a header compression configuration, and quality of service information required by applications or services.
- the method or apparatus may further comprise: receiving information about priority of the access bearer, the traffic flow template to map a service to an appropriate radio bearer, or a service specific quality of service information.
- One or more embodiments of an apparatus, terminal or method for a terminal may comprise: transmitting a notice that pre-conditions are supported by the terminal and that a resource reservation is requested; receiving a session description protocol answer; in response to a detection of an admission control for guaranteed bit rate information services, requesting a system architecture evolution (SAE) access bearer establishment for particular radio resources; determining that the terminal is unable to allocate the requested radio resources; transmitting a reject message to a mobile management entity indicative that the terminal is unable to allocate the requested radio resources; and receiving a network busy message indicative of an unsuccessful radio resource reservation from the mobile management unit using a direct transfer mechanism.

- multi-radio terminal refers to a terminal which can be used in 2G/3G as well as 3G LTE access networks.
- This terminal can be for example a network card used as a modem with laptop or a mobile handset like current mobile phones .
- UPE User Plane Entity In this description it refers to a combined LTE anchor and 3GPP anchor.

Abstract
Dans un mode réalisation de cette invention, un réseau décide de la qualité de service, QoS, à utiliser pour un flux d'informations entre le réseau et un terminal, et si oui ou non le terminal doit être informé d'une réservation de ressource non réussie nécessaire pour fournir la qualité de service. Le réseau informe le terminal en fonction du résultat de la décision. Une application exécutée dans le terminal, telle qu'une application compatible avec la QoS, est fournie avec des informations concernant un échec de réservation de ressource, et un établissement de session est annulé, ou une QoS par défaut est utilisée, ou des paramètres de session sont renégociés, en réponse aux informations concernant l'échec.
