Istote wzoru stanowi nowa i indywidualna postac przedmiotu przejawiajaca sie w ukladzie linii oraz rysunku powierzchni i kolorystyce. Przedmiot wzoru przemyslowego przedstawiono na zalaczonym materiale ilustracyjnym, na którego fig. 1 pokazano w widoku czolowym tubke papierowa do lodów w stanie rozlozonym, z ukazanym nad nia wieczkiem zamykajacym tubke, natomiast na fig. 2 pokazano tubke papierowa do lodów w widoku czolowym. Jak przedstawiono na materiale ilustracyjnym tubka ma postac scietego stozka o lagodnym kacie rozwarcia, przy czym w jej dolnej czesci jest wykonane karbowanie poprzez naciecie szeregiem równoleglych wzgledem siebie poziomych przetloczen. Tubka ma kolor czarny (Pantone Black 6C), a w jej centralnej czesci jest umieszczony napis ENERGY wykonany kursywa, wielkimi drukowanymi literami alfabetu lacinskiego, czcionka pogrubiona, w kolorze szarym (Pantone 877C). W linii równoleglej z napisem, na calej jego dlugosci, rozmieszczono szereg prostokatnych pól, w kolorze szarym (Pantone 877C), o zwiekszajacej sie szerokosci. W ostatnim z tych pól jest umieszczony napis ice wykonany czarna czcionka (Black 6C) o kroju prostym, malymi drukowanymi literami alfabetu lacinskiego. Z kolei wieczko zamykajace tubke od góry jest odbiciem kolorystycznym tubki, to jest na szarym tle (Pantone 877C) jest powtórzony napis ENERGY oraz prostokatne pola, tym razem utrzymane w kolorystyce czarnej (Black 6C), natomiast napis ice na najwiekszym z pól jest wykonany czcionka w kolorze szarym (Pantone 877C). The essence of the design is the new and unique form of the item, manifested in the arrangement of lines, surface drawing, and color. The industrial design is presented in the attached illustrations, where Fig. 1 shows a frontal view of the unfolded paper tube for ice cream, with the lid closing the tube visible above it, while Fig. 2 shows the frontal view of the paper tube for ice cream. As shown in the illustrations, the tube has the form of a truncated cone with a gentle opening angle, with a notch in the lower part made by cutting a series of parallel horizontal embossments. The tube is black (Pantone Black 6C), and in its central part is the inscription "ENERGY" in italics, in capital Latin letters, bold, and gray (Pantone 877C). Parallel to the inscription, along its entire length, are a series of rectangular gray (Pantone 877C) boxes of increasing width. The last of these boxes contains the inscription "ice" in straight black (Black 6C) and lowercase Latin letters. In turn, the lid closing the tube from the top is a reflection of the tube's color, i.e. on a gray background (Pantone 877C) there is a repeated inscription ENERGY and rectangular fields, this time in black (Black 6C), while the inscription ice on the largest of the fields is made in gray font (Pantone 877C). The essential features of the industrial design of a paper ice cream tube are as follows: 1. the shape of the tube is similar to a truncated cone with a small angle of convergence, the surface of the tube is black, 2. in the central part of the surface area of the tube is the inscription "ENERGY" written in grey letters, 3. parallel to the inscription "ENERGY", along its entire length, there is a series of rectangular fields of varying widths, with the inscription "ice" written in black font incorporated in the widest of these fields, 4. the lid closing the tube from the top is grey with the repetition of the graphic elements from the surface of the tube, but in black and with the inscription "ice" written in grey font, 5. in the upper part of the tube, next to the closing lid, there is the manufacturer's trademark.
