本発明は、飼主がペットのために残した財産をペットのために用いられるようにするという内容の遺言またはこれに類する契約を執行または履行するペット遺言執行方法およびそのシステム、遺言執行サーバ、並びにプログラムに係り、飼主が死亡した場合には、ペット専用口座に預けられている財産が飼主から財産管理人に移転され、かつ、財産管理人は、ペットの新飼主がペットを飼養するために必要な飼養費を財産から新飼主に対して支出する義務を負う旨を定めた遺言またはこれに類する契約を執行または履行する際に利用できる。

【背景技術】
従来より、自分の飼っているペットに遺産を残すことを希望する飼主は多い。ところで、ある地区の行政書士に対する相談件数の第一位は相続、遺言であり、また、近年、ペットを飼う者が増えてきている。このため、ペットへの遺産の相続に関する相談も増えてくるものと考えられる。

【発明が解決しようとする課題】
しかしながら、現行法上、動物は物として扱われているため、相続権は存在せず、飼主の希望があったとしても、ペットに遺産を残すことはできないという問題があった。従って、実質的に飼主がペットに遺産を残すことができるようなシステムの開発が望まれるところである。

本発明の目的は、飼主がペットに遺産を残すことができるペット遺言執行方法およびそのシステム、遺言執行サーバ、並びにプログラムを提供するところにある。

【課題を解決するための手段】
本発明は、飼主がペットのために残した財産をペットのために用いられるようにするという内容の遺言またはこれに類する契約を執行または履行するペット遺言執行方法であって、ペットのために用いられる財産を預けるペット専用口座を金融機関に設けるとともに、遺言または契約により、飼主が死亡した場合には、ペット専用口座に預けられている財産が飼主から財産管理人に移転され、かつ、財産管理人は、ペットの新飼主がペットを飼養するために必要な飼養費を前記財産から新飼主に対して支出する義務を負う旨を定めておき、さらに、遺言の執行または契約の履行に必要なデータを管理する遺言執行サーバに接続された個体識別情報データベースにペットの個体識別情報を記憶させておき、飼主の死亡後に新飼主がペット関連施設にペットを連れて行ってこのペット関連施設でペットの飼養に必要な商品を購入し、または役務の提供を受ける際には、ペット関連施設に設けられたペット関連施設端末装置に接続された個体識別情報入力手段により、ペット関連施設に連れて来られたペットの個体識別情報を入力した後、この入力した個体識別情報、並びに商品購入または役務提供に係る金額を含む購買情報を、ペット関連施設端末装置からネットワークを介して遺言執行サーバに送信し、続いて、遺言執行サーバの認証手段により、個体識別情報データベースに予め記憶されているペットの個体識別情報と、ペット関連施設端末装置から送信されてくるペット関連施設に連れて来られたペットの個体識別情報とを比較し、ペット関連施設に連れて来られたペットが遺言の執行対象または契約の履行対象となるペットであるか否かを判断し、ペット関連施設に連れて来られたペットが遺言の執行対象または契約の履行対象となるペットであると判断された場合にのみ、商品購入または役務提供に係る金額を財産管理人名義のペット専用口座からペット関連施設名義の口座へ引き落とすための引落要求信号をネットワークを介して金融機関の口座管理システムに送信することを特徴とするものである。

ここで、「財産管理人」は、法人であってもよく、個人であってもよいが、不正の未然防止や透明性の確保等の観点から、高い信用力のある団体、例えば愛犬協会等の公益法人などであることが好ましい。また、「財産管理人」は、「遺言執行サーバ」を運用・管理・維持する遺言執行補助者と一致していてもよい。

そして、「ペット関連施設名義の口座」とは、口座に預けられた預金を実質的にペット関連施設が受け取れるようになっていればよい趣旨であり、例えば、形式的な名義がペット関連施設の上位団体、下位団体、親会社、子会社、関連会社、フランチャイザー、フランチャイジー、親戚等になっていてもよい。「財産管理人名義のペット専用口座」および後述する「新飼主名義の口座」についても同様であり、実質的に財産管理人や新飼主が受け取れるようになっていればよい。

また、「金融機関」とは、必ずしも銀行や証券会社等である必要はなく、例えば、郵便局や電子プリペイド管理センター等も含まれ、「口座」とは、銀行、証券会社、郵便局等の口座だけではなく、例えば、電子プリペイド管理センターの管理する電子財布等であってもよい。

さらに、「ペット関連施設」とは、「商品」を取り扱う施設として、例えば、ペットフードやペット用品等を販売するペットショップ、あるいは「役務」を提供する施設として、例えば、獣医がペットの診断や治療を行うペットの病院、ペットへの予防注射を行う保健所、ペットの入浴や散髪等の手入れを行うペットヘルスセンター等である。

そして、「ネットワーク」には、例えば、ローカル・エリア・ネットワーク（ＬＡＮ）、メトロポリタン・エリア・ネットワーク（ＭＡＮ）、ワイド・エリア・ネットワーク（ＷＡＮ）、インターネット、イントラネット、エクストラネット、あるいはこれらの組合せ等、様々な形態のものが含まれ、有線であるか無線であるか、さらには有線および無線の混在型であるかは問わず、要するに、複数地点（距離の長短は問わない。）間で、ある程度の速度をもって情報を伝送することができるものであればよい。他の発明においても同様である。

また、「個体識別情報」とは、ペットの身体的特徴を示すデータであり、そのペットが本来的に有しているそのペットに固有のデータである。従って、ペットに対して人為的に付与された英数字の組合せ等による識別番号は、本発明における「個体識別情報」には含まれない。但し、インプラントチップデータは、インプラントチップがペットの体内に埋め込まれており、不正交換等が困難であるため、ペットの身体的特徴を示すデータとして捉えて本発明における「個体識別情報」に含まれるものとする。なお、人為的に付与された英数字の組合せ等による識別番号は、身体的特徴を示すデータと併用して認証処理に用いるのであれば、使用してもよい。

「個体識別情報」としては、例えば、虹彩データ、肉球データ、鼻紋データ、声紋データ、顔型データ、ＤＮＡデータ、インプラントチップデータ、血液データ、歯形または嘴形データ、臭い成分データ、唾液データ、毛色若しくは毛質を含む体毛または羽データ、骨格データ、体液濃度データ、鱗データ、角データ、皮膚データ、ほくろデータ、耳あか成分データ、爪データ、耳の形状データ、排泄物データ、胃の内容物データ、舌データ、生体エネルギーデータ、生体電気データ、行動データ、あるいはこれらの組合せ等が挙げられる。

このような本発明のペット遺言執行方法においては、新飼主がペット関連施設で商品を購入し、または役務の提供を受けた場合に、その代金の支払いは、財産管理人名義のペット専用口座からペット関連施設名義の口座への預金の引き落としにより行われる。この際、預金の引き落としは、遺言執行サーバの認証手段により、個体識別情報に基づき、ペット関連施設に連れて来られたペットが、遺言の執行対象または契約の履行対象となる本物のペットであることが確認された場合にのみ実行される。

このため、遺言の執行対象または契約の履行対象となる本物のペットがいなければ、ペット関連施設へ支払う代金を財産管理人名義のペット専用口座から引き落とすことができないので、例えば、他のペットのために財産を使用する、あるいはペットを殺してしまって財産だけを受けとる等の不正行為を未然に防止することが可能となり、遺言の執行対象または契約の履行対象となるペットのためにのみ飼主の残した財産が使われるようになる。

また、飼主の残した財産は、新飼主に直接に移転されるのではなく、先ず、財産管理人に移転され、財産管理人から新飼主の行為に対して支出される形が採られているので、上述したような不正行為の防止効果がより一層確実に得られるようになるうえ、遺言執行のしくみに対する信用力がより一層高まる。

従って、財産が確実にペットのために使われ、かつ、財産が確実に相続されるようにし、さらに、ペットをわざと殺すというようなモラルリスクを排除するという三つの要請を満足させることが可能となり、これらにより前記目的が達成される。

また、前述したペット遺言執行方法において、飼主の死亡後に新飼主がペット関連施設にペットを連れて行かずに、新飼主の立替払いによりペット関連施設でペットの飼養に必要な商品を購入し、または役務の提供を受ける際には、新飼主からの支払いを受けたペット関連施設の従事者の操作により、商品購入または役務提供に係る金額を含む購買情報を、ペット関連施設端末装置から遺言執行サーバに送信した後、遺言執行サーバで受信した購買情報を、遺言執行サーバに接続された購買情報記憶手段に記憶しておき、その後、ペット関連施設以外の場所に設けられた新飼主の操作する新飼主端末装置により、購買情報記憶手段に記憶されている立替金回収の対象となる購買情報を指定し、かつ、新飼主端末装置に接続された個体識別情報入力手段によりペットの個体識別情報を入力した後、この入力した個体識別情報をネットワークを介して新飼主端末装置から遺言執行サーバに送信し、続いて、遺言執行サーバの認証手段により、個体識別情報データベースに予め記憶されているペットの個体識別情報と、新飼主端末装置から送信されてくるペット関連施設以外の場所にいるペットの個体識別情報とを比較し、ペット関連施設以外の場所にいるペットが遺言の執行対象または契約の履行対象となるペットであるか否かを判断し、ペット関連施設以外の場所にいるペットが遺言の執行対象または契約の履行対象となるペットであると判断された場合にのみ、購買情報記憶手段に記憶された購買情報に基づき、商品購入または役務提供に係る金額を財産管理人名義のペット専用口座から新飼主名義の口座へ引き落とすための引落要求信号をネットワークを介して金融機関の口座管理システムに送信するようにしてもよい。

ここで、「新飼主の立替払い」には、例えば、現金、小切手、クレジットカード等による支払いが含まれる。

このように新飼主端末装置から遺言執行サーバに個体識別情報を送信するようにした場合には、ペット関連施設で商品を購入し、または役務の提供を受けた後に、例えば自宅に帰る等、ペット関連施設以外の場所に移動し、そこにいるペットの個体識別情報を遺言執行サーバに送信することができるようになる。

このため、新飼主は、ペット関連施設にペットを連れて行かなくても、事後的に遺言執行サーバによる認証処理を経ることができ、ペット関連施設へ支払った代金を財産管理人名義のペット専用口座から引き落とすことが可能となる。この際、ペット関連施設は、その場で新飼主の立替払いにより商品販売または役務提供に対する対価を得ることができるので、ペット関連施設に損失が生じるおそれはなく、一方、新飼主は、事後的に遺言執行サーバによる認証処理を経れば、立替払いをした代金を回収することができるので、不正行為をしない限り新飼主に損失が生じるおそれはない。

さらに、本発明は、飼主がペットのために残した財産をペットのために用いられるようにするという内容の遺言またはこれに類する契約を執行または履行するペット遺言執行方法であって、ペットのために用いられる財産を預けるペット専用口座を金融機関に設けるとともに、遺言または契約により、飼主が死亡した場合には、ペット専用口座に預けられている財産が飼主から財産管理人に移転され、かつ、財産管理人は、ペットの新飼主がペットを飼養するために必要な飼養費を前記財産から新飼主に対して支出する義務を負う旨を定めておき、さらに、遺言の執行または契約の履行に必要なデータを管理する遺言執行サーバに接続された個体識別情報データベースにペットの個体識別情報を記憶させておき、飼主の死亡後に新飼主がペット関連施設からペットの飼養に必要な商品を購入し、または役務の提供を受けるための注文をネットワークを介して行う際には、新飼主の操作する新飼主端末装置により、ペット関連施設が運用するペット関連施設サーバまたは遺言執行サーバから提供された注文入力フォームを用いて注文入力を行うとともに、新飼主端末装置に接続された個体識別情報入力手段によりペットの個体識別情報を入力した後、この入力した個体識別情報、および注文入力に係る金額を含む注文情報を、新飼主端末装置からネットワークを介して遺言執行サーバに送信し、続いて、遺言執行サーバの認証手段により、個体識別情報データベースに予め記憶されているペットの個体識別情報と、新飼主端末装置から送信されてくるペットの個体識別情報とを比較し、注文入力時に入力した個体識別情報を有するペットが遺言の執行対象または契約の履行対象となるペットであるか否かを判断し、注文入力時に入力した個体識別情報を有するペットが遺言の執行対象または契約の履行対象となるペットであると判断された場合にのみ、注文入力に係る金額を財産管理人名義のペット専用口座からペット関連施設名義の口座へ引き落とすための引落要求信号をネットワークを介して金融機関の口座管理システムに送信することを特徴とするものである。

ここで、「ペット関連施設が運用するペット関連施設サーバまたは遺言執行サーバから提供された注文入力フォーム」とは、ネットワークを介してペット関連施設サーバまたは遺言執行サーバから新飼主端末装置にダウンロードしたものであってもよく、あるいは、ペット関連施設または遺言執行サーバを運用・管理・維持する遺言執行補助者により作成されたＣＤ−ＲＯＭ等の記録媒体から新飼主端末装置に入力したものであってもよい。

また、新飼主端末装置からネットワークを介して遺言執行サーバに送信される「個体識別情報」および「注文情報」は、新飼主端末装置から直接に遺言執行サーバに送信されてもよく、新飼主端末装置からペット関連施設サーバを経由して遺言執行サーバに送信されてもよい。

さらに、「注文情報」が新飼主端末装置から直接に遺言執行サーバに送信されるようにする場合には、遺言執行サーバからペット関連施設サーバに「注文情報」が転送されるようにしてもよく、あるいは新飼主端末装置から遺言執行サーバとペット関連施設サーバとに並行して「注文情報」が送信されるようにしてもよい。要するに、「注文情報」は、金融機関の口座管理システムへ引落要求信号を送信するにあたって注文入力に係る金額（引き落とす金額）を遺言執行サーバで把握している必要があるため、遺言執行サーバに送信されなければならず、また、ペット関連施設が商品の発送等をして注文を実行するにあたって注文内容をペット関連施設サーバで把握している必要があるため、ペット関連施設サーバに送信されなければならない。

このような本発明のペット遺言執行方法においては、新飼主がペット関連施設から商品を購入し、または役務の提供を受ける際には、新飼主端末装置からネットワークを介して注文を行う。そして、注文に係る代金の支払いは、財産管理人名義のペット専用口座からペット関連施設名義の口座への預金の引き落としにより行われる。この際、預金の引き落としは、遺言執行サーバの認証手段により、個体識別情報に基づき、注文入力時に入力した個体識別情報を有するペットが、遺言の執行対象または契約の履行対象となる本物のペットであることが確認された場合にのみ実行される。なお、ペット関連施設は、自己名義の口座への引き落としを確認してから注文を実行すればよく、このようにすればペット関連施設が損失を被るおそれはなくなる。

このため、遺言の執行対象または契約の履行対象となる本物のペットがいなければ、ペット関連施設へ支払う代金を財産管理人名義のペット専用口座から引き落とすことができないので、例えば、他のペットのために財産を使用する、あるいはペットを殺してしまって財産だけを受けとる等の不正行為を未然に防止することが可能となり、遺言の執行対象または契約の履行対象となるペットのためにのみ飼主の残した財産が使われるようになる。

また、前述したように「個体識別情報」には、各種の身体的特徴を示すデータを採用することができるが、特に、次のようにすることが好ましい。すなわち、以上に述べたペット遺言執行方法において、個体識別情報には、虹彩データ、肉球データ、鼻紋データ、声紋データ、顔型データのうちの少なくとも一つのデータが含まれることが好ましい。

ここで、「少なくとも一つ」であるから、複数種類のデータを組み合わせて認証処理に用いるようにしてもよい。

このように虹彩データ、肉球データ、鼻紋データ、声紋データ、顔型データを認証処理に用いるようにした場合には、これらのデータが、その場で直ぐに採取でき、かつ、通信に適した量のデータであるので、認証の確実性が得られることに加え、処理時間の短縮や利用者の利便性の向上も図られる。

さらに、以上に述べたペット遺言執行方法において、金融機関の口座管理システムに送信される引落要求信号は、遺言執行サーバの認証手段による判断結果に基づき遺言執行サーバの引落要求信号送信手段により自動的に送信されるようにすることが好ましい。

このように引落要求信号が遺言執行サーバの引落要求信号送信手段により自動送信されるようにした場合には、遺言執行サーバを運用・管理・維持する遺言執行補助者が遺言執行サーバの認証手段による判断結果を参照して手動で引落要求信号を送信する場合に比べ、遺言執行補助者の手間の軽減が図られるうえ、遺言執行サーバによる認証処理と金融機関の口座管理システムによる引落処理とのタイムラグを無くすことができるので、処理時間の短縮が図られる。

そして、以上に述べた本発明のペット遺言執行方法を実現するためのシステムとして、以下のような本発明のペット遺言執行システムを挙げることができる。

すなわち、本発明は、飼主がペットのために残した財産をペットのために用いられるようにするという内容の遺言またはこれに類する契約を執行または履行するペット遺言執行システムであって、ペット関連施設に設けられたペット関連施設端末装置と、このペット関連施設端末装置とネットワークで接続されて遺言の執行または契約の履行に必要なデータを管理する遺言執行サーバとを備え、遺言または契約は、飼主が死亡した場合には、ペット専用口座に預けられている財産が飼主から財産管理人に移転され、かつ、財産管理人は、ペットの新飼主がペットを飼養するために必要な飼養費を前記財産から新飼主に対して支出する義務を負う旨を定め、ペット関連施設端末装置には、ペットの個体識別情報を入力する個体識別情報入力手段が接続され、この個体識別情報入力手段は、飼主の死亡後に新飼主がペット関連施設にペットを連れて行ってペット関連施設でペットの飼養に必要な商品を購入し、または役務の提供を受ける際に用いられ、ペット関連施設端末装置は、個体識別情報入力手段により入力されたペットの個体識別情報を遺言執行サーバに送信する個体識別情報送信手段と、ペット関連施設での商品購入または役務提供に係る金額を含む購買情報を遺言執行サーバに送信する購買情報送信手段とを含んで構成され、遺言執行サーバには、ペットの個体識別情報を予め記憶させておく個体識別情報データベースが接続され、遺言執行サーバは、ペット関連施設端末装置からネットワークを介して送信されてくる個体識別情報と個体識別情報データベースに記憶されている個体識別情報とを比較することによりペット関連施設に連れて来られたペットが遺言の執行対象または契約の履行対象となるペットであるか否かを判断する認証手段と、この認証手段によりペット関連施設に連れて来られたペットが遺言の執行対象または契約の履行対象となるペットであると判断された場合にのみ、商品購入または役務提供に係る金額を財産管理人名義のペット専用口座からペット関連施設名義の口座へ引き落とすための引落要求信号をネットワークを介して金融機関の口座管理システムに送信する引落要求信号送信手段とを含んで構成されていることを特徴とするものである。

このような本発明のペット遺言執行システムにおいては、前述した本発明のペット遺言執行方法で得られる作用・効果がそのまま得られるため、財産が確実にペットのために使われ、かつ、財産が確実に相続されるようにし、さらに、ペットをわざと殺すというようなモラルリスクを排除するという三つの要請を満足させることが可能となり、これらにより前記目的が達成される。

また、前述したペット遺言執行システムにおいて、遺言執行サーバには、遺言を執行し、または契約を履行させる遺言執行者となり得る者を記憶する遺言執行者データベースが接続され、遺言執行サーバは、遺言執行者データベースを用いて遺言執行者を検索する遺言執行者検索手段を備えていることが望ましい。

ここで、遺言執行者とは、遺言執行について責任を負える立場の者であることが好ましく、例えば、行政書士が好適であるが、その他に、弁護士や医師等であってもよい。

このように遺言執行者データベースおよび遺言執行者検索手段を設けた場合には、最適な遺言執行者の候補者を選定することが可能となる。なお、遺言執行者の候補者の選定処理は、遺言執行サーバを運用・管理・維持する遺言執行補助者が行うことが好ましい。

さらに、前述したペット遺言執行システムにおいて、遺言執行サーバには、遺言または契約の内容を記憶する遺言内容データベースと、血縁関係を含むペット同士の間の関係を記憶する家系図データベースとが接続され、遺言執行サーバは、遺言の執行対象または契約の履行対象となるペットの死亡時に遺言内容データベースを用いて死亡したペットと親戚関係にあるペットへの財産の分配希望があるか否かを検索する遺言内容検索手段と、この遺言内容検索手段により財産の分配希望があると判断された場合に家系図データベースを用いて財産を分配すべき親戚関係にあるペットを検索する親戚検索手段とを備えていることが望ましい。

このように遺言内容データベース、家系図データベース、遺言内容検索手段、親戚検索手段を設けた場合には、ペットが死亡した場合には親戚関係にあるペットに財産を分配したいという希望が飼主にある場合には、その飼主の希望を実現することが可能となる。

また、引落要求信号送信手段３２は、新飼主端末装置６０の設置場所、すなわちペット関連施設以外の場所（例えば、新飼主の自宅等）にいるペットが遺言の執行対象または契約の履行対象となるペットであると判断された場合にのみ、購買情報記憶手段４５に記憶された購買情報に基づき、商品購入または役務提供に係る金額を財産管理人名義のペット専用口座５１から新飼主名義の口座５３へ引き落とすための引落要求信号を、ネットワーク１を介して金融機関の口座管理システム５０に送信するものでもある。この送信は、飼主の死亡後に新飼主がペット関連施設にペットを連れて行かずに、新飼主の立替払いによりペット関連施設でペットの飼養に必要な商品を購入し、または役務の提供を受ける際に行われる。

このような本実施形態においては、以下のようにしてペット遺言執行システム１０により、飼主がペットのために残した財産をペットのために用いられるようにするという内容の遺言またはこれに類する契約を執行または履行する。

先ず、自分の飼っているペットに遺産を残したいと考える飼主は、飼主端末装置７０を用いてネットワーク１を介して遺言執行サーバ３０にアクセスすることによりペット遺言執行システム１０を使用するための諸手続を行うとともに、ペットのために用いられる財産を預けるペット専用口座５１を金融機関に開設する。

すなわち、飼主は、飼主端末装置７０を操作してペット遺言執行システム１０を使用するための新規登録フォームを遺言執行サーバ３０からダウンロードし、飼主端末装置７０の表示手段に表示された新規登録フォームに従い、飼主基本情報を入力する。飼主基本情報とは、例えば、飼主の氏名、年齢、職業、住所、電話番号、ファクシミリ番号、電子メールアドレス、ペットの種類、名前、性別、使用したい金融機関やその支店、口座種別、口座名義等である。また、飼主は、飼主端末装置７０に接続された個体識別情報入力手段７１によりペットの個体識別情報（例えば、虹彩データや肉球データ等）を入力する。

そして、これらの入力した飼主基本情報および個体識別情報を、ネットワーク１を介して遺言執行サーバ３０に送信する。遺言執行サーバ３０では、受信した飼主基本情報および個体識別情報について入力チェックを行い、入力が不備な場合には、再入力の要求信号を飼主端末装置７０に送信する。一方、入力が正しい場合には、遺言執行サーバ３０は、飼主基本情報および個体識別情報を遺言執行データベース４０の図示されない飼主基本情報データベースおよび個体識別情報データベース４１に記憶する。

なお、飼主端末装置７０に個体識別情報入力手段７１が接続されていない場合には、飼主は、遺言執行サーバ３０を運用・管理・維持する遺言執行補助者のもとにペットを連れて行き、個体識別情報の登録を依頼することができる。この依頼を受けた遺言執行補助者は、遺言執行補助者端末装置１００に接続された個体識別情報入力手段１０１により、そのペットの個体識別情報を入力し、これを遺言執行サーバ３０へ送信して個体識別情報データベース４１への登録を行う。

さらに、飼主は、自ら金融機関に出向き、口座開設作業を自ら行ってもよいが、遺言執行補助者に、作業の少なくとも一部を代行してもらう依頼をしてもよい。この依頼を受けた遺言執行補助者は、遺言執行サーバ３０で受信した飼主基本情報に基づき作業を代行する。

その後、金融機関から口座番号を付与されるので、遺言執行補助者は、この口座番号を遺言執行データベース４０の飼主基本情報データベースに記憶させる。そして、以上の処理が全て終了した時点で、遺言執行補助者は、遺言執行補助者端末装置１００を操作して電子メールにより飼主に新規登録の処理が完了した旨を通知する。飼主は、飼主端末装置７０の画面上で、この通知内容を確認することができる。なお、電子メールの他に、郵便、ファクシミリ、電話等による通知を併用してもよい。

次に、飼主は、ペット専用口座５１に適宜入金を行い、ペットのための預金の積立を行う。入金処理は、飼主が金融機関の現金自動預け払い機（ＡＴＭ）により行ってもよく、飼主端末装置７０を操作してネットワーク１を介して行ってもよい。また、飼主は、いつでも飼主端末装置７０からネットワーク１を介してペット専用口座５１の残金を確認することができる。なお、遺言執行サーバ３０と金融機関の口座管理システム５０との間で信号の送受信が行われる都度に、遺言執行データベース４０にペット専用口座５１の残金を記憶しておき、遺言執行サーバ３０で口座の残金を把握できるようにしておいてもよい。

また、飼主は、生前はいつでも金融機関に解約申込をしてペット専用口座５１を解約し、ペットのために積み立てた預金を別の用途に用いることができる。この口座解約作業は、飼主が自ら行ってもよいが、前述した口座開設作業の場合と同様に、遺言執行補助者に作業の少なくとも一部を代行してもらう依頼をしてもよい。この依頼は、飼主端末装置７０を操作してネットワーク１を介して遺言執行サーバ３０にアクセスすることにより行うことができるが、この際、飼主端末装置７０から口座番号の入力や個体識別情報入力手段７１による個体識別情報の入力を行うようにし、遺言執行サーバ３０で個体識別情報データベース４１を用いて入力情報の検索確認を行うようにすることが好ましい。そして、この依頼を受けた遺言執行補助者は、遺言執行データベース４０に記憶されている飼主基本情報および口座番号に基づき作業を代行する。なお、ペット専用口座５１の預金は、口座を解約しない限り、飼主といえども後述する遺言執行サーバ３０による認証処理（図５参照）を経なければ使うことができない。

続いて、飼主は、遺言作成作業を行う。すなわち、飼主は、飼主端末装置７０を操作して遺言作成申込の要求信号を遺言執行サーバ３０に送信し、遺言執行サーバ３０から遺言作成フォームをダウンロードし、飼主端末装置７０の表示手段に表示された遺言作成フォームに従い、遺言書またはこれに類する契約書の作成に必要となる事項を入力する。入力事項としては、個体識別情報および口座番号並びに遺言内容である。なお、飼主端末装置７０に個体識別情報入力手段７１が接続されていない場合等には、飼主が遺言執行補助者のもとに出向き、遺言作成に必要な諸手続を行ってもよい。

遺言執行サーバ３０では、飼主端末装置７０で入力された情報を受信すると、その入力情報をチェックし、口座番号が欠如している場合には、口座作成を促す信号を飼主端末装置７０に送信し、入力情報が正しい場合には、遺言内容データベース４３に遺言内容を記憶させる。

その後、行政書士は、行政書士端末装置９０を操作し、依頼人（遺言者）である飼主に対し、質問フォームで入力した質問および自己の連絡先を、電子メールで送信する。飼主は、飼主端末装置７０の画面上で、この送信内容を確認することができる。なお、電子メールの他に、郵便、ファクシミリ、電話等による通知を併用してもよい。

そして、飼主は、紙による遺言書または契約書を実際に作成する作業に入る。遺言書または契約書に記載すべき事項は、既に入力されて遺言執行データベース４０に記憶されている情報に基づき、遺言執行サーバ３０により自動的に作成されるので、飼主は、遺言書を作成する場合には、この自動作成された遺言書記載事項を飼主端末装置７０の画面上に表示するか、または飼主端末装置７０の出力手段で印刷し、これを参考にして遺言書を自筆して作成する。一方、契約書を作成する場合には、自動作成された契約書記載事項を飼主端末装置７０の出力手段で印刷し、これに押印して契約書を作成する。

このようにして作成される遺言書または契約書の一例が、図２〜図４に示されている。これらの遺言書または契約書は、いずれも飼主（ここでは、一例として犬飼太郎となっている。）が死亡した場合には、ペット専用口座５１に預けられている財産が飼主から財産管理人（ここでは、一例として財団法人東京愛犬協会となっている。）に移転され、かつ、財産管理人は、ペットの新飼主（ここでは、一例として猫目好子となっている。）がペットを飼養するために必要な飼養費を前記財産から新飼主に対して支出する義務を負う旨を定めている。

そして、遺言執行補助者は、金融機関による口座名義の変更処理を確認した後、遺言執行補助者端末装置１００を操作して遺言執行サーバ３０にアクセスし、口座名義変更に対応するデータの変更処理を行って遺言執行データベース４０に変更後のデータを保存する。さらに、遺言執行補助者は、口座名義変更に対応するデータの変更処理を完了した後、遺言執行補助者端末装置１００を操作し、新飼主に対し、口座名義の変更が行われた旨を電子メールで通知する。新飼主は、新飼主端末装置６０の画面上で、この通知内容を確認することができる。なお、電子メールの他に、郵便、ファクシミリ、電話等による通知を併用してもよい。

図５において、新飼主は、ペット関連施設でペットの飼養に必要な商品を購入し、または役務の提供を受ける際には、ペット関連施設端末装置２０に接続された個体識別情報入力手段２３を用いて、ペット関連施設に連れて行ったペットの個体識別情報をペット関連施設端末装置２０に入力し、かつ、パスワードも入力する。なお、個体識別情報の入力作業は、ペット関連施設の従事者に代行してもらってもよい。さらに、ペット関連施設の従事者は、ペット関連施設端末装置２０に商品購入または役務提供に係る金額を含む購買情報を入力する（ステップＳ１）。

なお、認証手段３１による判断結果は、直ぐに遺言執行サーバ３０からペット関連施設端末装置２０に送信されるので、ペット関連施設は、認証手段３１による判断結果をペット関連施設端末装置２０の画面上で確認してから、つまり遺言執行サーバ３０から口座管理システム５０へ引落要求信号が送信されたことを確認してから、新飼主に対し、実際に商品の引き渡し、または役務の提供を行うことができる。さらには、ペット専用口座５１からペット関連施設名義の口座５２への引き落とし処理が行われた旨の信号が、口座管理システム５０から遺言執行サーバ３０を介してペット関連施設端末装置２０に送信されるようにしておけば、ペット関連施設は、商行為を行うにあたり、より一層の安心感を得ることができる。

一方、ステップＳ３の認証処理で、認証手段３１により、ペット関連施設に連れて来られたペットが、遺言の執行対象または契約の履行対象となるペットでないと判断された場合には、引落要求信号は送信されず、口座管理システム５０によるペット専用口座５１からの引き落とし処理は行われない。従って、新飼主は、ペット専用口座５１の預金を使うことができないので、自ら代金を支払うか、あるいは商品の購入または役務の提供を受けることを諦めなければならない。

次に、飼主の死亡後に、新飼主がペット関連施設にペットを連れて行かずに、新飼主の立替払いによりペット関連施設でペットの飼養に必要な商品を購入し、または役務の提供を受ける際の処理の流れを説明する。

図６において、新飼主は、ペット関連施設でペットの飼養に必要な商品を購入し、または役務の提供を受ける際には、ペットを連れて来ていない状況では、その場で認証手段３１による認証を受けることはできないので、立替払いにより商品を購入し、または役務の提供を受ける。立替払いは、現金、小切手、クレジットカード等のいずれの支払い方法でもよく、要するに、認証手段３１による認証処理を経なくてもペット関連施設がその場で代金を受けとれることが確信できればよい。

新飼主からの支払いを受けたペット関連施設の従事者は、ペット関連施設端末装置２０を操作し、商品購入または役務提供に係る金額を含む購買情報を、ペット関連施設端末装置２０に入力する（ステップＳ１１）。すると、入力された購買情報は、購買情報送信手段２２により、ペット関連施設端末装置２０からネットワーク１を介して遺言執行サーバ３０に送信され（ステップＳ１２）、遺言執行サーバ３０は、受信した購買情報を購買情報記憶手段４５に保存する（ステップＳ１３）。

その後、新飼主は、自分の自宅等に戻り、新飼主端末装置６０を操作し、購買情報記憶手段４５に記憶されている立替金回収の対象となる購買情報（つまり、どの買い物についてペット専用口座５１の預金を使いたいのかという情報）を指定する作業を行う。この際、購買情報記憶手段４５には、各時期における各ペット関連施設での購買情報が記憶されているので、新飼主は、その中のいずれかの購買情報を指定する。この購買情報の指定は、例えば、購買情報記憶手段４５に記憶されている複数の購買情報を新飼主端末装置６０の画面上に表示し、その画面上での選択指定で行ってもよく、あるいは買い物時にペット関連施設で受け取った買い物番号（ペット関連施設端末装置２０から遺言執行サーバ３０に購買情報を送信したときに、遺言執行サーバ３０から返信されてくる番号）を新飼主端末装置６０に入力して遺言執行サーバ３０に送信すること等により行うことができる。また、新飼主は、新飼主端末装置６０に接続された個体識別情報入力手段６１により、その場にいるペットの個体識別情報を入力し（ステップＳ１４）、かつ、パスワードも入力する。

遺言執行サーバ３０では、入力チェックを行い（ステップＳ３５）、入力が不備な場合には、再び、ステップＳ３４の口座番号および新飼主基本情報の入力処理に戻り、一方、入力が正しい場合には、ペット専用口座５１の残高を確認する（ステップＳ３６）。ここで、残高がゼロの場合には、再び、ステップＳ３４の口座番号および新飼主基本情報の入力処理に戻り、一方、残高がある場合には、遺言内容検索手段３４により、遺言内容データベース４３を用いて遺言内容の検索処理を行い（ステップＳ３７）、遺言者に親戚関係にあるペットへの財産の分配希望があるか否かを判断する（ステップＳ３８）。

そして、ステップＳ３８で、分配希望ありと判断された場合には、親戚検索手段３５により、家系図データベース４４を用いて親戚の検索処理を行い（ステップＳ３９）、死亡したペットに親戚関係にあるペットがいるか否かを判断する（ステップＳ４０）。ここで、親戚ありと判断された場合には、遺言執行サーバ３０は、金融機関、遺言執行者である行政書士、遺言執行補助者、財産管理人、新飼主等の関係者に対し、ペット死亡情報および親戚情報を通知する処理を行う。この通知は、例えば電子メール等で行われるが、この他に、電話、ファクシミリ、郵便等の手段を併用してもよい。

そして、金融機関では、ペットの死亡が確認されると、ペット専用口座５１の名義の変更処理が行われる（ステップＳ４２）。すなわち、死亡したペットの名称を含む名義から、死亡したペットの親戚関係にあるペットの名称を含む名義に変更される。例えば、「財団法人東京愛犬協会　ヒッキー専用」から「財団法人東京愛犬協会　ポチ専用」に変更される等である。

また、ステップＳ３８で分配希望なしと判断された場合、およびステップ４０で親戚なしと判断された場合には、金融機関では、口座廃止処理が行われ（ステップＳ４３）、残金が財産管理人（公益法人等）に返還（寄付）される（ステップＳ４４）。従って、新飼主に残金が返還（寄付）されることはないので、新飼主がわざとペットを殺してしまって財産をせしめようとする行為は防止される。以上により、ペット遺言執行システム１０による処理の流れの説明を終了する。

このような本実施形態によれば、次のような効果がある。すなわち、ペット遺言執行システム１０は、個体識別情報に基づきペットが本物であるか否かを判断する認証手段３１を備えているので、遺言の執行対象または契約の履行対象となる本物のペットに対してのみペット専用口座５１の預金を用いることができる。

このため、遺言の執行対象または契約の履行対象となる本物のペットがいなければ、ペット関連施設へ支払う代金をペット専用口座５１から引き落とすことができないので、例えば、他のペットのために財産を使用する、あるいはペットを殺してしまって財産だけを受けとる等の不正行為を未然に防止することができ、遺言の執行対象または契約の履行対象となるペットのためにのみ飼主の残した財産を使うことができる。

また、飼主死亡時にペット専用口座５１の名義が飼主から財産管理人に変更されるようになっており、従って、飼主の残した財産は、新飼主に直接に移転されるのではなく、先ず、財産管理人に移転され、財産管理人から新飼主の購買行為に対して支出される形が採られているので、上述したような不正行為の防止効果をより一層確実に得ることができるうえ、遺言執行のしくみに対する信用力をより一層高めることができる。

従って、財産が確実にペットのために使われ、かつ、財産が確実に相続されるようにし、さらに、ペットをわざと殺すというようなモラルリスクを排除するという三つの要請を満足させることができ、これによりペットに遺産を残すことができる。

また、新飼主端末装置６０にも個体識別情報入力手段６１を接続しておくことにより、新飼主端末装置６０から遺言執行サーバ３０にペットの個体識別情報を送信することができるので、新飼主は、ペット関連施設にペットを連れて行かなくても、事後的に認証手段３１による認証処理を経ることができ、ペット専用口座５１の預金を使うことができる。

以上に述べたように本発明によれば、遺言執行サーバの認証手段による個体識別情報に基づく認証処理を経なければ、ペット専用口座から預金を引き落とすことができず、従って、遺言の執行対象または契約の履行対象となる本物のペットがいなければ、新飼主は、ペット専用口座の預金を使うことができないので、財産が確実にペットのために使われ、かつ、財産が確実に相続されるようにし、さらに、ペットをわざと殺すというようなモラルリスクを排除するという三つの要請を満足させることができ、これによりペットに遺産を残すことができるという効果がある。
