The message center pushes the system agreement invitation to all the contracting parties, if all the contracting parties, namely common contracting persons, agree to the agreement, the contract center sets the contract state of the electronic contract to be in effect, namely the effective state, the electronic contract enters a performance period, and the credit closed-loop electronic contract is informed to enter the closed-loop influence credit evaluation. And then, the credit closed loop starts to defend contract performance data, and a credit closed loop result is delivered to the contract center to return.
Please refer to fig. 4, which is a performance flow of the electronic contract. The performance of the electronic contract is completed by the contract market, the order center, the trading center, the contract center, the credit closed loop and the message center of the client and the server. The electronic contract can adopt an online contract-signing offline-performing mode, perform performing in an online offline store, namely a physical store, and return performing data through an application end. Specifically, the contractor can enter a contracted store through the two-dimension code or the contract market under the scanning line of the application end, and the commodity or the service is selected from the contract market through the application end. The contract market inquires the data of the commodities or the services in the contracted store from the order center and returns the data obtained by inquiry to the application end. And the application end displays the commodity or service data in the contracted store for the user to select the commodity or service, and places an order to the order center after the commodity or service selected by the user is obtained. And the order center receives the order from the application terminal, performs persistent order operation, generates an order number and returns the order number to the application terminal. The application may initiate a payment request to the trading center for the order. And the transaction center responds to the payment request of the application end, returns a payment result to the application end after completing corresponding payment operation, and asynchronously informs the order center of the payment result so that the order center updates the order transaction state, such as the order transaction state is updated to be paid. After the application end receives the payment result and returns, the application end can also synchronously inform the order center of the payment result, so that the order center updates the order transaction state. After the order transaction state is updated, the order center returns a notification result to the application end, and if the application end is notified that the order is completed, the fulfillment is completed once. For the performance of the contracted party, the order center will asynchronously inform the contract center of the order state, the contract center adds the record of the performance of the contracted party once, and pushes the performance to the credit closed loop, and the credit closed loop displays the credit guard, such as displaying the record of the performance of the electronic contract. When contract performance conditions of the electronic contract are fulfilled, the contract center sets the contract as performance completion, and transmits a contract performance completion message to all the contracting parties through the message center. The contract center also informs the credit closed loop of the completion of the performance, the credit closed loop sets the performance state of the electronic contract as the completion of the performance, performs the performance incentive to improve the credit assessment value of the performer, and pushes the result of the performance incentive to return to the contract center, the order center and the application terminal.
Please refer to fig. 5, which is a process of performing monitoring of an electronic contract. The method is completed by a timeout center, a contract market, a message center and a credit closed loop of a server side together. The overtime center carries out timing scheduling to the contract center so as to prompt the contract center to inquire contract details, and contract management is carried out according to the contract details, wherein the contract management comprises the following steps:
and when the contract state is initialized and the contract is created for more than a first preset time, such as 60 minutes, the contract is updated to be invalid, and the contract is not processed when the contract does not exceed the first preset time, such as 60 minutes. The contract status is in delivery and the contract is offered for more than a second predetermined time, e.g., 30 days, e.g., no contract, the contract is updated for off-shelf and the contract is removed through the contract market, and no processing is done if the electronic contract delivery does not exceed the second predetermined time, e.g., 30 days. When the contract status is in effect, if the contract is expired and has performed or has not expired and has performed, no processing is required. If the contract state is in an effective state, if the contract is not expired, pushing non-performing reminding information to all the contracting parties through the information center to remind the contracting parties to perform. When the contract state is in an effective state, if the contract is expired without performing and the expiration time exceeds a third preset time, such as 7 days, the contract can be updated to be performed default, a default notification message is pushed to all the contractors through the message center, a non-performing notification message is pushed to all the contractors, a performing list non-performing message is pushed to the credit closed loop, the electronic contract is set to be performed incomplete through the credit closed loop, and the credit evaluation value of the owner of the default party is punished and reduced.
In the embodiment, the credit wind control qualification auditing is carried out before the contract starting, and the credit wind control qualification incentive or punishment is carried out on the electronic contract in the performance process after the electronic contract takes effect, so that the credit closed management of the electronic contract is realized, and the binding force of the electronic contract is improved through the credit closed management; furthermore, when starting the contract, a starting partner is selected and invited by the contract service end to start the contract together to realize mass signing, and the credit wind control qualifications of the starting party, namely all the contractors, are subjected to performance incentive or default joint punishment, namely the performance incentive or default joint punishment of the electronic contract is realized by combining the mass signing and the credit closed management, so that the binding force of the electronic contract is improved.
Based on the embodiment, a credit closed-loop mass-signature commercialized electronic contract solution is realized. Assessing contract origination and contracted qualification using credit wind control, assessing a person's performance by credit rather than by asset; evaluating contract starting and contract receiving risks by using contract wind control, and avoiding malicious use and propagation of the contract by using the contract wind control; delivering and digesting electronic contracts using a contract market to commercialize the contracts no longer to have only contract properties but also commodity properties; the adoption of a light mode of many-sign contracts reduces the contracting burden of an initiator and the contracting burden of an acceptor, treats the performance as a light credit consumption behavior, directly contacts the initiator and the acceptor, reduces intermediate cost, and improves service quality and performance quality; the method orders the contract by using the credit evaluation value, realizes the contract transaction by using the credit as an equivalent, and realizes the commitment and punishment mechanism of the credit closed loop to the contract performance violation, so that the two parties of the contract are allowed to fulfill the commitment under the drive of the credit, and the method is a novel contract system which depends on the credit as a contract guarantee voucher.
Based on the foregoing embodiment, in a method for processing an electronic contract provided by a server, this embodiment further provides a processing apparatus for an electronic contract, referring to fig. 6, where the apparatus includes:
the credit wind control unit 61 is used for auditing the credit wind control qualification of the sponsor;
the contract processing unit 62 is used for acquiring a contract money and an offer partner selected by the offer initiator based on an offer request sent by an application end and sending an offer invitation to all offer partners based on the contract money if the credit wind control qualification audit of the offer initiator passes; receiving the offer feedback of the offer invitation, and delivering the electronic contract corresponding to the contract money in the form of commodities if all offer partners accept the offer invitation; receiving contract accepting feedback of the electronic contract, and if the contracted party agrees to accept, placing the electronic contract in an effective state;
a performing monitoring unit 63, configured to perform performing monitoring on the sponsor and the payee of the electronic contract after the electronic contract is validated;
and the credit management unit 64 is used for performing performance incentive on the credit wind control qualification of the performing party based on the monitoring data, or performing default punishment on the credit wind control qualification of the default party based on the monitoring data.
Optionally, the processing apparatus of the electronic contract may further include a contract wind control unit 65, configured to perform a contract wind control check on the electronic contract corresponding to the contract initiating request before sending the contract initiating invitation to all the contract initiating partners based on the contract money; and if the contract wind control verification is passed, executing the sending operation of the contract invitation, and if the contract wind control verification fails, feeding back the information of the failure of the contract invitation of the application end.
As an optional implementation, the credit management unit 64 is configured to: based on the monitoring data, judging whether the electronic contract is performed in a first time period before the electronic contract expires, if not, sending an overdue warning message to an unreveyor; or, based on the monitoring data, judging whether the electronic contract has been performed before or when the electronic contract expires, if so, exciting the credit wind control qualification of the sponsor and the credit wind control qualification of the contractor; or judging whether the electronic contract has been performed in a second time period after the electronic contract is expired based on the monitoring data, and if not, punishing the credit wind control qualification of the owner of the default party.
As an optional implementation, the contract processing unit 62 is further configured to: receiving a contract request for the electronic contract sent by the application terminal, and sending a contract invitation to a common contractor in the contract request based on the electronic contract; and receiving feedback of all the common acceptors to the invitation to accept, and if all the common acceptors agree to accept, putting the electronic contract into an effective state.
As an alternative embodiment, the credit wind control unit 61 is further configured to:
auditing credit wind control qualifications of an offer originator prior to said sending an offer invitation to a common offeree in the offer request based on the electronic contract; and if the credit wind control qualification audit of the agreement initiator passes, executing the operation of sending an agreement invitation to the common contractor in the agreement request based on the electronic agreement. And after qualification verification is passed, the operation of sending a contract invitation to the common contractor in the contract request based on the electronic contract is executed.
Based on the foregoing embodiment, in a method for processing an electronic contract provided by an application, this embodiment further provides a processing apparatus for an electronic contract, referring to fig. 7, where the apparatus includes:
an origination unit 71 configured to acquire an origination buddy list and select an origination buddy from the origination buddy list as a common originator; acquiring a contract money input by a user;
a sending unit 72, configured to send an offer initiation request to a server based on the contract money and the offer initiation partner;
the agreement initiation request is used for requesting the server side to send an agreement initiation invitation to all the agreement initiation partners, and after all the agreement initiation partners agree with the agreement initiation, the electronic contract generated by the contract money is delivered in a commodity form for being selected by the accepting party.
In a specific implementation process, the processing apparatus of the electronic contract may further include: a receiving unit 73, configured to receive performance information input by a user after the electronic contract is validated; the sending unit 72 is further configured to send the performance information to the server, so that the server performs performance monitoring on a sponsor and a payee of the electronic contract based on the performance information, performs performance incentive on credit wind control qualification of the performing party based on the monitoring data, or performs penalty on default on the credit wind control qualification of the default party based on the monitoring data.
In a specific implementation process, the slave processing device of the electronic contract may further include: an appointment unit 74 for acquiring a common appointment list and selecting a common appointment from the common appointment list; acquiring a target electronic contract selected by a user; sending a contract request to a server based on the target electronic contract and the common contractor; and the agreement request is used for requesting the server side to send an agreement invitation to all the common acceptors, and after all the common acceptors agree to the agreement, the target electronic contract is put into an effective state.
With regard to the apparatus in the above-described embodiments, the specific manner in which the respective units perform operations has been described in detail in the embodiments related to the method and will not be elaborated upon here.
Referring to FIG. 8, a block diagram of an electronic device 700 for implementing a method for processing an electronic contract is shown in accordance with an exemplary embodiment. For example, the electronic device 700 may be a computer, database console, tablet device, personal digital assistant, and the like.
Referring to fig. 8, electronic device 700 may include one or more of the following components: a processing component 702, a memory 704, a power component 706, a multimedia component 708, an input/output (I/O) interface 710, and a communication component 712.
The processing component 702 generally controls overall operation of the electronic device 700, such as operations associated with display, data communication, and recording operations. The processing element 702 may include one or more processors 720 to execute instructions to perform all or part of the steps of the methods described above. Further, the processing component 702 may include one or more modules that facilitate interaction between the processing component 702 and other components.
The memory 704 is configured to store various types of data to support operation at the device 700. Examples of such data include instructions for any application or method operating on the electronic device 700, contact data, phonebook data, messages, pictures, videos, and so forth. The memory 704 may be implemented by any type or combination of volatile or non-volatile memory devices such as Static Random Access Memory (SRAM), electrically erasable programmable read-only memory (EEPROM), erasable programmable read-only memory (EPROM), programmable read-only memory (PROM), read-only memory (ROM), magnetic memory, flash memory, magnetic or optical disks.
The power supply component 706 provides power to the various components of the electronic device 700. The power components 706 may include a power management system, one or more power sources, and other components associated with generating, managing, and distributing power for the electronic device 700.
The I/O interface 710 provides an interface between the processing component 702 and peripheral interface modules, which may be keyboards, click wheels, buttons, etc. These buttons may include, but are not limited to: a home button, a volume button, a start button, and a lock button.
The communication component 712 is configured to facilitate wired or wireless communication between the electronic device 700 and other devices. The electronic device 700 may access a wireless network based on a communication standard, such as WiFi, 2G or 3G, or a combination thereof. In an exemplary embodiment, the communication part 712 receives a broadcast signal or broadcast associated information from an external broadcast management system via a broadcast channel. In an exemplary embodiment, the communication component 712 further includes a Near Field Communication (NFC) module to facilitate short-range communications. For example, the NFC module may be implemented based on Radio Frequency Identification (RFID) technology, infrared data association (IrDA) technology, Ultra Wideband (UWB) technology, Bluetooth (BT) technology, and other technologies.
In an exemplary embodiment, the electronic device 700 may be implemented by one or more Application Specific Integrated Circuits (ASICs), Digital Signal Processors (DSPs), Digital Signal Processing Devices (DSPDs), Programmable Logic Devices (PLDs), Field Programmable Gate Arrays (FPGAs), controllers, micro-controllers, microprocessors or other electronic components for performing the above-described methods.
In an exemplary embodiment, a non-transitory computer readable storage medium comprising instructions, such as the memory 704 comprising instructions, executable by the processor 720 of the electronic device 700 to perform the above-described method is also provided. For example, the non-transitory computer readable storage medium may be a ROM, a Random Access Memory (RAM), a CD-ROM, a magnetic tape, a floppy disk, an optical data storage device, and the like.
A non-transitory computer-readable storage medium in which instructions, when executed by a processor of a mobile terminal, enable an electronic device to perform a method of processing an electronic contract, the method comprising:
auditing the credit wind control qualification of the sponsor; if the credit wind control qualification audit of the initiation sponsor passes, acquiring a contract money and an initiation partner selected by the initiation sponsor based on an initiation request sent by an application end, and sending initiation invitations to all initiation partners based on the contract money; receiving the offer feedback of the offer invitation, and delivering the electronic contract corresponding to the contract money in the form of commodities if all offer partners accept the offer invitation; receiving contract accepting feedback of the electronic contract, and if the contracted party agrees to accept, placing the electronic contract in an effective state; after the electronic contract takes effect, performing performance monitoring on an initiator and a receiver of the electronic contract; and carrying out performance incentive on the credit wind control qualification of the performing party based on the monitoring data, or carrying out default union punishment on the credit wind control qualification of the default party based on the monitoring data.
Wherein, prior to said sending an invitation to initiate to all of the initiating partners based on the contract money, the method further comprises: carrying out contract wind control verification on the electronic contract corresponding to the contract request; and if the contract wind control verification is passed, executing the sending operation of the contract invitation, and if the contract wind control verification fails, feeding back the information of the failure of the contract invitation of the application end.
Performing performance incentive on the credit wind control qualification of the performing party based on the monitoring data, or performing default punishment on the credit wind control qualification of the default party based on the monitoring data, wherein the method comprises the following steps: based on the monitoring data, judging whether the electronic contract is performed in a first time period before the electronic contract expires, if not, sending an overdue warning message to an unreveyor; or, based on the monitoring data, judging whether the electronic contract has been performed before or when the electronic contract expires, if so, exciting the credit wind control qualification of the sponsor and the credit wind control qualification of the contractor; or judging whether the electronic contract has been performed in a second time period after the electronic contract is expired based on the monitoring data, and if not, punishing the credit wind control qualification of the owner of the default party.
After receiving the contracting feedback of the electronic contract, if the contracting party agrees to contract, the electronic contract is put into effect, and the method comprises the following steps: receiving a contract request for the electronic contract sent by the application terminal, and sending a contract invitation to a common contractor in the contract request based on the electronic contract; and receiving feedback of all the common acceptors to the invitation to accept, and if all the common acceptors agree to accept, putting the electronic contract into an effective state.
Prior to the sending of a contract invitation to a common contractor in the contract request based on the electronic contract, the method further comprises: auditing the credit wind control qualification of the contracted initiator; and if the credit wind control qualification audit of the agreement initiator passes, executing the operation of sending an agreement invitation to the common contractor in the agreement request based on the electronic agreement.
It will be understood that the present embodiments are not limited to the precise arrangements described above and shown in the drawings, and that various modifications and changes may be made without departing from the scope thereof. Claims (20)

1. A processing method of an electronic contract is applied to a server side, and the method comprises the following steps:
auditing the credit wind control qualification of the sponsor;
if the credit wind control qualification audit of the initiation sponsor passes, acquiring a contract money and an initiation partner selected by the initiation sponsor based on an initiation request sent by an application end, and sending initiation invitations to all initiation partners based on the contract money;
receiving the offer feedback of the offer invitation, and delivering the electronic contract corresponding to the contract money in the form of commodities if all offer partners accept the offer invitation;
receiving contract accepting feedback of the electronic contract, and if the contracted party agrees to accept, placing the electronic contract in an effective state;
after the electronic contract takes effect, performing performance monitoring on an initiator and a receiver of the electronic contract; and carrying out performance incentive on the credit wind control qualification of the performing party based on the monitoring data, or carrying out default union punishment on the credit wind control qualification of the default party based on the monitoring data.
2. The method of claim 1, prior to said sending origination invitations to all origination partners based on said contract money, said method further comprising:
carrying out contract wind control verification on the electronic contract corresponding to the contract request;
and if the contract wind control verification is passed, executing the sending operation of the contract invitation, and if the contract wind control verification fails, feeding back the information of the failure of the contract invitation of the application end.
3. The method of claim 1, wherein the performing incentive for the credit pneumatic qualification of the performing party based on the monitoring data or the penalty punishment for the default credit pneumatic qualification based on the monitoring data comprises:
based on the monitoring data, judging whether the electronic contract is performed in a first time period before the electronic contract expires, if not, sending an overdue warning message to an unreveyor; alternatively, the first and second electrodes may be,
judging whether the electronic contract has been performed before or when the electronic contract expires based on the monitoring data, if so, motivating the credit wind control qualification of the sponsor and the credit wind control qualification of the contractor; alternatively, the first and second electrodes may be,
and judging whether the electronic contract has been performed in a second time period after the electronic contract is expired or not based on the monitoring data, and if not, punishing the credit wind control qualification of the owner of the default party.
4. A method as claimed in any one of claims 1 to 3, wherein receiving offer feedback for the electronic contract and placing the electronic contract in effect if the offer is agreed to by the offeree comprises:
receiving a contract request for the electronic contract sent by the application terminal, and sending a contract invitation to a common contractor in the contract request based on the electronic contract;
and receiving feedback of all the common acceptors to the invitation to accept, and if all the common acceptors agree to accept, putting the electronic contract into an effective state.
5. The method of claim 4, prior to said sending a contract invitation to a common contractor in the contract request based on the electronic contract, the method further comprising:
auditing the credit wind control qualification of the contracted initiator;
and if the credit wind control qualification audit of the agreement initiator passes, executing the operation of sending an agreement invitation to the common contractor in the agreement request based on the electronic agreement.
6. A processing method of an electronic contract is applied to an application end, and the method comprises the following steps:
obtaining an offer partner list, and selecting an offer partner from the offer partner list as a common offeror;
acquiring a contract money input by a user;
sending an offer initiation request to a server based on the contract money and the offer initiation partner;
the agreement initiation request is used for requesting the server side to send an agreement initiation invitation to all the agreement initiation partners, and after all the agreement initiation partners agree with the agreement initiation, the electronic contract generated by the contract money is delivered in a commodity form for being selected by the accepting party.
7. The method of claim 6, further comprising:
after the electronic contract takes effect, receiving performance information input by a user;
and sending the performance information to the server side, so that the server side performs performance monitoring on an initiator and a receiver of the electronic contract based on the performance information, performs performance incentive on credit wind control qualification of the performing party based on the monitoring data, or performs default punishment on the credit wind control qualification of the default party based on the monitoring data.
8. The method of claim 6, further comprising:
obtaining a common contractor list, and selecting common contractors from the common contractor list;
acquiring a target electronic contract selected by a user;
sending a contract request to a server based on the target electronic contract and the common contractor;
and the agreement request is used for requesting the server side to send an agreement invitation to all the common acceptors, and after all the common acceptors agree to the agreement, the target electronic contract is put into an effective state.
9. An electronic contract processing system, the system comprising:
the application terminal is used for acquiring a contract money and an offer partner input by a user and sending an offer request based on the contract money and the offer partner;
the server is used for auditing the credit wind control qualification of the sponsor; if the credit wind control qualification audit of the initiation sponsor passes, sending initiation invitations to all initiation partners based on the contract money; receiving the offer feedback of the offer invitation, and delivering the electronic contract corresponding to the contract money in the form of commodities if all offer partners accept the offer invitation; receiving contract accepting feedback of the electronic contract, and if the contracted party agrees to accept, placing the electronic contract in an effective state; after the electronic contract takes effect, performing performance monitoring on an initiator and a receiver of the electronic contract; and carrying out performance incentive on the credit wind control qualification of the performing party based on the monitoring data, or carrying out default union punishment on the credit wind control qualification of the default party based on the monitoring data.
10. The system of claim 9, the server further configured to:
based on the monitoring data, judging whether the electronic contract is performed in a first time period before the electronic contract expires, if not, sending an overdue warning message to an unreveyor; alternatively, the first and second electrodes may be,

11. A processing apparatus for an electronic contract, comprising:
the credit wind control unit is used for auditing the credit wind control qualification of the sponsor;
the contract processing unit is used for acquiring a contract money and an offer partner selected by the offer initiator based on an offer request sent by an application end under the condition that the credit wind control qualification audit of the offer initiator passes, and sending offer invitations to all the offer partners based on the contract money; receiving the offer feedback of the offer invitation, and delivering the electronic contract corresponding to the contract money in the form of commodities if all offer partners accept the offer invitation; receiving contract accepting feedback of the electronic contract, and if the contracted party agrees to accept, placing the electronic contract in an effective state;
a performing monitoring unit, configured to perform performing monitoring on a sponsor and a receiver of the electronic contract after the electronic contract takes effect;
and the credit management unit is used for carrying out performance incentive on the credit wind control qualification of the performing party based on the monitoring data, or carrying out default joint punishment on the credit wind control qualification of the default party based on the monitoring data.
12. The apparatus of claim 11, further comprising:
the contract wind control unit is used for carrying out contract wind control verification on the electronic contract corresponding to the contract initiating request before sending the contract initiating invitation to all contract initiating partners based on the contract money; and if the contract wind control verification is passed, executing the sending operation of the contract invitation, and if the contract wind control verification fails, feeding back the information of the failure of the contract invitation of the application end.
13. The apparatus of claim 11, the credit management unit to:

and receiving feedback of all the common acceptors to the invitation to accept, and if all the common acceptors agree to accept, putting the electronic contract into an effective state.
15. The apparatus of claim 14, the credit wind control unit further to:
auditing credit wind control qualifications of an offer originator prior to said sending an offer invitation to a common offeree in the offer request based on the electronic contract; and if the credit wind control qualification audit of the agreement initiator passes, executing the operation of sending an agreement invitation to the common contractor in the agreement request based on the electronic agreement.
16. A processing apparatus for an electronic contract, comprising:
an origination unit configured to acquire an origination buddy list and select an origination buddy from the origination buddy list as a common originator; acquiring a contract money input by a user;
a sending unit, configured to send an offer initiation request to a server based on the contract money and the offer initiation partner;
the agreement initiation request is used for requesting the server side to send an agreement initiation invitation to all the agreement initiation partners, and after all the agreement initiation partners agree with the agreement initiation, the electronic contract generated by the contract money is delivered in a commodity form for being selected by the accepting party.
17. The apparatus of claim 16, the apparatus further comprising: the receiving unit is used for receiving the performance information input by the user after the electronic contract takes effect;
the sending unit is further configured to send the performance information to the server, so that the server performs performance monitoring on a sponsor and a payee of the electronic contract based on the performance information, performs performance incentive on credit wind control qualification of the performing party based on the monitoring data, or performs penalty on default on the credit wind control qualification of the default party based on the monitoring data.
18. The apparatus of claim 16, the apparatus further comprising:
