My invention relates to rail fillers and is more particularly addressed to providing a rail filler consisting of a plurality of members, one or more or all of which have been 5 preformed in a factory so that one member may be used as a locking or wedging means to hold the filler in place in the rail.
In the drawing I have shown the cross section of a rail having my improved rail filler on the left of the webof the rail. In the drawing 1 is the rail; 2 and 3 constitute a rail filler, 3 being a sheet of prepared roofing formed of a sheet of felt saturated with a bitumen. Such a felt is flexible, elastic and somewhat plastic, by reason of its bitumen saturation.
As shown, the member 3 of the rail filler is placed in the rail against the web and the top of the base, after which the member 2, which is a preformed wedged shape member is introduction in the side of the rail and by means of a mallet, hammer or other suitable means is forced into the rail wedging the member 3 firmly against the upper side of the base of the rail and thereby locking the rail filler members 2 and 3 firmly in position between the ball and the base of the rail. The lower edge portion of the sheet 3, as shown, extends outwardly beyond the lower outer longitudinal edge of the block-like member 2, providing an apron insulating the rail from the adjacent paving.
The member 2 I preferably form to the desired shape in a factory from a material composed of a bitumen, preferably asphalt, a fibrous material either vegetable, animal or mineral and if a harder product is desired I also use pulverulent or granular'minerals.
If desired, and I have found it satisfactory in some instances, the wedged shape filler member 2 may be of a less plastic like nature or a more solid and hard nature than the member 3. This insures greater ease in installing the fillers and a more positive sealing effect between the filler and the rail.
I claim:
1. In a rail filler a plurality of plastic members adapted to form a filler between the base and the ball of a rail.

5. In a rail filler a member of a plastic like material, a separate preformed member containing bituminous material and of a more rigid and less plastic character adapted to form a wedge to hold both of said members in a rail.
6. In a rail filler a flexible member, a preformed relatively solid member containing bituminous material and adapted to form a wedge to hold both ofsaid members in the rail.
7. In a rail filler consisting of a plurality l 9. 11. A rail filler of the class described, comprising a preformed block-like compressible member adapted to substantially fill the space between the head and base of a rail, and
an insulating apron attached to and extendin% beyond one of the edges of the member su stantially as and for the purpose described.

A rail filler of the class described, comprising 'a preformed block-like compressible member adapted to substantially fill the space between the head andbase of a rail, and an insulating apron of waterproofed felt, attached to and extending beyond one of the longitudinal edges of the member substantially as and for the purpose described.
