2. Statement motivated according to articles 29. and 29.7 of the Regulations for the execution of Law 11/198, of March 20, on Patents on novelty and inventive activity; quotes and explanations in support of this statement

The present invention relates to a reassuring device for young children.

The object of the invention according to claims 1-4 is a device comprising a foldable corrugated surface formed by two layers of flexible material between which a plurality of rods also of flexible material are disposed transversely and having at their corners about mechanical fasteners for fixing to the floor, specifically suction cups or reusable adhesives.

Document D01, considered the closest state of the art, discloses a base for baby car with a relaxing effect consisting of a surface, made of a non-rigid plastic material that allows its winding, equipped with internal grooves opened by one of its sides, where nerves are introduced, made of semi-rigid plastic, which give it roughness. To hold this base to the floor, suction cups can be used in case of polished surfaces or velcro in case of porous floors (column 1, line 18 - column 2, line 35; figures).

The formation of the surface from two layers between which the rods are arranged or from a single surface in the one that a series of channels are realized for the introduction of the same ones are two of the several possibilities that a subject matter expert would select according to the circumstances, without the exercise of inventive activity. Accordingly, claims 1-4 lack inventive activity.

On the other hand, document D03 discloses a sleep aid device applied to children's cars consisting of a support surface for them comprising a series of longitudinal projections that cause a vibrating movement of the cart when it moves along the surface. and that is attached to the ground by means of, for example, suction cups (column 2, line 32 - column 4, line 14; figures).

The design features that differentiate this device from that of the application according to claims 1-4 are considered mere particular executions obvious to the person skilled in the art, so that in view of this document it is considered that said claims lack inventive activity .

The object of the invention according to claims 5-6 and 9 is a system like the one described above which is provided with a mechanical assembly consisting of an electric motor which, by means of gearboxes, transmits the rotation to an auger which causes the linear displacement along it of an internally threaded block that has associated side rods intended for anchoring the carriage wheels. This device also incorporates a control panel with a switch and speed regulation.

The underlying technical problem is the provision of a mechanism that allows the pram to move on the wavy surface automatically. This problem and its corresponding solution are described in document D02, which refers to a system for the automatic movement of a child car driven by an electric motor that, through a reduction mechanism, transmits the rotation to a cogwheel that move, back and forth, a strap to which the cart is fixed. The device has a control panel for movement and speed adjustment (paragraph [0001]; paragraphs [0017-0050]; figure 1; figure 4).

The use of a system consisting of an endless screw and a threaded block instead of a wheel and a belt for the transformation of the rotary movement into a rectilinear is a particular execution known in the state of the art - see document D04 (paragraph [0002 ]; paragraphs [0035-0039]; paragraphs [0042-0045]; paragraph [0049]; figures 1-4; figure 11) - and obvious to the person skilled in the art.

Likewise, the design features referred to in dependent claims 7-8 and 10 are considered mere particular executions obvious to the person skilled in the art.

Therefore, claims 5-10 lack inventive activity based on what is disclosed in documents D01 and D02.
