また、特開2004−73473号公開公報には上顎ピースと下顎ピースとの2ピースからなるマウスピースを開示するが、上顎ピースと下顎ピースとはそれぞれ歯列の咬合面に沿って被せるための馬蹄形になっているので歯形取りが必要である。
さらには、噛み込むことで歯形取りする1ピースタイプのマウスピースも提案されている。
しかし、これまでに提案された1ピースタイプのマウスピースにあっては、咬合面を歯形に合わせるために下顎が動かぬように固定するものばかりである。
これでは、睡眠中に下顎を動かすことができず苦痛を感じるものであった。

これらに示したマウスピースの噛み込み部の形状例は、奥歯のくぼみに納まる凸部と奥歯の左右の動きを許容する形状例を示したものである。
材質的には口腔内に装着する際に衛生的であり、弾力性の高い軟質樹脂やゴム系の樹脂がよい。
このように歯当たり面が凸形状になっていると図4に示すように、奥歯のくぼみに凸部がフィットし、図4(b)(c)に示すように奥歯の上下が左右に少しずれてもマウスピースが歯列から外れるのを防止するだけでなく、歯を左右にある程度動かすことができるので下顎が固定されないのでマウスピース装着時の苦痛が和らぐ。
図2(a)に示すように通常は上顎の前歯が下顎の前歯より少し前に出ていて、その時の奥歯の噛み合せは図2(b)に示すように歯のくぼみが少し左右にずれている。
これに対して図3(a)、(b)に示すようにマウスピースの噛み込み部を噛むことで若干、下顎が前に出るようになる。
これにより、下顎が下がるのを抑え、舌根が気道を狭めたり塞ぐのを防止する。
また、無呼吸状態になるのを抑え、いびき症が改善し、ストレス等が緩和する。
本発明に係るマウスピースは噛み込む動作にて気道を確保しつつ、上顎及び下顎がマウスピースにて固定されることがなく、睡眠時の自然な顎の動きを可能にしたことにより、患者のマウスピース装着から生じる不必要な苦痛、ストレスを解消できる。
従って、噛み込み部の断面方向の大きさは奥歯のくぼみにフィットし、強く噛み込む必要のない10mm×10mm以下がよい。
