FLANGEWAY GUARD.
Application filed September 25, 1925.
To all whom it may concern:
Be it known that I, CARROLL BURTON, a citizen of the United States, and resident of Johnstown, in the county of Cambria and State of Pennsylvania, have invented certain new and useful Improvements in Flangeway Guards, of which the following is a specification.
This invention relates to fiangeway guards, and more particularly to flangeway guards for use in track structures at ve hicular crossings and other points where it is customary to pave or otherwise fill the space between the tracks rails up to the level of the top of the track rails.
()ne object of the present invention is to provide a novel form of guard of this class which can be retained in place to hold the paving or other filling between the track rails in position during the replacement or re-spiking of the track rails.
Another object is to provide a 'llangeway guard having a novel construction whereby the head portioninay be moved out of the way independent of the body portion of the guard to permit free access to the track rails for renewal or re-spiking.
Another object is to provide a novel form of flangeway guard having the novel construction, design and combination of parts hereinafter described and illustrated in the accompanying drawings.

Referring more particularly to the drawings, the letter A designates the track structure as a whole, which is composed of: the usual track rails 2 secured on the ties 3 by spikes 4. Flangeway guards B are secured along the rails 2 and an asphalt or other paving material 5 is filled in between the fiangeway guards B up to approximately the level of the top face of the heads of the rails 2 to form a crossing.
Heretofore it has been customary to maintain the paving in spaced away relation to the track rails by the use of wood planks, old rails laid on their sides, and other make-shifts all of which had to be removed in order to renew or re-spike the track rails. The removal of the planks or other binding members allowed the paving to crumble and break and also was a more or less laborious task.
The fiangeway guards B of this invention are permanent structures especially designed for their particular use, and need not be removed when renewing or re-spiking the track rails and, therefore, provide a saving in labor and prevent the damage to the paving heretofore caused by removing the make-shift guards generally employed.
The flangeway guards B are composed of a base portion 7, a back portion 8 and a top or cover portion 9. The base and back portions are preferably formed integral in the form of a standard rolled angle and the top or cover portion 9 may be a rolled shape or otherwise formed as desired.
The base portion 7 is apertured along its free longitudinal edge as at "10 to form recesses to receive the track rail securing spikes 4- and is also provided with apertures 12 adjacent the rear longitudinal edge for the reception of spikes 13 which hold the flangeway guard in position.
The top or cover member is provided with a longitudinally extending groove or depression 14 forming a flangeway adjacent its free longitudinal edge and has its other or rear longitudinal edge hingedly secured to the back portion ;8 of the guard.
Hinged members 15 are secured to the back andtop portions 8 and 9 respectively, at spaced intervals so to secure these parts in operative relation and permit the top member to be moved about the hinged connections to permit free access to the base of the track rails for renewal or re-spiking of the rails.
Portions of the base 7 are cut along three sides and bent up at right angles to the base to form verti al supports 16 for the top member 9.
It will be understood however, that I do not wish to be limited to the construction of support 16 described above, since such supports may be formed of separate U- shaped members 1'? riveted to the top 9 by the rivets 18 that secure the hinge members 15 to the top, as shown in Figures 9l0 and 11, or the hinge members 15 may have the portion secured to top member 9 provided with a downwardly bent for aid end 19 forming a support, as shown in Figure The flangeway guards of this invention are preferably formed in short lengths of approximately 6 feet, since they can then be used on crossings on any ordinary railroad curve.
All the sections of the guard will be of duplicate construction, except the end sections which will preferably be the form shown. in Figures (3 and T. The. end sections of the guard will have the back wall portions 8 cut away on a downwardly inclined angle at their outer ends, as'at Q0, and the top portion 9 is bent downwardly on a corresponding angle forming an inclined approach portion 21. The flangeway groove portion 14 is cut away for a short distance adjacent the outer end of the inclined portion 2l for clearance and an aperture 22 is formed in the portion 21 registering with one of the apertures 12 to permit a track spike to be driven through the apertures 22 and 12 into one of the ties 3 to hold the top 9 in position.
With tlangeway guards constructed in accordance with this invention, it is only necessary to lift the hinged top members or portions 9 to expose the base of the track rails 2 and permit the renewal or respiking of the rails. Thus the paving is not disturbed and the cost and labor of renewing or re-spiking track rails at crossings is materially reduced.
lVhile I have shown and described certain specific embodiments of my invention, it will be understood that I do not wish to be limited thereto, since various modifications may be made without departing from the scope of my invention. as defined in the appended claims.
I claim l. The combination with a rail of a track structure, of a fiangeway guard comprising a base portion, a back portion rigidly supported from said base portion, and a top portion adapted to be bridged between said back portion and the rail, said top portion being freely movable independent of said base and back portions to permit renewing and spiking of the track rail.
2. The combination with a rail of a track structure, of a fiangeway guard comprising a base portion, a back portion rigidly supported from said base portion, and a top portion having a fiangeway groove formed therein, said top portion being bridged between said back portion and the rail and being freely movable independentcf said base and back portions to permit renewing and spiking of the track rail.
3. The combination with a rail of a track structure, of a flangeway guard comprising a base portion, a back portion rigidly supported from said base portion, and a top portion hingedly secured to said back portion and bridged between said back portion and the track rail so as to be freely movable independent of said base and back portions to permit renewing and spiking of the track rail.

The combination with a rail of a track structure, of a llangeway guard comprising a base portion, a back portion rigidly sup ported from said base portion, and a top portion having a flangeway groove formed therein, said top portion being hingedly secured along the upper edge of said back portion and bridged between said back portion and the track rail so as to be freely movable independent of said base and back portions to permit renewing and spiking of the track rail.
The combination with a rail of a track structure, of a fiangeway guard comprising a supporting portion and a top portion adapted to be bridged between said support ing portion and the track rail, said top portion being freely movable independent of said supporting portion to permit renewing and spiking of the track rail.

The combination with a rail of a track structure, of a flangeway guard comprising a supporting portion and a top portion having a flangeway groove formed therein, said top portion being bridged between said supporting portion and the track rail and being freely movable independent of said supporting portion to permit renewing and spiking of the track rail. 9

The combination with a rail of a track structure, of a flangeway guard comprising a base portion, a back portion, a top portion adapted to be bridged between said back portion and the track rail, said top portion being freely movable independent of said base and back portions to permit renewing and spiking of the track rail, and means extending between the base and top portions for supporting said top portion in operative position.

The combination with a rail of a track structure, of a fiangeway guard comprising a base portion, a back portion, a top portion hingedly connected along one of its longitudinal edges to the upper edge of said back portion and bridged between said back portion and the track rail, said top portion being freely movable independent of said base and back portions to permit renewing and spiking of the track rails, and means extending between the base and top portions for supporting said top portion in operative position.
9. The combination with a rail of a track structure, of a flangeway guard comprising a base portion, a back portion, atop portion having a fiangeway groove formed therein, said top portion being hingedly connected to said back portion and bridged between said back portion and the track rail, said top portion being freely movable independent of said base and back portions to permit renewing and spiking of the track rail, and means extending between the base and top portions for supporting said top portion in operative position.
10. The combination with a rail of a track structure, of a fiangeway guard comprising a base portion, a back portion, a top portion hingedly connected along one of its longitudinal edges to the upper edge of said back portion and bridged between said back portion and the track rail, said top portion being freely movable independent of said base and back portions to permit renewing and spiking of the track rails, and means formed integral with said base and extending between the base and top portions for supporting said top portion in operative position.
