New Zealand Paient Spedficaiion for Paient Number 545751 Patents Form 5 545751 New Zealand POST-DATED UNDER SECT. 12(4) to 21 August 2008 COMPLETE SPECIFICATION THE PATENTS ACT 1953 A WATER DRINK WITH SUPPLEMENTS TO ALLEVIATE THE EFFECTS OF AGEING •JOHN GORDON RUTHERFORD OF 2 Crest Lane, Christchurch 8, New Zealand, New Zealand Citizen, do hereby declare this invention to be described in the following statement: 1 545751 The present invention relates to a predominantly water based drink that includes compositions for nutritional supplementation in order to prevent, treat and/or alleviate the occurrence or negative effects of ageing with particular emphasis on skin, eye and joint deterioration, cardiovascular disease, osteoarthritis, osteoporosis, and certain types of cancers, presented in ready to drink form in a convenient to carry, bottle or can, as a dietary supplement.
Traditionally, therapeutic and dietary supplements have been packaged as powders, or tablets and capsules with a quantity or number on the label, recommended to be consumed on a daily basis. Those with busy schedules, or some degree of memory loss, are likely to forget to take tablets, or measure out powders, in accordance with labelled or prescribed instructions. The mouth does not tell the brain it needs a tablet but a dry mouth is an almost hourly occurrence hence the ubiquitous "tea break", or in hotter climates, a cool water based drink break .
Various dietary supplements exist in the form of powders or concentrates that are added to a single serve drink at the time of consumption such as a glass of water, cup of tea, fruit juice or similar popular libation. (US patent 6,248,390 Stillman and US Patent Application 20050186319 Williams et al). These supplements include items that have a long shelf life as a powder or concentrate in sealed or air tight containers but do not remain in suspension for periods of time suited to a drink marketed as a "water plus" drink in a bottle of a size suited to daily consumption or one which can be refrigerated after opening, and retained and consumed over several days, as might be the case with a bottle of milk or fruit juice. For such a purpose, carefully chosen ingredients that are compatible in a water drink that will remain on retail shelves for a period before being sold and will not deteriorate in. appearance or efficacy during the pre-sale preparation and display, comprise the composition of the present invention.
Recent developments in nutritional research suggest that nutritional supplementation with specific formulations including acids, vitamins and minerals, as an adjunct to proper diet, exercise and medical care, can aid in delaying, treating and/or alleviating the negative effects of ageing particularly in relation to skin, eye, heart, bone deterioration and some cancers. Eye deterioration in the form of cataracts, macular degeneration and glaucoma in one form or another affect all of our older people The loss of skin flexibility from middle age onwards is equally pervasive and global warming problems with loss of the ozone layer and increasing ultra violet radiation exacerbates skin dryness and skin cancer formation. 2 545751 Heart disease is the number one killer in most developed countries and various tablets are prescribed to lower blood pressure and minimise platelet formation in arteries susceptible to blockage. Problems with joint cartilage increase with age, resulting in osteoarthritis and diminishing bone mineral density leads to osteoporosis. There are supplements in pill or powder form supported by clinical trials for the alleviation of such age related deterioration.
Increasing concerns, especially for travellers, in respect to water quality have resulted in bottled water contained in lightweight plastic (generally PET) bottles with special drink dispenser stoppers which remove the need to transfer the drink to a glass or cup before consumption. Such are particularly fashionable with young people, as are derivatives such as the "sports" drink with added sugar for energy replenishment or similar stimulant. However there are no water based drinks of the type covered by this invention which provide the daily supplements appropriate to the mature and older people who are an increasing segment of world population.
Collagen is a major component of the human body. It comes in various types and is a popular injection for those of middle age wanting to retain wrinkle free skin, especially that on the face. Injections are not an appealing form of intake and many. find the thought of injections of collagen every few months either frightening or distasteful. Some collagens are soluble in water and a water drink with a collagen supplement is a much more appealing method of administration of this essential material than injections or even applications of uncertain efficacy as a skin cream. The present invention contains collagen as such is an appealing component in a health drink for those whose age brings with it a loss of skin tone.
The prime embodiment of the invention includes in the water drink, soluble collagen hydrolysate which is generally offered by manufacturers as a white odourless powder that is readily soluble in hot or warm water and is manufactured from a variety of substrates but the preferred basis is bovine or fish collagen, as such are supported by data in relation to shark and bovine cartilage products by scientists over the past century such as Dr Pruden in New York who initially supported the shark and the starfish as the only two examples of creatures that had not changed over thousands of years, with such being indicative of a strong immune system, however his philosophy 3 545751 changed in the later part of his life, so as to instead support the human use of bovine cartilage as being more related to mammals and human nutritional requirements.

The majority of studies have examined intra-articular injections of HA, but as it is a component of collagen in the body, it becomes an interactive agent with collagen hydrolysate when ingested in liquid form. The recommended daily intake is 50% collagen hydrolysate and 50% HA, but without limiting the percentages, weights or volumes, 10 grammes of each is a recommended amount in the preferred embodiment of this invention Low dose aspirin (Acetylsalicylic Acid) is recommended almost without exception, by cardiologists as an anti inflammatory and platelet prevention agent. Soluble aspirin is included in embodiments of the invention. Nonsteroidal Anti-inflammatory Drugs (NSAIDs) are chemically heterogeneous large groups of drugs which suppress inflammation in a manner similar to steroids, but with less side effects of sedation, respiratory depression, or addiction than steroids. They are widely used for the treatment of inflammatory disorders and painful conditions such as rheumatoid arthritis, gout, bursitis, painful menstruation, and headache. They are effective in the relief of pain and fever. The most prominent NSAID is aspirin.
Collagen-induced human platelet aggregation and adhesion to collagen under static conditions is referenced in recent medical research journals. A recent paper of Cabeza et al of the University of Munchen Germany confirms collagen, the major extracellular matrix protein in atherosclerotic tissue that induces platelet activation, particularly in Type 2 Diabetes cases, contributes significantly to thromboischemic complications, and platelet antagonists such as naphthoquinone, triterpenes, dipyridamole, and clopidogrel have been suggested by various researchers. Further joint enhancers with a proven record and appropriate for daily intake by older people, are glucosamine hydrochloride and condroitin sulphate, as such assist flexibility and joint health particularly as relates to osteoarthritis. Some or all of these are included in various amounts in some embodiments of this invention, additional to the three basic interactive ingredients listed above.
Cholecalciferol (Vitamin D3) is included in one embodiment of the invention due to its use in improving bone mineral density and preventing osteoporosis. It is soluble in organic solvents such as ethyl alcohol so a minor amount of the solvent must be included in the drink, when Cholecalciferol is included as the calcium ingredient. As an alternative to avoid use of alcohol as the solvent necessary to include a calcium ingredient, a water soluble calcium supplement is calcium ascorbate which is a preferred embodiment in some examples of the invention. Calcium Ascorbate is a natural form of Vitamin C, which is much more readily absorbed in the blood stream than the other forms of calcium. Importantly, calcium is coupled with Vitamin C to deliver the benefits of both calcium & Vitamin C. Calcium ascorbate is not only recommended for athletes and the elderly but also for those who wish to strengthen their muscle and bones. Calcium ascorbate is an immune booster and aids in fighting bacterial infections. It is a strong antioxidant destroying free radicals in the body. Minerals such as selenium, magnesium and zinc have been confirmed as preventive of cancers such as colon and prostate cancer and such are included in some embodiments of the invention.
Magnesium's importance to the health of a large number of biological systems is receiving ever-increasing support. Magnesium has an essential part in hundreds of biochemical roles, and depending upon the biological systems in the body that is involved, it may perform its function via different mechanisms. Magnesium's place in the area of platelet aggregation appears to be crucial to the control or palliation of a number of important health problems. The hyperactivity of platelets that results in their aggregation and the subsequent release of potent vasoconstrictors may be at the base of problems, such as migraine headaches and vascular diseases associated with diabetes, strokes and various cardiovascular diseases. Recent research indicates magnesium deficiency may be a factor in the development of atherosclerosis and coronary artery disease- the major cause of heart attacks. Several clinical studies indicate that maintenance of adequate red blood cell magnesium levels may be key in fighting these health problems. Magnesium compliments aspirin antiplatelet activity.
Magnesium citrate dissolves in water and the presence of citric acid gives a water based drink inclusive of such a supplement, a pleasant citrus flavour. An alternative magnesium derivative is Magnesium ascorbate, and such is an additional embodiment of the invention. Soluble zinc in the form of Zinc monomethionine is also present in some embodiments of the invention. In zinc monomethionine, zinc is organically bound to a sulphur containing essential amino acid- Methionine. This provides a soluble, readily absorbable and easily retained source of Zinc. Methionine has free radical scavenging activity by virtue of its sulphur atom, as well as its chelating ability. This anti-oxidant activity appears to account for its anti hepatotoxic activity. Zinc monomethionine supplementation significantly increases plasma zinc levels without affecting plasma copper levels. This is important since high levels of zinc often reduce copper absorption. It helps to strengthen immunity, enhances growth and has a major role in several basic cellular functions that are vital to the activities of immunological mediators. This makes LSM not only safer, but more bioavailable than other dry "blend" selenium and methionine products. Organically bound selenium has garnered heavy media attention as a pivotal component in the body's detoxifying system and for its role in the prevention of disease. LSM administered in the form of Selenomethionihe containing yeast was found to be effective in reducing the risk of cancer in a significant study. LSM is the preferred form of selenium supplementation due to its inherent safety and its scientific recognition as the most bioavailable form of selenium. Selenium plays multiple roles in the growth and functioning of living cells in higher animals and human. This element is unevenly distributed in the earth's crust. The primary nutritional sources is the soil form which it is absorbed by plants and enters the food chain. Geographical variations in the selenium status of populations therefore exist, necessitating selenium supplementation. The recommended levels for selenium supplementation in humans are 50-200 meg/day. 7 545751 In another embodiment, the compositions of the present invention may comprise pharmaceutically acceptable processing agents and carriers, such as one or more of binders, diluents, lubricants, colorants, emulsifiers, disintegrants, starches, alcohols, preservatives, vitamins (especially those soluble in water and containing nitrogen, such as; Thiamin (Bl); Riboflavin (B2); Niacin; Pyridoxine (B6); Pantothenic Acid; Folic Acid; Biotin; Choline; Cobalimin (B12)) solubilized fatty acids and proteins.
The present invention, may include sweetening agents such as one or more of sucrose, fructose, dextrose, saccharin, maltodextrin, aspartame, chocolate, and mixtures thereof.
In another embodiment of the invention, the compositions may comprise flavourants such as one or more of the oils of anise , cinnamon , peppermint, nutmeg, almond, lemon, orange, lime, grapefruit, grape seed, and fruit essences such as apple, strawberry, raspberry, apricot, and kiwifruit, mixed berry flavour, vanilla, menthol, and acidulents such as citric and other organic acids It is estimated that 50% of the population has problems swallowing whole tablets. These problems can lead to poor compliance, or even noncompliance, with dosing regimens and thus have a negative impact on prevention treatment efficiency. Administration of health supplements in a water based drink, and in quantities in the one bottle that cover a recommended daily dose of each nutrient solves this problem of throat irritation or forgetfulness. as the water necessary for daily wellbeing is also provided in a convenient, hygienic bottle.
The size of bottle that contains the appropriate level of supplements for each day, either individually or in the aggregate, will be easily portable and of similar size to the bottles used for bottled water marketed widely in sizes approximating 750ml or 1 litre. Larger sizes suitable for providing supplements as recommended by clinicians for longer periods may also be used in embodiments of the invention intended for use on long trips or where daily access to smaller bottles is impractical or unavailable. 8

Claims (14)

545751 One preferred form of the invention will now be described, in relation to 750ml of hot water (approximating 80degrees Celsius) of good quality to which is added lOgrammes of collagen hydrolysate powder and a similar quantity of hyaluronic acid powder is dissolved by agitation or stirring. The result is a clear liquid with a water appearance and neutral taste. To this composition 75mg of water soluble aspirin is added to provide a low dose aspirin content appropriate for a daily serving. Additional nutrients added to the above 750ml of water may be all or some of the following where the Nutrition Board of the National Academy of Sciences has recommended the following daily intake allowances: Calcium ascorbate 300mg, Zinc monomethionine 50mg, Magnesium ascorbate 400mg, Potassium aspartate 2000mg, L-selenomethionine lOOmcg, Folic Acid 300mcg, Bottling of the drink at a pasteurising temperature approximating 80 degrees Celsius is desirable to ensure good shelf life free from degrading pathogens. When the bottle of water plus nutrients is not drunk in the course of a day, it should be kept refrigerated after opening and consumed within a few days so as to maintain taste and efficacy. 9 545751 WHAT I CLAIM IS:-

5. A water drink in a portable format as in any one of claims 1 to 4 inclusive where the nutritional ingredients further comprise water soluble potassium aspartate.
6. A water drink in a portable format as in any one of claims 1 to 5 inclusive where the nutritional ingredients further comprise water soluble L-selenomethionine.
7. A water drink in a portable format as in any one of claims 1 to 6 inclusive where the nutritional ingredients further comprise water soluble alpha lipoic acid or dihydro lipoic acid or a lipoic acid derivative or a mixture of two or more thereof. 10 545751

10. A water drink in a portable format as in any one of claims 1 to 9 inclusive where the nutritional ingredients further comprise alpha tocopheryl phosphate.

A water drink in a portable format as in any one of claims 1 to 10 inclusive where the nutritional ingredients further comprise all or any of the following vitamins soluble in water and containing nitrogen, namely; Thiamin (Bl); Riboflavin (B2); Niacin; Pyridoxine (B6); Pantothenic Acid; Folic Acid; Biotin; Choline; Cobalimin (B12)) or a mixture of the same.
12. A water drink in a portable format as in any one of claims 1 to 11 inclusive where the nutritional ingredients further comprise water soluble hyaluronic acid sodium.
13. A water drink as in any one of claims 1 to 12 inclusive where the nutritional ingredients further comprise resveratrol that has been dissolved in alcohol or similar solvent and where the portable liquid format referred to in claim 1 is a dark bottle or can to prevent oxidation of the resveratrol by ingress of ultra violet light.
