Abstract
The invention provides a block chain-based patent securitization trading support system and a trading method thereof, which construct an ABS ecological trust mechanism by means of a block chain technology and combine a block chain and patent asset securitization to form a block chain-based patent securitization platform. The SPV platform is used as a special purpose company to isolate patent income from the operation condition of enterprises through real sale and bankruptcy isolation. The SPV evaluates and packages different patent assets, and then delivers the patent assets to underwriters for sale of securities through credit rating and credit increasing organization processing. Each time a patent is granted, funds flow into the SPV; the SPV then pays interest to the investor and pays principal to the investor periodically according to the preset rules. The related asset information and cash flow of the platform are written into a block chain, traceable and verifiable historical records and predictable and stable future cash flow can be obtained, the problem of opaque underlying assets is effectively solved, and online communication flow simplification and penetrating supervision of a supervision mechanism are realized.

Background
At present, the securitization of assets has been developed vigorously, and the securitization of assets based on patents has not been developed substantially. Chinese patent publication No. CN105488138A discloses a system for realizing patent securitization, which utilizes the capturing technique of getHTTPPage method and combines with database technique to realize patent securitization at low cost and high speed by legal data acquisition, but cannot solve the problem of poor fluidity of patent assets and cannot ensure information symmetry.
The patent securities market itself also has many pain points, and mainly has the following four problems:
patent assets are poor in mobility and difficult to convert known products into assets. The process is complicated, and the operation period is long: in the process of securitization of assets, not only asset evaluation but also asset packaging involve the benefits of all participants, the traditional mode is to coordinate all the parties through negotiation, the whole business link relates to dozens of support files, the making process is repeatedly modified, time is consumed for auditing and issuing documents, and the efficiency is low. And (III) the information is not symmetrically transparent, and the basic property is not transparent. The bottom assets are packaged assets, the quality of the assets in the bottom assets is different, the assets are good or bad, the information is not symmetrical, and the quality of each asset is difficult to distinguish by investors in patent asset securitization (IPBS). the system comprises user nodes, SPV platform nodes, credit rating mechanism nodes, credit increasing mechanism nodes and underwriting mechanism nodes, wherein the user nodes are arranged in a block chain and comprise patent holder nodes and patent purchaser nodes; the SPV platform node operates a plurality of patent pools, a patent holder uploads own patents to the SPV platform node and puts the patents into the patent pools, and the patent pools perform automatic transaction according to predefined rules in the pools by using an intelligent contract technology of a block chain; the SPV platform node is used as a special purpose company to isolate patent income from the operation condition of an enterprise through real sale and bankruptcy, predict future cash flow through acquiring transaction data in a patent pool, evaluate and pack different patent assets, deliver securities to a underwriter for sale through credit rating and design securities of a credit increasing mechanism, and invest by investors.
A patent securitization trading method of a block chain-based patent securitization trading support system comprises the following steps:
(1) creating a user node, an SPV platform node, a credit rating mechanism node, a credit increasing mechanism node and an underwriting mechanism node which are used for participating in patent transaction on a block chain;
(2) the user applies for future patent application permission to the SPV platform, the SPV platform returns price information to the user according to the rules of the patent pool, and the transaction record is linked up after agreement is reached; the SPV platform realizes real-time payment settlement by using a distributed account book technology, all information is stored in nodes owned and managed by benefit relatives, and the unification of data of each node is ensured through a block chain consensus mechanism;
(3) the SPV platform issues securities and comprises the following steps:
the SPV platform is used as a special purpose company and is not in the property range of a patent holder any more through patent transfer, and the patent of securitization is not influenced by the bankruptcy of the patent holder through bankruptcy isolation; the SPV evaluates and packs different patent assets by acquiring transaction records on the chain, designs securities by credit rating and credit increasing mechanisms, and finally delivers the securities to underwriters for selling, and links the securities issuing records;
(4) the SPV platform carries out security trading, and comprises the following steps: after investors invest patent securities, if users obtain the permission authorization of the patent, the patent transaction is carried out, and transaction funds flow into the SPV platform; the SPV platform automatically pays interest to investors periodically according to the preset rules of intelligent contracts, and pays principal to investors after securities are expired.
Has the advantages that: compared with the prior art, the invention has the following advantages:
firstly, the basic assets which can be securitized must have good history and predictable and stable future cash flow, the block chain realizes real-time payment settlement by using a distributed ledger technology, all information is stored on nodes owned and managed by stakeholders, and the unification of data of each node is ensured by a block chain consensus mechanism. Second, aiming at the opaque and asymmetric information of the underlying assets, only authorized persons in the private chain can see the information and transaction data in the chain. On the federation chain, information is disclosed to the parties participating therein. Participants on the chain can query for relevant asset information anytime and anywhere. Thereby reducing the potential risk to investors due to information asymmetry. Through the intelligent block chain contract, a complex game rule (namely, an intelligent contract) can be defined in advance, and the game rule cannot be changed once being determined, whether the game is a platform or a patent holder or a financial institution. Thereby effectively ensuring the fairness and justice in the process of asset evaluation, packaging and transaction. Third, many existing assets securitization files are paper or uploaded in PDF, but lack a uniform format and limit the automation process. The blockchain guarantees the validity of the transaction by recording the transaction on the primary centralized register and the connected common distributed register system. The fact that the data is embedded in the public network and updated with each transaction improves transparency and prevents modification or corruption. And online communication is realized, and the transaction flow is simplified. Fourth, the federation chain is also a valid tool for financial regulation. Financial supervision departments such as fund associations and the like can be invited to join a alliance chain to play a role in supervision, and each link in the process of securitization of assets is supervised in real time through technical means, so that the supervision work is changed from the current post supervision to real-time supervision, more data than the previous supervision work as a single center is mastered, the underlying assets are effectively mastered, and the penetrating supervision is really realized. The invention provides a block chain-based patent securitization transaction support system, the structure diagram of which is shown in figure 1 and comprises: the system comprises user nodes, SPV platform nodes, credit rating mechanism nodes, credit increasing mechanism nodes and underwriting mechanism nodes, wherein the user nodes are arranged in a block chain and comprise patent holder nodes and patent purchaser nodes; the SPV platform node operates a plurality of patent pools, a patent holder uploads own patents to the SPV platform node and puts the patents into the patent pools, and the patent pools perform automatic transaction according to predefined rules in the pools by using an intelligent contract technology of a block chain; the SPV platform node is used as a special purpose company to isolate patent income from the operation condition of an enterprise through real sale and bankruptcy, predict future cash flow through acquiring transaction data in a patent pool, evaluate and pack different patent assets, deliver securities to a underwriter for sale through credit rating and design securities of a credit increasing mechanism, and invest by investors.
Fig. 2 is a flow chart of a trading method of the block chain-based patent securitization trading support system, wherein the patent holders, companies (patent demanders), credit enhancement institutions, credit scoring institutions, underwriters and the like are in the chain in fig. 1. Part 201 is the basic transaction function of the platform, a plurality of users (companies) for participating in patent transaction are created on the block chain, the users apply for future patent enforcement permission to the SPV platform, the SPV platform returns price information to the users according to the rules of the patent pool, and the transaction records are linked after agreement is reached. The SPV platform realizes real-time payment settlement by using a distributed account book technology, all information is stored on nodes owned and managed by benefit relatives, and the unification of data of each node is ensured through a block chain consensus mechanism. Part 202 is the security issue part of the SPV platform, which mainly implements patent securitization, and the SPV platform is a special purpose company that is subject to patent transfer so that it no longer belongs to the property scope of the patent holder, and performs bankruptcy isolation so that bankruptcy of the patent holder does not affect the securitization patent. The SPV platform acquires transaction records on the chain through a revenue method to evaluate and pack different patent assets, designs securities through credit rating and credit increasing mechanisms, and finally delivers the securities to underwriters for selling, and links the securities issuing records. And simultaneously inviting government agencies and supervision agencies to link and supervise the securitization and transaction process of patent assets, supervising each link in the securitization process of the assets and realizing penetration type real-time supervision. Part 203 is a security trading part of the platform, after investors invest in patent securities, if users (companies) obtain the permission and authorization of the patent, namely the patent trading is carried out, trading funds flow into the SPV platform; the SPV platform automatically pays interest to the investor periodically according to the preset rules of the intelligent contract, and pays the principal to the investor after the securities are expired.

the system comprises user nodes, SPV platform nodes, credit rating mechanism nodes, credit increasing mechanism nodes and underwriting mechanism nodes, wherein the user nodes are arranged in a block chain and comprise patent holder nodes and patent purchaser nodes; the SPV platform node operates a plurality of patent pools, a patent holder uploads own patents to the SPV platform node and puts the patents into the patent pools, and the patent pools perform automatic transaction according to predefined rules in the pools by using an intelligent contract technology of a block chain; the SPV platform node is used as a special purpose company to isolate patent income from the operation condition of an enterprise through real sale and bankruptcy, predict future cash flow through acquiring transaction data in a patent pool, evaluate and pack different patent assets, deliver securities to a underwriter for sale through credit rating and design securities of a credit increasing mechanism, and invest by investors.
2. A patent securitization transaction method based on the block chain-based patent securitization transaction support system of claim 1, comprising the steps of:
(1) creating a user node, an SPV platform node, a credit rating mechanism node, a credit increasing mechanism node and an underwriting mechanism node which are used for participating in patent transaction on a block chain;
