본 발명은 소유자가 존재하는 토지 상공의 공중권 명시와 거래를 지원하기 위하여 대체 불가능한 디지털 토큰(non-fungible token; NFT)으로써 공중권에 대하여 배타성과 공신력을 부여함으로써 공중권의 거래 활성화를 지원하는 공중권 명시 및 거래 시스템에 관한 것이다.
소유자가 존재하는 토지는 매매가 가능한 자산으로 인식되며, 공중권은 토지의 상공에 가상의 상한이 설정됨으로써 과부족에 기인한 교환가치가 발생하는데, 탄소배출권 거래가 비근한 예이다.
또한, 도심부 용적 및 고도 관리, 노후 구조물 리모델링 및 재건축 소요 증가로 인한 재원 조달, 조망권 및 일조권 권리 조정에 대한 법적 수요 증가로 인하여 공중권 명시 및 가치 산정이 중요한데 기존 기술로는 해결이 난망하다.
또한, 토지 소유권은 등기부에 항시 명시된 권리임에 반해 공중권은 권리 변동에 따른 설정행위에 의하여 명시에 이르는 문제점이 존재하고, 기존 등기부 시스템은 소유권에 관한 추정력만 인정되고 공신력은 인정되지 아니하므로 공중권 거래 활성화를 위해서는 물권 변동에 대한 배타성 및 공신력 부여 수단이 요구된다.

본 발명은 상기와 같은 기존 기술의 한계를 개선하기 위해 안출된 것으로, 공중권 설정내용이 항시 명시됨으로써 거래 활성화가 가능하도록 대체 불가능한 디지털 토큰으로써 공중권에 대하여 배타성과 공신력을 부여하는 것을 목적으로 한다.
또한, 상기의 수단으로써 토지 상부의 미사용 공간(unused space)을 양도하는 공중권(air rights) 본연의 개념 뿐 아니라, 일방의 미사용 개발권을 타방으로 임대하는 이전 가능한 개발권(transferable development rights)의 확장된 개념까지 포함함으로써 통합적인 거래실시가 가능하도록 하는 것을 목적으로 한다.
또한, 상기의 수단으로써 거래의 안전성을 확보하여 선의의 피해자 발생을 방지하고, 공중권의 분할거래도 가능하게 함으로써, 기존 부동산 시장에 대하여 추가적인 유동성을 공급하는 것을 목적으로 한다.
또한, 상기의 수단으로써 차등적으로 적용되는 규제나 소유자의 필요에 따라 공중권 설정고도를 입력할 수 있도록 함으로써, 인위적인 과부족 발생에 의해 시장에서의 교환가치가 보다 제고되도록 하는 것을 목적으로 한다.

본 발명에 따르면, 본 발명은 상기와 같은 종래 기술을 개선하기 위해 안출된 것으로서, 공중권에 관한 권리내역이 항시적으로 명시되도록 하기 위하여 대체 불가능한 디지털 토큰으로써 배타성을 부여함으로써 법리적 해석의 차이를 극복하고 공중권을 통합 거래할 수 있을 뿐 아니라 분할매매 및 분할임대까지도 가능하도록 할 수 있다.
또한, 본 발명에 따르면 설정된 공중권 제반정보의 원본이 네트워크 경유로 분산되어 저장되므로 공신력 부여가 가능하고 위·변조 차단과 권리의 이중양도에 따른 선의의 피해자 발생을 원천적으로 방지할 수 있을 뿐 아니라, 거래내역 공개로 인해 계약 체결 즉시 자동으로 정부에 대한 납세가 가능하도록 할 수 있다.
또한, 본 발명에 따르면 차등적으로 적용되는 개발규제나 소유자의 필요에 따라 공중권 설정고도를 입력할 수 있도록 함으로써, 인위적인 과부족 발생에 의해 시장에서의 교환가치가 보다 제고되도록 할 수 있다.
도 1은 본 발명의 관한 디지털 토큰에 의한 공중권 명시 및 거래 시스템의 개념도를 도시한 것이다.
도 2는 소유자가 존재하는 토지의 소유권이 상·하부에 미치는 입체적 권리를 도시한 것이다.
도 3은 미사용 공간에 대한 소유권 양도를 의미하는 본연의 공중권과 미사용 개발권의 임대를 의미하는 개발권의 이전을 구분하여 설명하기 위해 도시한 것이다.
도 4는 조망권 및 일조권을 포함하는 사적 권리의 조정을 위하여 본 발명에 의해 안출된 공중권 명시 및 거래의 구체적인 활용 예를 도시한 것이다.
이하, 첨부된 도면들 및 첨부된 도면들에 기재된 내용들을 참조하여 본 발명의 실시를 위한 최선의 형태를 상세하게 설명하지만, 본 발명이 실시예들에 의하여 제한되거나 한정되는 것은 아니다. 각 도면에 제시된 동일한 참조부호는 동일한 부재를 나타낸다.
도 1은 본 발명의 관한 디지털 토큰에 의한 공중권 명시 및 거래 시스템의 개념도를 도시한 것이며, 도 2는 소유자가 존재하는 토지의 소유권이 상·하부에 미치는 입체적 권리를 도시한 것이며, 도 3은 미사용 공간에 대한 소유권 양도를 의미하는 본연의 공중권과 미사용 개발권의 임대를 의미하는 개발권의 이전을 구분하여 설명하기 위해 도시한 것이며, 도 4는 조망권 및 일조권을 포함하는 사적 권리의 조정을 위하여 본 발명에 의해 안출된 공중권 명시 및 거래의 구체적인 활용 예를 도시한 것이다.
본 발명에 의한 대체 불가능한 디지털 토큰에 의한 공중권 명시 및 거래 시스템(1)은 메인 서버(100)와 검증부(200)와 블록체인 서버(300)와 본부(10) 내 조작부(500)와 본부(10) 외부의 분산저장소(400)와 공중권 거래 마켓플레이스(20)와 회원의 정보 입출력을 지원하는 조작부(500)와 고유한 전자지갑을 보유한 매수자와 매도자와 중개업자와 정부로 구성되며, 본부(10)에서 설정된 공중권 제반정보를 블록체인 서버(300)에 기록하고 원본을 네트워크 경유로 분산저장소(400)에 분산하여 저장함으로써 공신력을 부여하고 대체 불가능한 디지털 토큰으로 생성함으로써 배타성 부여를 통해 거래의 활성화가 가능하도록 할 수 있다. 여기서 지시하는 공중권이라 함은, 소유자가 존재하는 토지 상공에 존재하고 소유자의 정당한 권리 행사가 인정되는 공간에 미치는 권리를 의미하며, 디지털 토큰 내에 약정된 계약이행에 의하여 설정된 공중권의 범위 및 기간만큼 임대되거나 양도가 실시되도록 설정된 배타적 권리를 뜻한다.
상기 본부(10)의 일측을 이루는 메인 서버(100)는, 매수자와 매도자와 중개업자와 정부가 네트워크 경유로 공중권 마켓플레이스를 통해 고유정보 기입 후 회원등록을 신청하면 회원정보 데이터베이스(110) 내 등록회원 테이블(111)에 당해 정보가 기록됨으로써 회원가입이 완료되며, 상기 각 회원은 소정의 절차에 의거하여 지불수단의 입출금을 위한 전자지갑을 생성한다.
상기 메인 서버(100)의 일측을 이루는 지도정보 데이터베이스(120)는, 회원에게 공중권 명시를 위한 지도정보와 공중권의 범위를 표시하기 위한 부분이며, 상기 지도정보 데이터베이스(120) 내에 설치된 지도정보(121)의 출력 화상을 각 회원의 조작부(500)에 부착된 디스플레이 장치를 통해 표시한다. 상기 지도정보 데이터베이스(120)는, 회원 증가에 따라 표시정보가 과다할 경우 과부하로 인하여 별도의 지도 서버 구축을 통해 대처해야 할 수도 있는데, 이 경우 상기 메인 서버(100) 내부에 상기 지도정보 데이터베이스(120) 구축을 통해 운용하는 현행 방안과, 상기 메인 서버(100) 외부에 별도의 지도 서버를 구축하되 상기 본부(10) 내에 두는 방안과, 네트워크 경유로 지도 전문 업체가 제공하는 지도정보 서비스를 활용하는 방안이 가능하다.
상기 지도정보 데이터베이스(120)의 일측을 이루는 고도제한정보 테이블(122)은, 차등적으로 적용되는 개발규제나 소유자의 필요에 따라 공중권 설정고도를 기록할 수 있도록 한다. 도 2에서 보듯, 고도나 용적에 관한 규제가 존재하지 아니하다면 공중권은 상기 고도제한정보 테이블(122)에 대한 기록 없이 공적 공중권 하부에 존재하는 사적 공중권에 한정되는 것으로 간주된다.
상기 본부(10)의 일측을 이루는 검증부(200)는, 상기 조작부(500)를 매개한 회원의 입력에 의하여 설정된 공중권 등기정보와 공중권 고도제한정보와 거래조건 정보가 입력되면 본 정보의 유효성을 검증함으로써 허위 매물 배제 및 사회적 편익을 기하기 위한 수단으로서 공중권 거래 마켓플레이스(20)의 신뢰도 제고를 위해 설치된 부분이다. 검증에 실패한 경우, 이 사실을 회원에게 통지한 후 입력정보의 정정이나 취소를 요구한다.
상기 본부(10)의 일측을 이루는 블록체인 서버(300)는, 상기 검증부(200)를 경유하여 등록이 인가된 정보를 내부에 설치된 공중권 데이터베이스(310) 내 공중권 등기 테이블(311)과 공중권 고도제한 테이블(312)과 거래조건 테이블(313)에 체계적으로 기록한다.
본 발명의 일측을 이루는 분산저장소(400)는, 상기 검증부(200)를 경유하여 등록이 인가된 정보의 원본이 네트워크 경유로 분산 저장됨으로써, 명시된 공중권에 공신력을 부여하고 미이용 공간의 양도와 미사용 개발권의 임대 행위 간에 발생하는 법리적 차이에도 불구하고 통합거래가 가능하도록 한다. 도 3을 통해, 토지 상부의 미사용 공간에 대한 양도라는 공중권 본연의 개념과, 미사용 개발권을 임대하는 개발권 이전 간 법리적 차이점을 알 수 있는데, 이는 본 발명이 블록체인 기술의 단순 접합에 그치지 아니하고, 기존 기술로는 구현이 어려웠던 법리적 차이 극복을 통해 전체적으로 통합된 진보성을 구성하는 주요한 부분이다.
본 발명의 일측을 이루는 상기 본부(10) 내부의 조작부(500)는, 제반정보를 화상으로 출력하는 디스플레이 장치와 연산처리장치와 입력장치의 조합으로 구성된다. 또한 본 발명의 또 다른 일측을 이루는 상기 본부(10) 외부의 조작부(500)는, 고유의 전자지갑을 보유한 매수자와 매도자와 중개업자와 정부를 상기 공중권 거래 마켓플레이스(20) 경유로 본부(10)와의 정보 입출력을 매개하며, 상기 장치가 전부 구비되고 네트워크 접속이 가능한 휴대용 기기로 대체될 수 있다. 특히 상기 중개업자는 본 발명에 관한 대체 불가능한 디지털 토큰에 의한 공중권 명시 및 거래 시스템(1)의 활성화를 위한 주요 부분이며, 토지 소유자의 공중권 설정 및 명시를 유치함으로써 체결된 거래 발생 시 대체 불가능한 디지털 토큰 내 약정된 수수료가 즉시 상기 중개업자의 전자지갑으로 입금되는 인센티브가 주어진다. 또한 상기 정부는 체결된 거래 발생 시마다 대체 불가능한 디지털 토큰 내 규정된 세금이 즉시 상기 정부의 전자지갑으로 입금된다.
본 발명의 일측을 이루는 상기 공중권 거래 마켓플레이스(20)는, 상기 본부(10)에서 대체 불가능한 디지털 토큰으로 생성된 공중권이 네트워크 경유로 명시되며 조건별로 공중권의 통합거래가 실시되는 부분이다.
상기 공중권 거래의 일례를 들면, 도 4는 조망권 및 일조권을 포함하는 사적 권리의 조정을 위하여 본 발명에 의해 안출된 공중권 명시 및 거래의 구체적인 활용 예를 도시한 것으로, 상부에 고층 구조물이 존재하는 토지 G 소유자들의 총의에 의하여 향후 예상되는 조망권이나 일조권 침해를 재산상 수단으로써 방지하기를 원하는 경우, 상기 공중권 거래 마켓플레이스(20)에 토지 E 소유자들에 대하여 공중권 E′에 대한 매수 의사를 게시할 수 있다.
또 다른 일례를 들면, 리모델링에 소요되는 재원조달을 위해 토지 E 소유자 전원의 합의를 근거로 단일 명의의 회원가입을 실시한 후 상기 공중권 거래 마켓플레이스(20)에 공중권 E′의 매도주문을 게시하고, 설정된 계약조건에 의한 계약 체결 즉시 전자지갑으로 입금되며, 소유권 변동정보와 거래이력은 상기 블록체인 서버(300)에서 갱신 처리되고, 동시에 상기 분산저장소(400)에 동일하게 갱신 처리됨으로써 공신력이 부여된다.
또 다른 일례를 들면, 농경을 수행하는 토지 F 소유자가 공중권 F′의 매도를 통해 미이용 공간을 유효하게 활용하고자 하는 경우, 공중권 F′를 상기 공중권 거래 마켓플레이스(20)에 명시하면 토지 G 소유자들이 이를 구입함으로써 일조권 및 조망권 확보는 물론, 초상권 및 사생활 침해까지 재산상 수단으로써 방지할 수 있는데, 이 경우 취득한 공중권 F′에 대한 공중권 설정정보를 비행금지 상태로 변경하면 되고, 이는 상기 고도제한정보 테이블(122)에 공중권 F′의 설정고도를 0m로 수정하면 상기 지도정보(121)에 반영됨으로써 타 회원에 의한 당해 취지의 조회가 가능하다. 만약 이를 무시하고 공중비행체가 고의로 공중권 F′ 영역에 침입한 경우, 무단점유를 이유로 재산상 수단으로써 제재하는 법적 효용을 얻을 수 있고, 추가로 공중권 H′를 취득한다면 더욱 완벽한 법적 효용을 기대할 수 있다.
또 다른 일례를 들면, 철도청 소유의 토지 I에 부설된 철도 궤도 상부의 미이용 공간에 대하여 공중비행체를 수단으로 하는 물류업자가 공중 배송로 구축을 희망하는 경우 공중권 I′를 매입하면 되고, 이로써 철도청은 유휴 공간 처분을 통해 추가적 재정여력을 확보하는 한편, 공중비행체를 수단으로 하는 물류업자는 전용의 공중 배송로를 확보할 수 있다. 만약 철도청이 위 공중권 I′ 하부에 위치한 공중권 I″ 매각을 통해 부설된 철도 궤도 상부에 구조물을 설치하는 계획을 수립한 경우, 같은 방법으로 세부사항 설정 후 상기 공중권 거래 마켓플레이스(20)를 통한 경쟁입찰 방식으로 매각할 수 있다.
또 다른 일례를 들면, 정부가 승객 운송용 도심비행체가 통행하는 운항로 설정을 계획하는 경우, 토지 D와 토지 E와 토지 F와 토지 G와 토지 H 소유자의 정당한 공중권을 침해하지 아니하는 공중권 J′에 대한 정부의 소유권을 명시한 후 상기 고도제한정보 테이블(122)에 고도설정 정보를 갱신하는 방법으로 소기의 정책목표 달성이 가능하다. 같은 방법으로 기존 고도제한과 같은 일방적 규제를 지양하고, 정부가 적극적으로 공중권을 취득하거나 소유를 명시함으로써 규제가 아닌 재산상 수단을 통해 도심부의 개발행위를 효과적으로 조정하고 토지의 균형발전을 기할 수 있다.

Claims (3)

  1. 대체 불가능한 디지털 토큰에 의한 공중권 명시 및 거래 시스템(1)에 있어서, 회원정보 데이터베이스(110)와 지도정보 데이터베이스(120)로 구성된 메인 서버(100)와, 메인 서버(100)에서 출력된 정보의 유효성을 검증하는 검증부(200)와, 검증부(200)에서 유효성을 검증받은 공중권 등기정보와 공중권 고도제한정보와 거래조건 정보를 기록하는 블록체인 서버(300)와, 본 시스템에서 대체 불가능한 디지털 토큰으로써 생성된 고유한 공중권이 네트워크를 경유하여 명시되고 거래가 실시되는 공중권 거래 마켓플레이스(20)와, 공중권 관련 제반 정보 및 거래 관련 정보를 화상으로 출력하는 디스플레이 장치와 연산처리장치와 입력장치의 조합으로 구성되는 조작부(500)로 구성되며, 상기 회원정보 데이터베이스(110)는 가입한 회원 목록과 고유정보를 체계적으로 기록하는 등록회원 테이블(111)로 구성되며, 상기 블록체인 서버(300)는 공중권 데이터베이스(310)로 구성되고 이 공중권 데이터베이스(310)는 검증부(200)를 통해 유효성이 검증된 상기 정보가 항목별로 체계적으로 기록되는 공중권 등기 테이블(311)과 공중권 고도제한 테이블(312)과 거래조건 테이블(313)로 구성되는 것을 특징으로 하는 대체 불가능한 디지털 토큰에 의한 공중권 명시 및 거래 시스템.
  2. 제1항에 있어서, 상기 대체 불가능한 디지털 토큰에 의한 공중권 명시 및 거래 시스템(1)은, 검증부(200)에서 유효성을 검증받은 공중권 등기정보와 공중권 고도제한정보와 거래조건 정보가 기록된 블록체인 서버(300)와 네트워크 경유로 상기 공중권 등기정보와 공중권 고도제한정보와 거래조건 정보의 원본을 본부(10) 밖으로 분산하여 저장하는 분산저장소(400)와, 상기 블록체인 서버(300)와 분산저장소(400)가 공유하는 동일한 항목별 정보를 바탕으로 대체 불가능한 디지털 토큰으로써 생성된 고유한 공중권이 네트워크를 경유하여 공중권 거래 마켓플레이스(20)와 각 조작부(500)를 통해 연결되고 고유한 전자지갑을 보유한 매수자와 매도자와 중개업자와 정부로 구성되며, 상기 분산저장소(400)는 공중권 데이터베이스(310)에 기록된 정보의 원본이 네트워크 경유로 전달되어 항목별로 체계적으로 기록되는 공중권 등기 테이블(411)과 공중권 고도제한 테이블(412)과 거래조건 테이블(413)로 구성되는 것을 특징으로 하는 대체 불가능한 디지털 토큰에 의한 공중권 명시 및 거래 시스템.
  3. 제1항에 있어서, 상기 지도정보 데이터베이스(120)는, 조작부(500)에 부착된 디스플레이를 통해 화상으로 출력되는 지도정보(121)와 고도제한정보 테이블(122)로 구성되며, 상기 고도제한정보 테이블(122)은 토지 소유자의 공중권이 존재하는 지역의 규제가 존재하거나 필요시 공중권의 구체적 범위를 지정함으로써 지역에 따른 과부족 발생에 따라 공중권의 교환가치가 보다 효율적으로 제고될 수 있도록 하기 위해 설정된 고도가 체계적으로 기록되도록 하는 것을 특징으로 하는 대체 불가능한 디지털 토큰에 의한 공중권 명시 및 거래 시스템.
