本願発明は、インターネット等の通信ネットワークを通じてコンテンツを端末に配信して販売するためのコンテンツ販売システム等に関する。

【従来の技術】
近年のインターネットに代表される通信ネットワークの発達により、電子記録媒体を介さずに、サーバから利用者の端末に直接コンテンツをダウンロードさせるシステムが普及している。そして、かかるシステムにおいては、コンテンツのダウンロードに対する対価の課金・決済のための処理もインターネット上で行われる。従来、かかるコンテンツの対価の課金・決済のための処理からコンテンツのダウンロードまでを行うシステムとして、「カタログサイトでユーザにコンテンツを選択させ、ダウンロードサイトからダウンロードさせてユーザにコンテンツを配信し、ダウンロードが成功した場合にのみ課金サイトがユーザに対して課金処理を行うコンテンツ配信の課金システム」が存在した。（特許文献１を参照）。

【発明が解決しようとする課題】
しかし、当該特許文献１（特開２００１−１９５４８２）で示される従来のシステムでは、ユーザが最初にアクセスするポータルサーバ（カタログサイト）に、ダウンロードの対象となるコンテンツのサンプル等を蓄積する必要がある。

ポータルサーバが魅力あるものであるためには、多くのコンテンツサンプル又はコンテンツをポータルサーバに蓄積する必要がある。しかし、多くのコンテンツサンプル等を蓄積するとポータルサーバの負荷が増大し、ポータルサーバの運営・管理が容易でなくなる。一方、コンテンツサンプル等の数を少なくすればポータルサーバの魅力は低下する。

かかる問題を解決するために、端末が直接コンテンツ提供サーバにアクセスするようにすることが考えられる。かかる従来例として「ネットワークで複数の販売者コンピュータと通信する複数の購入者コンピュータを用いてユーザが製品を取引できるネットワーク販売システム」が存在する（特許文献２を参照）。この従来例では、決済のための処理を行う決済サーバの役割を有する販売者コンピュータ若しくは支払者コンピュータに、利用者の金融機関に関する情報等を含む情報（ペイメントオーダ）をその都度送信する必要がある。かかる仕組みでは、決済のための処理が煩雑であり通信費等の費用が発生する。

そこで、本願発明はかかる問題点に鑑み、ユーザの端末が最初にアクセスするポータルサーバ（カタログサイト）を魅力あるものにしつつ、その運営・管理を容易にするシステムの提供を目的とする。また、コンテンツ提供サーバ（ダウンロードサーバ）からユーザの端末へのコンテンツのダウンロードに対する対価の決済のための処理を行う仕組みを安価で構築できるシステムの提供を目的とする。さらに、ユーザ（コンテンツ利用者）の情報をポータルサーバで確保することができるシステムの提供を目的とする。

【課題を解決するための手段】
かかる課題を解決するために、本願発明は、ポータルサーバと一又は二以上のコンテンツ提供サーバと、決済サーバと、コンテンツ利用者が前記コンテンツ提供サーバからコンテンツを取得するための端末とからなるコンテンツ販売システムを利用する。端末はポータルサーバにアクセスし、誘導情報を受信する。「誘導情報」とは、コンテンツを提供するコンテンツ提供サーバにコンテンツ利用者を誘導するための情報である。端末は、当該誘導情報に基づいてコンテンツサンプルを蓄積するコンテンツ提供サーバにアクセスすることで、コンテンツのサンプルの閲覧が可能となる。さらに、端末は、閲覧したコンテンツサンプルで示されるコンテンツの選択を示す情報であるコンテンツ選択情報を送信する。コンテンツ提供サーバは端末から送信されたコンテンツ選択情報を受付るする。決済サーバは、当該コンテンツ選択情報を送信した端末がコンテンツをダウンロードする権原を有しているか否かを判断する。そして、端末に権原があると判断した場合に、当該コンテンツ選択情報で示されるコンテンツを利用者が取得することに対する対価の決済のための処理を行う。決済のための処理が完了した場合に、コンテンツ提供サーバは当該コンテンツ選択情報で特定されるコンテンツを端末に対して送信する。

また、請求項２に示すように、本願発明のコンテンツ販売システムは、コンテンツ販売システムを構成するポータルサーバがコンテンツ利用者の金融機関に関する情報である利用者金融機関情報を蓄積する。そして、決済サーバが当該利用者金融機関情報に基づいてコンテンツを利用者が取得することに対する対価の決済ための処理を行う。従来例では決済サーバは単一のサーバであるが、本願発明のコンテンツ販売システムでは決済サーバは複数のサーバで構成されていてもよい。これにより、コンテンツ提供サーバが従来から運営・管理している決済サーバを本願発明のコンテンツ販売システムに利用することも可能となる。この場合、コンテンツ提供サーバの側では新たに別個の決済サーバを設けて決済のための処理を行う仕組みを構築しなくてもよい。また、ポータルサーバに利用者金融機関情報を蓄積することで、ポータルサーバにおいて、顧客たるコンテンツ利用者の囲い込みを行うことができる。

まず、ポータルサーバ２００について説明する。

「ポータルサーバ２００」は、誘導情報送信部２０１を有する。

「誘導情報送信部２０１」は、前記コンテンツ利用者を前記コンテンツ提供サーバに誘導するための情報である誘導情報を送信する。

「誘導情報」とは、上述のとおり、コンテンツ利用者を前記コンテンツ提供サーバ２２０に誘導するための情報であり、テキスト、画像等で構成される。具体的には、誘導されるコンテンツ提供サーバで取得できるコンテンツの種類、内容、数、料金等に関する情報、また、当該コンテンツ提供サーバのＵＲＬに関する情報等が含まれる場合がある。つまり、誘導情報は、コンテンツ提供サーバの宣伝広告としての役割を果たすことを特徴とする。

誘導情報の具体例としては、例えば、ミニシアター（単館系の映画館）で上映された映画の、監督や俳優、国等に関するテキスト情報を映像を交えてダイジェストとしたものが該当する。ミニシアターの作品は一般的に取っ付きにくいと言われている。その理由として最も多く挙げられるのは、その情報量の少なさが挙げられる。大きな配給会社から配給されるロードショー作品が、テレビコマーシャルや新聞・雑誌広告などで大々的に宣伝され、メディアに取り上げられることも多いのに対して、小さな配給会社が配給することが多い単館系映画の宣伝の主力は、各劇場のロビーに置かれているチラシ等でありメディアに取り上げられることも少ない。しかし、一つ一つの映画の宣伝にあまり予算をかけられない小さな配給会社から配給される映画であっても、その特徴をダイジェストとして簡単に閲覧できるようにすれば少ない予算でも効果的な宣伝広告が可能となる。

また、一のコンテンツ提供サーバについては、一の誘導情報があればよい。一方、コンテンツサンプルは、コンテンツ提供サーバで提供するコンテンツの数の分だけ必要となる場合がある。従って、ポータルサーバでは、コンテンツサンプルを管理するよりも誘導情報を管理する方が管理する情報の数が少なくて済むことから管理が容易となる。これにより、ポータルサーバに魅力を持たせつつその運営管理が容易となる。

上述のとおり、端末は誘導情報を受信するためにポータルサーバにアクセスするが、かかるアクセスのみではポータルサーバは当該端末の情報（端末を識別するＩＤ、端末がアクセスしたサイトの履歴等）しか取得できない場合がある。そこで、利用者金融機関情報の登録をポータルサーバで行うように構成することで、当該利用者金融機関情報に含まれる利用者の利用する銀行口座の口座番号等の情報を取得してコンテンツ提供サーバの顧客でもあるコンテンツ利用者の囲い込みをポータルサーバで行うことができる。

「コンテンツサンプル」とは、コンテンツを構成する当該コンテンツの一部、若しくは、コンテンツの概要を示すコンテンツに関する情報をいう。例えば、コンテンツが映画コンテンツである場合、コンテンツサンプルには当該コンテンツを構成する一部の映像、又は、ダイジェストとして編集した映像等が該当する。「端末で閲覧可能とする」とは、前記コンテンツサンプルを、電気通信回線を通じて接続された前記端末に受信可能に送信し、又は、ストリーミング再生可能なデータとして送信すること等をいう。また、「コンテンツ」、「コンテンツサンプル」には、映像、画像、音、文字、コンピュータプログラム等が含まれる。コンテンツサンプルの具体例としては、映画のコンテンツであれば当該映画のダイジェスト、音楽のコンテンツであればその音楽のさわりの部分またはさびの部分、プログラムのコンテンツであれば当該プログラムの機能を制限したもの等が該当する。

ポータルサーバの魅力を増すためには、ポータルサーバで多くの誘導情報を蓄積し、当該誘導情報で誘導されるコンテンツ提供サーバが多く存在することに加えて、当該コンテンツ提供サーバのコンテンツが充実している必要がある。　コンテンツ提供サーバで、コンテンツサンプルを閲覧できなく、コンテンツのプロパティー（「映画」、「音楽」等コンテンツの属するジャンル、コンテンツのデータのサイズ等）のみを閲覧可能とした場合は、ダウンロードを希望するコンテンツをコンテンツ利用者が直感的に選択することができない。従って、コンテンツサンプルを閲覧できないコンテンツ提供サーバでは、映像等当該コンテンツの内容を分かりやすく示す情報を基に、コンテンツ利用者がコンテンツを選択することができず、コンテンツ利用者にとっては魅力が少ないものとなり、ポータルサーバの魅力も低下する。

「コンテンツ送信部２２５」は、前記コンテンツ送信指示情報受信部で受信した前記コンテンツ送信指示情報に基づいてコンテンツを前記端末に送信する。送信のデータ形式は特に問わない。送信は、例えば、前記端末で解読可能に暗号化して行われるもの、また処理や通信などの負担を軽減するために圧縮したものを送信することで行われるものであってもよい。また、コンテンツを暗号化して送信する場合は、復号化のための解読鍵を端末がポータルサーバから受信するように構成してもよい。このように構成することで、ポータルサーバで情報を集中化することができる。

「権原判断部２１１」は、前記コンテンツ選択情報を送信した端末がコンテンツをダウンロードする権原を有しているか否かを判断する。権原を有している否かを判断する構成の一例として、前記コンテンツ選択情報で示される端末が、前記ポータルサーバに予め登録された情報で示される端末と一致するか否かを判断することにより行うことが考えられる。

かかる権原の判断には、利用者権原判断、端末権原等判断がある。利用者権原判断では、コンテンツをダウンロードする端末を利用する利用者が端末にコンテンツをダウンロードする権原を有するか否かを、当該利用者に割り当てられたＩＤ、パスワード、当該利用者の名前、生年月日、住所、電話番号等の個人情報に基づいて判断する。また、端末権原判断では、端末や通信回線の識別ＩＤ等、当該端末と一意に関連付けられた情報等に基づいて、当該端末がコンテンツをダウンロードする権原を有するか否かを判断する。例えば、事前にコンテンツをダウンロードすることができるコンテンツ利用者、端末として、前記ポータルサーバ、コンテンツ提供サーバのいずれか一方又は双方で登録を受けている場合に、端末が権原を有すると判断されるように構成することができる。しかし、権原の判断はかかる態様に限定されず、端末にコンテンツの不正利用防止機能、不正コピー防止機能等が備えられているか否かを判断し、かかる機能を有すると判断された場合に、コンテンツをダウンロードする権原を有すると判断する場合等を含む。

「決済処理部２１２」は、前記コンテンツ選択情報で示されるコンテンツを利用者が取得することに対する対価の決済のための処理を行う。「コンテンツを利用者が取得することに対する対価」は、予めコンテンツごとに定められていてもよく、また、ダウンロードするコンテンツの種類、データ量に応じて定めされるものであってもよい。決済処理は、通常、金融機関内、または金融機関間で行われる。しかし、本実施形態の決済サーバの決済処理部で行われる決済のための処理は、この決済処理を意味するものではなく、その前段階の処理を意味する。具体的には、「決済のための処理」には「銀行・クレジット決済のための処理」、「プリペイド型決済のための処理」、「プロバイダ代行徴収型決済のための処理」等が含まれる。「銀行・クレジット決済のための処理」は、例えば、ポータルサーバに予め登録された前記コンテンツ利用者の利用する金融機関に関する情報に基づいて、銀行振替依頼又はクレジットカードによる決済依頼をすることにより行われる。前記利用者の利用する金融機関に関する情報には、利用者の銀行口座番号、クレジットカード番号、デビットカード番号等が含まれる。「プリペイド型決済のための処理」は、例えば、決済サーバ側の提携のコンビニエンスストア等で購入したプリペイドカードに記載された番号を予めポータルサーバに登録し、その番号に基づいてコンテンツを利用者が取得することに対する対価に相当するカードの度数を減じることにより行われる。「プロバイダ代行徴収型決済のための処理」は、前記端末の利用者の契約しているプロバイダのインターネット接続料にコンテンツの対価を加算すること等により行われる。

決済処理部２１２におけるコンテンツの対価の決済のための処理は、前記ポータルサーバ２００、前記コンテンツ提供サーバ２２０、前記端末２３０のいずれかの指示に基づいて行われる。ポータルサーバ又はコンテンツ提供サーバの指示に基づいて当該処理が行われる場合は、端末が直接決済サーバにアクセスしないことから、端末から決済サーバに対する不正が行われ難くなり、決済サーバのセキュリティーが向上する。これは、端末側からは、決済サーバのインターネットアドレスを容易に知ることができないからである。

図４は本実施形態の具体例の一例を示す図である。同図を用いて本実施形態の具体例について説明する。

まず、端末４３０はポータルサーバ４００にアクセスし、コンテンツ提供サーバ４２０ＸのＵＲＬを含む誘導情報を受信した。端末４３０は、受信した誘導情報に含まれるＵＲＬに基づいてコンテンツ提供サーバ４２０Ｘにアクセスした。さらに、様々なコンテンツ（コンテンツＡ、コンテンツＢ）のコンテンツサンプルの閲覧が可能であるサンプル閲覧部４２２Ｘで、コンテンツＡのコンテンツサンプルであるコンテンツサンプルＡを閲覧した。コンテンツサンプルはそれぞれのコンテンツ提供サーバ（コンテンツ提供サーバＸ，Ｙ）で閲覧可能となっているため、端末にコンテンツサンプルを閲覧可能とするための負荷は各コンテンツ提供サーバに分散される。従って、ポータルサーバの負荷は軽減される。そして、ダウンロードを希望するコンテンツＡの選択を示す情報であるコンテンツ選択情報をコンテンツ提供サーバ４２０Ｘに送信した。コンテンツ選択情報には、端末４３０の利用者の名前「日本　太郎」、当該利用者の電話番号「０３−１１１１−２２２×」等利用者の個人情報が含まれていた。コンテンツ提供サーバ４２０Ｘのコンテンツ選択受付部４２３Ｘでは、当該コンテンツ選択情報を受付けた。そして、決済サーバ４１０は、このコンテンツ選択情報を送信した端末４３０がコンテンツをダウンロードする権原を有するか否かを判断し、前記利用者の名前「日本　太郎」、当該利用者の電話番号「０３−１１１１−２２２×」が予め登録された情報と合致していたので、権原があると判断した。
