Abstract

A vacuum sealable container for baked or cooked food, the container comprising a tray and a cover correspondingly fitting onto the tray, the tray and the cover including one or more curved-shaped load bearing units. The load bearing units resist deformation when an interior of the container is at a pressure associated with a package sealing vacuum and when an exterior of the container is at ambient atmospheric pressure.

Claims

AMENDED CLAIMS received by the International Bureau on 15 December 2015 (15.12.2013) What is claimed is:
1. A vacuum sealable container for vacuum-compressible food, the container comprising: a tray and a cover correspondingly fitting onto said tray, wherein at least one of said tray and said cover comprises one two or more curved-shaped load bearing units, each supported by one or more pins, rods or blades which extend into an interior of said container and wherein said load bearing units resist deformation when said interior is at a pressure associated with a vacuum packaging and when an exterior of the container is at ambient atmospheric pressure, thereby to generally prevent compression of said vacuum-compressible food.
2. A container according to claim 1 further comprising reinforcement ribs for supporting said one or more load bearing units.
3. A container according to claim 2 wherein said reinforcement ribs comprise a cross- section shaped in the form of at least one of a U-shape, a T-shape, an L-shape, a circle, or a polygon.
4. A container according to claim 2 further comprising circular reinforcement units for supporting said reinforcement ribs.
5. A container according to claim 4 wherein said circular reinforcement units are placed at the intersection of at least two reinforcement ribs.
6. A container according to claim 1 wherein at least one of said tray and said cover comprises scalloped-shaped edges along its perimeter.
7. A container according to claim 1 wherein said load bearing units resist deformation when a pressure differential between said interior package sealing vacuum and said external ambient pressure is approximately 1 kg/cm2.
8. A container according to claim 1 where said tray and said cover are formed from a plastic material.
9. A container according to claim 8 wherein said plastic material is transparent.
10. A container according to claim 8 wherein said plastic material is colored.
11. A container according to claim 1 wherein said tray and said cover comprise rims.
12. A container according to claim 11 wherein said tray and said cover include means for aligning one with the other.
13. A container according to claim 1 wherein the container comprises a rectangular shape.
14. A container according to claim 1 wherein the container comprises a round shape.

15. A container according to claim 1 wherein a perimeter of said curved- shaped load bearing units is square-shaped.
16. A container according to claim 1 wherein a perimeter of said curved- shaped load bearing units is pie-shaped.
17. A container according to claim 1 wherein said tray and/or said cover are formed from a metallic material.
18. A container according to claim 1 wherein the container comprises a triangular shape.
19. A container according to claim 1 further comprising air conduits to enable air removal from an interior of the container.

STATEMENT UNDER ARTICLE 19(1)

Old claim 13 has been cancelled and the claim set has been renumbered. The claim numbering referred to herein is the new claim numbering.

In the Written Opinion, the Examiner rejected claims 1 - 3 and 11 - 12 as lacking novelty under PCT Article 33(1) over Mathews Bernard Ltd. (EP 1866214) (Dl).

In the Written Opinion, the Examiner rejected claims 4 - 10 and 13 - 19 as lacking inventive step as being design features.

In the Written Opinion, the Examiner rejected claims 20 - 21 as lacking inventive step over a combination of Dl and D2 (Grace AG, EP748746).

Applicants respectfully disagree.

Document Dl shows a container for meat products, such as turkey crowns, which has a cover and a tray. Document Dl states:

[0008] When packing meat products using a modified atmosphere system, the active gas (typically carbon dioxide) is absorbed by the meat. A vacuum results in the container so that it can be hermetically sealed. Normal atmospheric pressure outside the container can cause such a container to implode or collapse as the gas is absorbed by the meat and, as it collapses around the flexible joint of the present invention, the joint's natural action provides a controlled shrinking, resulting in minimal distortion of the container as a whole, whilst providing an extended shelf life for the contained meat.

Document Dl discusses the same problem as the present invention (that of implosion of the container onto the food). Document Dl solves this with a joint which controls shrinkage of the container.

The present invention, on the other hand, solves the problem for vacuum-compressible foods (which suffer from the implosion even more than turkeys). Moreover, the present invention solves the problem with multiple load-bearing units "each supported by one or more pins, rods or blades which extend into an interior of said container and wherein said load bearing units resist deformation when said interior is at a pressure associated with a vacuum packaging and when an exterior of the container is at ambient atmospheric pressure, thereby to generally prevent compression of said vacuum-compressible food".

Document Dl has no such pins, rods or blades, nor does it prevent compression of the vacuum- compressible food. The combination with D2 does not solve this as D2 is concerned with making its container an easy-to-open container which has nothing to do with vacuum-compressibility.

Thus, the combination of Dl and D2 does not provide the present invention as recited in amended independent claim 1.
