DESCRIPTION OF THE PRIOR ART I In the past, elasticized contoured diapers have been developed such as that disclosed in the Pafcnt to Buell, No. 3.869,003, issued January 14, 19?5» for Contractable Side Portion^ for Disposable Diapers, wherein elastic strips are secured to the crotch portions of the diaper forming elasticized crotch seals for securement over the legs of the infant to prevent loss of fluid from the interior of the dalper along the legs of the infan^. In United States Patent to Woon and Endres, No. k,050,^1 >2, II jj elastic strips are also provided in the crotch area of the diaper, !j 5| The crotch seals do prevent leakage of fluid down the jj legs, but when an infant is lying down, very often fluid leaks ,! past the waist of the diaper. Experimental use of waist bands jl i! has proven unsatisfactory because no elastic means for adjusting the tension at the waist has been heretofore achieved. Elasticized waist seals are old and well known for various garments including diapers. These waist seals have been for the purpose of maintaining the garment in place and have not been for the purposes of the present Invention soas to provide for a fluid barrier while also providing for positioning the diaper on an Infant with an adjusted comfortable amount of tension at th« waist. -2- I ) 202257 SUMMARY OP THE INVENTION The present invention overcomes the disadvantages of the prior art diapers by providing for an elastic member along the waist portion of the diaper whereby a waist seal is formed. In carrying out the Invention, a substantially hourglass shape diaper is formed having a backing she&, an absorbent pad on the backing sheet, and a top sheet overlying the absorbent body. Opposed side elastic members may be secured to the backing sheet to form crotoh seals as desired. Fig. b is a view similar to Fig. 2 of another and preferred form of the Invention. 3- 2022 S7j DETAILED DESCRIPTION OF THE INVENTION With continuing reference to the accompanying drawings, wherein like reference numerals designate similar parts throughout; the various views, reference numeral 10 generally designates an Elasticized and contoured diaper constructed In accordance with the concept of the present Invention. The diaper 10 is of an hour-glass configuration forming a orotch area 12 and four portions of greater width deflnlngears 14, 16, etc. The diaper Includes a backing sheet 22 of an impervious polyethylene or the like. A top sheet 24, preferably of non-woven polyethylene or polypropylene fibers is secured to the backing sheet 22 along the peripheral edges of the diaper 10 preferably with adhesive, either hot melt or pressure sensitive. An absorbent pad 26 is disposed between the top sheet 2k and the backing sheet 22 and may be of woodfluff or the like. Wadding sheets may be proMded as desired, Optionally, and not particularly forming a part of the preeent invention, a pair of elasticized strips may be provided (not shown) forming crotch seals In a convetlonal manner. An elastlo member 40 Is bonded to the baoklng sheet 22 by lines or spots of adhesive or other suitable means. As shown in Figs. 1 through 3, the elastic member 40 may be bonded on the outside of the backing sheet. Alternatively, and preferably, as shown in Fig. 4, the elastic member 40 is bonded to the backing sheet inwardly thereof. The elastic member 40 Is bonded to the baoklng sheet 22 when In a stretched condition and thus contracts the waist area to form a waist seal. -4_ 20225 7 In order to fasten the diaper on an infant, tabs 42 and 44 may be employed. These tabs, In the embodiment shown in Pigs. 1 and 2 are Integral extensions of the waist elastic member 40 and are coated with adhesive 46 with protective release sheets 48 removably disposed thereon for removal Immediately prior to use. In placing the diaper on an Infant, the waist may be stretched to a desirable comfortable tension and the tabs 42 and 44 secured to the after pair of ears (not shown) of the diaper. In Fig, 3 there is shown a modified form of the invention In which separate tabs 50 are bonded to elastic member 40 in alignment therewith for placing desired stretch and tension on the elastic member 40 when securing the diaper on an infant. In Fig. 4, the preferred form of the invention^ there is employed the elastic member 40 inwardly of the backing sheet 40 with adhesive 46 on the ends 42 extending beyond the backing sheet 22 and release sheets 48 provided to protect the adhesive until immediately before use. 5 </div>

Claims

1. A disposable diaper comprising a backing sheet, an absorbent pad on said backing sheet, a top sheet overlying said absorbent pad, said top sheet being secured to said backing sheet along the peripheral edge thereof, an elastic member secured to said backing sheet along an end edge forming a waist seal, and waist tabs in alongitudinal alignment with said elastic member for fastening the diaper on the user for adjusting the tension on said waist seal, wherein said tabs are integral extensions of said elastic member.

2. A diaper according to claim 1, wherein said tabs are of an elastic material.

3. A disposable diaper according to claim 2, wherein said elastic member is waterproof forming fluid barriers.

4. A disposable diaper according to claim 2, wherein said top sheet and said backing sheet are bonded together along the peripheral edge thereof and outwardly of said waist seal. :..Z. !-ATEhJT OFFICE -6- 1 ft JUL 1985 202257

5. A disposable diaper according to claim 2, wherein said top sheet is heat sealed to said backing sheet.

6. A disposable diaper according to claim 1, wherein said absorbent pad is of an hour-glass shape defining ears spaced from said crotch area.
