TH E FI ELD OF TH E I NVENTION
The present invention is in the field of commercial instrument security. More specifically, in the field of
Bank Cheques security.
BACKG ROU N D OF TH E I NVENTION
Check (hereinafter also spelled Cheque) is defined in the literature as a bill of exchange drawn on a bank and payable on demand; it has become a substantial form of currency transfer in the domestic commerce of developed countries. As a written order to pay money, it may be transferred from one person to another by endorsement and delivery or, in some instances, by delivery alone. Negotiability can be qualified by appropriate words, as with restrictive endorsements, or by the check form itself. Most checks are not paid in currency but by debiting and crediting of bank deposits. Clearings are accomplished either by direct
presentation , by correspondent banks, through local clearinghouses, or by commercial or central banks.
The terminology usually used : a "drawer" orders a "drawee" to pay money to a third person , the "payee." If the drawee is a bank, and the draft is payable on demand . The payee could and sometimes should to endorse the Cheque by signing it. Sometimes such endorsement is in favor of a new party who becomes the new payee.
A cheque is a document often used for payments, or otherwise, fund transferring ordered by one person to the benefit or order of another person.
In various legal systems, a cheque is a negotiable instrument, bill of exchange, promissory note, or another legally defined financial tool, which aims basically to exchange money.
A cheque is usually a pre-printed document that could be regulated in electronic means such has magnetic printed numbers, scanning , or other. Its legal status Is stronger than a mere contract or binding document since its legal status binds more than a contractual obligation .
The Cheque is drawn by a drawer, which is the one that obliges to pay, and orders the drawee, usually a bank, to pay from the drawer account a certain sum, at a specific date to a payee whose name is written on the Cheque or to another person at the payee’s order.
Although the digital era diminished the usage in cheques for many transactions, cheques remain an Important and indeed essential payment method for various segments of society, and it Is still a preferred way of commercial and private currency transformation because of numerous characteristics.
The advantages of cheques are rooted in two main aspects: The first is that cheques are legally binding by itself separated from the transaction they paid for. The second is that cheques could be drawn to future dates, and being non-computerized by the bank, not to use the line of credit or oblige of the drawer. The combination of these two aspects allow for a cheque to be postponed as a rain cheque, and sometimes endorsed by the payee, blankly or to a specific another payee, allowing for
payments to be made along a chain of suppliers without using credit or funds.
The problems solved by the present invention related basically to cheque frauds and scams. There are three major types of cheques fraud :
A. Counterfeit - a cheque that has been created on non-bank paper to look genuine. It relates to a genuine account, but has actually been created and written by a fraudster for the purposes of committing fraud .
B. Forgery - a genuine cheque, however, the signature is not that of the drawer. The fraudster had forged the signature by signing the Cheque themselves, often when the cheques were stolen or unlawfully taken from the drawer.
C. Fraudulently altered ~ a genuine cheque made out by the genuine drawer, but a fraudster has altered it before it has been paid in (e.g . , by altering the payee's name on the Cheque, the amount, the date or any combination thereof) .
Numerous attempts for enhanced security or digital registration and enrolment of cheques are known in the art. Such attempts include:
US2012030105 discloses embodiments of an invention relate to systems, methods, and computer program products for maintaining an updated check register in connection with an on-line banking account of a payor that tracks pending check payments using check imaging technology. Some embodiments of the present invention provide a computer-implemented method including the following steps: receiving an image of at least a portion of a paper check, wherein the portion comprises an indication of an amount of money to be drawn on a financial account, processing the image to determine the amount, identifying the financial account, and recording the amount in connection with the financial account, wherein the recording step occurs prior to receiving any indication that the check has been presented for payment. ; In addition , the method may also include making the financial account with an indication of the pending payment available to be viewed by the payor.
US20031 15155 describes a method of certifying checks.
A check writer contacts the writer’s bank, over the internet, and requests a certified check. The bank deducts the amount of the check from the writer's account, and issues a validation number to the writer, over the I nternet. The writer prints the validation number on the check, in a set of blank spaces designed to accept this number. The check also contains a U RL, U niform Resource Locator, which identifies a web site maintained by the bank. Any interested party, such as a payee of the check, can contact the web site, present the validation number, and learn whether the check is valid . Thus, a certified check can be issued without a visit to a bank, the latter being required under present technology.
US2003074327 discloses method and system for verifying a check that is being used for an on-line transaction , utilizes a hash code value either printed directly on the check, or obtained from an insert card provided by a check printer. To conduct an on-line transaction using a check, the customer enters in data
obtained from a M ICR line of the check, whereby the data includes a one-way hash value that is based on the data provided on the MI C R line as well as private data not provided on the M ICR line. A web server of an e- taller for which the customer seeks to make the on-line transaction , receives the data entered by the customer. The web server of the e-tailer transmits, to a check verifier, the data entered by the customer. ; The check verifier verifies whether or not the check is valid , by comparing the hash code value entered in by the customer with a hash code value that is separately calculated by the check verifier based on private data of the customer obtained by the check verifier from a database.
Nevertheless, all attempts and measures known in the art to protect, certify or otherwise secure or register cheques do not preserve the advantages of the Cheque as a financial instrument out of the line of credit and a self legally binding document with a self-representing value.
Therefore, there is a need in the art for a method to secure a cheque without reporting the transaction it represents to the bank while maintaining its nature of a self-value legal-binding financial-instrument.
A SUMMARY OF TH E I NVENTION
The present invention discloses a method and a system for securing cheques, by allowing activation of a cheque as a condition for its validity.
An object of the present invention is to provide a method and a system that technically allows for securing a cheque against theft, counterfeit, or other forms of fraud .
Another object of the present invention is to provide a method and a system that legally secure a cheque against theft, counterfeit, or other forms of fraud .
The method and the system consist of an action done by a drawer of a cheque, resulting in the activation of said Cheque.

Said activation could preferably serves also as a legal essential for the validity of the Cheque. It will be noted that according to some legal systems, a bill of exchange or financial instrument is not allowed to have a conditional payment. However, all systems require a set of essentials for declaring the validity of such a bill or instrument. Among such essential, there are the drawer signature, date of the bill , an exact sum, and more. Sometimes the Cheque must include the name of a payee, or of a drawee (usually a bank) and sometimes a cheque is crossed , to indicate that it should be deposited directly to an account with a bank and not to be immediately cashed to the payee, or another holder of the Cheque.
A drawer could also limit the transaction of a cheque by limiting the possibility of the payee to endorse it to another payee or holder.
It will be emphasised that in according to the present invention , the terms activation and validation are interchangeable and refers to the act of the drawer or a further holder of a cheque in order to allow verification and collection of the Cheque.
According to the present invention , a validation of the check Is an essential requirement to its validity, and the cheques are void unless activated .
It is therefore understood that unless all cheques are made in accordance with the present invention , the need for verification should be known to everybody who handles the Cheque, preferably by marking the Cheque as needed to be activated .
It should be apparent that the present invention is not for a digital cheque but rather to secure a paper signed cheque digitally, thus as described herein , all benefits of a paper cheque are preserved , including the obligatory legal character of such a financial instrument.
