Statement motivated according to articles 29.6 and 29.7 of the Regulations for the execution of Law 11/1986, of March 20, on Patents on novelty and inventive activity; quotes and explanations in support of this statement El documento D01 describe un sistema de retención y seguridad infantil para automóvil, que comprende una pieza inferior inflable, provista de dos brazos laterales (3) y un elemento puente (5) que los une, un colchón inflable (8) articulado al elemento puente y una abertura transversal (12) para el paso de un cinturón de seguridad (14), de forma que las piernas de un/a niño/a (4) quedan retenidas encima del asiento del automóvil, debajo del elemento puente (6) y entre los brazos laterales de la pieza inferior. El colchón inflable (8) comprende una porción superior plana en plano inclinado hacia atrás y está articulado al elemento puente (6) por medio de una pieza bisagra (9). En consecuencia, a la vista del documento D01, la reivindicación independiente 1 y sus dependientes 4 y 7 carecen de novedad según el art. 6.1 de la LP. En relación con la reivindicación dependiente 2, se considera que acoplar un elemento de espalda con una forma determinada, inflable y desmontable no tiene actividad inventiva. Un ejemplo, se puede ver en el documento de patente D03. Se considera que tampoco las reivindicaciones dependientes 3 y 5 a 6 contienen ninguna característica técnica que no resulte obvia para un experto en la materia. Se concluye, por tanto, que las reivindicaciones dependientes 2, 3, 5 y 6 carecen de actividad inventiva según el art. 8.1 de la LP. Un razonamiento semejante se podría realizar a la vista del documento D02, que también anticipa las características técnicas de la reivindicación 1, 4 y 7. Se divulga también la utilización de válvulas de seguridad (7,8) en la pieza inferior y en el colchón inflable, por tanto la reivindicación 6 carece también de novedad según el art. 6.1 de la LP. Consequently, in view of document D01, independent claim 1 and its dependents 4 and 7 are novel in accordance with art. 6.1 of the LP. In relation to dependent claim 2, it is considered that coupling a back element with a certain, inflatable and removable shape has no inventive activity. An example can be seen in patent document D03. Dependent claims 3 and 5 to 6 are also not considered to contain any technical characteristics that are not obvious to a person skilled in the art. It is concluded, therefore, that the dependent claims 2, 3, 5 and 6 lack inventive activity according to art. 8.1 of the LP. Similar reasoning could be carried out in view of document D02, which also anticipates the technical characteristics of claim 1, 4 and 7.
