2. Statement motivated according to articles 29.6 and 29.7 of the Regulations for the execution of Law 11/1986, of March 20, on Patents on novelty and inventive activity; quotes and explanations in support of this statement

The object of the invention set forth in the main claim can be considered to be novelty since any of the documents cited in the Report discloses an object identical to that which appears to be detached from the wording given to the claim. This is mainly due to the fact that the first claim defines in a generic and limited way the object for which protection is sought, including terms based on the result that is intended to be achieved, which results in what can be considered that documents D01 to D08 anticipate it, since all of them indicate an identical result achieved with the same means or technical characteristics.

Choosing document D01 as the basis for the analysis, which can be considered the state of the art closest to the content of the application, in it (see parts cited in the EIT, references in parentheses apply to that document) describes a :

Thus, document D01 contains all the technical characteristics of the main claim, so it is not new, and therefore the application does not meet the requirements of article 6.1 of the Patent Law (LP 11/1986).

In addition, as already anticipated, this main claim cannot be considered new in view of any of the documents D02 to D08 cited in the State of the Art Report.

Claims 2-5 are dependent on the principal and delimit a series of additional optional and theoretically non-essential characteristics. The technical objects that seem to be deduced from them, according to the wording given to these claims, in combination with the characteristics of the main claim on which they depend, can be considered at least devoid of inventive activity, in view of the state of the technique represented by documents D01 to D03 cited, for the following reasons:

With respect to the second claim, the same decoy of document D01 can be considered to have a

"Plummet connected to the body by means of an arm that extends outside the body and that has a limited movement clearance with respect to the body", since from figure 1 of document D01 it follows that the union to the body can be considered equivalent to a short arm length. This possible difference is considered a lack of inventive activity, as it seems a mere choice between different design possibilities available to an expert in the field.

The characteristic of the third claim, dependent on the principal, can also be considered devoid of inventive activity in view of document D03 which, as stated above, serves to challenge the novelty of the first claim. The lure shown in D03 can be considered to comply with the limitations included in this claim and therefore that "the body of the lure (18) is connected to the plumb line (16) on the line holding element (24) and a connecting element (22) which has a limited movement clearance with respect to the line holding element ”(see summary and figures).

The characteristic of the fourth claim, dependent on the principal and the second, can also be considered devoid of inventive activity in view of document D02. The embodiment of the second figure of that document can be considered to comply with the limitations included in this claim and therefore that "the plumb element (15) has a limited fixing position clearance for the element (12a) clamping line (L) ”.

Finally, the object of the fifth claim lacking at least inventive activity can also be considered in view of document D01 itself, since the decoy presented in that document also seems to meet the limitation that

"It has a plumb line fixed to the body by means of the projection arm, with a clearance of the angular position between the projection arm and the lure body".
