El documento D01 se considera el más próximo del estado de la técnica al objeto de la invención reivindicada en la reivindicación nº 1 (las referencias y comentarios entre paréntesis corresponden a este documento). Así con respecto a las características descritas en la reivindicación nº 1, divulga un bastón para enfermos de Parkinson, el cual, cuando el usuario sufre un parón incapacitante al caminar, el mismo pueda efectuar un golpe sobre el pie sin tener que levantar el bastón del apoyo sobre el suelo, que comprende un mástil tubular (12), con una empuñadura (16) en la parte superior, mientras que en la zona extrema inferior incorpora articulada una barra (3) que es susceptible de bascular entre una posición plegada en alineación con el mástil tubular y una posición de abatimiento en perpendicular respecto al mismo (descripción, columna 2, líneas 11-23, columna 3 líneas 61-63) Las características de las reivindicación nº 1 ya son conocidas del documento D01. Esta reivindicación no es nueva a la vista del estado de la técnica conocido y no satisface el criterio establecido en los artículos 6 y 8.1 de la Ley 11/86 de 20 de marzo de patentes. Igualmente El documento D02 se considera cercano al estado de la técnica al objeto de la invención reivindicada en las reivindicaciones nº 1 y 4 (las referencias y comentarios entre paréntesis corresponden a este documento). Así con respecto a las características descritas en la reivindicación nº 1, divulga un bastón (1) que comprende un mástil tubular (2), con una empuñadura (5) en la parte superior, mientras que en la zona extrema inferior incorpora articulada una barra (8) que es susceptible de bascular entre una posición plegada en alineación con el mástil tubular y una posición de abatimiento en perpendicular respecto al mismo (descripción, columna 1, líneas 4 -12). La invención de la reivindicación nº 1 consiste simplemente en una nueva utilización de un bastón, bastón cuyas características son conocidas del documento D02. Esta aplicación para enfermos de Parkinson no implica más que el aprovechamiento de las características del bastón ya conocidas del documento D02. Por lo tanto, no se aprecia actividad inventiva en el objeto del la reivindicación nº1. Con respecto a las características reivindicadas en la reivindicación nº 4, el documento D02 divulga que la barra (8) se dispone articulada en el interior del mástil tubular (2), alojándose en posición plegada dentro del mismo, pudiendo salir y entrar a través de una abertura (17), definida en dicho mástil tubular. Por tanto la invención definida en las reivindicaciones nº 1 y 4 no difieren de la técnica conocida descrita en el documento D02 en ninguna forma esencial. Por lo tanto, la invención según dichas reivindicaciones no se considera que implique actividad inventiva y no satisfacen el criterio establecido en los artículos 6 y 8.1 de la Ley 11/86 de 20 de marzo de patentes. La reivindicación nº 2 divulga que el bastón comprende un casquillo que permite alojar el extremo libre de ésta para retenerla en la posición de plegado sobre el mástil tubular, estando dicho casquillo empujado por un muelle y relacionado por medio de un cable o varilla con un gatillo de tracción dispuesto en la empuñadura. Aunque el documento D03 revela un bastón para enfermos de Parkinson que dispone de un gatillo (H) de tracción dispuesto en la empuñadura que se relaciona por medio de un cable (E) a una barra basculante (A); el sistema desarrollado en el documento D03 no contempla la existencia del casquillo que retiene a la barra en el interior del mástil y no se ha encontrado en el estado de la técnica sistemas que conciban esta disposición de la barra dentro de un casquillo, y no se considera obvio que un experto en la materia incluya dicha característica, por lo que constituye un efecto mejorado con respecto al estado de la técnica. En cuanto a las características divulgadas en la reivindicación nº 3, el documento D04 divulga un bastón caracterizado porque en el extremo inferior del mástil tubular (3) va dispuesto un taco (5) que es empujado por un muelle (7) permitiendo hacer bascular a una barra (9) por empuje de dicho taco mediante la presión del bastón contra el suelo. Pero en este caso el sistema hace que al presionar el bastón la barra bascule de una posición plegada a una posición abatida, caso contrario al que preconiza la invención donde al presionar el taco la barra que está en posición abatida pasa a una posición de plegado, dado que la barra se apoya en el taco en posición sobresaliente con respecto el mástil tubular. Además la invención reivindicada dispone de dos mecanismos para la operación de abatimiento/plegado de la barra, el de accionamiento mediante la empuñadura para abatir la barra y el de presión del bastón sobre el taco para plegar dicha barra. Por tanto no se ha encontrado en el estado de la técnica bastones que conciban dicha disposición y no se considera obvio que un experto en la materia incluyan dichas características por lo que constituye un efecto mejorado con respecto al estado de la técnica. No se ha encontrado en el estado de la técnica ningún documento, tomado sólo o en combinación que revele la invención definida en las reivindicaciones nº 2 y 3. Además, no se considera obvio que un experto en la materia conciba dicha invención. Por lo tanto, la invención reivindicada en las reivindicaciones nº 2 y 3 es nueva, implica actividad inventiva y tiene aplicación industrial de acuerdo con los artículos 6 y 8.1 de la Ley 11/86 de 20 de marzo de patentes.
