Description

Method, device and system for screening high-asset-value patents
Technical Field
The invention relates to the technical field of value prediction of intangible assets, in particular to a method, a device and a system for screening patents with high asset value.
Background
Value or value is a generally accepted attribute of an asset, and thus whether it is in physical form (or physical form), and assets can be classified as tangible and intangible. Among them, patents are an important type of intangible assets. A patent is an intangible asset, and the value of a patent asset refers to the performance (generally expressed as an economic benefit) of the benefit that the patent is expected to bring to its owner or user under realistic market conditions. Patents that bring benefits beyond industry average standards may be referred to as high asset value patents. The determination of the amount of value of a patent asset is typically dependent on a patent value assessment. The patent value evaluation method comprises a cost method, a market price method and a profit method, wherein the market price method is taken as an example, and the method is a method for determining the value of an evaluated asset by comparing the similarity and the dissimilarity of the evaluated asset and comparable similar assets and adjusting the market price of the similar assets. On the other hand, there are also prior arts attempting to evaluate the value of the invented patent using different classical financial models, from a simple financial calculation method based on the monetary time value, to a very complicated complex model (patent value evaluation model) integrating quantitative analysis and qualitative analysis. By way of example, a patent currency value assessment model developed by Hua for the company, Union Oxford university, uses 4 primary indexes, 16 secondary indexes, and 10 tertiary indexes, and introduces variables in dimensions of patent technology, business data, market, and macro economy. The patent value is evaluated by integrating information of multiple dimensions such as technology, law, economy and the like, and the method is also a mode commonly adopted by various Chinese and foreign value evaluation organizations.
At present, if a user wants to know patent information and patent value information of the user or a competitor (which can be an enterprise object or a personal object), a professional intellectual property office is usually required to be searched for consultation and evaluation is carried out by a patent engineer, and the problems of too long time consumed in a consultation process and an evaluation process, poor timeliness of information feedback and the like exist in both field consultation and online consultation.
Based on the above problems, some technical solutions for automatically generating and testing intellectual property value are proposed in the prior art, and by taking chinese patent application 2019113359053 as an example, a system for automatically generating and testing intellectual property value is disclosed: the device comprises a receiving unit, a storage unit, a calculation unit, an evaluation unit and a feedback unit; the receiving unit comprises a character receiving unit and a number receiving unit; the character receiving unit is used for receiving and uploading characters in the input patent documents; the number receiving unit is used for receiving and uploading the digital labels in the input patent documents; a storage unit for storing the patent documents received by the receiving unit and recording the patent documents in the test system; the calculation unit is used for calculating whether wrongly written characters exist in the contents of the received patent documents, whether sentences are smooth or not and whether formats are normal or not; the evaluation unit is used for evaluating the patent document without series errors after the calculation is finished by the calculation unit, evaluating the value of the patent document and other patent documents in the same technical field in intellectual property rights and generating value data; and the feedback unit is used for transmitting the value data to the terminal through the cloud server and checking the value data through the terminal. However, the system is only suitable for evaluating the value of a certain patent, and cannot evaluate and screen the value of the relevant patent of a certain enterprise or personal object. Meanwhile, the defect of inconvenient communication also exists, and if the user doubts the value evaluation result, the user cannot directly communicate with the service party on the test system.
In summary, how to provide an intelligent, intuitive and convenient patent screening method for information interaction is a technical problem that needs to be solved urgently at present.

Examples
Referring to fig. 1, a method for screening high-asset-value patents is provided according to an embodiment of the present invention. The method comprises the following steps:
and S100, collecting patent screening requests triggered by users aiming at enterprise objects or personal objects based on the instant messaging tool.
Specifically, a contact object corresponding to an enterprise object or a personal object may be established in the instant messaging tool based on the enterprise object or the personal object. And a patent screening control is arranged corresponding to the enterprise contact person object, and when the user selects the patent screening control, a patent screening request is triggered.
The instant messenger, also called instant messenger, is commonly referred to in the art as a client with instant messaging capability, such as WeChat, QQ, and nailing. By way of example and not limitation, the instant messaging tool may be a web application, a PC application, or a handheld APP application.
The user establishes the connection between the instant communication client and the instant communication server by logging in the instant communication tool. The instant communication tool outputs a user main interface to a user through a display screen of the user terminal. In the prior art, the user main interface may display a contact list pushed by an instant messaging server, where the contact list records friend information such as a head portrait, a nickname, a signature, an online status, a session message, and a ranking of a friend (a contact object). If the user triggers an interactive operation, which is commonly used, for a certain contact object in the contact list, for example, clicks to trigger a corresponding contact avatar, an IM interactive interface is generated accordingly. And the IM interactive interface is used for displaying historical interactive information, current interactive information and the like. The functions of the contact person application are improved, the patent screening control is arranged on the basis of the contact person object in the contact person application, the patent screening control can send a patent screening request aiming at the contact person object to the instant messaging server after being triggered, and the patent screening request comprises the contact person object information. When the contact object is an enterprise object, the contact object may include enterprise-related information such as an enterprise name and an organization code, and when the contact object is a personal object, the contact object may include personal-related information such as a name, a mobile phone number, and identification information.
S200, acquiring the patent information corresponding to the enterprise object or the personal object, establishing a patent information group corresponding to the enterprise object or the personal object in the instant communication tool, and adding each patent of the enterprise as a contact object into the patent information group to form a group member.
According to the enterprise or personal related information in the patent screening request, the instant messaging server obtains the patent information corresponding to the enterprise object or the personal object by searching the associated patent database (which can be a local patent information database, a network patent information database and/or a patent information database of other permitted terminals). Then, based on the patent information, a patent information group corresponding to the enterprise object or the personal object is established in the instant communication tool, and each patent of the enterprise object or the personal object is taken as a contact object to be added into the patent information group to form a group member.
The patent evaluation group may be displayed in a group list as other conventional chat groups.
Taking the IM tool Wechat as an example, referring to fig. 2, a user starts the IM tool through a user terminal, a user main interface is output on a display screen of the user terminal, a user avatar 110, a search bar 120 and a contact display bar 130 are displayed on the user main interface, and a contact list 131 of the user is displayed in the contact display bar 130. The contact list displays the contact objects of the user, and each contact corresponds to a communication object (which may be an enterprise object or a personal object). Each contact object corresponds to an avatar. In the contact list 131, for a contact object associated with patent information, a patent filtering control 140 is provided in a contact ITEM. After the patent screening control 140 is triggered, a patent information group corresponding to the corresponding enterprise object or personal object can be established in the instant messaging tool, and each patent of the enterprise object or personal object is added to the patent information group as a contact object to form a group member, as shown in fig. 3. The names of the members of the patent groups can represent the technical field and/or key technical content of the patent, wherein the names are preferably the application numbers or names of the patents, and can also be only indicated by numbers, such as patent 1, patent 2, patent 3 and the like.
In this embodiment, whether the contact object is associated with patent information may be set by a user or automatically set by the system. Optionally, a patent association object table may be set in the instant messaging tool, and the user may add the nickname or communication account of one or more contact objects in the contact list to the patent association object table, and the contact object added to the patent association object table is regarded as being associated with patent information. Further, the patent information associated with each contact object can be set through a patent associated object table. For example, if the user adds a friend "lie four" to the patent association object table, the friend "lie four" is an object associated with patent information, and the ITEM of the friend "lie four" is provided with the patent filtering control 140.
Optionally, the contact object associated with the patent information is displayed in the contact list 131 in a differentiated manner, for example and without limitation, a distinguishing identifier is set at the upper end of the avatar of the contact object associated with the patent information — a cloud identifier is illustrated in fig. 2, so that the user can conveniently identify which friends in the contact list are associated with the patent information. Of course, other character or graphic indicators may be used as desired, and are not intended to limit the present invention.
And S300, evaluating the value of each patent in the patent information group through a patent asset value evaluation system.
The patent asset worth assessment system is preferably provided by an instant messaging tool. Optionally, the instant messaging tool provides a plurality of patent asset value evaluation systems for the user to perform personalized selection as required, for example, a free value evaluation system and a paid value evaluation system may be included for the user to select.
S400, for the patent with the evaluation value exceeding the preset threshold value, outputting a high asset value identification through an ITEM ITEM of the group member corresponding to the patent.
Obtaining a value evaluation result of a patent asset value evaluation system, judging a patent with an evaluation value exceeding a preset threshold value as a high asset value patent, and outputting a high asset value mark through an ITEM ITEM of a group member corresponding to the patent, wherein the typical mode includes, for example, amplifying and displaying head portraits of the group members of the high asset value patent, loading a special color on the head portraits of the group members, or marking a star near the head portraits of the group members.
Preferably, the evaluation value of each patent is displayed on the ITEM of the corresponding group member of the patent, such as above or below the group avatar, in the form of a value mark 153, as shown in fig. 4. In this way, the user can intuitively obtain the evaluation value of the patent through the ITEM of the group member.
The patent asset value evaluation system provided by the embodiment can perform component-based asset value evaluation based on the element components of the patent.
Specifically, the step of evaluating the value of each patent in the patent information group by the patent asset value evaluation system may be as follows:
firstly, for each patent, performing element analysis on each patent based on a preset element analysis model, and acquiring a technical element component and a non-technical element component contained in the patent. The non-technical element components may specifically include legal element components and economic element components.
Specifically, for each patent, the patent asset value evaluation system of the instant messaging tool may obtain the patent related information of the aforementioned patent by searching the related patent database (which may be the local patent information database, the network patent information database and/or the patent information database of other licensing terminal), which may include the full patent document, technical related information (including information such as substitution, advancement, innovation, maturity, practicability, defensiveness and monopolization of the patent asset), legal related information (including information such as right attribute and right limitation of the patent asset, patent category, legal state of the patent, protection period of the remaining patent issue, protection range of the patent, review information, invalid information and litigation information), economic related information (including information such as acquisition cost, profitability, licensing fee, etc. of the patent asset), Transaction price of similar assets, etc.). The patent association information in the associated patent database may be pre-stored, and the patent database may be a database established by the instant messaging tool itself, or may be related data services purchased by the instant messaging tool, which is not limited herein. And then, the instant messaging server performs element analysis on the patent associated information of the patent to be evaluated based on a preset element analysis model to obtain a technical element component and a non-technical element component contained in the patent to be evaluated. As a typical example, the element analysis model adopts a three-element model, the three elements include technical elements, legal elements and economic elements, the element analysis model can divide the patent related information into three major categories, namely technical element components, legal element components and economic element components, and each major category of element components can further include one or more minor element components. It should be noted that, depending on the completeness of the patent association information of different patents to be evaluated, a patent to be evaluated does not necessarily include all three major categories of elements, for example, a certain patent to be evaluated may only include a technical element component (which may include one or more minor category element components) and a legal element component (which may include one or more minor category element components) because it does not have economic association information.
Then, the instant messaging server selects technical asset value evaluators matched with the field from a preset evaluator information base according to the field to which the technical element components belong as first associated contacts, and sends the component contents of the technical element components to the first associated contacts to evaluate the technical asset value; and selecting a non-technical asset value evaluator matched with the field from a preset evaluator information base according to the field to which the non-technical element component belongs as a second associated contact, and sending the component content of the non-technical element component to the second associated contact for non-technical asset value evaluation.
