Przedmiotem wzoru przemyslowego jest karata rabatowa, która przeznaczona jest do dokumentowania wielkosci realizowanych zakupów w systemach wspierajacych bezgotówkowa sprzedaz paliw, produktów poza paliwowych i uslug na stacjach paliw, oplaty za tunele, mosty, autostrady, promy oraz oplaty w hotelach. Znane sa powszechnie karty kredytowe oraz róznego rodzaju karty rabatowe stalego klienta, które charakteiyzuja sie swoista kolorystyka, rysunkami i stylizowanymi napisami. W opisie wzoru zdobniczego nr 15283 ujawniona jest karta magnetyczna, na której na tle stylizowanego zegara umieszczono napisy „BANK PBH" i ponizej „KARTA BANKOMATOWA SEZAM". W opisie wzoru przemyslowego nr 3355 przedstawiono karte rabatowa zawierajaca miedzy innymi na przedniej stronie rysunek, który ma nierównomierne tlo o skosnie umieszczonych jasniejszych przebarwieniach i jest wypelniony nachodzacymi na siebie, czteroramiennymi gwiazdkami o róznej wielkosci, gdzie srodki gwiazd maja wybarwienie intensywne, rozjasniajace sie w kierunku ramion. Umieszczone sa równiez biale, cienkie linie, które tworza obrysy duzych liter. Istote wzoru przemyslowego stanowi nowa kolorystyka, uklad linii, konturów, napisów oraz jego ornamentacja.Wzór karty rabatowej zostal uwidoczniony na zdjeciach, na których fig. 1- przedstawia awers karty rabatowej, fig. 2 - rewers karty rabatowej. Karta rabatowa w postaci prostokata o zaokraglonych rogach, majaca wielkosc zblizona do typowych kart kredytowych, na awersie z prawej strony na szarym tle z cieniem „tao" ma niebieskawy cieniowany kontur, w którym umieszczony jest wizerunek stacji paliw LOTOS. U góry i z prawej strony karty umieszczony jest pasek z bialym nadrukiem „tao" i LOTOS. „Tao" oparte jest na ksztalcie kola, w które wpisany jest kwiat lotosu majacy dwa platki w ksztalcie kropli, a trzeci w ksztalcie plomyka. Ponizej lewego górnego rogu znajduje sie zloty prostokat. Na rewersie na szarym tle z rastrowanym napisem LOTOS wraz ze znakiem „tao" z prawej strony umieszczony jest niebieskawy kontur, w srodku którego znajduje sie „tao" w szarym kolorze. Z lewej strony u góry znajduje sie znak slowno-graficzny LOTOS GRUPA w kolorach czerwonym i niebieskim. Cechy istotne wzoru przemyslowego polegaja na tym, ze na awersie karty rabatowej na szarym tle z cieniem „tao" umieszczony jest niebieskawy cieniowany kontur, w którym jest wizerunek stacji paliw LOTOS. „Tao" oparte jest na ksztalcie kola, w które wpisany jest kwiat lotosu majacy dwa platki w ksztalcie kropli, a trzeci w ksztalcie plomyka. U góry i z prawej strony karty umieszczony jest pasek z bialym nadrukiem „tao" i LOTOS. Ponizej lewego górnego rogu znajduje sie zloty prostokat. Credit cards and various types of loyalty discount cards are commonly known, characterized by their unique colors, designs, and stylized inscriptions. The description of ornamental design no. 15283 discloses a magnetic card with the inscriptions "BANK PBH" and "SEZAM ATM CARD" placed against the background of a stylized clock. The description of industrial design no. 3355 depicts a discount card containing, among other features, a design on the front, featuring an uneven background with diagonally placed lighter shades and filled with overlapping four-pointed stars of varying sizes, with the centers of the stars having an intense color that lightens toward the points. There are also thin white lines that form the outlines of the capital letters. The essence of the industrial design is the new color scheme, arrangement of lines, contours, lettering, and its ornamentation. The discount card design is shown in the photographs, where Fig. 1 shows the obverse of the discount card and Fig. 2 shows the reverse. The discount card is a rectangle with rounded corners, similar in size to a typical credit card. On the front, on the right side, against a gray background with a shadow of "tao," there is a bluish, shaded outline containing the image of the LOTOS gas station. At the top and right side of the card, there is a strip with a white print of "tao" and LOTOS. "Tao" is based on the shape of a circle, within which is inscribed a lotus flower with two drop-shaped petals and the third in the shape of a flame. Below the upper left corner, there is a gold rectangle. On the reverse, against a gray background with a rasterized LOTOS inscription and the "tao" symbol on the right, there is a bluish outline, in the center of which is a gray "tao." On the upper left side, there is a word and graphic symbol LOTOS GRUPA in red and blue. The essential features of the industrial design are that on the obverse of the discount card, on a gray background with the shadow of "tao", there is a bluish shaded outline with the image of the LOTOS gas station. "Tao" is based on the shape of a circle with a lotus flower inscribed in it, with two drop-shaped petals and the third one in the shape of a flame.
