" arcitizen of the United States, residing at t Hartford, in the county of Hartford ahd st'ate of Connecticut, have invented a new and Improved Firearm, of which the following is a specification.
' One form of device embodying my invention and in the construction and use of which the objects herein set out, as well as others, may be attained, is illustrated in the accompanying drawings, in which:

Fig.13 is a detail plan view of the device shown in Figs. 1 and 2.
' In the use of firearms of the magazine type and perhaps especially of that type commonly held'in the hand while being discharged, fatal accidents have been caused from a failure to know that removal of the magazine does not, in all cases, remove all of the cartridges from the firearm. I have, therefore, provided means whereby, when the magazine is removed, accidental discharge of the firearm is prevented and cause for accident is.avoided. Such a structure 18 shown in the accompanying drawings in which the numeral 5 indicates a portion of the gripping member of a firearm, 6 the trigger guard, 7 the trigger, 8 the receiver, 9 the slide, 10 the magazine,'11 the hammer tail or prong, and 12 the hammer of a firearm that may be of any well known type of construction.

As the slide moves backwardly in the operation of the firearm the beveled upper wall of the recess 19 pushes the actuator downwardly below the lower end of the sear 13 so that the latter is free to move into engagement with the hammer as the latter is cocked in the backward movement of the slide and without liability of being held from such disengagement by pressure upon the trigger 7. This construction is for the purpose of preventing a repeat in the firing operation,
the spring pressing against the beveled end of the actuator and forcing it upwardly. All of the parts thus far described are of old and-well known construction and, except in combination with the other parts to be now described, constitute no part of my invention.
In carrying my invention into eifect a re cess 20 is formed in the frame, and a shifter 21 is secured in this recess, and has an opening 22 through which the end of the extension 18 projects. Shoulders 23 are formed on the extension, said shoulders underlying the shifter 21 and constituting means by which it is actuated. The front end 24 of the shifter lies in the path of movement of the upper end of the magazine 11 by which said front end is lifted and does not press upon the shoulders 23. In the form of the structure herein shown this shifter is re silient so that it'will move downwardly and press upon the extension 18 whenever the magazine is removed.
The operation of the device will be read ily understood from the illustration and description contained herein, it being suf ficient to say that when the magazine is removed the shifter presses downwardly against the shoulders 23 on the extension 18, forcing the actuator 14 with its lower end below the lower end of the sear 13 so thatany movement of the actuator caused by the trigger or otherwise will not be effective upon the sear and the hammer cannot, therefore, be released for firing action. When the magazine is inserted in the hanxdle the shifter will be raised and in this position will haveno effect upon the actuator which may then operate in its normal and intended way.

I claim 1. In combination with the firing mechanism of a firearm including a scar, a scar actuator movably mounted to be located in an ineffective position with respect to its operation of'said sear, a trigger bar separately formed from and movable independently of the actuator to operate it, a trigger to actuate the trigger bar, and means to move said actuator into its ineffective position. said means being positioned for operation by the magazine.
2. In combination with the firing mechanism of a firearm including a sear, a trigger bar with means for operating it. a sear actuator movably mounted to be located in an ineffective position with respect to its operation of said sear, said actuator being formed independently from and movable independently of the trigger bar, and a shifter positioned for operation by the magazine and movably mounted to engage the actuator to move it into its ineffective position.
3. In combination with the firing mechanism of a firearm including a scar, a trigger bar With means for operating it. a sear actuator movably mounted to be located in an ineffective position with respect to its operation of said sear, said actuator being formed independently from and movable independently of the trigger bar, and a shifter located in the path of movement of a magazine into the firearm and movable to engage said actuator to move it into its ineffective position upon movement of the magazine.
4. In combination with the firing mechanism of a fi-rearm including a trigger bar with means for operating it, a slide and a sear, said slide being arranged to be. actuated in each firing operation of the fire arm, a sear actuator movably mounted to be located in an ineffective position with respect to its operation of said scar and proa shoulder, and a shifter positioned to pwss against said shoulder and the end of the shifter being located in the path of innate-- ment of a magazine into the firearm. wi-uawby the shifter moves the actuator into its ineffective position upon downward movement of the magazine.
(3. In combination with the firing 'hifillflnism of a firearm including a trigger bar with means for operating it, and a scan. an actuator formed independently from and movable independently of said trigger but movably mounted to engage the sear, means connecting the actuator and tiring mechanism to place the actuator in m erative position with respect to the sear at each firing operation of the firearm, and a sl-i-ifle-r to operate the actuator independently of said firing mechanism. said shifter being :arranged f'or ope 'ation by the magazine when inserted in the firearm to permit movement of the actuator into position to engage the sear.
7. In combination with the firing mechanism including a scar. an actuator moral-fly mounted to engage the sear, means automatically actuated in each firing operation to engage said actuator and disengage it from said sear, a shifter having an opening through which said actuator extends. the latter having a shoulder underlying said shifter, and said shifter being located in the path of movement of a magazine when inserted in the firearm to be moved thereby out of engagement with said actuator.
