Abstract

The invention relates to a composition for killing, controlling and repelling mosquitoes comprising an effective amount of at least one acyclic organosiloxane compound in an aqueous based system. It acts as an effective larvaecide, pupicide and adulticides for all type of mosquitoes.

Claims

AMENDED CLAIMS

1. A composition for killing, controlling and repelling mosquitoes comprising an effective amount of
at least one acyclic organosiloxane compound;
at least one naturally occurring active ingredient: selected from neem oil, catnip oil, lemon grass oil and citronella oil;
a stabilizing agent selected from a group consisting of at least one of allyloxypolyalkylene glycol methyl ether, polyoxyalkylene monoallyl ether and polyoxyalkylene monoallyl acetate; wherein the alkylene group is selected from the lower alkyl groups;
a synergist, wherein the synergist is piperonyl butoxide; and,
optionally, at least one synthetic active ingredient selected from synthetic pyrethroids, N,N-diethyl-3-methylbenzamide (DEET) and para-methane-3,8-diol, in an aqueous based system.
2. The composition of claim 1, wherein the acyclic organosiloxane compound is at least one modified polysiloxane compound selected from a group consisting of: a. hydroxyl alkyl disiloxanes;
b. polyether modified polysiloxane;
c. polyester modified polysiloxane;
d. polydimethyl si loxane - polyethylene oxide copolymer;
e. polyether trisiloxane copolymer;
f. polyalkylene - modified polysiloxane;
g. linear trisiloxanes; h. polydiorganosiloxane-polyoxyalkylene copolymers;
i. polyether-polysiloxane copolymer;
j. ABA type silicone compounds;
k. Branched silicone compounds;
1. Gemini type silicone compounds;
m. Amine based silicone compounds;
n. siloxane glycol copolymers; and,
o. si!oxane-alkylene oxide copolymers.
3. The composition of claim 1, wherein the acyclic organosiloxane compound is polyalkylene oxide modified heptamethyl tri-siloxane; wherein the alkylene group is selected from the lower alkyl groups.
4. The composition of claim 3, wherein the polyalkylene oxide modified heptamethyl tri-siloxane is polyethylene oxide modified heptamethyl tri-siloxane.

6. The composition of claim 1, wherein the acyclic organosiloxane compound is in a range of about 0.001% to about 50% on a w/w basis of the total weight of the composition.
7. The composition of claim 1, wherein the stabilizing agent is in a range of about 2% to about 30% on a w/w basis of the total weight of the composition.
8. The composition of claim 1, wherein the aqueous based system is in a range of about 70% to about 99.9% on a w/w basis of the total weight of the composition.
9. The composition of claim 1, wherein the aqueous based system comprises water, mixture of polar solvents with water and mixture of non-polar solvents with water.

12. The composition of claim 1, further comprising at least one fragrance selected from natural fragrances and synthetic fragrances.
13. The composition of claim 1, wherein the synergist in the range of about 0.1% to about 0.5% on a w/w basis in the composition.
14. The composition of claim 1, wherein the composition is formulated as at least one of a suspension concentrate, a homogenous solution and an emusifiable concentrate.
15. A process of preparing a composition for killing, controlling and repelling mosquitoes, the process comprising:
a) . adding an effective amount of at least one acyclic organosiloxane compound in water to obtain a mixture; and,
b) . stirring the mixture for about 3-5 minutes in ambient conditions to obtain a homogenous composition.
16. The process of claim 15, wherein step a), further comprises adding a stabilizing agent selected from a group consisting of at least one of al!yloxypolyalkylene glycol methyl ether, polyoxyalkylene monoallyl ether and polyoxyalkylene monoailyl acetate to water to obtain the mixture.
17. The process of claim 15, further comprising adding at least one naturally occurring active ingredient to the composition.
18. The process of claim 17, further optionally comprising adding at least one synthetic active ingredient to the composition.
19. A method of application of the composition for Icilling, controlling and repelling mosquitoes, wherein the composition of claim 1 is applied to flying mosquitoes and mosquito breeding sites.

STATEMENT UNDER ARTICLE 19(1)

Present invention as claimed in claims 1 to 4; 6 to 9 and 12-14 relates to a composition for killing, controlling and repelling mosquitoes comprising an at least one acyclic organosiloxane compound; at least one naturally occurring active ingredient selected from neem oil, catnip oil, lemon grass oil and citronella oil; a stabilizing agent selected from a group consisting of at least one of allyloxypolyalkylene glycol methyl ether, polyoxyalkylene monoallyl ether and polyoxyalkylene monoallyl acetate; wherein the alkylene group is selected from the lower alkyl groups; a synergist, wherein the synergist is piperonyl butoxide; and, optionally, at least one synthetic active ingredient selected from synthetic pyrethroids, N,N-diethyl-3-methylbenzamide (DEET) and para-methane-3,8-diol in an aqueous based system. Claims 15-19 relate to a process of preparation of said composition.

D1 (Material Safety Data Sheet for Silwet L-77) discloses a composition comprising polyalkylene oxide modified heptamethyltrisiloxane and allyloxypolyethyleneglycol methyl ether.

D 1 however does not disclose matter claimed in the amended claims 1-19

D2 (US4656162) discloses a composition for controlling pests comprising an organosilicon compound.

D2 however does not disclose matter claimed in the amended claims 1-19.

D3 (Effects of Foliar Surfactants on Host plant selection behaviour of Liriomyza huidobrensis (Diptera: Agromyzidae) discloses effect of surfactants on host selection behaviours of female Liriomyza huidobrensis. D3 however does not disclose matter claimed in the amended claims 1 -19.

D4 (Effect of Sihvet L-77 and diazinon on the three tephritid fruit flies and associated endoparasitoids) discloses the effect of Silwet L-77 on three tephritid fruit flies

D4 however does not disclose matter claimed in the amended claims 1-19.

D5 (Efficacy of Silwet L-77 against several arthropod pests of Table grape) discloses the activity of Silwet-L-77 , an organosilicone surfactant to several arthropod pests of California Table Grapes.

D5 however does not disclose matter claimed in the amended claims 1-19.

D6 (WO 2009/143138) discloses method of treating arthropods application of a liquid formulation comprising at least one surfactant

D6 however does not disclose matter claimed in the amended claims 1 -19.

D7 (WO 2007/136597) discloses a composition domprising a combination of a first defined silicone surfactant and a second defined silicone surfactant to control arthropods.

D7 however does not disclose matter claimed in the amended claims 1-19.

D8 (Laboratory and field evaluations of Silwet L-77 and kinetic alone and in combination with imidacloprid and abamectin for the management of the asian Citrus psyllid, Diaphorina citri.) discloses composition of Silwet L-77 alone and in combination with imidacloprid and abamectin for the management of the asian Citrus psyllid.

DS however does not disclose matter claimed in the amended claims 1-19.

D9 (Inert formulation ingredients with activity: Toxicity of Trisiloxane surfactant solution to twospotted Spider mites (Acari: Tetranychidae) discloses the efficacy of aqueous solutions of the trisiloxane surfactants Silwet L-77, Silwet 408, and Silwet 806 against adult female twospotfed spider mites with a leaf dip method.

D9 however does not disclose matter claimed in the amended claims 1 -19.

D10 (Toxicity of organosilicone adjuvants and selected pesticides to the asian citrus psyllid (Hemiptera: Psyllidae) and its parasitoid Tamaixia Radiata (Hymenoptera: Eulophidae) discloses the acute toxicity of the adjuvants Silwet L- 77 and Kinetic, alone and in combination with petroleum oil and copper hydroxide, to the Asian citrus psyllid in screenhouse bioassays.

D 10 however does not disclose matter claimed in the amended claims 1-19.

Dll (Insecticidal activity of surfactants and oils against silverleaf whitefly (Bemisia argentifolii) nymphs (Homoptera: Aleyrodidae) on collards and tomato discloses insecticidal activity of four surfactuants - Cide-kick, Silwet L-77, M-Pede and APS A 80), a dishwashing detergent, a mineral oil, a cotton seed oil and vegetable oil, alone or in combination nymphs of silverleaf whitefly.

Dl 1 however does not disclose matter claimed in the amended claims 1 -19.

D12 (Bioassay and efficacy of Bacillus thuringiensis and an Organosilicone surfactant against Citrus Leaf miner (Lepidoptera: Phyllocnistidae) discloses activity of commercial preparations of Bacillus thuringiensis and an organosilicone surfactant against Citrus Leafminer, Phyllocnistis citronella.

D12 however does not disclose matter claimed in the amended claims 1-19.

D13 (Effects of the agricultural adjuvant Sylgard 309 and the insecticide pymetrozine on demographic parameters of the aphid parasitoid, Diaeretiella rapae) discloses effects of pymetrozine and the adjuvant Sylgard 309 on the life table parameters of the aphid parasitoid, Diaeretiella rapae)

D13 however does not disclose matter claimed in the amended claims 1-19. D14 (Effect of various pesticides on the non-target species Microctonus hyperodae, a biological control agent of Listrdnotus bonariensis) discloses the effect of various pesticides such as asulam, chlorpyrifos, diflubenzuron, etc. and surfactants such as Silwet - 77 in the control of the aphid parasitoid.

D14 however does not disclose matter claimed in the amended claims 1-19.

D15 (Surface films as mosquito larvicides: partitioning the mode of action) discloses oils and other surface films used against mosquito larvae which act by flooding the tracheal system with oil by disrupting the surface forces that allow larvae to rest at the surface by toxicity or by eliciting chemosensory responses.

D15 however does not disclose matter claimed in the amended claims 1-19.

It is respectfully submitted that the amended claim 1 which refers to the composition for killing, controlling and repelling mosquitoes comprising an at least one acyclic organosiloxane compound; at least one naturally occurring active ingredient selected from neem oil, catnip oil, lemon grass oil and citronella oil; a stabilizing agent selected from a group consisting of at least one of allyloxypolyalkylene glycol methyl ether, polyoxyalkylene monoallyl ether and polyoxyalkylene monoallyl acetate; wherein the alkylene group is selected from the lower alkyl groups; a synergist, wherein the synergist is piperonyl butoxide; and, optionally, at least one synthetic active ingredient selected from synthetic pyrethroids, N,N-diethyl-3- methylbenzamide (DEET) and para-methane-3,8-diol in an aqueous based system is not disclosed hi any of the cited documents.

It is further respectfully pointed out that taking cue from any document Dl - D15, it would not be possible for a person of ordinary skill in the art to arrive at the specific composition as claimed in the amended claims.

In fact, it has been surprisingly determined by the inventors that the use of only 4 ml. of the composition as claimed in the amended claim 1 exhibited 100% mosquito mortality as has been indicated on Page 10 of the PCT application PCT/TN2011/000078.

We therefore request that the amended claims be kindly taken on record with the Statement under Article 19.
