SON, a citizen of the United States, residing at Hattiesburg, in the county of Perry and State.
of Mississippi, have invented certain new and useful Improvements in Warranty Deeds; and I do declare the following to be a full,
clear, and exact description of the invention, such as will enable others skilled in the art to which it appertains to make and use the same, reference being bad to the accompanying drawing, and to the figures of reference marked thereon, which forms a part of this specification.
My invention relates to a warranty deed, and has for its object to provide a printed form wherein the property conveyed and warranted has its exact relative position and location clearly set forth by a simple plat, which is preferably arranged as shown in the accompanying drawing and as will be hereinafter fully described.
It is my object to provide a deed which will furnish ready reference without going to the plat, book, or map and by which mistakes are avoided, as the description of the property conveyed and warranted must be identical with and distinguished by the plat forming part of the deed. It is well known by persons handling real estate that serious errors arise from depending upon the description alone of the ground to be conveyed, causing great loss and damage. When the description, however, and plat are both in the deed and both are carefully compared and both correspond, the danger of mistakes is reduced to the minimum.
The laws of the various States and localities require different forms of deeds, and it is my intention to change the body or form of the deed to suit existing requirements.
Referring to the accompanying drawing, the figure is a representation of a warranty deed.
Referring to the drawing by reference-numerals, 1 indicates the deed as a whole, and 2 is the grant, warranty, and descriptive clause at the beginning thereof.
3 is the form of acknowledgment, and 4-indicates the plat, preferably below the above forms, which is separated therefrom by a line or lines 5. The plat consists, preferably, of
- three divisions 6, 7, and 8, the division 6 repas is the usual arrangement of a block having its lots facing in this manner. 8 represents a plat of the entire township, the squares 9 therein representing the sections of the township.
In order to illustrate the operation and use of this warranty deed, We will suppose that Thomas M. Ferguson has conveyed to John Doe lots numbered '6 and 8 in block '6 of section 5 of the survey or addition to the village of Hattiesburg, county of Perry, and State of Mississippi, said lots having a frontage of forty feet each on Market street. This or similar description would appear in the body of the instrument and would be also indicated as follows on the plat-section: Lots Nos. 6 and 8 would be made red or otherwise marked. The numeral 6 would be supplied to the block, as indicated. The name of the street, which is Market, would be supplied, showing the frontage of'the lots on said street, and, if necessary, the remaining three streets surrounding block 6 would also be indicated, which would im mediately indicate the exact location and position of the lots conveyed. To further identify the property, the exact section of the township within which block 6 is located would be indicated by making said section red or otherwise marking the same. Thus it is seen that the possibility of error in setting forth the position and location of the lots when this deed is employed is reduced to a minimum, as the same must be indicated 7 three times in the instrument.
The block 7 is of course employed to indicate lots which have a frontage either north or south, the manner of indicating them being the-same as above described. 7
Having thus set forth my invention, I do not wish to be understood as limiting myself to the exact construction herein set forth, as various slight changes may be made therein ICO ' which would fall within the limit and scope of myinvention, and I consider myself clearly entitled to all such changes and modifications.
What I claim as my invention, and desire to secure by Letters Patent of the United States, is
1. A warranty deed having the usual clauses therein, and a plat separate from said clauses but on the same sheet therewith, said plat consisting of three substantially rectangular spaces 6, 7 and 8, said rectangular spaces representing a town block being composed of oblong horizontal spaces indicating lots and the space surrounding said oblong horizontal spaces within said rectangular space 6, indicating the streets encompassing said town block, said rectangular space 7, representing a town block, being composed of oblong vertical spaces, representing lots, and the space surrounding said oblong vertical spaces within said rectangular space 7, indicating the street encompassing said town block, and said rectangular space 8, being composed of a number of smaller rectangular spaces indicating the subdivisons of the township. A warranty deed having the usual clauses therein and a plat separate from said clauses but on the same sheet therewith, said plat consisting of a substantially rectangular space representing a town block, said rectangular space being composed of oblong rectangular spaces indicating the lots of said town block, and the space surrounding said oblong rectangular spaces but within said rectangular space representing the streets encompassing said town block, and a rectangular space composed of a series of smaller rectangular spaces indicating the subdivisions of the township.
