In the current e-commerce environment, domestic vendors face serious infringement problems on overseas e-commerce platforms. With the continuous expansion of the scale of cross-border electronic commerce in China, the severity of infringement problems is also increased. In order to solve the problem, the application provides an electronic commerce infringement analysis system, and the core of the embodiment of the application shown in fig. 1 is as follows: the system comprises an infringement word acquisition module, wherein the infringement word acquisition module is used for acquiring an infringement word through internet retrieval and establishing a mapping rule of the infringement word and a product in the system; the infringement word detection module is used for detecting infringement words of the product according to the infringement word acquisition module; and the infringement processing module is used for timely processing the infringement product when the product infringes.
It can be appreciated that the infringement word acquisition module of the present application: and acquiring infringement word information from the network through an internet retrieval technology. It is able to automatically search for infringement words related to intellectual property rights and build mapping rules of these infringement words with products in the system. Thus, the association between the infringement word and the product can be established, and support is provided for subsequent detection of the infringement word. Infringement word detection module: and detecting infringement words of products in the system according to the infringement word information obtained by the infringement word obtaining module. By analyzing and comparing the text contents such as the title, description, keywords and the like of the product, the module can identify whether the use of infringement words exists. Thus, the potential infringement problem can be found in time and corresponding measures can be taken for processing. Infringement processing module: when the infringement word detection module finds that the product has an infringement problem, the module timely processes the infringement product. The processing may include off-shelf infringing the merchandise, sending a warning notification to the seller, modifying the infringing product, etc. By timely processing infringement products, infringement losses can be reduced and intellectual property rights can be protected. Through the core module, the electronic commerce infringement analysis system provided by the application can comprehensively and systematically manage intellectual property rights, and reduce infringement behaviors and related losses of sellers. The system utilizes internet retrieval to acquire infringement words, performs infringement word detection and timely processes infringement products so as to help sellers to better manage intellectual property risks.
In some embodiments of the present application, the infringement word acquisition module includes: capturing all recorded information from the brand records of all electronic commerce platforms, and putting the recorded information into an infringement word stock; acquiring public effective trademark information from each intellectual property organization, and putting the effective trademark information into an infringement word stock; capturing illegal keywords of each area of each platform, and putting the illegal keywords into an infringement word stock; and placing infringement words which are automatically added by the user into an infringement word stock.
The infringement word acquisition module comprises the following functions:
capturing recorded information from brands recorded on each e-commerce platform: the system collects the recorded brand information by accessing a brand record database of each e-commerce platform and adds the information to an infringement word stock. Thus, the system can be ensured to have the latest brand record information for detecting and managing infringement words.
Obtaining public valid trademark information from an intellectual property organization: the system obtains valid trademark information by accessing a public database of an intellectual property organization like WIPO (worldwide intellectual property organization) and adds it to an infringement word stock. Therefore, the system can be ensured to have wide trademark information, and the detection accuracy and coverage of infringement words are improved.
Grabbing violation keywords of each area of each platform: the system captures the violation keyword information from the E-commerce platforms and the regulations of different areas. These offensive keywords are added to the infringement word stock so that the system can effectively identify and alert the user to avoid using these words in subsequent infringement word detection.
Infringement words added autonomously by the user: the system provides a function for users to add infringement words autonomously, and users can add words they consider likely to be infringement through buttons or interfaces in the system. Infringement words added by the users are also added to the infringement word library so that the system can take into account the user-specific needs and risks during the detection process.
In summary, the infringement word acquisition module collects and integrates infringement word information through the approaches of brand record, intellectual property organization, platform regulation, independent addition of users and the like of each electronic commerce platform, constructs an comprehensive and real-time updated infringement word library, and provides basic data support for subsequent infringement word detection and prevention.
In some embodiments of the present application, the establishing a mapping rule between the infringement word and a product in the system includes: and establishing a mapping between the keywords and products in the system according to the trademark NIS classification, so that the infringement words in the infringement word bank and the products in the system correspond to each other according to the NIS classification.
The method for establishing the mapping rule of the infringement words and the products in the system is as follows: and establishing a mapping rule of the keywords and products in the system according to the trademark NIS classification, so that the infringement words in the infringement word bank and the products in the system can correspond to each other according to the NIS classification. The trademark nisi classification (Nice Classification) is an internationally common goods and services classification system for classifying goods and services in trademark applications by similarity. It is managed and maintained by the World Intellectual Property Organization (WIPO). The brand nisi classification is divided into 45 categories altogether, with categories 1 to 34 being merchandise classifications and categories 35 to 45 being service classifications. Each category represents a particular type of good or service. Each category has a set of keywords that describe the goods or services under that category. Each category corresponds to a set of keywords that describe the goods and services of that category. In specific implementation, the method can be carried out according to the following steps:
collecting trademark nism classification information: information of the brand nism classification is obtained from a related intellectual property organization or database, including a list of keywords for each category.
Mapping of keywords to system products: keywords in the trademark nisi classification are mapped to products in the system. The mapping may be performed by: each keyword is matched with a product in the system. For example, the keyword "cell phone" in the trademark nism class is matched with cell phone class products in the system. And automatically matching the keywords with products in the system by using natural language processing technology and algorithm. The automatic mapping may be implemented using text similarity calculations, keyword matching algorithms, and the like. Building a mapping rule of keywords and products: and establishing a mapping rule of the keywords and products in the system according to the mapping result. These rules may be stored in a system in a map, or other form for subsequent infringement word detection and management use. By establishing a mapping rule of the infringement words and products in the system, the system can accurately identify the infringement words related to the products in the system according to the corresponding relation of the trademark nism classification in the infringement word detection process, and remind a user to avoid using the infringement words, so that infringement risks and losses are effectively reduced.
In some embodiments of the present application, the infringement word detection of the product includes: and in the selecting stage, the infringement word detection module detects whether the product development document has infringement words in real time, and if so, sends out reminding information.
When the product selection is carried out, a developer writes a product development document which comprises information such as titles, descriptions, keywords and the like. An infringement word detection module is arranged in the system and is responsible for detecting whether the developed document contains an infringement word or not in real time. And the infringement word detection module detects the developed text in real time and compares the developed text with an infringement word library to judge whether infringement words exist. If the infringement word is detected to exist in the development document, the system sends reminding information to the developer. The reminding information can be presented in the forms of popup window, warning notice, mail and the like, and informs a developer of infringement problems in the text. After receiving the reminding information, the developer needs to further judge the developed document. They may modify the document, delete infringement words, or use legal substitute words to avoid infringement problems. Through detecting infringement words in the product development document in real time in the selection stage, the system can timely discover potential infringement problems and remind developers to take corresponding measures. This helps reduce the risk of infringement, protects the intellectual property rights of the seller, and improves the compliance of the product on shelves.
In some embodiments of the present application, the infringement word detection of the product includes: and in the translation editing stage, the infringement word detection module detects whether the product translation editing text has infringement words in real time, and if so, sends out reminding information.
When the product translation editing is carried out, a translation editing personnel carries out translation and editing work on the product document, so that the document is ensured to accurately convey product information. An infringement word detection module is arranged in the system and is responsible for detecting whether the translation editing text contains infringement words or not in real time. And the infringement word detection module detects the translation editing text in real time and compares the translation editing text with an infringement word library to judge whether infringement words exist. If the infringement word exists in the translation editing text, the system sends reminding information to the translation editing personnel. The reminding information can be presented in the forms of popup window, warning notice, mail and the like, and informs a translation editor to pay attention to infringement problems in the text. After receiving the reminding information, the translation editor needs to further judge the translation edit document. They may modify the document, delete infringement words, or use legal substitute words to avoid infringement problems. Through detecting infringement words in the product document in real time in the translation editing stage, the system can timely find potential infringement problems and remind translation editing personnel to take corresponding measures. This helps reduce the risk of infringement, protects the intellectual property rights of the seller, and improves compliance of the product document.
In some embodiments of the present application, the infringement word detection of the product includes: in the publishing stage, the infringement word detection module detects infringement words of the product according to the publishing platform and the publishing site; judging that the product is legal according to the publishing platform and the publishing site to finish publishing if the infringement words exist; infringement words exist, and the illegal product is judged according to the publishing platform and the publishing site, so that the publishing is intercepted; and (5) no infringement word exists, and publishing is completed.
The method relates to the selection of a cross-border e-commerce platform and the judgment of a publishing site. These platforms include amazon, eBay, walma, fast sales, dried shrimps, music days, and the like. For example, amazon acts as a cross-border e-commerce platform with multiple sites worldwide, such as the U.S. sites, canada, mexico, australia, singapore, middle east, europe, etc. Since trademarks and patents are regional and laws, beliefs and customs are different in different regions, infringement words in infringement word banks are not applicable to all platforms and sites. Therefore, when the product is published to the e-commerce platform, an additional judgment needs to be made to determine whether the infringement word in the product document needs to be deleted. This determination may be made by reference to the following steps: platform selection: and selecting a proper cross-border electronic commerce platform for publishing according to the characteristics of the product and the target market. Judging the site: in the selected platform, listing sites are selected according to the target region of the product. For example, if the target market for the product is the united states, the amazon us site is selected for publication. Infringement word detection: and using an infringement word detection module in the system to detect the infringement word of the product document before publishing. Judging infringement words: judging whether the infringement words accord with site regulations according to factors such as territory, legal requirements, local beliefs, customs and the like of the published sites. This may be done by preset rules or by manual judgment. Deleting infringement words: if the infringement words are determined to be non-compliant with the listing site specifications, the system will alert the user to delete the infringement words and make corresponding modifications. Through the judging flow, infringement words in the product document conform to local laws and regulations on different cross-border electronic commerce platforms and publishing sites, the problem caused by the infringement words is avoided, and the product is ensured to complete publishing under the compliance condition.
In preparation for publishing the product to the e-commerce platform, the published platform and site need to be selected. And an infringement word detection module is arranged in the system and is used for detecting infringement words according to the publishing platform and the publishing site. And the infringement word detection module is used for detecting the infringement word of the product document according to the selected publishing platform and the selected publishing site. If the detection result shows that infringement words exist in the product document, but the product is judged to be legal according to the regulations of the publishing platform and the publishing site, the system allows the publishing process to be completed. If the detection result shows that infringement words exist in the product document, and the product is judged to be illegal according to the regulations of the publishing platform and the publishing site, the system intercepts the publishing process and sends out corresponding reminding information to prompt the user to modify the document or take other measures. If the detection result shows that the infringement word does not exist in the product document, the system allows the publishing process to be completed. By performing infringement word detection according to the listing platform and the listing site, the system can judge whether the product is legally listed according to the regulations of the platform and the site. This helps to prevent infringement and ensures that the product is properly placed under compliance.
In some embodiments of the present application, the infringement word detection of the product includes: and in the stage of putting on shelf, the infringement word detection module monitors the modification of the product list in real time, and intercepts the modification operation when the infringement word exists in the modification operation.
On the cross-border e-commerce platform, the seller maintains its own product list, including information, descriptions, prices, etc. of the product. An infringement word detection module in the system can monitor the modification operation of a seller on the product list listing in real time. When the seller modifies the product list, the infringement word detection module monitors the modified content in real time. The infringement word detection module detects infringement words of the modified content and judges whether the infringement words appear. If the infringement word is detected to exist in the modification operation, the infringement word detection module immediately intercepts the modification operation and prevents the infringement word from appearing. Through the real-time monitoring and intercepting mechanism, infringement words in a product list can be timely found and prevented from appearing, sellers are ensured to observe intellectual property regulations in the stage of putting on shelf, and infringement behaviors are avoided. This helps to maintain the reputation and brand image of the seller and reduces the risk of infringement.
In some embodiments of the application, the infringement processing module includes: when a product infringes, adding an infringement word of the product into an infringement word library, and detecting a product number containing the infringement word; and executing the preset function of the infringement processing module according to the product number, and deleting or replacing the infringement word in the product.
When the infringement behavior of the product is found, the infringement processing module adds the infringement word of the product into an infringement word library for subsequent detection and processing. The infringement processing module performs a detection action to find all product numbers (ASINs) that contain the infringement word. And the infringement processing module executes a preset function, namely deleting or replacing the infringement words in the product according to the obtained product numbers containing the infringement words. This can be done in an automated fashion to increase process efficiency and accuracy.
ASIN is an abbreviation for "Amazon Standard identification number" on Amazon platform, and is collectively referred to as "Amazon Standard Identification Number". ASIN is a unique identification number for each item on the Amazon platform. It consists of 10 characters and can be used to accurately locate and identify specific merchandise on the amazon website. Amazon assigns a unique ASIN to each item it sells. This number is unique in the amazon inventory and is used to identify different products, whether books, electronics, household items, or other items. With ASIN, a customer can search for a particular product on Amazon and purchase the desired item. It should be noted that the use of product numbers in the present application is not limited to identification of merchandise ASINs on an amazon platform, and other online retailer identification systems may be used. In addition, amazon uses standard identification codes such as ISBN, EAN, and UPC to identify books, products, and merchandise.
In some embodiments of the application, the infringement processing module further includes: the infringement processing module automatically generates a processing log that includes all product inventory management feedback information that has been deleted or replaced with an infringement word.
The system automatically generates a log and feeds back all SKUs (Stock Keeping Unit, stock units) deleted or replaced infringement products to the purchasing and logistics departments. This log provides detailed information about the product being processed, including SKU, substitution of infringement words, etc. The purchasing and logistics departments receive the feedback information and judge subsequent operations according to conditions. They may need to consider whether the purchase amount needs to be reduced, whether returns are needed, how to handle inventory, and so forth. Such feedback mechanisms may assist the purchasing and logistics departments in knowing the infringement of the product so that they can make corresponding decisions and adjustments. By timely feedback and collaboration, inventory and supply chains can be better managed, infringement problems are guaranteed to be properly resolved, and potential business risks are reduced.
SKU is an abbreviation for "stock keeping unit", and is collectively referred to as "Stock Keeping Unit". In the commodity management and retail industry, SKUs are codes or numbers used to uniquely identify, track, and manage commodities. Each commodity has a unique SKU, which is typically composed of letters, numbers or symbols, that distinguish between different product variants, sizes, colors or other attributes. SKUs can help businesses effectively manage inventory, record inventory, restock, and sales tracking. Through SKU, the business can track sales of specific goods, learn inventory levels, forecast demand, and restocking demand. In addition, SKUs are also used in electronic commerce to facilitate the customer's search for and purchase of specific products.
SKU is a common unit used to identify and manage inventory when it involves the system generating logs and feeding them back to the purchasing and logistics departments. However, this scheme may be extended or replaced according to specific needs. In addition to using SKUs, other product identifiers may be contemplated, such as product IDs, product bar codes, custom identifiers, and the like. The product ID is a number that uniquely identifies a product and may be associated with a processing record of infringement words. The bar code is a globally unique identification of the product and can be conveniently matched with the processing records of the infringement words. Custom identifier schemes may be designed and used according to particular needs. This may be an identifier defined internally in the system for uniquely identifying the product and associated with the processing record of the infringement word. Whichever scheme is chosen, it is critical to ensure the uniqueness and reliability of the identifier in order to properly record and track infringing information. The expansion or replacement scheme should be evaluated and implemented according to the specific requirements of the system and the business process.
The method for analyzing e-commerce infringement shown in fig. 2 is applied to the system described in any one or more of the above embodiments, and the method may include the following steps:
obtaining infringement words through internet retrieval, and establishing mapping rules of the infringement words and products in a system; detecting infringement words of the product according to the infringement words; and when the product infringes, the infringement processing module timely processes the infringement product.
