Opis wzoru przemyslowego Przedmiotem wzoru przemyslowego jest etykieta opakowania podloza do roslin, która moze stanowic sciane czolowa lub byc nanoszona na sciane czolowa w róznego rodzaju opakowaniach. Znane sa róznego rodzaju opakowania podlozy do roslin, jak pudelka, wiaderka, butelki, torebki, a takze worki foliowe lub z tkanin jutowych, których sciany czolowe sa zaopatrzone w barwne ilustracje i napisy wskazujace na ich przeznaczenie. Ilustracje i napisy sa czesto nanoszone bezposrednio na sciane czolowa opakowania lub sa na nie naklejone w postaci etykiet. Istota wzoru przemyslowego jest nowa postac i indywidualny charakter etykiety opakowania podloza do roslin, nadana mu w szczególnosci przez cechy linii i kolorystyke ilustracji. Przedmiot wzoru przemyslowego jest ukazany w szesciu odmianach na zalaczonych ilustracjach, Fig. 1 - 6 oraz na ilustracji zbiorczej. Etykieta wedlug wzoru przemyslowego przedstawia barwna fotografie rozmieszczona pomiedzy dwoma szerokimi, pionowymi pasami w kolorze jasno-brazowym, imitujacym tkanine jutowa z wyraznie widocznym splotem wlókien. Fotografia posiada szerokosc trzykrotnie wieksza od szerokosci kazdego z pasów i te sama wysokosc co pasy. Fotografia jest podzielona w poziomie na trzy czesci. Dolna polowe jej powierzchni zajmuje widok bialo-bezowych ludzkich dloni zlozonych zewnetrznymi krawedziami i nachylonych ku dolowi, widzianych od wewnetrznej strony i tworzacych jakby pojemnik, usytuowany na tle brazowo-czarnej ziemi stanowiacej podloze dla roslin. W zlozonych dloniach sa umieszczone podloza i rózne rosliny, do uprawy których przewidziane sa podloza. Widok dloni stanowi okolo polowe dolnej powierzchni fotografii, natomiast górna polowe powierzchni fotografii wypelnia widok blekitnego nieba z bialymi chmurkami i rozmieszczony ponizej niego zólty poziomy pas, sluzacy do umieszczenia napisów informacyjnych. Widok nieba zajmuje mniej wiecej 2/3 powierzchni górnej polowy calej fotografii, a zólty pas 1/3 tej powierzchni. W pierwszej odmianie wzoru, pokazanej na Fig. 1 - w dloniach tworzacych pojemnik jest usytuowana garsc brazowego podloza, jakby zaczerpnieta z ziemi, na której spoczywaja dlonie. W drugiej odmianie wzoru, pokazanej na Fig. 2 - w dloniach tworzacych pojemnik znajduje sie garsc podloza, na którym sa usytuowane w zwartej grupie krzewy i drzewa iglaste o róznych formach, pokroju i zabarwieniu, glównie zielone i zólte, przy czym rózne odmiany krzewów stanowia pierwsze pietro, a drzewa iglaste drugie pietro. Ponad zóltym pasem i czesciowo na nim oraz na tle nieba po lewej i prawej stronie sa rozmieszczone galazki iglaka z szyszkami. W trzeciej odmianie wzoru, pokazanej na Fig. 3 - w dloniach tworzacych pojemnik znajduje sie garsc podloza, na którym sa usytuowane trzy kepy dekoracyjnych zielonych roslin doniczkowych. Ponad zóltym pasem i czesciowo na nim oraz na tle nieba po lewej stronie jest usytuowana galazka z blado i intensywnie zabarwionymi zielonymi liscmi. W czwartej odmianie wzoru przemyslowego, uwidocznionej na Fig. 4 – w dloniach tworzacych pojemnik znajduje sie garsc podloza, na którym jest usytuowany zielony krzew paproci. Ponad zóltym pasem i czesciowo na nim oraz na tle nieba po lewej stronie jest usytuowanych kilka galazek paproci. W piatej odmianie wzoru przemyslowego, przedstawionej na Fig. 5 – w dloniach tworzacych pojemnik znajduje sie garsc podloza, a w nim baldachy pelargonii i surfinie w róznych kolorach: czerwone, rózowe, biale, czerwono-biale, rózowo-biale i fioletowe. Ponad zóltym pasem i czesciowo na nim oraz na tle nieba po lewej stronie znajduje sie baldach czerwonej pelargonii, a po prawej stronie bukiet bialo-rózowo-fioletowych surfinii i pelargonii. W szóstej odmianie wzoru przemyslowego, pokazanej na Fig. 6 – w dloniach tworzacych pojemnik znajduje sie garsc podloza, a na nim w czesci srodkowej jest rozmieszczony pas zielonej trawy, otoczony wiencem utworzony z róznokolorowych owoców, warzyw oraz kwiatów ogrodowych i doniczkowych. Various types of plant substrate packaging are known, such as boxes, buckets, bottles, bags, and plastic or jute bags, whose front panels are provided with colorful illustrations and inscriptions indicating their intended use. The illustrations and inscriptions are often applied directly to the front panel of the packaging or are glued to it as labels. The essence of the industrial design is the new form and individual character of the plant substrate packaging label, given to it in particular by the line features and color scheme of the illustrations. The industrial design is shown in six variations in the attached illustrations, Figs. 1-6, and in the collective illustration. The industrial-style label features a color photograph arranged between two wide, vertical stripes in light brown, imitating jute fabric with a clearly visible fiber weave. The photograph is three times the width of each stripe and the same height as the stripes. The photograph is divided horizontally into three parts. The lower half of the photograph shows a view of white-and-beige human hands, their outer edges together and tilted downward, viewed from the inside, forming a container, set against a background of brown-and-black soil serving as a substrate for plants. The cupped hands contain growing media and various plants for which the media are intended. The image of a hand constitutes approximately half of the lower part of the photograph, while the upper part is filled with a view of a blue sky with white clouds and a yellow horizontal stripe below it, used for informational text. The image of the sky occupies approximately two-thirds of the upper half of the photograph, and the yellow stripe occupies one-third of that area. In the first variation of the design, shown in Fig. 1, the hands forming the container hold a handful of brown soil, as if taken from the earth on which the hands rest. In the second variation of the design, shown in Fig. 2, the hands forming the container hold a handful of soil on which shrubs and conifers of various forms, shapes, and colors, primarily green and yellow, are arranged in a compact group, with various varieties of shrubs constituting the first layer and conifers the second layer. Above and partially on the yellow stripe, and against the sky on the left and right, are conifer branches with pine cones. In the third variation of the design, shown in Fig. 3, the hands forming the container hold a handful of soil on which three clumps of decorative green potted plants are placed. Above and partially on the yellow stripe, and against the sky on the left, is a branch with pale and intensely colored green leaves. In the fourth variation of the industrial design, shown in Fig. 4, the hands forming the container hold a handful of soil on which a green fern bush is placed. Above and partially on the yellow stripe, and against the sky on the left, are several fern branches. In the fifth variation of the industrial design, shown in Fig. 5, the hands forming the container hold a handful of substrate, and within it are umbels of geraniums and surfinia in various colors: red, pink, white, red-and-white, pink-and-white, and purple. Above and partially on the yellow stripe, and partially on it, and against the sky background, on the left is an umbel of red geranium, and on the right is a bouquet of white, pink, and purple surfinias and geraniums. In the sixth variation of the industrial design, shown in Fig. 6, the hands forming the container hold a handful of substrate, and on the central part of the umbels is a strip of green grass, surrounded by a wreath of colorful fruits, vegetables, and garden and potted flowers. Above the yellow stripe, against the sky on the left there is an apple tree branch with two red apples and a blackcurrant branch, while on the right above the stripe and partially on it there is a fragment of a composition of shrubs and conifers.PL 18957 3 Essential features of the industrial design 1. The label of the plant substrate packaging according to the industrial design presents a colour photograph, placed between two vertical stripes imitating jute fabric, divided horizontally into three parts, the lower part of which shows the view of human hands folded with their outer edges and forming a sort of container, placed against the background of the earth constituting the substrate for the different plants, the upper part shows a view of a blue sky with white clouds, and between them a yellow horizontal stripe intended for information inscriptions. 2. In the cupped hands forming the container are located substrates and various plants for which the substrates are intended. 3. In the first variation of the design, shown in Fig. 1, the hands forming the container hold a handful of substrate, as if taken from the earth on which the hands rest. 4. In the second variation of the design, shown in Fig. 2, the hands forming the container hold a handful of substrate on which shrubs and conifers of various forms, habit, and color are arranged in a compact group. 5. In the third variation of the design, shown in Fig. 3, the hands forming the container hold a handful of substrate on which decorative potted plants are placed. 6. In the fourth variant of the industrial design, shown in Fig. 4, the hands forming the container hold a handful of substrate on which a fern bush is situated. 7. In the fifth variant of the industrial design, shown in Fig. 5, the hands forming the container hold a handful of substrate, and in it balcony and garden plants in various colors. 8.
