Abstract

L'invention concerne un procédé et un dispositif permettant l'établissement de prêts à risques réduits. Ce procédé fait appel à des techniques d'évaluation, de surveillance et de correction ainsi qu'à des privilèges servant de garantie dans le cadre d'un processus extensif conçu pour réduire le risque associé à l'octroi de prêts. On obtient une réduction du risque par l'utilisation conjointe de quatre composantes relevant de l'invention. La première composante requiert l'application systématique de la norme de souscription du prêteur associée à l'utilisation de données connues du prêteur ou facilement accessibles à ce dernier. La traitement des données se rapportant à l'emprunteur permet l'établissement de conditions de prêt définies en proportion du risque perçu. La seconde composante permet d'assurer que tous les documents de prêt et les contrats connexes sont établis de manière correcte, dûment signés par l'emprunteur et transmis au prêteur dans leur intégralité. Si l'emprunteur demande un crédit sur un fonds de roulement, (crédit commercial), un contrat de « transfert en garantie du produit et des privilèges » est signé de manière à donner au prêteur une garantie complémentaire permettant de couvrir un risque perçu. La troisième composante comprend la surveillance du respect des conditions du prêt par l'emprunteur. Si l'équilibre entre le prêt et ses conditions n'est pas réalisé, les déboursements additionnels du produit sont suspendus jusqu'à ce que tous les défauts ou manquements ait été corrigés. La quatrième composante est mise en oeuvre lorsqu'un défaut ou un manquement en peut être corrigé dans un délai raisonnable ou qu'il n'est pas possible de le corriger. Cette dernière composante sert à rendre définitifs les privilèges cédés au prêteur. L'utilisation de toutes ces composantes lors de la gestion d'un prêt sert à réduire le risque et par conséquent à augmenter la vraisemblance d'un octroi de crédit.
