Statement motivated according to articles 29.6 and 29.7 of the Regulations for the execution of Law 11/1986, of March 20, on Patents on novelty and inventive activity; quotes and explanations in support of this statement La presente invención se refiere a un piso para calzado estructurado en 3 piezas de material elastomérico que permiten su deformación elástica tanto vertical como transversal, con el fin de absorber los sobre-esfuerzos de la pisada. El documento D01 se considera el más próximo del estado de la técnica al objeto de la invención reivindicada en las reivindicaciones nº 1, nº 2 y nº 3 (las referencias y comentarios entre paréntesis corresponden a este documento). Así con respecto a las características descritas en la reivindicación nº 1, el documento D01 divulga un piso para calzado, del tipo de los que cuentan con una suela de material elastomérico (párrafo 61) resistente al desgaste, que permite su deformación en sentido transversal, constituido por la combinación de 3 piezas: una suela (50) inferior, una plantilla (40) intermedia y una palmilla (30) superior; la plantilla obtenida en material elastomérico, mientras que la palmilla elásticamente deformable también en sentido transversal a nivel de planta se materializa a nivel del enfranque y el tacón en una pieza rígida (90) (párrafos 103, 104), que se adapta a la zona correspondiente de la plantilla y que distribuye la carga corporal por toda la superficie de esta última. Encontramos en el documento D01, diferentes modos de realización de la invención, así podemos apreciar en las figuras 14 y 15, dicha pieza rígida distribuida a lo largo de la palmilla y en la figura 16 otra variante donde la palmilla está configurada a partir de 2 piezas (posterior y anterior) con materiales con distintos grados de deformación. Por lo tanto un experto en la materia podría utilizar la configuración expuesta en la figura 16 (párrafo 110), con los materiales que representan las figuras 14 o 15, obteniendo una palmilla de características similares a la palmilla objeto de la invención. El piso reivindicado en la presente solicitud, de acuerdo con la reivindicación nº 1 difiere de lo conocido en el documento D01, en la forma de acoplamiento suela-plantilla sin embargo, esta característica ya ha sido empleada en un piso para calzado en el documento D02 donde se divulga que una suela (30) presenta un nervio perimetral (34) donde se establece una ranura (34a) que permite el acoplamiento machihembrado de una plantilla (50) (párrafos 22-24, figura 5). El experto en la materia podría por lo tanto considerar como una opción válida el incluir la característica descrita en el documento D01 para resolver el problema planteado. Con respecto a la reivindicación nº 2, encontramos en el documento D01 que el piso para calzado configura a nivel del enfranque y el tacón una especie de cazoleta (50) en la que se acopla ajustadamente la zona posterior correspondiente a la plantilla en la que a su vez queda encajada la palmilla (descripción, párrafo 71). De igual manera el documento D02 describe la cazoleta (30) donde se ajusta la zona posterior de la plantilla y donde encaja a su vez la palmilla (28). Con respecto a la reivindicación nº 3, encontramos en una de las formas de realización de la invención del documento D01 (descripción, párrafo 118, figura 18) que la plantilla (440) incorpora un vaciado (479) sensiblemente centrado sobre la zona correspondiente al talón. De igual manera el documento D02 divulga una plantilla (50) con un vaciado (52) en la zona del talón. Por tanto, se considera que un experto en la materia intentaría combinar las partes principales del documento D01 con el documento D02 para obtener las características de las reivindicaciones nº 1, nº 2 y nº 3 y tener una expectativa razonable de éxito. Por lo tanto, la invención según dichas reivindicaciones no se considera que implique actividad inventiva y no satisface el criterio establecido en el Artículo 8.1 de la Ley 11/86 de 20 de marzo de Patentes. Con respecto a las características descritas en la reivindicación nº 4, el documento D03 divulga un piso para calzado de naturaleza elastomérica donde una palmilla (figura 3) incorpora una pluralidad de pequeños orificios (10) para aireación del pie (descripción, página 5, líneas 16-22), y donde presenta en la parte anterior unas piezas (8,8`,7) afectadas por ventanas ocupadas por dos láminas (6) de tejido elástico que se fijan a las citadas piezas a través de una costura perimetral (descripción, página 9, líneas 10-24, figura 3). Para un experto en la materia podría ser obvio el utilizar dicha configuración de la palmilla en la palmilla descrita en el documento D01 para resolver el problema técnico planteado, ya que el documento D01 revela variantes de realización (descripción, párrafos 108-110, figuras 15-16) muy cercanas a la descrita en el documento D03. Por lo tanto, la invención la reivindicación nº 4 no se considera que implique actividad inventiva y no satisface el criterio establecido en el Artículo 8.1 de la Ley 11/86 de 20 de marzo de Patentes. The floor claimed in the present application, according to claim 1 differs from what is known in document D01, in the form of sole-insole coupling however, this feature has already been used in a shoe floor in document D02 where it is disclosed that a sole (30) has a perimeter rib (34) where a groove (34a) is established that allows the tongue and groove coupling of a template (50) (paragraphs 22-24, figure 5). The person skilled in the art could therefore consider it a valid option to include the characteristic described in document D01 to solve the problem. With respect to claim 2, we find in document D01 that the footwear floor configures at the level of the opening and the heel a kind of bowl (50) in which the back area corresponding to the template in which a in turn, the palm is fitted (description, paragraph 71). In the same way, document D02 describes the bowl (30) where the back part of the template is adjusted and where the palm (28) fits in turn.
