This invention relates to packaging.
This invention has utility when incorporated in packages, more particularly of the multi-ply wall type, and incorporating therewith a useful novelty as an attraction to purchasers apart from the goods contained therein.

Container I is provided with closure or cover 2 hinged therewith. Preferably this primary container I is a sheet metal can providing pocket 3 wherein material Il may be directly deposited or if such material is subject to drying or is affected by climate, light or other weather conditions, such material may be sealed in inner or secondary container or envelope 5 which in turn may be placed in the primary container I.
The inner container or envelope 5 may be formed from a sheet of iiexible material such as paper, Cellophane, or the like into a pocket, the sealing of which is by folds 6 held by adhesive 7.
In multi-ply wall packages of this type, the usual practice is to seal the contents i within the soft or fragile envelope 5 and then place such into the comparatively rigid outer container I as an armor against crushing or other detrimental actions. There is thus provided a substantial package suitable for long-time storage of perishable or easy damaged products common in packaging tobacco, foodstuffs, condiments, cleaning preparations, etc.
The invention herein is primarily directed to the provision of an additional utility to the container as well as to invite desire therefor in the container itself beyond the particular appeal of the contents. To this end staff or pipe cleaner 8 comprising a resilient wire core 9 mounting fibrous material II), is bent into a U-shape, the
extent' of the bending being less than suicient to hold its U-shape with legs I'I, I2, thereof in the same plane, so that if' the legs are forced into the same plane, the wire Sis under torsion and when the holding pressure is released, the member will spring to move into its free or non-torsion position.
In sealing a fold 6, leg II of the member 8 may be embraced thereby to fix this leg in such fold with the leg I2 extending free therefrom. With bend I3 a smooth arc and not crimped, the free leg I2 will tend to extend upwardly from the envelope 5. With the envelope 5 in the can I, closing of the cover 2 will force the free leg I2 downwardly and place such under tension. When the cover 2 is shifted to open position, the leg I2 will spring upward to extend out of the container I toward the user providing a readily gripped terminus which may be pulled from the container in turn initially opening the folds B so that the inner envelope may then be readily and completely opened to expose the contents 4. When a particular type of opening element, such as a pipe cleaner, is used in connection with tobacco dispensing, it has a peculiar utility in that the user of the tobacco is provided with means for readily opening the package and in addition thereto the opening means has additional utility as a duct cleaner before being discarded. A pipe cleaner also has utility when used as the opening element in packages containing cleaners of various types, as the member 8 may be saturated with the cleaner to be applied to confined places otherwise hard to reach.
As an additional eye-attracting utility, legend carrying tag I4 may be slipped on the free leg I2 so that as the package is opened, the legend will be sprung toward the user insuring it to be observed. The tag I4 may contain instructions for using the product, slogans or advertising matter for other or kindred items.
In some instances it may be desirable to market the product in a soft package comprising a single ply envelope I5 having themember 8 attached thereto by having leg II embraced by a fold 6 and the arc I3 so bent as to have the free leg I2 rest snugly against the package. The member 8 may rst be straightened (Fig. 5) and then pulled up from the package which will cause such to be opened.
Again, in some instances, the invention may be incorporated in a multi-ply soft package (Fig. 6) and the member 8 fixed with a fold of an inner wrapper I6 While outer wrapper I'I may encase the contents, any number of'wrapping plies, and the member 8 which may be bent to lie snugly against the inner container without torsion or be under tension s0 as to spring outwardly when the outer wrapper II is opened. The various plies may be paper, foils, cellophane, or other like materials.
The member 8 may have its free leg I2 bent into various patterns or designs such as a spiral, an initial or such may be coiled into a helix I8 so as the outer wrapper is removed the terminus I9 will spring outwardly.
The inherent resiliency of the common pipe cleaner is such that it may be so bent as to have the free leg I2 spring outwardly from an opened package even though such has been packed for a considerable period of time.
What is claimed and it is desired to secure by United States Lette-rs Patent is:
1. A can having a cover, a material housing envelope in said can provided with a fold as a seal therefor, a resilient U-shaped member between said cover and envelope providing a pair of legs, one of said legs embraced by said fold and the other leg free to spring outwardly from amzos said can upon shifting said cover to can-open position.
2. A tobacco package embodying a can having a cover, a tobacco containing envelope in said can having a fold providing a seal therefor, a pipe cleaner formed to provide a resilient member and held under torsion between said cover and envelope when said cover is in can-closing position, a portion of said member being embraced by said fold, and an additional portion being free to spring outwardly from said can when the cover is shifted to can-open position.
3. A package providing inner and outer containers one Within the other, said inner container providing a fold as a seal therefor, and a U- shaped resilient element providing a pair of legs, one embraced by said fold, whereby removal therefrom opens said fold, said inner package and U-shaped element being enveloped by the outer package to hold the U-shaped element under torsion.
