音楽データの著作権の保護の方式として、SCMS(Serial Copy ManagementSystem) やCGMS(Copy Generation Management System) が知られている。SCMSは、CD(Compact Disc)、MD(Mini Disc) において採用されているもので、1世代目のコピーは認め、2世代目のコピー(孫コピー)は禁止されるものである。CGMSでは、コピー禁止か、またはコピーが何世代目まで可能かのような世代制限を行なうものである。これらのコピー制限を実現するために、SCMSビット、CGMSビットがコンテンツデータと別に用意されている。これらを総称して、SCMS/CGMSビットと表す。コピーが行なわれる時には、SCMS/CGMSビットで示される世代情報が1世代進められるようになされる。

【発明が解決しようとする課題】
オリジナルとコピーを区別することによって、コピー制限をより確実とすることが可能となり、また、オリジナルの所有者に対して特典を与え、それによってオリジナルの価値をより高めることが可能となる。従来のコピー制限の方法は、オリジナルとコピーを確実に区別することができなかった。すなわち、コピーに際して、記録装置がSCMS/CGMSビットの表す世代情報を必ず書き換える前提の下では、SCMS/CGMSビットに基づいて、コンテンツがオリジナルかコピーかを判別することができる。しかしながら、記録装置がSCMS/CGMSビットを更新しない場合には、判別が正しくなされない。

また、コンテンツがメインチャンネル上で伝送され、SCMS/CGMSビットがサブチャンネル上で伝送されることがある。このように、コンテンツとSCMS/CGMSビットとが別チャンネルで伝送されると、例えばパーソナルコンピュータ上は、メインチャンネルしか取り扱わないので、オリジナルかコピーかを表す情報は、失われてしまう。パーソナルコンピュータによる処理後のコンテンツが記録されたCD−R(CD-Recordable) と音楽ソフトとして販売されているCDとが区別できない。

上述した課題を解決するために、請求項1の発明は、コンテンツデータがオリジナルであるか、コピーであるかを示す識別データが付随されたコンテンツデータが伝送され、伝送されたコンテンツデータを再生するデータ再生装置であって、コンテンツデータに付随された識別データを分離する識別データ分離手段と、分離された識別データからコンテンツデータがオリジナルであるか、コピーであるかを判別する識別データ判別手段とを有し、分離されたコンテンツデータを再生部へ供給し、判別結果に応じて、コンテンツデータがオリジナルであると判別したときには、付加的なサービスを提供し、コンテンツデータがコピーであると判別したときには、付加的なサービスとは異なるサービスを提供すると共に、コピーが不可能である旨のメッセージを表示するデータ再生装置である。

以下、この発明の一実施形態について説明する。図1は、この発明の一実施形態の概念を説明するものである。音楽データ、画像データ等のコンテンツ1Aに対して、コンテンツ1Aに関連するデータが挿入されるコンテンツヘッダ2Aが付加される。コンテンツヘッダ2A内にオリジナルマーク3(図面中では、*で表す)が含まれている。オリジナルマーク3は、例えば予め決められたビットパターンのディジタルデータである。オリジナルマーク3のコピーは、一切禁止される。すなわち、ディジタル出力およびアナログ出力の何れの形態でも出力されない。

したがって、コピー後のコンテンツ1Bのコンテンツヘッダ2Bには、オリジナルマーク3が含まれていない。他の例として、コンテンツヘッダ自体のコピーを禁止することによって、オリジナルマーク3のコピーを禁止してもよい。さらに、オリジナルマーク3を所定のビットパターンを有するコピーマーク(図ではドットで示す)4に変更することによって、実質的にコピーマーク3のコピーを禁止しても良い。

図5は、この発明を記録媒体例えば再生専用の光ディスクに対して適用した場合の記録装置(カッティング装置)の基本的構成を示す。オリジナルなコンテンツを光ディスクに記録して提供する時に、オリジナルマークと光ディスクとの間が密接な関係を持つことが好ましい。マスタリング装置では、ガスレーザや半導体レーザから出射されたレーザ光が光変調器で変調され、感光物質であるフォトレジストが塗布されたディスク状のガラス原盤44に対して光ピックアップによって照射される。それによって、データが記録される。ガラス原盤44は、トラッキング、フォーカス、スピンドル等のサーボで制御される。

以上の説明から明らかなように、この発明によれば、コピー禁止とされたオリジナルマークがコンテンツに付随して伝送されるので、オリジナルとコピーの識別を確実に行なうことができる。また、コンテンツの権利者は、オリジナルの所有者に対してのみに特典を与えるようなサービスを行なうことができる。それによって、オリジナルを購入することがより魅力的となり、オリジナルの販売を拡大することができる。さらに、オリジナルマークとオリジナルの提供媒体とを密接に関係させることによって、オリジナルマークのセキュリティを向上できる。すなわち、オリジナルの提供媒体でない所にあるオリジナルマークは、偽物と判定することができる。
