Abstract

The invention is related to the process of patent registration applications and a patent tracking system that enables the tracking of certified applications through mobile devices characterized in that it comprises of patent information main screen (A) that provides access to the patent information database (10) via a mobile device (C) or does not provide access to the patent information database (10) in remote computer (S) which store copies of data (patent registration application information) published in the bulletins of official patent institutions such as Turkish Patent and Trademark Office, EPO (European Patent Office), WIPO (World Intellectual Property Organization), USPTO (United States Patent and Trademark Office), patent information user screen (B) accessed from the patent information main screen (A) with the personalized ID number, a patent registration module (1) located in the patent information user screen (B) and / or the patent information main screen (A), loading module (3) and scanning module (2) positioned inside the user screen (B) and/or the patent information main screen (A) which enable the documents required for patent registration applications to be uploaded to the system, scan the barcoded patent application documents from the mobile phone or tablet screen and automatically transferring information such as application date and applicant, enable it to be recorded in the patent information database (10) on the remote computer (S).

Description

PATENT TRACKING SYSTEM ON MOBILE DEVICES

Field of the Invention:

This invention is related to the patent tracking system, which reminds the renewal processes of applications that have received national and/or international patent registration application, processes and certificates and provides how much fees should be paid at the end of these processes, to be notified to the applicant/invention/rightful owner or owners via mobile devices.

The invention is related to the process of patent registration applications and a patent tracking system that enables the tracking of certified applications through mobile devices.

State of the Art:

The most common problem with processes after patent registration is the tracking of renewal times. Patent registration requires the renewal of protection periods by performing operations such as patent annual renewal.

Today, there are many deputies and consultancy companies that serve in the follow-up of patent registration processes. Other than that, processes are monitored by employees of patent-holding firms or by invention/applicant.

There are different processes related to patent registration, which have intellectual and industrial property rights.

After the patent registration certificate is obtained, the annual renewal process should be done. Annual renewal fee, which is not paid within the normal period, can be paid with a penalty with an additional fee. If this process has not been followed, the compensation fee is received with the declaration of invalidity and if it is not paid within two months with an additional fee request, the application is deemed to have been dropped. Thus, the applications made can be produced by anyone, either to the public or to the market. Patent owners suffer great losses due to the canceled registration documents.

The biggest reason for an application to lose its validity is that the processes cannot be followed up consciously. Especially in applications made without an attorney, there are problems regarding annual renewal processes. Due to the loss of validity of the documents as a result of these problems, the inventors of the invention experience enormous financial losses. The inventors experience a great grievance due to the lack of pursuit of the processes.

Today, there are systems such as software that remind about renewal periods and annual renewal periods for patent registration. For example, the software described on the website http://marksoft.com.tr/ekrangoruntuleri.html and the website http://www.markanabak.com.tr/MarkanaBak/ are the solutions preferred by consulting companies in terms of intellectual and industrial property rights. However, a reminder note should be made for these systems. If this adjustment is not made, the system does not automatically make any reminders. In other words, the initiative in this system entirely belongs to the user. Therefore, it is possible that an application that is overlooked by the user is not renewed.

In the renewal procedures made before the Turkish Patent and Trademark Office without an attorney, a form downloaded from the official website of the Turkish Patent and Trademark Office and the receipt given as a result of the payment made to the bank for the application fees must be delivered by hand. This process is called the transactions made by means of physical documents. Transactions made through physical documents take at least two days, depending on the distance from the Turkish Patent and Trademark Office headquarters. Depending on the situation, this period may be longer. Therefore, these procedures cause a waste of time for the applicants. In addition, users who cannot receive notifications electronically and only receive information by mail sometimes cause problems in following the processes due to the inability of mail to reach them.

Consequently, there is a need for a new technology that can overcome the disadvantages mentioned above, that sends reminders about the processes of patent applications, that informs the inventors about the annual renewal processes, that reminds the deadlines and the fee to be paid and that helps in making the application procedures and following the application processes.

Description of the Invention:

The present invention is an improvement of the screen frame of mill screen machines 30 which can overcome the above-mentioned disadvantages, sends reminders about the processes of patent applications, informs the inventors about the annual renewal processes, reminds the deadlines and the fee to be paid and that helps in making the application procedures and following the application processes.

The invention ensures that every person entering the system can only see their own patent registration applications. The invention can be used in two ways, with and without internet connection.

With the invention, patent registration applications can be made easily. Visual objects and documents can be scanned and uploaded to the application system from the camera on the mobile device used.

In invention, there are many modules for patent registration with intellectual and industrial property rights. All processes after the application process will be sent to the user via SMS or information e-mail. This message can also be accessed from the notifications module in the application.

With the invention, the file in Word or PDF format prepared for the patent application will be uploaded to the application and the patent registration application process will be made after the necessary payment is made. In addition, the application process will be carried out by loading the power of attorney from the power of attorney module required for the patent registration application. It will be sufficient to sign the power of attorney along with the name and address of the applicant. It will be possible to take a signed power of attorney photograph, which does not require notarization, from the mobile device camera and upload it to the system.

Payments for transactions such as application transactions and annual renewals are made through the payments module in the product subject to the invention. In addition, invoices issued for the payments made can be viewed from the invoices module. The invention provides important advantages to the inventors both financially and by preventing the loss of validity of the applications by making the necessary reminders to the inventors especially about the annual renewal process of the patent applications, preventing the problems that occur in the performance of this process. Thanks to the invention, the processes will be prevented from entering the penalty situation and the application will be prevented from being dropped or canceled. Thus, the grievances experienced by the inventors are minimized.

The inventors will be able to see the patent attorney closest to them with the map module in the product subject to the invention. Thus, the inventors will be able to consult the patent attorney as soon as possible when they have a patent-related process.

Nowadays, patent applications lose their validity due to the wrong transactions, especially in patent applications made without a representative. With this application, the inventors will be able to get the correct information about the path to be followed by reaching the closest patent attorney. The invention both eliminates the victimization of inventors and enables inventors who meet patent attorneys to work together in the future. The map module will also contribute to the creation of a new business resource for patent attorneys. In addition, patent offices will be able to create a new business resource by placing advertisements on the application. Those who apply without an attorney first fill out a form for the renewal process. With this filled form, the payment is made by going to the bank and the filled form with the receipt is sent to official patent institutions such as Turkish Patent and Trademark Office or EPO (European Patent Office) or WIPO (World Intellectual Property Organization) or USPTO (United States Patent and Trademark Office). By eliminating these processes, the product subject to the invention both increases environmental awareness by preventing paper costs and enables beneficiaries to get rid of cargo costs. In addition, transactions made in existing systems take time. The invention has minimized this time frame.

The invention records the reminder in the cloud based on the system time or internet time of the mobile device. Thus, even if the device is formatted, there is no loss of information after the application is installed.

Disclosure of the Invention:

The invention has payment module (5) containing my receipts sub-module. The invention has power of attorney module (8) that allows the proxy's power of attorney to be shared via SMS and/or MMS and/or e-mail and/or social media applications or transferred to the printer. The invention has notifications module (7) that provides information about patent registration applications such as annual / certificate renewal dates/fee information. The system of invention comprises of user module (12) that enables registration to the system by entering the patent application date, user registration information, citizenship information, telephone number.

The system of invention comprises of patent reporting module (11), which informs the user logged in the system about the latest status of all patent registration applications. The invention has patent registration module (1) to issue an audible or visual notification of renewal date (document / annual renewal) regarding patent registrations whose application date has been recorded. The invention has notification module (7) that issues one or more warnings in 360 days from the registered patent registration application date (preferably).

The invention can notify of renewal date (certificate / annual renewal) for patent registrations registered only by the applicant. The invention can give a notice of the renewal date (certificate / annual renewal) regarding the patent registrations registered in the patent information database (10) by the patent attorney. The invention warns the user regarding the renewal date (certificate / annual renewal) regarding the patent registrations.

The invention accesses the patent information database (10) of the user by using the ID number associated with the identification number or phone number and shows patent registration applications registered, published or unpublished on behalf of the user, on the patent information main screen (A) and/or on the patent information user screen (B)

The invention has patent registration module (1) located inside or outside of the loading module (3) or scanning module (2) can be transferred to the patent information database (10) by encrypting the power of attorney and/or patent specification set and/or drawing document and/or other application documents.

The invention shares and sends annual / document renewal fees and time from SMS and/or MMS and/or e-mail and/or social media applications. The invention comprises of mobile device (C) recording the renewal dates (document / annual renewal) of the patent registrations on the cloud based on the system time or internet time.

Detailed Disclosure of the Invention:

The modules that make up the invention are as follows: patent registration module (1), scanning module (2) and loading module (3), invoice module (4), payment module (5), map module (6), notifications module (7), power of attorney module (8), settings module (9), patent information database (10), patent reporting module (11), user module (12) and announcement module (13) (Figure-1, Figure-2, Figure-3).

The sub-module of the patent registration module (1) in the product subject to the invention is my patents sub-module (1.1) (Figure-3). The user who logs into the system can see all patent applications belonging to him/her from this module.

The use of the invention is as follows; The user is allowed to enter the system via a mobile device (C), which can be a phone and / or tablet. There are two types of login to the system for the user. First, you can login to the system for free without being a member. It is an entry system where only patent applications can be followed. In this system, the user can follow up a maximum of two patent applications. The second system is a system where all applications can be followed. First of all, the system is registered. In this system, it is also possible to make new patent applications. In both systems, the date on which the notification will be made can be set from the settings module (9), especially for reminding the renewal processes of patent applications (Figure- 1). If this setting is not made, the system automatically notifies you five days before the due date. For example, a patent application has an annual renewal fee paid each year. From the settings module (9), the option to notify after 350 days can be set (Figure- 1). The number of days is entirely at the user's discretion. The reminder that will come as a result of the setting made can be seen from the notification module (7) (Figure- 1). In addition to seeing the reminder from the notification module (7), a message will be sent to the user as SMS or e-mail (Figure- 1).

Login to the system as a member is as follows; the user requests access to the system by opening the patent information main screen (A) from the mobile device (C), which is a phone and / or tablet, from the user module (12) on the patent information user screen (B) by the ID number matched with the identification number and / or phone number. The ID number is approved from the patent information database (10) in the remote computer (S). The approved user can access the system. It sees the published patent applications registered in the name of the official institutions (R) of the user accessing the system. Official institutions (R) are as follows: Turkish Patent and Trademark Office, EPO (European Patent Office), WIPO (World Intellectual Property Organization), USPTO (United States Patent and Trademark Office).

From the patent information main screen (A), which provides access to the patent information database (10) on the remote computer (S), where the copies of data published in the bulletins of official patent institutions such as the Turkish Patent and Trademark Office, EPO, WIPO, USPTO are stored, the patent registration module (1) in the patent information user screen (B) accessed from the information main screen (A) enables the user to access his/her applications.

From the notifications module (7) positioned on the patent information user screen (B) and / or the patent information main screen (A), the user can see the payments required to be made so as to warn about patent applications (annual renewal fee, document fee, etc.). User patent application fee payments by credit card and / or paracard and / or bitcoin and / or paypal etc. With virtual payment systems, it can perform the payment transaction from the payment module (5) positioned on the Patent Information user screen (B). E-invoices are issued by working simultaneously with the payment module (5), which allows the payment of fees specific to patent applications. The issued e- invoice can be viewed from the invoice module (4) positioned on the patent information user screen (B).

The patent is positioned on the patent information user screen (B) and / or the patent information main screen (A) so that the user can share and send the status report of patent applications from applications such as SMS and / or MMS and / or e-mail and / or social media applications. It can be viewed from the reporting module (11). The user can fill in the application documents for the patent applications to be made in addition to the existing applications and the power of attorney downloaded from the power of attorney module (8) on the patent information user screen (B) and uploaded to the system via the upload module (3). Upon completion of the upload process, the document of the application number with the barcode is sent to the user via the notification module (7) via SMS and / or MMS and / or e-mail during the day. Subsequent developing processes are also sent to the user as a notification. For example, the formal review has been completed, the publication process will start from this date, or you will receive a request for research.

There is an announcement module (13) that allows the user to make sales regarding the patent applications he/she owns. For example, for a patent application to be transferred, the notarized documents are loaded into the system from the loading module (3) and the transaction is carried out during the day.

Patent applications in two types are registered for the product subject to the invention. The first way is to manually fill in the user's information such as application date and applicant. The second way is to scan the barcoded patent application documents on the mobile phone or tablet screen via the scanning module (2) and automatically record the information such as the application date and the applicant in the patent information database (10) on the remote computer.

Claims

1- Patent tracking system on mobile devices characterized by comprising;

— patent information main screen (A) that provides access to the patent information database (10) via a mobile device (C) or does not provide access to the patent information database (10) in remote computer (S) which store copies of data (patent registration application information) published in the bulletins of official patent institutions such as Turkish Patent and Trademark Office, EPO (European Patent Office), WIPO (World Intellectual Property Organization), USPTO (United States Patent and Trademark Office)

— patent information user screen (B) accessed from the patent information main screen (A) with the personalized ID number,

— a patent registration module (1) located in the patent information user screen (B) and / or the patent information main screen (A),

— loading module (3) and scanning module (2) positioned inside the user screen (B) and/or the patent information main screen (A) which enable the documents required for patent registration applications to be uploaded to the system, scan the barcoded patent application documents from the mobile phone or tablet screen and automatically transferring information such as application date and applicant, enable it to be recorded in the patent information database (10) on the remote computer (S).
